सं. 29 -सीए/लों/डी-128/2008--चार्टर्ड एकाउन्टेन्ट्स विनियम, 1988 के विनियम 18 के साथ गठित चार्टर्ड एकाउन्टेन्ट अधिनियम, 1949 की धारा 20 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय चार्टर्ड एकाउन्टेन्ट्स संस्थान की परिषद् द्वारा , एतद्वारा यह अधिसूचित किया जाता है कि माननीय दिल्ली उच्च न्यायालय ने, उक्त अधिनियम की धारा 21 ( 6 ) ( ग ) के अनुसरण में , चार्टर्ड एकाउन्टेन्ट संदर्भ संख्या 2/2003 में 5 नवम्बर, 2007 को यह आदेश किया था कि श्री लोकेश धवन , एफसीए , चार्टर्ड एकाउन्टेन्ट, 218 , कैलाश हिल्स, नई दिल्ली-110065 ( सदस्य संख्या 81041 ) को चार्टर्ड एकाउन्टेन्ट अधिनियम, 1949 की धारा 21 के साथ पठित धारा 22 के निबंधनों में ' अन्य अवचार ' का दोषी पाए जाने के कारण , उनका नाम तीन मास की अवधि के लिए सदस्यों के रजिस्टर से हटा दिया जाए । तद्नुसार , यह सूचित किया जाता है कि उक्त श्री लोकेश धवन का नाम तारीख 1 फरवरी, 2009 से तीनं मास की अवधि के लिए सदस्यों के रजिस्टर से हटा दिया जाएगा । उक्त अवधि के दौरान वह माननीय दिल्ली उच्च न्यायालय के उक्त आदेश के निबन्धनानुसार चार्टर्ड एकाउन्टेन्ट के रूप में व्यवसाय नहीं करेंगे ।

नई दिल्ली-110002 , दिनांक सितम्बर 2008 विश्वविद्यालय अनुदान आयोग ( विश्वविद्यालयों द्वारा प्रदान की गई उपाधि एवं अन्य पुरस्कार ) नियम, 2008 एफ.1-19/2005 ( सी.पी. पी. 2) विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा 26 की उपधारा ( 1 ) धारा ( एफ ) और (जी ) साथ में धारा 14 द्वारा प्रदत्त अधिकारों के तहत् विश्वविद्यालय अनुदान आयोग ने निम्नलिखित नियमों को निर्मित किया है : -- 1. संक्षिप्त नाम, विनियोग एवं प्रारम्भ
1.1 इन नियमों को विश्वविद्यालय अनुदान आयोग ( विश्वविद्यालयों द्वारा प्रदान की गई उपाधियां एवं अन्य मुरूस्कार ) नियम, 2008 से जाना जाएगा । 1.2 ये एक केन्द्रीय अधिनियम या एक प्रान्तीय अधिनियम या एक राज्य/संघ क्षेत्रीय अधिनियम या समाविष्ट समस्त विश्वविद्यालयों एवं विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा ( 3 ) के अन्तर्गत सम विश्वविद्यालयों की संस्थाओं पर लागू होंगे । 1.3 ये सरकारी राजपत्र में प्रकाशित होने की तिथि से लागू माने जाएंगे ।
2. परिभाषाएं
इन नियमों में यदि किसी विपरीत संदर्भ की आवश्यकता पड़ी : -- 2.1 " अधिनियम" का अर्थ विश्वविद्यालय अधिनियम, 1956 ( 1956 ) के अधिनियम 3 )
2.2 "प्राधिकारी " का अर्थ है प्राधिकारी जैसे कार्यकारिणी परिषद् एवं अकादमिक परिषद्, जो विश्वविद्यालय के अन्तर्गत अपने अधिनियम द्वारा परिभाषित किया गया है । " कालेज" का अर्थ है एक संस्था जो उच्च शिक्षा और/या शोध में व्यस्त हो , जो या तो विश्वविद्यालय द्वारा स्थापित उसके घटक एकक या उससे सम्बद्ध हो । 2.3
" आयोग " का अर्थ है विश्वविद्यालय अनुदान आयोग , जो इस अधिनियम द्वारा स्थापित है । 2.4 भाग III-खण्ड 4]
