भारत सरकार के राजपत्र में 20 अप्रैल 1946 के प्रकाशित तथा 29 अप्रैल 1954 की अधिसूचना सं. एफ. ( 8 ) 70/बी 52 और भारत सरकार के दिनांक 21 फरवरी , 1990 के धारण राजपत्र सं. 67 के अंतर्गत यथा संशोधित लोक ऋण अधिनियम 1944 की धारा 28 के अंतर्गत भारत सरकार द्वारा बनाए गए लोक ऋण नियमावली 1946 के नियम 18 के अनुसरण मार्च 2009 को समाप्त माह के लिए निम्नलिखित सूची खो गई आदि ऐसी प्रतिभूतियों के बारे में एतद्वारा विज्ञापित कीजाती है, जिसके संबंध में इस बात का विश्वास करने के लिए प्रथम दृष्टया आधार मौजूद है कि प्रतिभूतियां खो गयी है और आवेदकों का दावा न्यायोचित है । नीचे लिखे गये संबंधित दावेदारों से इतर सभी व्यक्ति जिनका प्रतिभूतियों पर किसी प्रकार का दावा हो, तत्काल महा प्रबंधक, भारतीय रिज़र्व बैंक केन्द्रीय कार्यालय, सरकारी और बैंक लेखा विभाग, केन्द्रीय ऋण प्रभाग, मुम्बई-400008 को संसूचित करें । सूची दो भागों में विभाजित की गई है । भाग " क " में अभी पहली बार विज्ञापित प्रतिभूतियां शामिल की गई है और भाग " ख " में पूर्व विज्ञापित प्रतिभूतियों की सूची दी गई है ।

अध्यक्ष राष्ट्रीय कृषि और ग्रामीण विकास बैंक मुम्बई, दिनांक 26 मार्च 2009 राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन (संशोधन ) विनियमावली , 2008

सं. राष्ट्रीय कृषि और ग्रामीण विकास बैंक अधिनियम, 1981 ( 1981 का 61 वां ) की धारा 60 की उप- धारा ( 2 ) के खंड ( जे ) तथा उप - धारा ( 4 ) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बोर्ड, केन्द्र सरकार के पूर्व अनुमोदन तथा भारतीय रिज़र्व बैंक के परामर्श से, राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन विनियमावली , 1993 में संशोधन के लिए एतद् द्वारा निम्नलिखित विनियमावली बनाता हैं , नामतः: -

1. ( 1 ) इस विनियमावली को राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन ( संशोधन ) विनियमावली , 2008 कहा 'आएगा । ( 2) यह सरकारी राजपत्र में उसके प्रकाशन की तारीख से प्रभावी होगी ।

[भाग III-खण्ड 4 2. राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन विनियमावली, 2008 के विनियम 32 के खंड 5 ) को प्रतिस्थापित किया जाएगा, नामतः-- " ( 5 ) परिवार पेंशन की सामान्य दर निम्नानुसार होगी :

( क ) उन कर्मचारियों के संबंध में जो 01-11-1992 के पहले सेवानिवृत्त हुए हैं :

वेतनसीमा

प्रतिमाह परिवार पेंशन की दर 1500 रुपये तक

वेतन का 30 % , न्यूनतम 375/ - रुपये प्रति माह को शर्त के अधीन

1501/- रुपये से

वेतन का 20% , न्यूनतम 450/- रुपये प्रति 3000/- रुपये तक

माह की शर्त के अधीन

3000/- रुपये में अधिक वेतन का 15% , न्यूनतम 600/- रुपये प्रति माह की शर्त तथा अधिकतम 1250/ - रुपये प्रतिमाह की सीमा के अधीन

(ख ) उन कर्मचारियों के संबंध में जो 01-11-1992 को या इसके बाद मेवानिवृत्त हुए हैं :

