सर्वसाधारण हेतु सूचित किया जाता है कि कम्पनी के अंशधारको ने तिथि 29 जून, 2009 में आयोजित उनकी असाधारण सामान्य बैठक में निम्नलिखित विशेष संकल्प पत्र पारित किया है ।

"संकल्पित है कि कम्पनीज़ अधिनियम, 1956 की धारा 484 (1 ) ( बी) के प्रावधानो की शर्तों में सदस्यों की स्वैच्छिक रुप से समाप्ति हेतु मंगलवार 30 सितम्बर 2008 में आयोजित उनकी वार्षिक साधारण बैठक में एक संकल्प पत्र पारित किया है तथा एतद्वारा वापिस/ पुनः आमंत्रित / प्रतिस्थापित है । "

फोनोग्राफिक परफॉरमेन्स लिमिटेड, भारत सरकार द्वारा अधिकत एवं पंजीकृत सोसाइटी है जो कि इण्डियन कॉपीराइट एक्ट के अन्तर्गत प्रतिलिप्याधिकार के क्षेत्र में व्यवसाय में करने हेतु रजिस्टार ऑफ कॉपीराइट कार्यालय द्वारा पंजीकरण संख्या सी.एस./ ०३ / साउड रेकॉर्डिंग / ६६ दिनांक ७ मई १६६६ के तहत कॉपीराइट एक्ट की धारा ३३ (३) के अन्तर्गत पंजीकृतकिया गया है । फोनोग्राफिकपरफॉरमेन्स लिमिटेड के सदस्यों के रूप में १६० से अधिक भारतीय एवं विदेशी संगीतकम्पनियों तथा क्षेत्रीय लेबल , जो अपने सम्बन्धित संग्रह / कृति पर स्वामित्व रखती हैं । इन समस्त सदस्य कम्पनियों द्वारा केवल फोनोग्राफिक परफॉरमेन्स लिमिटेड सोसाइटी को पब्लिक परफॉरमेंन्स के प्रबन्धन हेतु अधिकृत किया गया है । इस प्रकार फोनोग्राफिक परफॉरमेन्स लिमिटेड अपने सदस्य संगीत कम्पनियोंद्वारा अधिकृत ए कमात्र ऐसी संस्था है जो कि पब्लिक परफॉरमेन्स लाइसेन्स जारी करती है ।

पूर्वप्रकाशित आम सूचना जो कि दिनॉक १०-६-०५ से १६-६-०५ के भारत सरकार के गजट में प्रकाशित हुई थी, के ऑशिक संशोधन के कम में एतदद्वारा सर्वसाधारण को यह सूचित किया जाता है कि फोनोग्राफिक परफॉरमेन्स लिमिटेड केसदस्य संगीत कम्पनियों द्वारा , जो कि साउन्ड रिकार्डिंग के स्वामी हैं, दिनॉक २०-६-०८ को आयोजित वार्षिक साधारण बैठक में यह निर्णय लिया गया कि पब्लिक परफॉरमेंस लाइसेंस की कुछ श्रेणियों के शुल्क को संशोधित / परिवर्तित किया जाये । उपरोक्तानुसार, एतदद्वारा यह सूचित किया जाता है संगीत के प्रयागकर्ताओं द्वारा दिनॉक १-१०-२००८ से निम्नलिखित पब्लिक परफॉरमेंस शुल्क फोनोग्राफिक परफॉरमेन्स लिमिटेड सोसाइटी को अदा की जायेगी ।

टैरिफ पद्वति

निम्नलिखित टैरिफ केवल उन अनुपालक अनुज्ञप्तिधारकों/ लाइसेंसधारकों अर्थात संगीत के उन प्रयोगकर्ताओं के लिए लागू होगा, जिन्होंने कि सोसाइटी के संगीत कति को प्रयोग करने , सुसंगत करार/ एग्रीमन्ट को स्वीकार करने, यथा समय समुचित शुल्क अदा करने अगर कोई हो तो और अनुज्ञप्ति की शर्तों का अनुपालन करने से पूर्व अनुज्ञप्ति हेतु आवेदन किया हो और अनुज्ञप्ति प्राप्त कर लिया हो । अनुज्ञप्ति की शर्तों का उल्लंघन करने वाले आवेदकों को, जो कि पूर्व उल्लंघन के विनियमितीकरण / कम्पनी के अधिकारों / अनुज्ञप्ति की शर्तों की अनदेखी करने /वर्तमान अनुज्ञप्ति की शर्तों का पालन न करने और गैर- प्राधिकत रूप से संगीत का प्रयोग करने पर निश्चित टैरिफ राशि से २५ प्रतिशत अधिकशुल्क, सोसाइटी के निर्णयानुसार, अदा करनी होगी ।

