General Statutory Rules (Including Orders , Bye- laws etc. of a general character) issued by the Ministries of the Government of India (other than the Ministry ofDefence) andby the Central Authorities (other than the Administrations ofUnion Territories)

( ख) " परिषद्" से अधिनियम की धारा 30 की उपधारा ( i) के अधीन स्थापित परिषद् अभिप्रेत है ;

(ग) " सदस्य सचिव " से परिषद् का सदस्य सचिव अभिप्रेत नईदिल्ली, 15 सितम्बर , 2009
है;
(2) इन नियमों में प्रयुक्त ऐसे शब्द और पद जो परिभाषित नहीं हैं किंतु अधिनियम में परिभाषित हैं के वही अर्थ होंगे जो अधिनियम में हैं ।
सा. का. नि. 138.-केन्द्रीय सरकार, राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 (2007 का 29) की धारा 34 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्नलिखित नियम बनाती है , अर्थात्:-
3. बैठक और कारबार संचालित करने का तरीका.-( 1 ) परिषद् की एक कैलेंडर वर्ष के दौरान कम से कम एक बैठक होगी । 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम राष्ट्रीय प्रौद्योगिकी संस्थान ( परिषद्) नियम, 2009 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
(2) परिषद् की बैठकों का संचालन स्वप्रेरणा से या सदस्य सचिव के अनुरोध पर या परिषद् के दस सदस्यों से अन्यून द्वारा हस्ताक्षरित अध्यपेक्षा पर परिषद् के अध्यक्ष द्वारा किया जाएगा । 2. परिभाषाएं.-( 1 ) इन नियमों में जब तक संदर्भ से अन्यथा अपेक्षित न हो,-
(3 ) परिषद्के आधे सदस्य परिषद् की बैठक के लिए गणपूर्ति गठित करेंगे ।
(क) " अधिनियम " से राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम, 2007 (2007 का 29 ) अभिप्रेत है ;

