2. यह भी स्पष्ट किया जाता है कि उपर्युक्त तदर्थ नियुक्ति डॉ. भारद्वाज को संयुक्त सलाहकार के पद पर नियमित नियुक्ति का कोई अधिकार प्रदान नहीं करती और न ही संयुक्त सलाहकार के पद पर उनकी इस तदर्थ नियुक्ति की अवधि को संयुक्त सलाहकार ग्रेड में वरियता के लिए अथवा उच्च स्तर पर प्रोन्नति के लिए गिना जाएगा ।

श्री एस. पी. एन. भांबी, अधीक्षक ( विधि ) के नाम पर विचार किया गया था । चूंकि उक्त अधिकारी उस समय सतर्कता के दृष्टिकोण से मुक्त नहीं थे, अतः विभागीय प्रोन्नति समिति की सिफारिश को एक सीलबंद लिफाफे में रख दिया गया था । अनुशासनात्मक कार्यवाही वर्ष 2006 में समाप्त हुई थी और जांच अधिकारी ने अपनी रिपोर्ट दिनांक 28.9.2006 कोअनुशासन प्राधिकारी को सौंपी थी । जांच रिपोर्ट को देखने तथा श्री भांबी के दिनांक 4.11.2006 के उत्तर पर विचार करने के पश्चात्, अनुशासन प्राधिकारी ने यह मानते हुए कि आरोपी अधिकारी को किसी गंभीर कदाचार अथवा लापरवाही का दोषी नहीं माना जा सकता है, यह निर्णय लिया कि केन्द्रीय सिविल सेवा ( पेंशन ) नियमावली , 1965 के नियम 9 के अधीन उन पर कोई शास्ति नहीं लगाई जा सकती क्योंकि अब वे पेंशनयाफ्ता है । अतः अनुशासन प्राधिकारी ने सेवानिवृत्त हो चुके श्री भांबी के विरूद्ध लगाए गए आरोपों को छोड़ दिया और अपने दिनांक 6 सितम्बर, 2007 के आदेश सं. सी-14012/1/95 - सतर्कता के तहत्यह आदेश दिया कि श्री भांबी की दिनांक 15.06.91 से 27.05.93 की अनधिकृत अनुपस्थिति को उन्हें देय किसी भी प्रकार की छु‌ट्टी मान लिया जाए ।

2. तत्पश्चात्, विभागीय प्रोन्नति समिति की दिनांक 27 अक्तूबर , 99 की बैठक की सीलबंद लिफाफे में रखी गई सिफारिश को खोला गया जिसमें श्री भांबी के संबंध में निम्नलिखित सिफारिश की गई थीं:-

" अतः समिति ने इस मूल्यांकन के आधार पर यह सिफारिश की है कि उनके विरूद्ध लंबित सतर्कता के मामले में उनके द्वारा अनापत्ति प्रमाण- पत्र प्राप्त किए जाने पर और सक्षम प्राधिकारी द्वारा इस संबंध में अपेक्षित सत्यनिष्ठा प्रमाणपत्र प्रस्तुत किए जाने पर उनका नाम पैनल में क्रम सं . 3 के श्री जोसेफ आर. डी. गोडिन्हो से नीचे तथा क्रम सं. 4 के श्री आर. बी. पाटणकर से ऊपर शामिल किया जाए । " 3. श्री जोसेफ आर. डी. गोडिन्हो को प्रोन्नत नहीं किया जा सका क्योंकि उनका वर्तमान पता मालूम नहीं है । तथापि, उनके कनिष्ठ अर्थात् श्री आर. बी. पाटणकर को दिनांक 12.11.1999 से सहायक विधि सलाहकार के पद पर प्रोन्नत किया गया । चूंकि विभागीय प्रोन्नति समिति ने यह सिफारिश की थी कि श्री भांबी के द्वारा सतर्कता संबंधी अनापत्ति प्रमाण- पत्र प्राप्त किए जाने पर और सक्षम प्राधिकारी द्वारा अपेक्षित सत्यनिष्ठा प्रमाण- पत्र प्रस्तुत किए जाने पर उनका नाम पैनल में क्रम सं. 3 के श्री जोसेफ आर. डी. गोडिन्हों से नीचे तथा क्रम सं. 4 के श्री आर. बी. पाटणकर से ऊपर शामिल किया जाए, राष्ट्रपति द्वारा , जो श्री भांबी के मामले में अनुशासन प्राधिकारी भी हैं, श्री भांबी को दिनांक 12.11.99 से अर्थात् जिस तारीख से उनके कनिष्ठ श्री आर. बी. पाटणकर को सहायक विधि सलाहकार के पद पर प्रोन्नत किया गया था, रुपये 10,000-325-15,200/- के वेतनमान ( संशोधन पूर्व ) में सैद्धांतिक आधार पर सहायक विधि सलाहकार के पद पर प्रोन्नति प्रदान करने का निर्णय लिया गया है ।

4. इस तथ्य पर विचार करते हुए कि श्री भांबी दिनांक 30 सितम्बर, 2003 को सेवानिवृत्त हो चुके हैं और जिस तारीख को अनुशासन प्राधिकारी ने उनके विरूद्ध आरोप का त्याग किया , उस तारीख को अर्थात् दिनांक 6 सितम्बर, 2007 को वे सतर्कता की दृष्टि से मुक्त हुए माने जाएंगे, श्री भांबी उक्त प्रोन्नति से सहायक विधि सलाहकार के ग्रेड में सैद्धांतिक

[भाग -खण्ड 2 आधार पर अपना वेतन निर्धारित करवाने के हकदार होंगे ताकि वे उस सैद्धांतिक वेतन, जो उनकी अधिवर्षिता की तारीख को सहायक विधि सलाहकार के ग्रेड में उन्हें देय होता , के आधार पर अपनी पेंशन पुनर्निध ििरत करवा सकें । उक्त सैद्धांतिक वेतन निर्धारण के कारण सेवानिवृत्त अधिकारी वेतन की किसी प्रकार की कोई बकाया राशि पाने का हकदार नहीं होगा ।

2. चूंकि सीधी भर्ती और प्रोन्नति वाले सीमा शुल्क मूल्यांकों, जो ग्रुप-ए भा.रा.से. ( सी.शु. एवं के.उ.शु. ) में प्रोन्नति के लिए फील्डर ग्रेडों में से एक है, के बीच वरिष्ठता विवाद के कारण ग्रुप - ए भा.रा.से. ( सी.शु. एवं के.उ.शु. ) अधिकारियों की वरिष्ठता सूची को अंतिम रूप दिया जाना संभव नहींहो पाया है, एन.एफ.एस.जी. ग्रेड में होने वाली रिक्तियों की उपलब्धता के अनुसार पात्र अधिकारियों को एन.एफ.एस.जी. प्रदान किया जा रहा है। यह देखते हुए कि वरिष्ठता विवाद से संबंधित मामले विभिन्न न्यायालयों में निर्णयाधीन हैं, एन एफ एस जी का प्रदान किया जाना ऐसे न्यायालय के मामलों के परिणाम के अधीन होगा । चूंकि अधिकारियों की वरिष्ठता विवाद में है, उपर्युक्त सूची में अधिकारियों के नाम वर्णक्रम में व्यवस्थित किए गए हैं ।