भाग १ : पार्श्व संगीतः

२ ) पॉप संगीत /क्विजेजः यह टैरिफ उस दशा में लागू होगा जब साउन्ड रिकार्डिंग ऐसे सीलों पर प्रयुक्त हो रहा हो जहाँपॉप क्विजेज , म्यूजिक क्विजेज और कोई अन्य संगीत क्विज का आयोजन हो रहा हो और संगीत के किसी भी त त्वका

प्रयोग हो रहा हो । शुल्क रु. ५०० प्रति क्विज

जहाँ कि पॉप / संगीत क्विज के लिए रि- रिकार्डिंग बनाने का प्रश्न है, वहाँ आयोजक को चाहिए कि वह संबंधित संगी त कम्पनी से इस कार्य हेतु पूर्वानुमति अवश्य ले लें । ऐसी स्थिति में पथक ब्रॉडकास्टिंग / टेलीकास्टिंग टैरिफ लागू होगा ।

[PART IV ४ ) ज्यूकबॉक्सः जब ज्यूकबॉक्स का प्रयोग कार्यक्षेत में संगीत के आवक श्रोत के रूप में प्रयोग होता हो अर्थात जब ज्यूकबॉक्स का संयोजन मुख्य प्रणाली से किया गया हो और तत्पश्चात संगीत का प्रयोग सम्पर्ण कार्यक्षेत में किया जा रहा हो ।

शुल्क: प्रयोग किये जा रही साइट के अनुसार ।

जब कभी ज्यूकबॉक्स को एकल संयंत के तौर पर लगाया गया हो तथा इसका कार्यक्षेत निषिदध किया गया हो और इसका संयोजन केवल इसी उपकरण के स्पीकरों तक ही सीमित हो तोः- अ) पार्श्व संगीत के बिनाः जहाँ पर ज्यूक बॉक्स पार्श्व संगीत के बिना प्रतिष्ठापित किया गया हो उन स्थलों पर निम्न टैरिफ लागू होगाः

एकल उपकरण : रू. ६,००० प्रति वर्ष प्रति ज्यूकबॉक्स

बहुल उपकरण : रू. ३,००० प्रति वर्ष प्रति ज्यूकबॉक्स

ब) पार्श्व संगीत के साथः जहाँ पर ज्यूकबॉक्स पार्श्व संगीत के साथ प्रतिष्ठापित किया गया हो । इस प्रकार के प्रतिष्ठापन को फ्रीप्ले सुविधा युक्त ज्यूकबॉक्स माना जायेगा तथा उन पर निम्न टैरिफ लागू होगाः

एकल उपकरण : रू. ६,००० प्रति वर्ष प्रति ज्यूकबॉक्स

बहुल उपकरण : रू. ४,००० प्रति वर्ष प्रति ज्यूकबॉक्स

यदि ज्यूकबॉक्स का प्रयोग संगीत के डिजिटल संग्रह हेतु किया जा रहा हो तो उपकरण सप्लायर को अस्थायी संग्रह के लिए उपरोक्त शुल्क के साथ अतिरिक्त चार्जेज अदा करने पड़ेंगे (अस्थाई संग्रह कीमत ज्यूकबॉक्स श्रेणी देखें) ५) नृत्य शिक्षणः यह टैरिफ नृत्य शिक्षकों एवं नृत्य स्कूलों के लिए लागू होगा जहाँ साउण्ड रिकार्डिंग का प्रयोग नृत्य वर्ग एवं एकल ट्यूशन के प्रयोजनार्थ होता हो । नृत्य के प्रकारों में बॉलरूम , लेटिन, जॅज , बेलेट , डिस्को, टेप तथा अन्य समकालिक नृत्य निर्देश सम्मिलित हैं ।

साउण्ड रिकार्डिंग के प्रयोग की पहिचान करने के लिए एक बेन्डेड टैरिफ प्रयोग होता है । प्रायः यह टैरिफ किसी कार्यक्रम में उपस्थित होने वाले लोगों की संख्यानुसार अथवा उस स्थान के आकारानुसार तय किया जाता है , ताकि अंतिमशुल्क से प्रयोग गये रिकार्डिंग की अवधि परिलक्षित हो जाये !