प्रत्येक सदस्य को बैठक का स्थान , तारीख और समय उसमें वर्णित करते हुए बैठक की तारीख से कम से कम दस दिन पहले सूचना भेजी जाएगी :
परन्तु अध्यक्ष अत्यावश्यक मुद्दों पर विचार करने के लिए संक्षिप्त सूचना पर परिषद् की विशेष बैठक बुला सकेगा । ( 5 ) बैठक की सूचना परिषद् के कार्यालय में अभिलिखित प्रत्येक सदस्य के पते पर हाथ द्वारा या रजिस्ट्रीकृत डाक द्वारा भेजी जाएगी और यदि इस प्रकार भेजी जाती है तो यह उस समय पर सम्यक् रूप से परिदत्त की गई समझी जाएगी जिसको सूचना डाक के साधारण अनुक्रम में भेजी जाती :
परन्तु सूचना अनुकृति, इलेक्ट्रानिक मेल या संक्षिप्त संदेश सेवा के माध्यम से भेजी जा सकेगी ।
(6) बैठक की कार्यसूची का संचालन सदस्य सचिव द्वारा सदस्यों को बैठक के कम से कम सात दिन पूर्व किया जाएगा । (7 ) कार्यवृत्त में किसी मद को सम्मिलित करने के लिए संकल्प की सूचना सदस्य सचिव को बैठक के कम से कम तीन दिन पूर्व पहुंच जानी चाहिए :
परन्तु परिषद् का सदस्य ऐसे किसी मद को, जिसके लिए सूचना प्राप्त नहीं हुई है, सम्मिलित करने की अनुज्ञा दे सकेगा । (8 ) प्रक्रिया के सभी प्रश्नों के संबंध में परिषद् के अध्यक्ष का विनिर्णय अंतिम होगा।
(9 ) परिषद् की बैठक की कार्यवाहियों का कार्यवृत्त सदस्य सचिव द्वारा बनाया जाएगा और परिषद् के सभी सदस्यों को परिचालित किया जाएगा ।
( 10 ) सुझाए गए किसी संशोधन या संशोधनों के साथ कार्यवृत्त को इसकी अगली बैठक में परिषद् की पुष्टि के लिए रखा जाएगा । (11 ) परिषद् के अध्यक्ष द्वारा कार्यवृत्त की पुष्टि किए जाने और हस्ताक्षरित किए जाने के पश्चात् उन्हें कार्यवृत्त बही में अभिलिखित किया जाएगा जिसे कार्यालय समय के दौरान प्रत्येक समय परिषद् के सदस्यों के निरीक्षण के लिए खुला रखा जाएगा ।
( 12 ) परिषद् के बैठक में विचारित सभी प्रश्नों का विनिश्चय परिषद् के अध्यक्ष सहित उपस्थित सदस्यों के बहुमत द्वारा किया जाएगा :
परंतु यदि मतों का समान विभाजन होता है तो परिषद् के अध्यक्ष के पास द्वितीय या निर्णायक मत होगा ।
4. परिषद् के कृत्य परिषद् उसे समनुदेशित कृत्यों का प्रयोग निम्नलिखित रीति से करेगा , अर्थात्:-
(क) परिषद् ऐसी शक्तियों का प्रयोग करेगा और ऐसे कृत्यों का पालन करेगा जो उसे अधिनियम द्वारा समनुदेशित किया गया है ;
(ख) जहां बैठक संचालित करना समीचीन न हो सदस्य सचिव परिषद् के अध्यक्ष के अनुमोदन से ऐसी मद या मदों का
[PART II-SEC. 3 ( 1)] परिचालन सदस्यों में कर सकेगा जिसे आवश्यक समझा जाए जिससे कि परिषद् का अध्यक्ष उस पर विनिश्चय करने के लिए उनकी टिप्पणियां अभिप्राप्त कर सके और ऐसे विषय की सूचना इसकी अगली बैठक में परिषद् को दी जाएगी ;
( ग ) परिषद् निश्चित संदर्भ निर्देशों के साथ स्थायी या तदर्थ ऐसी समिति या समितियां गठित कर सकेगा जो आवश्यक समझी जाएं और ऐसी समिति या समितियों की रिपोर्ट या रिपोर्ट इसकी बैठक में विचारार्थ परिषद् के विनिश्चय के लिए रखी जाएगी ;
(घ ) यदि अध्यक्ष की राय में कोई आपात स्थिति पैदा होती है जिस पर तत्काल कार्रवाई अपेक्षित हो तो वह ऐसी कार्रवाई कर सकेगा जो वह आवश्यक समझे और इसकी अगली बैठक में परिषद् के अनुमोदन के लिए इसे सूचित करेगा । 5. यात्रा और अन्य भत्ते ( 1 ) अधिनियम की धारा 30 की उपधारा ( 2 ) के खंड ( ग ) और खंड ( झ ) में निर्दिष्ट परिषद् के सदस्यों के यात्रा भत्तों का विनियमन समान श्रेणी के समूह ' क ' अधिकारियों को लागू नियमों के अनुसार किया जाएगा । (2) अधिनियम की धारा 30 की उपधारा ( 2 ) के खंड (ञ ) मेंनिर्दिष्ट परिषद् के सदस्य ऐसे यात्रा और दैनिक भत्ते के हकदार होंगे जो उन्हें भारत सरकार द्वारा गठित समितियों और आयोगों को नियुक्त संसद सदस्यों को अनुज्ञेय है।
(3 ) अधिनियम की धारा 30 की उपधारा ( 2 ) के खंड (क), खंड (ख) , खंड ( घ) , खंड ( ङ ) , खंड ( च) खंड ( छ ) , खंड (ज ) , खंड ( ट) , खंड ( ठ) , और ( ड) में निर्दिष्ट परिषद् के सदस्य ऐसे यात्रा और दैनिक भत्तों के हकदार होंगे जो उन्हें उनके नियोजनकर्ता निकायों के नियमों के अधीन अनुज्ञेय हैं । (4) सदस्य अपने संबद्ध संगठनों से जिसका वह सदस्य है अपने यात्रा और दैनिक भत्तों का दावा कर सकेगा ।

(Department of Higher Education) New Delhi, the 15th September, 2009 G.S.R. 138. In exercise of the powers conferred by Section 34 of the National Institutes of Technology Act, 2007 (29 of 2007), the Central Government hereby makes the following rules , namely:-
1. Short title and commencement. ( 1 ) These rules may be called the National Institutes of Technology (Council) Rules , 2009 .

(2) They shall come in to force on the date of their publication in the Official Gazette .
2. Definitions .In these rules, unless the context otherwise requires ,-
(a) " Act" means the National Institutes of TechnologyAct, 2007 (29 of2007) ;
(b)" Council " means the Council established under sub section (i) of Section 30 of theAct;
(c) "Member Secretary" means the Member Secretary ofthe Council ;
(2) Words and expressions used in these rules but not defined and defined in the Act shall have the meanings respectively assigned to them in the Act .
3. The meetings and the manner of conducting business.(1 ) The Council shall meet at least once during a calendaryear .
(2) The meetings of the Council shall be convened by the Chairman ofthe Council suo -moto or at the request ofthe Member Secretary or on a requisition signed by not less than ten members of the Council.
(3) Half of the members of the Council shall form a quorum for a meeting of the Council .
(4)Awritten notice ofevery meeting shall be sent by the Member Secretary to every member at least ten days before the date ofthe meeting mentioning therein the place, date and time of the meeting:
Provided that the Chairınan may call a special meeting of the Council at short notice to consider urgent issues .
(5) The notice of a meeting may be delivered either byhand or sent by registered post at the address of each member, as recorded in the office of the Council and if so, sent , shall be deemed to be duly delivered at the time at which notice would be delivered in the ordinary course of post:
Provided that the notice may also be sent through Facsimile , electronic mail or Short Message Service .
(6) Agenda for a meeting shall be circulated by the Member Secretary to the members at least seven days before a meeting.
(7) Notices of motions for inclusion of any item in the agenda must reach the Member Secretary at least three days before the meeting:
Provided that the Chairman of the Council may , however, permit inclusion of any item for which due notice has not been received .
(8) The ruling ofthe Chairman ofthe Council in regard to all questions of procedure shall be final .

