आ.अ. 30.-यतः 2005 में हुए हरियाणा विधानसभा के साधारण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री ओम प्रकाश जैन , निवासी 624 एल , पृथ्वी चौक, मॉडल टाउन , पानीपत हरियाणा को भारत निर्वाचन आयोग के आदेश सं. 76/हरियाणा- वि. सभा/2005 ( 7 ) दिनांक 7-11-2006 द्वारा लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 क के अधीन उक्त अधिनियम और तद्धीन बनाए गए नियमों और आदेशों द्वारा अपेक्षित निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहने के कारण निरर्हत किया गया है; और
यतः श्री जैन से उक्त निर्वाचन के निर्वाचन व्ययों के लेखों से संबंधित दस्तावेज प्रस्तुत करते हुए एवं अनुबंधित समय - सीमा के अंदर लेखा प्रस्तुत न करने का कारण देते हुए दिनांक 23-2-2009 और 22-5-2009 का आवेदन प्राप्त हुआ है । उन्होंने निरर्हता हटाने के लिए व्यक्तिगत सुनवाई का भी निवेदन किया है ; और
यतः श्री जैन को व्यक्तिगत सुनवाई का भी अवसर प्रदान किया गया था । आयोग ने उनके निवेदन को मान लिया और इस मामले में 2-7-2009 को उनकी बात सुनी और उनकी मौखिक स्वीकृति के अलावा उन्होंने निवेदन किया कि उनके मामले पर सहानुभूतिपूर्वक विचार किया जाये , और यदि वे फिर भी दोषी पाए जाते हैं, तो चूंकि वह पहले से ही दो वर्ष और सात महीने की सजा भुगत चुके हैं, अतः निरर्हता आदेश में परिवर्तन किया जा सकता है ताकि वे अगले साधारण निर्वाचन में निर्वाचन लड़ सकें; और
यतः निर्वाचन ने कागजातों को ध्यान से पढ़ने और मामले के तथ्यों और परिस्थितियों का लिहाज रखते हुए लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 10क के अधीन उक्त श्री ओम प्रकाश जैन पर लगाई गई निरर्हता की अवधि को इस आदेश की तारीख तक कम कर दिया है ।
अतः अब आयोग के आदेश सं. 76/हरियाणा-वि. सभा/2005( 7 ) दिनांक 7-11-2006 में क्रम संख्या 7 में दर्शित श्री ओम प्रकाश जैन का नाम दिनांक6-7-2009 से उक्त आदेश से विलोपित मान लिया जाये ।

New Delhi, the 6th July, 2009
O.N. 30. Whereas , Shri Om Prakash Jain , r/o 624 L, Prithvi Chowk, Model Town, Panipat (Haryana) , a contest- ing candidate for the General Election to the Legislative Assembly of Haryana held in 2005 was disqualified by the Election Commission of India, vide its order No. 76 /HN - LA/ 2005(7) , dated 7-11-2006, under Section 10A ofthe Representation ofthe People Act, 1951 , for failure to lodge his account of election expenses as required by the said Act and the Rules and Orders made thereunder ; and
Whereas, applications dated 23-02-2009 and 22-05-2009 were received from Sh . Jain submitting therewith the documents pertaining to the accounts of his election expenses in the said election and reasons for non submission of accounts within the stipulated time . He also requested for personal hearing for removal of disqualification; and Whereas , Sh . Jain was afforded an opportunity to be heard in person . The Commission acceded to his request and heard him on 2-7-2009 , in the matter and apart from his oral submission he requested that his case may be considered sympathetically and if at all he is found guilty , the disqualification order may be modified as he has already undergone penalty of two years and seven months so that he may be able to contest the next general elections; and Whereas , having perused the papers and having regard to the facts and circumstances of the Commission in exercise of the powers conferred under Section 11 of R.P. Act, 1951 , has reduced the period of disqualification imposed under Section 10A of the said Act on the said Sh. Om Prakash Jain up to the date of this order .
Now, therefore, the name of Sh. Om Prakash Jain appearing at Sl . No. 7 in the Commission's order No. 76/HN -LA/ 2005(7) , dated 7-11-2006 shall deemed to have been omitted from the said order with effect from 6-7-2009.

आ.अ. 31.-यतः भारत निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ 2 में विनिर्दिष्ट गोवा विधान सभा के साधारण निर्वाचन , 2007 में स्तम्भ 3 में विनिर्दिष्ट निर्वाचन क्षेत्र से उनके नाम के सामने स्तम्भ 4 में विनिर्दिष्ट निर्वाचन लड़ने वाले अभ्यर्थी उक्त सारणी के स्तम्भ 5 में दर्शाए गए अनुसार लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;
और यतः , उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक नोटिस दिए जाने के बाद भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं किया है अथवा उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के बाद निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई उचित कारण अथवा न्यायौचित्य नहीं है ;
अतः अब उक्त अधिनियम की धारा 10 - क के अनुसरण में निर्वाचन आयोग, यह घोषणा करता है कि नीचे की सारणी के स्तम्भ 4 में विनिर्दिष्ट व्यक्ति, राज्य की विधान परिषद् अथवा विधान सभा अथवा संसद के दोनों सदनों अथवा संघ राज्य क्षेत्र में सदस्य चुने जाने अथवा होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित किए जाते है : -

Whereas, the Election Commission of India is satisfied that each of the contesting candidate speci- fied in column 4 of the Table below at the General Election to the Goa Legislative Assembly, 2007 specified in column 2 and held from the constituency specified in column 3 against his/her name has failed to lodge the account of his/her election expenses as shown in column 5 of the said Table as required by the Representation of the People Act, 1951 and the Rules made thereunder,

आ.अ. 32.-यतः भारत निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट गुजरात विधान सभा के साधारण निर्वाचन के लिए जो स्तम्भ ( 3 ) में यथा विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है , स्तम्भ ( 4) में विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा- दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;
और यतः , उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर , यदि कोई हों , विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः अब निर्वाचन आयोग उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ (4 ) में विनिर्दिष्ट व्यक्तियों का संसद के किसी भी सदन के या किसी राज्य संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए एतद्वारा निरर्हित घोषित करता है : --