६ ) नृत्य केन्द्र- स्टूडियाः यह टैरिफ नृत्य केन्द्र / स्टूडियो जहाँ पर एकल स्टूडियो और रिहर्सल कक्ष किराये हेतु उपलब्ध होंके लिए लागू होगा । यह टैरिफ समस्त प्रकार के नृत्यों एवं कक्षों में होने वाली गतिविधियों में साउन्ड रिकार्डिंग के प्रयोगके लिए लागू होगा । शुल्क रू. ३० प्रति घंटा प्रति स्टूडियो ( शुल्क की गणना साप्ताहिक योग तथा वार्षिक निर्धारण के आधार पर होगी)

७) व्यायामः यह टैरिफ ऐरोबिक्स , कीप फिट, स्लिमिंग , केलिस्थेनिक्स, एक्वाऐरोबिक्स, मीडो, लबन तथा अन्य समस्त नाटय गतिविधियों तथा व्यायाम कक्षाओं हेतु लागू होगा ।

शुल्क: रू. २,००० प्रति वर्ष प्रति सोसाइटी

६) नाट्यग्रहीय उत्पादनः यह टैरिफ उस श्रेणी के उपयोगकताओं पर लागू होता है जहाँ साउन्ड रिकार्डिंग का नाट्यग्र हीय उत्पादन के दौरान और ऑन स्टेज या ऑफ स्टेज ध्वनि प्रभावों के लिए प्रयोग होता हो ।

नोट:(अ) किसी प्रतिष्ठान में जहाँ संगीत का उपयोग मनोरंजन के लिये एक विशिष्ट आकर्षण के रूप में होता हो तो भाग २ मे दिये गये टैरिफ लागू होंगे उदाहरण के तौर पर किसी रेस्टोरेंट या मॉल में जहाँ दैनंदिन कार्यक्रम में संगी त रेकार्डिंग का प्रयोग होता हो पार्श्वसंगीत टैरिफ लागू होगा, परंतु इन्हीं जगहों पर नये साल या व्हलेंटाइन डे पार्टी इत्यादि में जबसंगीत का उपयोग एक विशिष्ट आकर्षण के रूप में होता हो तो तब भाग २ में दिए गये इव्हेंट टैरिफ लागूहोगी।

उत्पादन प्रसिध्दि कार्यक्रम ( Product Launch ) या इतर प्रायोजित कार्यक्रम भी भाग २ ( इव्हेंटस) के अंतर्गत माने जायेंगे ।

१) डिक्कोथेक / लॉन्जबार / कोई भी डान्स फलोर (१-१०-०८ से संशोधित): इस श्रेणी के प्रयोगकर्ताओं पर विशिष्ट मनोरंजन टैरिफ लागू होगा जहाँ पर संगीत का प्रयोग पार्श्व संगीत की बजाय विशिष्ट आकर्षण के रूप में होता हो । उदाहरणार्थ, उन प्रतिष्ठानों में जहाँ संगीत का प्रयोग परफॉरमेन्स अथवा नाटय प्रयोजनार्थ, संगीत के श्रोत को ध्यान में न रखते हुए , संगीत उपकरण या डिस्क जौकी के माध्यम से आयोजित होः