561 (9) The minutes of the proceedings of a meeting of the Council shall be drawn up by the Member Secretary and circulated to all the members of the Council .
(10) The minutes , together with any amendment or amendments suggested , shallbe placed for confirmation ofthe Councilat its next meeting.
( 11) After the minutes are confirmed and signed by the Chairman of the Council, they shall be recorded in a minute book which shall be kept open for inspection ofthe members of the Council at all times during office hours.
(12) All questions considered at the meeting of the Council , shall be decided by a majority of the votes ofthe members present, including the Chairman of the Council :
Provided that if the votes are equally divided , the Chairman of the Council shall have a second or casting vote.
4. Functions of the Council. The Council shall exercise the functions , assigned to it, in the following manner , namely:-
(a) the Council shall exercise such powers and perform such duties as are assigned to it by the Act ;
(b) where it is not expedient, to convene a meeting. theMember Secretary may with the approval ofthe Chairman ofthe Council, circulate such item or items , as are considered necessary , among the Members so as to obtain their comments to enable the Chairman ofthe Council to take decisions thereon and such matters shall be reported to the Council at its next meeting;
(c) the Council may set up such Committee or Committees , standing or ad hoc, with definite terms of reference , as are considered necessary and the report or reports of such Committee or Committees shall be placed for consideration and decisions of the Council at its meeting; and
(d) if, in the opinion of the Chairman, any emergency has arisen which requires immediate action , he may take such actions as he deems necessary and shall report the same for approval to the Council in its next meeting..
5. Traveling and other allowances . ( 1 ) The traveling allowances ofthe members ofthe Council referred to in clauses (c) and ( i ) of sub - section (2) of Section 30 of the Act shall be regulated as per the rules applicable to Group A Officers ofthe equivalent Grade .
(2) The members ofthe Council referred to in clause (j) of sub - section (2 ) of Section 30 of the Act shall be entitled to such traveling and daily allowances as are admissible to them as Members of Parliament appointed to Committees and Commissions set up by the Government ofIndia.

(ii ) शीर्षक " आवश्यक" के अधीन , मद संख्या 3 के पश्चात्, ' या ' शब्द कालोप किया जाएगा ।
[फा. सं. ए -12018/45/2000- लेप/सीसीडी ] (3) The Members ofthe Council referred to in clauses (a), (b), (d), (e). (f) , ( g ). ( h ), (k ). ( I ) . and (m ) of sub -section (2) of Section 30 of the Act shall be entitled to such traveling and daily allowances as are admissible to them under the rules of their employing bodies .

G.S.R. 139. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the President hereby makes the following rules to amend the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute, Raipur Driver group ' C' posts Recruitment Rules , 2005 namely:-
1. ( 1 ) These rules may be called the Ministry ofHealth and Family Welfare , Regional Leprosy Training and Research Institute , Raipur Driver group ' C ' posts Recruitment (Amendment) Rules, 2009 .
सा. का. नि. 139.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , स्वास्थ्य और परिवार कल्याण मंत्रालय , प्रादेशिक कुष्ठ प्रशिक्षण और अनुसंधान संस्थान, रायपुर , ड्राइवर समूह ' ग ' पद भर्ती नियम , 2005 का संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

2. In the Schedule to the Ministry of Health and Family Welfare , Regional Leprosy Training and Research Institute, Raipur Driver group ' C ' Recruitment Rules , 2005 ( hereinafter referred to as the said Rules ),- (2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
In column 7 , for Note I and the entry relating thereto the following Note and entry shall be substituted , namely:--

"Note-1 The crucial date for determining the age limit shall be the closing date for receipt of applications from the candidates in India (and not the closing date prescribed for those in Assam , Meghalaya, Manipur, Nagaland, Tripura, Sikkim , Ladakh Division of Jammu and Kashmir State , Lahul and Spiti District and Pangi Sub-division of Chamba District of Himachal Pradesh and Union Territories ofAndaman and Nicobar Islands or Lakshadweep) " ; (b) incolumn 8.
(i) under the heading ' essential ' in item number 3, for the entry , the following entry shall be substituted, namely:-
" टिप्पण !:-आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड, त्रिपुरा , सिक्किम, जम्मू-काश्मीर राज्य के लद्दाख खंड , हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है) । "
"Knowledge of motor mechanism (the candidate should be able to remove minor defects in vehicles not requiring the skill of trained mechanic ) ." (ख) स्तंभ 8 में ,