वेतनसीमा

प्रति माह परिवार पेंशन की दर 2870 रुपये तक

वेतन का 30 % . न्यूनतम 720/- रुपये प्रति माह की शर्त के अधीन

2871/- रुपयेसे

वेतन का 20 % , न्यूनतम 800/ - रुपये प्रति 5740/- रुपये तक

माह की शर्त के अधीन

5740/- रुपये से अधिक वेतन का 15 %, न्यूनतम 1150/- रुपये प्रति माह की शर्त तथा अधिकतम 2400/ - रुपये प्रति माह की सीमा के अधीन

स्पष्टीकरण

अंशकालिक कर्मचारी के मामले में परिवार पेंशन की न्यूनतम और अधिकतम राशि लागू होन वाली मज़दूरी के अनुपात में होगी । टिप्पणी

मूल विनियमावली 29 अक्तूबर 1994 के भारत का राजपत्र में दिनांक 16 सितम्बर 1994 की अधिसूचना सं. जीएसआर द्वारा प्रकाशित कोगई थी।

सं.जीएसआर-- राष्ट्रीय कृषि और ग्रामीण विकास बैंक अधिनियम, 1981 ( 1981 की 61 ) की धारा 60 की, उपधारा ( 2 ) के खंड ( जे) के साथ पठित उप- धारा ( 1 ) और उप - धारा ( 4 ) द्वारा प्रदत्त शक्तियों का उपयोग करते हुए राष्ट्रीय कृषि और ग्रामीण विकास बैंक के निदेशक बोर्ड ने केन्द्र सरकार के पूर्व अनुमोदन और भारतीय रिज़र्व बैंक के परामर्श से राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन ( संशोधन ) विनियमावली , 2008 के माध्यम से राष्ट्रीय कृषि और ग्रामीण विकास बैंक पेंशन विनियमावली , 1993 में कुछ संशोधनों का अनुमोदन किया है और उन्हें इसके साथ प्रकाशित किया जा रहा है ।

सं. ए 12 ( 11 ) -11 : 2008-चि.4--कर्मचारी राज्य बीमा अधिनियम , 1948 ( 1948 का 34 की धारा 97 की उप धारा ( 2क ) के साथ पठित भाग III-खण्ड 4]

उक्त धारा की उप धारा ( 1 ) और धारा 17 की उप धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पिछले सभी भर्ती विनियमों , जहाँ तक वे सामान्य कार्य चिकित्सा अधिकारी के पद/ संवर्ग से संबंधित है, के अधिक्रमण के पहले की गई अथवा करने से रह गई बातों के अलावा निगम एतद्वारा सामान्य ड्यूटी चिकित्सा अधिकारी के संवर्ग पद की भर्ती प्रक्रिया को विनियमित करने हेतु निम्नलिखित विनियम बनाता है , अर्थात्: -- 1. संक्षिप्त नाम और प्रारम्भ :--

( i ) ये विनियम कर्मचारी राज्य बीमा निगम ( सामान्य ड्यूटी चिकित्सा अधिकारी संवर्ग/पद ) भर्ती विनियम, 2008 कहे जायेंगे । (ii ) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे । 2. अनुप्रयोज्यता:--

येविनियम इसके साथ संलग्न अनुसूची के कालम । में विनिर्दिष्ट पर्दो परलागू होंगे ।

3. पदों की संख्या, वर्गीकरण एवं वेतनमान: --

उक्त पदों की संख्या, उनका वर्गीकरण और उनसे सम्बद्ध वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कालम 2 से 4 में यथा विनिर्दिष्ट होंगे । 4. भर्ती की पद्धति , आयु सीमा, अर्हताएं तथा अन्य मामले आदि: -- भर्ती की पद्धति, आयु सीमा, अर्हताएं और उक्त पद से संबंधित अन्य मामले अनुसूची के कालम 5 से 13 में यथा विनिर्दिष्ट होंगे । 5. जिन पदों के संबंध में सीधी भर्ती विहित की गई है उनके संबंध में चयन बोर्ड का गठन, चयन की प्रक्रिया आदि :