[PART IV (अ) यह टैरिफ उन सभी नियमित कियाकलापों पर लागू होगा जहाँ साउन्ड रिकार्डिंग और साउन्ड विडियो मनोरंजन का मुख्य आकर्षण हो तथा वहाँ पर होने वाले नाच, कैरोक और अन्य कोई भी मनोरंजक क्रियाकलाप के लिए संगीत या संगीत विडियो , किसी डीजे द्वारा प्रदान किया जाने वाला, अभिन्न और अनिवार्य तत्व हो! ( ब) प्रति कार्यकम रिकार्ड प्रयोग करने की अवधि वह अवधि होती है जिस समय में संगीत का प्रयोग वास्तवित रूप में हुआ हो (समीपवर्ती आधे घंटे तक) (क ) शुल्क की दर की गणना करने के लिए निम्नलिखित तीन सूचनायें देना अनिवार्य हैः किसी भी कार्यक्रम के दौरान कितने घंट संगीत का प्रयोग हुआ, उस कार्यक्रम में औसत उपस्थिति तथा इस अवधि में आयोजित कार्यक्रमों की संख्या । (ड) इस टैरिफ का प्रयोग सभी नियमित / समयावधिक कार्यक्रमों जिनमें श्रोताओं का प्लवमान होता हो , के लिए होता है । किसी एक इव्हेंट के लिये कृपया इव्हेंट लाइसेन्स देखिये ।

५७ ) होटल अभिदान के लिए संगीत सेवा प्रबन्धक अर्थात अभिदानकर्ता द्वारा अदा किया हुआ । जहाँ अभिदानकर्ता और उसके होटल में आनेवाले मेहमान को एक ही शुल्क के बदले में कई सेवायें प्रदान की जाती हों । (१ ) कुल राजस्व की गणना केवल उन अनेक सेवाओं के फलस्वरूप अर्जित धनराशि के ३० प्रतिशत पर की जायेगी ।

अस्थाई सन्निविष्टि / संग्रह / स्थानान्तरण की सामान्य शर्तेंः

१-यह लाइसेंस लाइसेंसधारक को साउण्ड रिकार्डिंग को नये कैरियर में डब और संग्रह कर प्रयोग करने का अस्थाई अधिकार देता है ।

२- यह लाइसेंस लाइसेंसधारक को एकल संगीत उपकरण में साउण्ड रिकार्डिंग के संकलन जमा करने का अधिकार दे 'ता है ।

३-इस प्रकार से जमा या संकलित संगीत का उपयोग केवल लाइसेंस लिये गये स्थल पर ही पब्लिक परफॉरमेन्स हेतु प्रयोग किया जायेगा ।

४ - इस प्रकार से जमा या संकलित संगीत को जनविमोचित या विपणित नहीं किया जायेगा ।

५- यह लाइसेंस संगीत के अस्थाई संग्रह हेतु केवलं १२ माह के लिए वैघ होगा और प्रत्येक १२ माह के बाद लाइसेंस का नवीनीकरण करवाना होगा ।

६-१२ माह बाद नवीनीकरण न करने की दशा में संगीत का संग्रह करना अवैध माना जायेगा ।

७- यह लाइसेंस लाइसेंसधारक को संगीत को जनसंचारित या परफॉरमेन्स करने लिए मान्य नहीं होगा तथा ऐसा करने के लिए नये लाइसेंस की आवश्यकता होगी ।

८- सकल राजस्व का अर्थ है लाइसेंसधारक द्वारा अभिदान , विज्ञापन तथा प्रायोजित कार्यक्रमों के माध्यम से अर्जित राजस्वं सम्मिलित हैं । 286

PHONOGRAPHIC PERFORMANCE LTD . ( PPL ) is the Copyright Society registered with and authorised by Government of India vide Registration No. CS/ 03 /Sound Recording / 96 to carry out Copyright business in Sound Recording vide Certificate of Registration dated 7th May 1996 issued by Registrar of Copyrights under Section 33(3) of the Copyright Act , 1957. PPL has over 160 members (music companies ) , who include national , International and regional labels that own /control substantial repertoire of sound recordings. These member companies have exclusively authorized PPL to administer , inter alia , the public performance rights in their sound recordings , by virtue of which PPL is the sole designated body to issue Public Performance Licences in the country on behalf of all its members .