2.5 " दीक्षान्त समारोह " का अर्थ है विश्वविद्यालय का एक आनुष्ठानिक सभा जो सामान्यतः अपने पात्रित अभ्यर्थियों को उपाधियों एवं अन्य पुरूस्कार प्रदान करने के लिए आयोजित की जाती है ।
2.6 " सरकार " का अर्थ है केन्द्रीय सरकार या राज्य/संघ क्षेत्रीय सरकार, जैसा भी मामला हो ।
2.7 "स्नातक समारोह " का अर्थ है कॉलेज को एक आनुष्ठानिक सभा जो सामन्यतः पात्रित अभ्यर्थियों को उपाधियों एवं अन्य पुरूस्कार प्रदान करने के लिए आयोजित की जाती है । 2.8 "विश्वविद्यालय " का अर्थ है विश्वविद्यालय जिसको आयोग विश्वविद्यालय अनुदान आयोग अधिनियम, 1956 की धारा (2) की धारा ( एफ) के अन्तर्गत मान्यताप्राप्त हो या इसी अधिनियम की धारा ( 3 ) के अन्तर्गत आयोग की सलाह पर सरकार ने सरकारी राजपत्र में समविश्वविद्यालयों को अधिसूचना द्वारा अधिसूचित किया हो ।
3. उद्देश्य
इन नियमों का निम्नलिखित उद्देश्य होगा जैसे :-- 3.1 यह सुनिश्चित करना कि प्रत्येक विश्वविद्यालय प्रत्येक अकादमिक वर्ष में अपने पात्रित छात्रों को उपाधियां या अन्य पुरस्कार नियमित रूप से प्रदान कर सके । 3.2 दीक्षान्त समारोह का समयपूर्वक सुसाध्य करते हुए या किसी अन्य तरीके से आयोजित कराना ताकि प्रत्येक विश्वविद्यालय के पात्रित छात्रों को उपाधियां/अन्य पुरस्कार प्रदान किए जा सकें ।
3.3 पात्रित छात्रों को नौकारी में जाने के लिए, उच्च अध्ययन/अन्य सुअवसरों के लिए बिना किसी विलम्ब के उपाधियों एवं अन्य पुरूस्कारों को प्रदान करने में सहायता देना । 3.4 अपने पूर्व घोषित अकादमिक कैलेन्डर को सख्ती से अनुपालन करते हुए सम्बद्ध विश्वविद्यालय की गुणवत्ता एवं मापदण्ड का संवर्धन करना ।
3.5 भागीदारों मुख्यतः छात्रों का विश्वास , आदर एवं सद्भाव को विश्वविद्यालयों की समयानुसार एवं सुव्यवस्थित कार्यशीलता द्वारा प्राप्त करना ।
4. अनुपालन की प्रक्रिया
प्रत्येक विश्वविद्यालय निम्नलिखित प्रक्रिया का अनुपालन करेगा: -- 4.1 प्रत्येक अकादमिक वर्ष के प्रारम्भ में विश्वविद्यालय अपने अकादमिक कैलेन्डर को घोषित करेगा जिसमें वर्ष के दौरान होने वाली अपनी समस्त गतिविधियों के कार्यक्रमों का ब्यौरा होगा ।
4.2 अकादमिक गतिविधियों के कार्यक्रमों जैसे पाठ्यक्रमों एवं परीक्षाओं के अतिरिक्त, ये कैलेन्डर उपाधि प्रदान करने की तिथि/तिथियों को भी सम्मिलित करेंगे ।
4.3 यादि आवश्यक हो तो विश्वविद्यालय उपाधि प्रदान करने के कार्यक्रम को एक वर्ष में कई बार अपने अकादमिक कैलेन्डर में सम्मिलित करेगा ।

4.4 उपाधि प्रदान करने की तिथि/तिथियां छात्रों को उपाधि की अर्हता का अपेक्षित उम्मीदवार होने और उनके पात्रित होने के 180 दिनों के भीतर होना चाहिए ।
4.5 सुनिश्चित की गई तिथि/तिथियों के 30 दिनों के भीतर विश्वविद्यालय उपाधि प्रदान करने की तिथि को अधिसूचित करेगा ताकि अभ्यर्थी उसके लिए आवेदन कर सके । 4.6 विश्वविद्यालय पात्रित छात्रों के लिए दीक्षान्त समारोह आयोजित करेगा या किसी अन्य तरीके से उनको सुनिश्चित तिथि पर उपाधियों और अन्य पुरूस्कार प्रदान करेगा । 4.7 यदि दीक्षान्त समारोह आयोजित हुआ तो वह विश्वविद्यालय अधिनियम , संविधियां, अध्यादेशों के तहत् आनुष्ठानिक पहलुओ को सम्मिलित रखेगा ।
