(नीति प्रभा. ) 202/मुमप्र( पीके) -2008-- भारतीय रिज़र्व बैंक, ऐसा करना जनहित में आवश्यक समझकर तथा इस बात से संतुष्टहो कर कि देश हित में ऋण प्रणाली को विनियमित करते हेतु रिज़र्व बैंक को सक्षम बनाने के लिए गैर बैंकिंग वित्तीय ( जमाराशि न स्वीकरण या धारण) कंपनियाँ विवेकपूर्ण मानदण्ड ( रिज़र्व बैंक ) निदेश, 2007 , जो 22 फरवरी 2007 की अधिसूचना सं. गैबैपवि. 193/डीजी ( वीएल ) -2007 में अंतर्विष्ट हैं, को संशोधित करना आवश्यक है , भारतीय रिज़र्व बैंक अधिनियम , 1934 (1934का 2 ) की धारा 45 -ञक द्वारा प्रदत्त शक्तियों और इस संबंध में उसे सक्षम बनाने वाली सभी शक्तियों का प्रयोग करते हुए एतद्वारा निदेश देता है कि उक्त निदेश तत्काल प्रभाव से निम्नवत संशोधित होंगे अर्थातः--
1. पैराग्राफ 2, खंड ( 1 ) , उप खंड ( xx ) में " स्वाधिकृत निधि के दस प्रतिशत " शब्दों के बाद निम्नलिखित शब्द जोड़े जाएंगे, अर्थात,

Mumbai -400005 , the 29th October 2008 No. DNBS ( PD ) 202/ CGM ( PK) -2008 .--The Reserve Bank of India, having considered it necessary in public interest and being satisfied that, for the purpose of enabling the Bank to regulate the credit system to the advantage of the country, it is necessary to amend the Non -Banking Financial (Non - Deposit Accepting or Holding) Companies Prudential Norms (Reserve Bank) Directions , 2007 contained in Notification No. DNBS . 193 /DG ( VL ) -2007 dated February 22, 2007 in exercise of the powers conferred by section 45JA of the Reserve Bank of India Act, 1934 ( 2 of 1934) and of all the powers enabling it in this behalf, hereby directs that the said directions shall be amended with immediate effect as follows , namely :-
1. In paragraph 2 , in clause ( 1 ) , in sub clause (xx) , after the words , ' ten percent of the Owned Fund; the following words shall be inserted , nemely, " and perpetual debt instruments issued by a Systematically important non - deposit taking non -banking financial company in each year to the extent it does not exeeed 15% of the aggregate Tier I Capital of such company as on March 31st of the previous accounting year;"
2. In paragraph 2, in clause ( 1) , in sub clause (xxi ) , in item ( d) , after the words ' hybrid debt capital instruments ; ' the word, ' and ' shall be omitted .
3. In paragraph 2, in clause ( 1 ) , in sub clause ( xxi ) , after item ( e) , the following words , brackets and figures shall be inserted , namely, " and
(f) perpetual debt instruments issued by a Systematically important non - deposit taking non - banking financial company which is in excess of what qualifies for Tier I Capital " .