In partial modification of the Public Notice published in the Gazette of India dated September 10- September 16, 2005, it is hereby notified that the members of PPL who are the owners of Sound Recording works have revised /rationalized/ modified some of the license categories and licence fees , in the annual general meeting on 29.9.2008 . Accordingly, the License fees payable by music users to Phonograpic Performance Ltd for public performance w.e.f. 1st October 2008 are as under:

Tariff Scheme: Below tariffs are applicable only for " Compliant Licencees " i.e. those users who apply for and obtain licence prior to using the Society's repertoire , sign relevant agreements , pay the fees and deposits , if any, on time , and comply with/abide by the terms and conditions of the licence . In respect of " Non - Compliant Licensees " i.e. those users who seek to regularize past infringements / violations / breach of Society's rights and licenses ( including non - compliance with terms and conditions of existing licence agreements , usage without license , mis- representations , etc ) , a load of 25% over the tariff shall apply at the discretion of Society.

2. POP/ Music Quizzes : This tariff is applicable when sound recordings are played at premises providing pop quizzes , music quizzes and any general quiz involving some musical content . Fee : Rs.500/- Per Quiz . When re - recording is involved to make up tapes for pop/ music quizzes , the applicant must first obtain the prior written permission of the record companies concerned and separate tariff Broadcasting/ Telecasting would apply as the case may be .

[PART IV 4. JUKE BOXES : When Juke box is used as an irward source for the whole area of operation i.e. when it is connected to the main system and is audible to the entire area of operation . Fees: As per the site of usage . Whenever the Juke box is installed as a stand -alone machine and its area of coverage is restricted & is limited to the reach of its own audio speakers . ( A. ) Without Background Music: This tariff should be used for premises when a juke box without a background music facility has been installed . Single : Rs 4,000 per annum per Juke Box . Multiple : Rs 3,000 per annum per Juke Box. ( B. ) With Background Music : This tariff is applicable for premises that have a juke box with a background music facility. You may recognise this as a juke box with a facility for free play . Single : Rs 6,000 per annum per Juke Box . Multiple : Rs 4,000 per annum per Juke Box. In case if the Juke Box involves digital storage of music . in addition to the above Public Performance fees , additional charges for Temporary Storage to be paid by the equipment supplier . ( refer Temporary Storage Cost - Juke Box) .

5. Dance Teachers: This tariff is for dance teachers and dancing schools when sound recordings are played during dancing classes and tuition for individual pupils . Types ofdancing covered include ballroom , latin , jazz, baliet , disco , tap and other forms of contemporary dance instruction .

A banded tariff is used in recognition of the way in which you play sound recordings .

Often these tariffs are banded according to the numbers of people at an event or the size of the venue so that the final fee reflects the extent to which recordings are being used.

9. THEATRICAL PRODUCTIONS: This tariff is for the playing of sound recordings during the action of theatrical productions and for on - stage or off-stage effects . Fees : Up to 5 min of Performance : Rs 200 per performance . For every Additional 5 min or part ofperformance : Rs 100 per performance . When recording is involved , the applicant must also obtain the prior written permission of the record companies concerned .

10. TEMPORARY CAMPS / SHACKS : Fees: Rs 10 Per day Per Shack ( subject to a minimum of 90 days) .

Where a Subscriber and the Guests in the Subscriber's Hotels are provided for the payment of a single fee with a bundle of services that include the Service :

[PART IV ( i ) the Gross Revenue shall be calculated by only using 30% of the Funds derived from the provision of that bundle of services.

General Conditions of Embodiment / Storage /Transfer Licenses .

1. This License allows the Licensee the temporary right to dub & store the sound recording on a new Carrier.

1 . This License allows the Licensee to aggregate and create compilation on a single playing device .

III . Such compilation or aggregation to be used only for public performance at a licensed site/ venue and ,

IV . Such compilation or new aggregated sound recording not be released in public or distributed to any other aggregator / users.

V. The License is based for a 12 month period temporary storage and has to be renewed after every 12 months .

VI . In case the License does not renew on expiry of 12 months , the right to store shall cease to exist and the Licensee shall have to delete / destroy all such compilation or aggregated content .

VII . This License does not allow the Licensee to communicate or perform in public , for which a separate license as per the applicable tariff needs to be Vill . The Gross Revenue means the revenue generated by the Licensee and includes revenue generated by way of subscription / Advertising / Sponsorship .

IX. or not . The License is not a Precedental and the Licensor reserves the right to renew it