4.8 अगर किसी कारणवश दीक्षान्त समारोह आयोजित नहीं हो सका, विश्वविद्यालय पात्रित अभ्यर्थियों को इस अवसर पर उपाधियां एवं अन्य पुरूस्कार प्रदान करेगा ।
4.9 विश्वविद्यालय को यह अधिकार होगा कि वह अपनी ओर से चयनित कालेजों को स्नातक समारोह सुनिश्चित तिथि पर अपने छात्रों के लिए आयोजित किया करे । ऐसे कालेजों को विश्वविद्यालय के आदेशों का अनुपालन करना आवश्यक होगा और स्नातक समारोह सुनिश्चित कार्यक्रम के अनुसार आयोजित किया जाएगा । 4.10
यदि खण्ड 4.8 और 4.9 का अनुपालन किया गया, प्राधिकारी के लिए यह आवश्यक होगा कि वे विश्वविद्यालय अधिनियमों/ अध्यादेशों एवं नियमों का संशोधन करें । 4.11
विश्वविद्यालय आयोग को वार्षिक रिपोर्ट उपरोक्त धाराओं के अनुपालन में नियमित रूप से निर्धारित प्रारूप में प्रस्तुत करेगा । 4.12
5. दण्ड
यदि कोई विश्वविद्यालय इन नियमों की किन्हीं धाराओ का अनुपालन नहीं करता है, तब आयोग को यह शक्ति है कि वह विश्वविद्यालयों पर जुर्माने के रूप में दण्ड दे और कोई अन्य कार्यवाही करे जो वह उचित समझता हो , जिसमें सम्बन्धित विश्वविद्यालय को सुनवाई का अवसर देने के उपरान्त, भारत सरकार को सिफारिश करना सम्मिलित है । 5.1
6. व्याख्या
6.1 इन नियमों की व्याख्या का कोई भी प्रश्न आयोग द्वारा निश्चित किया जाएगा, जिसका निर्णय इस सम्बन्ध में विश्वविद्यालयों पर अन्तिम एवं बाध्य होगा ।
6.2 आयोग को यह शक्ति होगी कि वह किसी भी संदेह, कठिनाई या अनियमतता को दूर करने के लिए स्पष्टीकरण को जारी करे ।
7. न्यायालय का क्षेत्राधिकार
7.1 दिल्ली की राष्ट्रीय राजधानी क्षेत्र ही केवल न्यायालय का क्षेत्राधिकार होगा जो इन नियमों में दी गई धाराओं से उत्पन्न किसी भी वाद/मुद्दों पर विचार करेगा ।

Dr. SUMAN MUKHERJEE State Medical Commissioner UGC [ GRANT OF DEGREE AND OTHER AWARDS BY UNIVERSITIES] REGULATIONS , 2008 UNIVERSITY GRANTS COMMISSION New Delhi - 110002, the September 2008 No. F. 1-19 /2005 ( CPP II) . In exercise of the power conferred by clause ( f) and ( g) of Sub- section ( 1) of Section 26 of the UGC Act, 1956, the University Grants Commission makes the following regulations namely :--
1. Short Title , Application and Commencement :
1.1 The Regulations may be called the UGC [ Grant of Degrees and Other Awards by Universities ] Regulations , 2008;
1.2 These shall apply to all Universities established or incorporated by or under a Central Act, a Provincial Act , or a State/ Union Territory Act and to all institutions deemed to be Univerisities under Section 3 of the UGC Act, 1956;