( 1 ) चयन बोर्ड

( i ) चयन बोर्ड में निम्नलिखित शामिल होंगे :-- (क ) भारत सरकार के सचिव या अपर सचिव स्तर का अंशकालिक अध्यक्ष जिसे सचिव या महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा अध्यक्ष , कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व-अनुमोदन से नियुक्त किया जाएगा ।

(ख) जिस विद्या/विशेषज्ञ क्षेत्र के संबंध में भर्ती की जानी है उससे संबंधित दो चिकित्सा विशेषज्ञ जिन्हों महानिदेशक , कर्मचारी राज्य बीमा निगम द्वारा इस प्रयोजन के लिए अनुरक्षित विशेषज्ञों के पैनल में से, चयन बोर्ड के अध्यक्ष द्वारा चुना जाएगा । ( ग ) नई दिल्ली में चिकित्सा आयुक्त, कर्मचारी राज्य बीमा निगम का विभागीय प्रतिनिधि होगा तथा अन्य राज्यों के मामलों में संबंधित राज्य का वरिष्ठ राज्य चिकित्सा आयुक्त अथवा राज्य चिकित्सा आयुक्त विभागीय प्रतिनिधि होगा । इन अधिकारियों के किसी कारणवश उपलब्ध न होने की स्थिति में महानिदेशक विभागीय प्रतिनिधि के रूप में किसी अन्य अधिकारी को नामित कर सकता है ।

(ii ) अंशकालिक अध्यक्ष की पदावधि सामान्यतः चयन बोर्ड के गठन कीतारीख से एक वर्ष के लिए होगी। परन्तु, अध्यक्ष, कर्मचारी राज्यबीमा निगम के सुस्पष्ट पूर्व अनुमोदन से महानिदेशक द्वारा उनकी पदावधि कम अथवा बढ़ाई जा सकती है।

(iii ) अंशकालिक अध्यक्ष और चिकित्सा विशेषज्ञ, सरकार द्वारा विहित दरों को ध्यान में रखते हुए समय - समय पर महानिदेशक द्वारा नियत दरों पर यात्रा भत्ता , बैठक शुल्क आदि के हकदार होंगे । (2) चयन की प्रक्रिया तथा रीति : --

(क) अनुसूची में शामिल पदों पर सीधी भर्ती, जहाँकहींलागू हो, सामान्यतः राज्य स्तर पर लिखित परीक्षा के आधार

2573 पर पात्र और सफल उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी ।

यदि भर्ती हेतु भिन्न तरीका अंगीकृत करना आवश्यक हो जाता है तो अध्यक्ष, कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन प्राप्त करने के पश्चात महानिदेशक द्वारा इसे अंगीकृत किया जा सकेगा । तथापि, भर्ती की रीति विज्ञापन में अधिसूचित कर दी जाने के पश्चात कोई अनुवर्ती परिवर्तन नहीं किया जा सकेगा ।

( ख ) साक्षात्कार के लिए आमंत्रित किए जाने वाले उम्मीदवारों की संख्या का निर्णय अध्यक्ष , चयन बोर्ड द्वारा रिक्तियों की संख्या और विहित अपेक्षाओं को पूरा करने वाले आवेदकों की संख्या को ध्यान में रखते हुए किया जाएगा । (ग ) आयु, अर्हता , अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक को साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दावे का अधिकार प्राप्त नहीं होगा ।

( घ ) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष , चयन बोर्ड को प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक , कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा किया जाएगा ।

(ङ) चयन बोर्ड को आवश्यक सचिवीय सहायता, महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी ।

6. निरर्हता :

ऐसाकोई व्यक्ति :--

( क ) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसकाविवाहिती जीवित है अथवा

(ख ) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह करने का करार किया है उक्त पद पर नियुक्तिका पात्र नहीं होगा ।

परन्तु यदि महानिदेशक इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्तिऔर विवाह की दूसी पार्टी पर लागू वैयक्तिक कानून के अन्तर्गत अनुमेय है और ऐसा करने के अन्य आधार भी हैं तो वे किसी व्यक्ति को इस विनियम से छूट दे सकते हैं । 7. ढ़ील देने की शक्ति:

जहाँनिगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा कलोचित हैतो वह अध्यक्ष , कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन लेने के पश्चात, कारणों को लेखबद्ध करके आदेश द्वारा किसी श्रेणी अथवा व्यक्तियोंके वर्ग के लिए इन विनियमों के किसी भी उपबंध मेंढ़ील दे सकते हैं। 8. अपवाद :

इन विनियमों की कोई बात आरक्षणों , आयु सीमा में ढील और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिकों और व्यक्तियों के अन्य विशेष वर्गों के लिए उपबंध कराना आपेक्षित है।

( 1 ) भारतीय आयुर्विज्ञान परिषद अधिनियम, 1956 की प्रथम अथवा द्वितीय अनुसूची अथवा तृतीय अनुसूची के भाग- 2 में (लाइसेंसिएट अर्हताओं के अलावा) में शामिल मान्यता प्राप्त मेडिकल अर्हता । (तृतीय अनुसूची के भाग 2 में शामिल शैक्षिक अर्हता धारकों को भारतीय आयुर्विज्ञान परिषद अधिनियम, 1956 की धारा 13 की उप धारा (3) में अनुबद्ध शर्ते पूरी करनी होगी । ' (2) अनिवार्य आवती इंटर्नशिप

पूरी की हो (3) भाषा परीक्षाः अभ्यर्थी को संबंधित राज्य, जहाँ रिक्तियां अधिसूचित की गई है की राजभाषा में मिडिल स्तर की टिप्पणी- जिन अभ्यर्थियों ने अर्हता परीक्षा पास करनी होगी। अनिवार्य आवर्ती इंटनेशिप पूंरी नहीं की है वे लिखित परीक्षा में भाग लेने के हकदार होंगे बशर्ते यदि चयन हो जाता है तो उनहे नियुक्ति से पूर्व अनिवार्य इटर्नशिप आवती संतोषजनक रूप से पूरी करनी होगी

[ भाग III--खण्ड 4 संख्या ए-12(11 )/11/2008-चि.4 कर्मचारी राज्य वोमः अधिनियम 1948 ( 1948 का 34) की धारा 97 की उप धारा (25) के साथ पठित उक्त धारा की उप धारा ( 1 ) और धार। 17 की उप धारा (3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पिछले सभी भर्ती विनियमों, जहाँ तक वे विशेषज्ञों के पदों/ संवर्ग से संबंधित है के अधिक्रमण में. ऐसे अधिक्रमण के पहले की गई अथवा करने से रह गई बातों के अलावा निगम एतद्वारा सामान्य ड्यूटा चिकित्सा अधिकारी के संवर्ग /पद की भर्ती प्रक्रिया को विनियमित करने हेतु निम्नलिखित विनियम बनाता है , अर्थात:-

संक्षिप्त नाम और प्रारम्भ: - 1.

(i) ये विनियम कर्मचारी राज्य बीमा निगम ( विशेषा संवर्ग पद) भर्ती विनियम , 2008 कहे जायेंगे ।

(ii ) ये शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होगे

2. अनुप्रयोज्यता:

ये विनियम इसके साथ संलग्न अनुसूची के कालम 1 में विनिर्दिष्ट पदों पर लागू होंगे ।

पदों की संख्या , वर्गीकरण एवं वेतनमान:

उक्त पदों की संख्या, उनका वर्गीकरण और उनसे सम्बद्ध वेतनमान इन विनियमों के साथ संलग्न अनुसूची के कालम 2 से 4 में यथा विनिर्दिष्ट होंगे ।

4. भर्ती की पद्धति , आयु सीमा, अर्हताएं तथा अन्य मामले आदि:

भर्ती की पद्धति, आयु सीमा, अर्हताएं और उक्त पद से संबंधित अन्य मामले उक्त अनुसूची के कालम 5 से 13 में यथा विनिर्दिष्ट होंगे ।

5. जिन पदों के संबंध में सीधी भर्ती विहित की गई है उनके संबंध में चयन बोर्ड का गठन, चयन की प्रक्रिया आदि:

(1) चयन बोर्ड:

(1) चयन बोर्ड में निम्नलिखित शामिल होंगे:-

(क) भारत सरकार के सत्तिव या अपर सचिव स्तर का अंशकालिक अध्यक्ष जिसे सचिव या महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा अध्यक्ष. कर्मचारी राज्य बीमा निगम के सुस्पष्ट पूर्व-अनुमोदन से नियुक्त किया जाएगा । (ख) जिसविद्या/विशेषज्ञ क्षेत्र के संबंध में भर्ती की जानी है उससे संबंधित दो त्चिकित्सा विशेषज्ञ जिन्हें महानिदेशक, कर्मचारी राज्य बीमा निगम द्वारा इस प्रयोजन के लिए अनुरक्षित विशेषज्ञों के पैनल में से, चयन बोर्ड के अध्यक्ष द्वारा चुना जाएगा ।

(ग) नई दिल्ली में चिकित्सा आयुक्त , कर्मचारी राज्य बीमा निगम का विभागीय प्रतिनिधि होगा तथा अन्य राज्यों के मामलों में संबंधित राज्य का वरिष्ठ राज्य चिकित्सा आयुक्त अथवा राज्य चिकित्सा आयुक्त विभागीय प्रतिनिधि होगा । इन अधिकारियों के किसी कारणवश उपलव्ध न होने की स्थिति में महानिदेशक विभागीय प्रतिनिधिके रूप में किसी अन्य अधिकारी को नामित कर सकता है ।

(ii) अंशकालिक अध्यक्ष की पदावधि सामान्यतः चयन बोर्ड के गठन की तारीख से एक वर्ष के लिए होगी । परन्तु, अध्यक्ष , कर्मचारी राज्य बीमा निधाम के सुस्पष्ट पूर्व अनुगोदन से महानिदेशक द्वारा उनकी पदावधि कम अथवा बढ़ाई जा सकती है ।

(iii) अंशकालिक अध्यक्ष और चिकित्सा विशेषज्ञ, सरकार द्वारा विहित दरों को ध्यान में रखते हुए समय - समय पर महानिदेशक द्वारा नियत दरों पर यात्रा भत्ता, बैठक शुल्क आदि के हकदार होंगे । 2583 भाग III-खण्ड 4]

चयन की प्रक्रिया तथा रीति:

(क) अनुसूची में शामिल पदों पर सीधी भर्ती, जहाँ कहीं लागू हो , सामान्यतः राज्य स्तर पर लिखित परीक्षा के आधार पर पात्र और सफल उम्मीदवारों के साक्षात्कार के आधार पर की जाएगी ।

(ग) आयु , अर्हता, अनुभव आदि की विहित अपेक्षाएं पूरा करने मात्र से ही आवेदक को साक्षात्कार हेतु आमंत्रित किए जाने अथवा विज्ञापित पद पर किसी प्रकार के दावे का अधिकार प्राप्त नहीं होगा । (घ) आवेदनों के संबंध में विज्ञापन जारी करने तथा अध्यक्ष, चयन बोर्ड को प्रस्तुत करने के लिए आवेदनों के प्रक्रमण संबंधी समस्त कार्य महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा किया जाएगा ।

(ड.) चयन बोर्ड को आवश्यक सचिवीय सहायता , महानिदेशक, कर्मचारी राज्य बीमा निगम के कार्यालय द्वारा उपलब्ध कराई जाएगी ।

6. निरर्हता:

ऐसाकोई व्यक्ति:-

(क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह करने का करार किया है जिसका विवाहिती जीवित है : अथवा (ख) जिसने अपने विवाहिती के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह करने का करार किया है उक्त पद पर नियुक्ति का पात्र नहीं होगा :

: परन्तु यदि महानिदेशक इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह की दूसरी पार्टी पर लागू वैयक्तिक कानून के अन्तर्गत अनुमेय है और ऐसा करने के अन्य आधार भी हैं तो वे किसी व्यक्ति को इस विनियम से छूट दे सकते हैं ।

