(i) यह पद स्थायी है किन्तु वह नियुक्ति की तिथि से 2 वर्ष की अवधि के लिए परिवीक्षा पर रहेंगे जिसे सक्षम अधिकारी के विवेक पर बढ़ाया जा सकता है । परिवीक्षा की अवधि के दौरान उन्हें उन प्रशिक्षण कार्यक्रमों में भाग लेना होगा और परीक्षाएं देनी होंगी जिसे सरकार द्वारा निर्धारित किया जाएगा । परिवीक्षा अवधि के भीतर निर्धारित परीक्षा उत्तीर्ण न करने पर उन्हें यथास्थिति या तो सेवामुक्त कर दिया जाएगा या उस मूल पद पर प्रत्यावर्तित कर दिया जाएगा, जिस पद पर वे लियन पर हैं ।

(ii) इस नियुक्ति से पूर्व निर्धारित प्रपत्र पर इस आशय की घोषणा प्रस्तुत करनी होगी कि यदि उनके एक से अधिक जीवित पत्नियां हैं, या एक पति/पत्नी के जीवित रहते उन्होंने विवाह किया है और यह विवाह पति/ पत्नी के रहते किए जाने के कारण अमान्य करार दिया गया हो तो यह नियुक्ति इस संबंध में निर्धारित शर्तों के लागू होने से उन्हें दी गई छूट के अध्यधीन होगी ।

(iii) महिला उम्मीदवार को इस नियुक्ति से पूर्व निर्धारित प्रपत्र पर इस आशय की घोषणा करनी होगी कि किसी ऐसे व्यक्ति से विवाह करने पर जिसकी एक पत्नी जीवित है , यह नियुक्ति इस संबंध में निर्धारित शर्तों के लागू होने से उन्हें दी गई छूट के अध्यधीन होगी । ( iv) यह नियुक्ति नजदीकी रिश्तेदारों के बारे में एनआईसीएफ द्वारा उपलब्ध कराए जाने वाले निर्धारित प्रपत्र पर सूचना प्रस्तुत करने 196

के अध्यधीन होगी । प्रपत्र में दिए गए ब्यौरे में किसी प्रकार के परिवर्तन को प्रत्येक वर्ष के अंत में सूचित करना होगा ।

( v ) विहित प्रपत्र पर इस आशय की सत्यनिष्ठ अभिपुष्टि करने के लिए भारत के संविधान के प्रति निष्ठा/ईमानदारी की शपथ लेना ।

बढ़ाया जा सकता है । परिवीक्षा की अवधि के दौरान उन्हें उन प्रशिक्षण कार्यक्रमों में भाग लेना होगा और परीक्षाएं देनी होंगी जिसे सरकार द्वारा निर्धारित किया जाएगा । परिवीक्षा अवधि के भीतर निर्धारित परीक्षा उत्तीर्ण न करने पर उन्हें यथास्थिति या तो सेवामुक्त कर दिया जाएगा या उस मूल पद पर प्रत्यावर्तित कर दिया जाएगा , जिस पद पर वे लियन पर हैं ।

(vi ) उक्त नियुक्ति के तहत अधिकारी को भारत के किसी भी भाग में तैनात किया जा सकता है ।

(vii) सेवा की अन्य शर्तें उपर्युक्त विषय पर समय- समय पर जारी किए गए नियमों और आदेशों द्वारा अभिशासित होंगी ।

2. यह नियुक्ति प्रस्ताव अनंतिम है जो संवर्ग नियंत्रण प्राधिकारी अर्थात् दूरसंचारविभाग द्वारा चरित्र और पूर्ववृत्त के सत्यापन की पुष्टि कर दिए जाने के अध्यधीन होगी ।

(ii) इस नियुक्ति से पूर्व निर्धारित प्रपत्र पर इस आशय की घोषणा प्रस्तुत करनी होगी कि यदि उनके एक से अधिक जीवित पत्नियां हैं, या एक पति/पत्नी के जीवित रहते उन्होंने विवाह किया है और यह विवाह पति/पत्नी के रहते किए जाने के कारण अमान्य करार दिया हो तो यह नियुक्ति इस संबंध में निर्धारित शर्तों के लागू होने से उन्हें दी गई छूट के अध्यधीन होगी ।

