संकल्प

सं. 6/6/2009 - ई एण्ड एमडीए सरकार के दिनांक 12.02.2009 के संकल्प सं. 6/6/ 2009 - ई एण्ड एमडीए को जारी रखते हुए, सरकार ने यह निर्णय लिया है कि पूर्वोक्त संकल्प में उल्लिखित राष्ट्रीय निर्यात बीमा खाता के विस्तारित लाभों को दिनांक 31.03.2010 तक बढ़ाया जाएगा तत्पश्चात् उसकी पुनरीक्षा की जाएगी :--

निम्नलिखित को संकल्प की एक - एक प्रति संप्रेषित करने का आदेश दिया जाता है : --

सं. एफ. - 9-48/2004- यू.-3--जबकि केन्द सरकार को विश्वविद्यालय अनुदान आयोग की सलाह पर विश्वविद्यालय अनुदान आयोग ( यूजीसी ) अधिनियम, 1956 की धारा 3 के तहत् किसी उच्चतर अध्ययन शिक्षा संस्था को " सम- विश्वविद्यालय " घोषित करने की शक्ति प्राप्त है;

2. और जबकि विश्वविद्यालय अनुदान आयोग की सलाह पर (i ) जवाहर लाल नेहरू चिकित्सा कॉलेज, वर्धा और ( ii ) शरद पवार दंत चिकित्सा कॉलेज, वर्धा सहित दत्ता मेघे आयुर्विज्ञान संस्थान , नागपुर, महाराष्ट्र को उपर्युक्त अधिनियम के उद्देश्यार्थ इस मंत्रालय की दिनांक 24 मई, 2005 की सम - संख्यक अधिसूचना के जरिए अनंतिम रूप से पांच वर्ष की अवधि के लिए ' सम विश्वविद्यालय संस्था ' कतिपय शर्तों के अधीन घोषित किया गया था ;

[भाग -खण्ड 1 3. और इसके अतिरिक्त जबकि इस ' सम विश्वविद्यालय' संस्था ने ( i) महात्मा गांधी आयुर्वेदिक कॉलेज , अस्पताल और अनुसंधान केन्द्र, वर्धा, ( ii ) रविनायर फीजियोथेरेपी कॉलेज , वर्धा और (iii) श्रीमती राधिका मेघे स्मारक नर्सिंग कॉलेज , वर्धा सहित अपने अधिकार क्षेत्र की कुछ संस्थाओं को शामिल करने के लिए फरवरी , 2007 में एक प्रस्ताव प्रस्तुत किया था;

4. और जबकि, विश्वविद्यालय अनुदान आयोग ने दिनांक 14 मई, 2008 के अपने प्रपत्र संख्या एफ.6-98/2004 ( सीपीपी -1 ) के जरिए इस मंत्रालय को यह सिफारिश की थी कि' सम विश्वविद्यालय संस्था' दत्ता मेघे आयुर्विज्ञान संस्थान के अधिकार क्षेत्र में निम्नलिखित तीन कॉलेजों को इस शर्त के अधीन शामिल किया जाए कि विश्वविद्यालय अनुदान आयोग प्रारंभ में तीन वर्षों के लिए और इसके बाद प्रत्येक पांच वर्षों के बाद इन कॉलेजों के समग्र निष्पादन का वार्षिक अनुवीक्षण करेगा;

( i) रविनायर फिजियोथेरेपी कॉलेज , वर्धा

( ii) श्रीमती राधिकाबाई मेघे स्मारक नर्सिंग कॉलेज, वर्धा

(iii) महात्मा गांधी आयुर्वेदिक कॉलेज, वर्धा

5. इसलिए अब विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विश्वविद्यालय अनुदान आयोग की सलाह पर केन्द्र सरकार एतद्वारा दत्ता मेघे आयुर्विज्ञान संस्थान , नागपुर, महाराष्ट्र एक ' सम- विश्वविद्यालय ' संस्था के अधिकार क्षेत्र के तहत् उपर्युक्त अधिनियम के उद्देश्यार्थ परवर्ती संघटक शिक्षण इकाइयों के रूप में निम्नलिखित शर्तों के अधीन ( i ) रविनायर फिजियोथेरेपी कॉलेज , वर्धा ( ii ) श्रीमती राधिकाबाई मेघे स्मारक नर्सिंग कॉलेज, वर्धा और (iii) महात्मा गांधी आयुर्वेदिक कॉलेज, अस्पताल और अनुसंधान केन्द्र, वर्धा को शामिल करती है;