7. ढील देने की शक्ति:

जहाँ निगम के महानिदेशक की राय में ऐसा करना आवश्यक अथवा कालोचित है तो वह अध्यक्ष, कर्मचारी राज्य बीमा निगम का सुस्पष्ट पूर्व अनुमोदन लेने के पश्चात , कारणों को लेखबद्ध करके आदेश द्वारा किसी श्रेणी अथवा व्यक्तियों के वर्गके लिए इन विनियमों के किसी भी उपबंध में ढ़ीलं दे सकते हैं ।

8. अपवाद:

इन विनियमों की कोई बात आरक्षणों, आयु सीमा में ढील और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिकों और व्यक्तियों के अन्य विशेष वर्गों के लिए उपबंध कराना अपेक्षित है ।

( छूट) प्राप्त/ 151 /2523--जहां अनुसची -1 में उल्लिखित स्थापना के नियोक्ता ने ( जिसमें इसके पश्चात् उक्त स्थापना कहा गया है ) कर्मचारी भविष्य निधि एवं प्रकीर्ण उपबंध अधिनियम , 1952 ( 1952 का 19 ) जिसे इसके पश्चात् उक्त अधिनियम कहा गया है, की धारा 17 की उप धारा ( 2 क ) के अंतर्गत छूट के लिए आवेदन किया है ।

4. नियोजक सरकार द्वारा अनुमोदित सामूहिक बीमा योजना के नियमों की एक प्रति और जब कभी उसमें संशोधन किया जायेगा तब संशोधन की प्रति तथा कर्मचारियों की बहुसंख्या के आधार पर उनकी भाषा में उसकी मुख्य बातों का अनुवाद स्थापना के सूचनापट्ट पर प्रदर्शित करेगा । 5. यदिकोई कर्मचारी जो भविष्य निधि या उक्त अधिनियम के अधीन छूट प्राप्त किसी स्थापना की भविष्य निधि का पहले से ही सदस्य है, उसको स्थापना में नियोजित किया जाता है तो नियोजक सामूहिक बीमा योजना के सदस्य के रूप में उसका नाम तुरन्त दर्ज करेगा और उसकी बाबत आवश्यक प्रीमियम का भारतीय जीवन बीमा निगम में भुगतान करेगा।

6. यदि कर्मचारियों का सामूहिक बीमा योजना के अधीन उपलब्ध लाभ उक्त योजना के लाभों से अधिक अनुकूल हैं तो नियोजक सामूहिक बीमा योजना के अधीन कर्मचारियों को उपलब्ध लाभों में उपयुक्त वृद्धि किए जाने कीव्यवस्थाकरेगा ।

7. सामूहिक बीमा योजना में किसी बात के होते हुए भी, यदि किसी कर्मचारी की मृत्यु पर इस योजना के अधीन संदाय राशि से कम है तो जो कर्मचारी को उस दशा में संदाय उक्त योजना के अधीन होता है तो, नियोजक कर्मचारी के विधि वारिस नाम निर्देशितों को प्रतिकार के रूप में दोनों राशियों के अंतर राशि का संदाय करेगा ।

1. उक्त स्थापना के संबंध में नियोजक ( जिसे इसके पश्चात् नियोजक कहा गया है ) संबंधित क्षेत्रीय भविष्य निधि आयुक्त को ऐसा विवरणियां भ `जेगा और लेखा रखेगा तथा निरीक्षण के लिए ऐसी सुविधाएं प्रदान करेगा जो केन्द्रीय भविष्य निधि आयुक्त समय- समय पर निर्दिष्ट करेंगे । 9. अतः यदि किसी कारणवश उक्त स्थापना का कर्मचारी भारतीय जीवन बीमा की सामूहिक बीमा योजना के, जिसको स्थापना पहले ही अपना चुकी है, अधीन नहीं रह जाता है या इस योजना के अधीन कर्मचारियों कोप्राप्त होने वाला लाभ कम हो जाये तो छूट को रद्द किया जा सकता है । 10. यदि किसी कारणवश नियोक्ता भारतीय जीवन बीमा निगम द्वारा नियत तारीख के भीतर प्रीमियम संदाय करने में असफल रहता है और पालिसी व्यपगत हो जाती है तो छूट रद्द की जा सकती है ।