( iv) यह नियुक्ति नजदीकी रिश्तेदारों के बारे में एनआईसीएफ द्वारा उपलब्ध कराए जाने वाले निर्धारित प्रपत्र पर सूचना प्रस्तुत करने के अध्यधीन होगी । प्रपत्र में दिए गए ब्यौरे में किसी प्रकार के परिवर्तन को प्रत्येक वर्ष के अंत में सूचित करना होगा । 3(ख ) . यदि किसी भी समय उनकी योग्यता के संबंध में उनके द्वारा भेजा गया कोई भी प्रमाण- पत्र या दस्तावेज ठीक नहीं पाया जाता है अथवा उनकी योग्यता के संबंध में कोई भी सूचना/तथ्यात्मक सामग्री छुपाई गई है/ गलत प्रस्तुत की गई है, तो संगत नियमों के अधीन उनकी नियुक्ति को किसी अन्य दंडात्मक कार्रवाई पर बिना कोई प्रभाव डाले तत्काल रद्द किया जा सकता है ।

( vi) उक्त नियुक्ति के तहत अधिकारी को भारत के किसी भी भाग में तैनात किया जा सकता है ।

4. यह आवंटन अनंतिम है और यह माननीय उच्च न्यायालय, मद्रास द्वारा डब्ल्यूपी संख्या 1814-1815/ 2008 में जारी आदेश के विरुद्ध माननीय उच्चतम न्यायालय में दायर एसएलपी संख्या 13571-13572/2008 में निर्णय के अध्यधीन है ।

(vii ) सेवा की अन्य शर्तें उपर्युक्त विषय पर समय- समय पर जारी किए गए नियमों और आदेशों द्वारा अभिशासित होंगी ।

2. यह नियुक्ति प्रस्ताव अनंतिम है जो संवर्ग नियंत्रण प्राधिकारी अर्थात् दूरसंचार विभाग द्वारा चरित्र और पूर्ववृत्त के सत्यापन की पुष्टि कर दिए जाने के अध्यधीन होगा ।

5. इस प्रस्ताव पर अपनी स्वीकृति या अस्वीकृति की सूचना इस विभाग को हर हालत में दें । यदि यह नियुक्ति प्रस्ताव स्वीकार्य हो तो महाप्रबंधक ( प्रशिक्षण एवं वित्त ) , दूरसंचार विभाग , एनआईसीएफ, गाजियाबाद को रिपोर्ट करें । यदि इस आदेश के जारी होने की तारीख से एक महीने के भीतर कार्यभार ग्रहण नहीं करते हैं तो यह प्रस्ताव रद्द हो जाएगा ।

3 (ख) . यदि किसी भी समय उनकी योग्यता के संबंध में उनके द्वारा भेजा गयाकोई भी प्रमाण-पत्र या दस्तावेज ठीक नहीं पाया जाता है अथवा उनकी योग्यता के संबंध में कोई भी सूचना/तथ्यात्मक सामग्री छुपाई गई है/गलत प्रस्तुत की गई है, तो संगत नियमों के अधीन उनकी नियुक्तिको किसी अन्य दंडात्मक कार्रवाई पर बिना कोई प्रभाव डाले तत्काल रद्द किया जा सकता है।

4. यह आबंटन अनंतिम है और यह माननीय उच्च न्यायालय, मद्रास द्वारा डब्ल्यूपी संख्या 1814-1815/2008 में जारी आदेश के विरुद्ध माननीय उच्चतम न्यायालय में दायर एसएलपी संख्या 13571-13572/2008 में निर्णय के अध्यधीन है ।

5. इस प्रस्ताव पर अपनी स्वीकृति या अस्वीकृति की सूचना इस विभाग को हर हालत में दें । यदि यह नियुक्ति प्रस्ताव स्वीकार्य हो तो महाप्रबंधक ( प्रशिक्षण एवं वित्त ) , दूरसंचार विभाग , एनआईसीएफ , गाजियाबाद को रिपोर्ट करें । यदि वह इस आदेश के जारी होने की तारीख से एक महीने के भीतर कार्यभार ग्रहण नहीं करते हैं तो यह प्रस्ताव रद्द हो जाएगा ।