1.3 These shall come into force from the date of their publication in the Official Gazette.
2. Definitions :
In these Regulations , unless the context otherwise requires:
2.1 "Act " means the University Grants Commission Act , 1956 (Act 3 of 1956) ;
2.2 "Authorities " means authorities like Executive Council and Academic Council , so defined by a University in its Act;
2.3 " College " means an institution engaged in higher education and/or research , either established by a University as its constituent unit or is affiliated to it;
2.4 " Commission " means the University Grants Commission , established under the Act;
2.5 " Convocation" means a ceremonial assembly of a University, normally held for conferring Degrees and other awards to its eligible candidates;
2.6 " Government " means the Central Government or the State/Union Territory Government, as the case may be;

2.8 " University " means a University so recognized by the Commission under Clause (f) of Section 2 of the UGC Act , 1956, or a deemed to be University so declared by notification in the Official Gazette by the Government, on the advice of the Commission under Section 3 of the same Act.
3. Objectives :
These Regulations shall have the following objectives , namely :
3.1 To ensure that each University grants Degrees and other awards to its eligible students regularly in every academic year ;
3.2 To facilitate timely holding of a convocation or adopting any other method, for conferring the Degrees/ other awards to eligible students at each University;
3.3 To assist the eligible students going for employment, higher studies and/ or other opportunities , by giving their Degrees and other awards without delay;
3.4 To enhance the quality and standard of the University concerned, through its strict adherence to the academic calendar announced in advance;
3.5 To gain the confidence, goodwill and respect of stake holders , particularly students , through timely and orderly functioning of the University.
4. Procedure to be followed :
Each University shall follow the following procedure , namely:
4.1 At the beginning of each academic year, the University shall announce its academic calendar, giving the schedules for all its activities during the year;
4.2 In addition to the schedules for academic activities like courses and examinations , the calendar shall also include the date/s for Degree awards;
4.3 If necessary, the University may schedule Degree awards more often than once in a year and the same shall be included in its academic calendar;
4.4 The Degree award date/s shall be within 180 days of the date/s by which the students are expected to qualify and become eligible for them;
4.5 The University shall notify a programme for Degree awards at least 30 days before the date/ s so fixed, so that the candidates can apply for the same;

4.6 The University shall hold a convocation or follow any other method on the date/s so fixed, to confer the Degrees and other awards to eligible students ;
4.7 If a convocation is held , it shall include the ceremonial aspects , as per the provisions made for them in the University Act , Statutes and/ or Ordinances;
4.8 If for any reason the convocation is not held, the University shall only give away the Degrees and other awards to the eligible applicants at this time;
4.9 The University shall have the power to assign selected Colleges to hold graduation ceremonies for their students on its behalf, on the date/ s so fixed;
4.10 Such Colleges shall be required to abide by the directions of the University and hold the graduation ceremonies as per the schedule fixed;
4.11 In case , Clause 4.8 and 4.9 are followed, it may be necessary for the Authorities to amend the University Statutes , Ordinances and/or Rules ;
4.12 The University shall furnish an annual return to the Commission on the observance of the above provisions regularly, in the prescribed proforma.
5. Penalty :
5.1 In case , a University does not comply with any of the provisions of these Regulations , the Commission shall have the power to impose penalty on the University in the form of fine and take such other action as it may deem fit including recommendation to the Government, after giving due opportunity to the University concerned to be heard .
6. Interpretation :
6.1 Any question as to the interpretation of these Regulations shall be decided by the Commission, whose decision shall be final and binding on the University in the matter ;
6.2 The Commission shall have the power to issue clarifications to remove any doubt , difficulty or anomaly, which may arise in regard to the implementation of these Regulations.
7. Jurisdiction of Courts :
7.1 The Courts in the National Capital Territory of Delhi alone shall have the jurisdiction to entertain any disputes / issues arising out of the provisions contained in these Regulations .