11. नियोजक द्वारा प्रीमियम के संदाय में चूक करने के मामले में मृतक सदस्य के निर्देशितों या विधिक वारिसों को बीमा लाभों के संदाय का उत्तदायित्व नियोजक पर होगा ।

In exercise of the powers conferred by sub- section (1 ) of section 97 read with sub - section ( 2A ) of the said section and sub - section (3) of section 17 of the Employees ' State Insurance Act , 1948 ( 34 of 1948) and in supersession of all previous Recruitment Regulations so far as they relate to the post cadreof General Duty Medical Officer Grade except as respects things done or omitted to be done before such supersession , the Corporation hereby makes the following regulations regulating the method of recruitment to the General Duty Medical Officer cadre/ posts namely: -

1. Short title and commencement: (1) These Regulations may be called the

Employees' State Insurance Corporation ( GDHOS Cadre Posts ) , Recruitment Regulations , 2008 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Application: - These regulations shall apply to the posts specified in Column 1 of the Schedule annexed hereto .

3. Number of posts, classification and scale of pay: The number of the said posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedules annexed to these Regulations .

4.Method of recruitment , age limit, qualifications and other matters etc.- The method of recruitment , age limit , qualifications and others matters relating to the said posts shall be as specified in columns 5 to 13 of the said Schedule .

5. Composition of Selection Board, procedure of Selection etc. in respect of posts for which direct recruitment is prescribed:

(1) Selection Board:

( i ) The selection Board shall consist of: -

(a) A part- time Chairman of the status of Secretary or Additional Secretary to the Government of India , who maybe appointed by Secretary or the Director General , Employees' State Insurance Corporation , with the specific prior approval of the Chairman, Employees ' State Insurance Corporation .

(b) Two Medical experts from the discipline / specialised field pertaining to which recruitment is to be made , who may be chosen by the Chairman Selection Board from the panel of experts maintained for the purpose by the Director General, Employees' State Insurance Corporation .

(c) The Medical Commissioner , Employees 'ees ' State Insurance Corporation will be the departmental representative in New Delhi and in case of other States , the Senior StateMedical Commissioner or State Medical Commissioner of the respective States will be departmental representatives . In case , these officers are not available for some reason then Director General can nominate some other officer as the departmental representative .

(ii ) The term of office of the part- time Chairman shall ordinarilybe one year from the date of constitution of the Selection Board . His term may , however ,be curtailed or extended by the Director General , with the specific prior approval of the Chairman , Employees' State Insurance Corporation .

( iii ) The part- time Chairman and the Medical Experts shall be entitled to travelling allowances , sitting fees etc. at such rates as may be fixed by the Director General from time to time , keeping in view the rates prescribed by the Government .

(2) Procedure and manner of Selection: -

(a) Direct recruitment to the posts included in the schedule , wherever applicable , shall ordinarily be made at state level on the basis of a written examination followed by an interview of eligible and successful candidates .

In case , it becomes necessary to adopt a different mode of recruitment , the same may be adopted by the Director General after obtaining specific prior approval of the Chairman , Employees ' State Insurance Corporation . However , once a mode of recruitment is notified in the advertisement , no change shall be made subsequently.

(b) The number of candidates to be invited for interview shail be decided by the Chairman, Selection Board , keeping in view the number of vacancies and the number of applicants who satisfy the prescribed requirement.

(c) Mere fulfillment of the prescribed requirement of age , qualification , experience etc. will not confer any right on the applicant to be called for interview or to any claim over the post advertised .

(d) All work relating to issue of advertisement in respect of applications and processing ofapplications for submission to the Chairman , Selection Board will be handled by the office of the Director General . Employees ' State Insurance Corporation .

(e) The Selection Board will be provided necessary Secretarial assistant by the office of the Director General , Employees ' State Insurance Corporation .

6. Disqualification - No person :-

(a) Who has entered into on contracted a marriage with a person having a spouse living; ог

(b) Who , having a spouse living , nas entered into or contracted a marriage with any person; shall be eligible for appointment to the said posts:

Provided that the Director General may , if satisfied that such marriage is permissible under the personal law applicable to sucli person and the other party to the marriage and that there are other grounds for so doing , exempt any person from theoperation of this Regulation .

7. Power to relax: Where the Director General of the Corporation is of the opinion that it is necessary or expedient to do so , he may , by order , for reasons to be recorded in writing and after obtaining specific prior approval of the Chairman , Employees ' State Insurance Corporation , relax any of the provisions of these regulations with respect to any class or category of persons .

8. Savings: - Nothing in these regulations shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

Now therefore , in exercise of the powers conferred by Sub- Section (2A) of Section 17 of the said Act and subject to the conditions specified in Schedule - II annexed hereto , the Central provident Fund Commissioner hereby exempt each of the said establishment in Schedule - I from the operation of said Scheme for a period as mentioned in the Schedule - l against each of the said establishment . Exemption in respect of said establishment from Sl . No. 1 & 2 is extension of exemption in continuation of previous Notification No. and date shown against the said establishment .

SCHEDULE -HI

1. The employer in relation to each of the said establishment ( hereinafter referred to as the employer ) shali submit such returns to the Regional Provident Fund Commissioner concerned and maintain such account and provide such facilities for inspection , as the Central Provident Fund Commissioner may direct from time to time.

2. The employer shall pay such inspection charges as the Central Govt. may from time to time , direct under clause ( a ) Sub - Section (2A ) of Section 17 of the said Act within 15 days from the close of every month .

3. All expenses involved in the administration of the Group Insurance Scheme including maintenance of account , submission of retums , payment of Insurance premium, transfer of accounts , payment of inspection charges etc. shall be borne by the employer .

4. The employer shall display on the notice board of the establishment , copy of the Rules of the Group Insurance Scheme as approved by the Central Govt./Central Provident Fund Commissioner as and when amended alongwith translation of salient features thereof in the language of the majority of the employees.

5. Whereas an employee , who is already a member of the Employees' Provident Fund or the Provident Fund of an establishment Exempted under the said Act is employed in his establishment the employer shall immediately admit him as a member of the Group Insurance Scheme and pay necessary premium in respect of him to Life Insurance Corporation of India.

6. The employer shall arrange to enhance the benefits available to the employees under the Group Insurance Scheme appropriately if the benefits available under Group Insurance Scheme are more favourable to the employees than the benefits under the said scheme.

7. Notwithstanding anything contained in the Group Insurance Scheme, if on the death of an employee the amount payable under the Scheme be less than the amount that wouldbe payable had the employees been covered under the said Scheme, the employer shall pay the difference to the nominees(s ) , legal heir(s) of the employee as compensation .

8. No amendment of the provisions of the Group Insurance Scheme shall be made without the prior approvat of the Regional Provident Fund Commissioner concemed and where any amendment is likely to effect adversely the interest of the employees by this approval , give a reasonable opportunity to the employee to explain his point of view.

9. Therefore, for any reason the employee of the said establishment do not remain covered under the Group Insurance Scheme of the Life Insurance , Corporation of India as already adopted by the said establishment, or the benefits to the employees under this scheme are reduced in any manner , the exemption shall be liable to be cancelled.

10. Where for any reason the employer fails to pay the premium etc. within the due date as fixed by the Life Insurance Corporation of India and the policy is allowed to lapse, the exemption shall be liable to be cancelled.

11. In case of default, if any , made by the employer in payment of premium the responsibility for payment of assurance benefits to the nominee( s ), legal heir( s ) of deceased member who would havebeen covered under the said scheme but for grant of this exemption shall be that of the employer.

12. Upon the death of the member covered under the Group Insurance Scheme , the Life Insurance Corporation of India shall ensure prompt payment of the sum assured to the nominee(s ) , legal heir(s) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in all respect .