( i) दत्ता मेघे आयुर्विज्ञान संस्थान, नागपुर एक ' सम विश्वविद्यालय संस्था' को केवल अगले अकादमिक वर्ष अर्थात् 2009-2010 से ही अपने नामांकन के तहत् उपर्युक्त तीन कॉलेजों ( संबंधित सांविधिक परिषदों द्वारा यथा-अनुमोदित ) के अकादमिक पाठ्यक्रमों/कार्यक्रमों में विद्यार्थियों को दाखिल करने की अनुमति प्राप्त होगी;

(ii) संबंधित ' सम- विश्वविद्यालय ' संस्था की संघटक शिक्षण इकाइयों के रूप में (i ) रविनायर फिजियोथेरेपी कॉलेज , वर्धा, ( ii ) श्रीमती राधिकाबाई मेघे स्मारक नर्सिंग कॉलेज, वर्धा की उद्घोषणा उनके संबंधन विश्वविद्यालय अर्थात् महाराष्ट्र स्वास्थ्य विज्ञान विश्वविद्यालय , नासिक, महाराष्ट्र से उनका संबंधन समाप्त होने की तारीख से प्रभावी होगी;

(iii) दत्ता मेघे आयुर्विज्ञान संस्थान, नागपुर ' सम विश्वविद्यालय ' संस्था के रूप में उपर्युक्त कॉलेजों के अकादमिक पाठ्यक्रमों/कार्यक्रमों के संबंध में केवल उन्हीं विद्यार्थियों को डिग्री प्रदान करेगा जिन्हें इन कॉलेजों में अकादमिक वर्ष 2009-2010 में तथा इसके बाद दाखिल किया जाएगा ;

(iv) जहां तक (i ) रविनायर फिजियोथेरेपी कॉलेज , वर्धा और (ii) श्रीमती राधिकाबाई मेघे स्मारक नर्सिंग कॉलेज, वर्धा में पहले से ही दाखिल किए गए विद्यार्थियों का संबंध है, वे अपने अकादमिक पाठ्यक्रमों/अध्ययन कार्यक्रमों को महाराष्ट्र स्वास्थ्य विज्ञान विश्वविद्यालय, नासिक ( संबंधन विश्वविद्यालय ) के नामांकन और संबंधन के तहत् जारी रखेंगे और यही विश्वविद्यालय उनकी परीक्षाएं आयोजित करेगा तथा इन तीनों कॉलेजों में इस समय जारी अध्ययन पाठ्यक्रमों/ कार्यक्रमों के सफलतापूर्वक पूरा करने पर डिग्रियां प्रदान करेगा ।

(v) उपर्युक्त पैरा 5 में की गई उद्घोषणा में केवल उन्हीं अकादमिक पाठ्यक्रमों, जो महाराष्ट्र स्वास्थ्य विज्ञान विश्वविद्यालय , नासिक के संबंधन के तहत् इस समय ( i ) रविनायर फिजियोथेरेपी कॉलेज, वर्धा ( ii ) श्रीमती राधिकाबाई मेघे स्मारक नर्सिंग कॉलेज, वर्धा में संचालित किए जाते हैं तथा ऐसे पाठ्यक्रमों जो संबंधति ' सम- विश्वविद्यालय' संस्था द्वारा प्रासंगिक सांविधिक परिषदों ( जैसे भारतीय नर्सिंग परिषद् इत्यादि) और विश्वविद्यालय अनुदान आयोग के मानदंडों के अनुसार भविष्य में संचालित किए जा सकते हैं, को शामिल किया जाएगा ।

(vi ) संबंधित ' सम - विश्वविद्यालय ' संस्था के तहत् महात्मा गांधी आयुर्वेदिक कॉलेज, अस्पताल और अनुसंधान केन्द्र, वर्धा को शामिल करने के लिए पैरा 5 में की गई उद्घोषणा में केवल बीएएमएस पाठ्यक्रम को ही शामिल किया जाएगा जो उक्त कॉलेज में स्वास्थ्य और परिवार कल्याण मंत्रालय के अनुमोदन से केन्द्रीय भारतीय चिकित्सा परिषद्, नई दिल्ली के मानदंडों के अनुसार संचालित किया जाता है ।

( vii ) विश्वविद्यालय अनुदान आयोग एक विशेषज्ञ समिति के माध्यम से प्रारंभ में तीन वर्षों के लिए और इसके बाद प्रत्येक पांच वर्षों के लिए उपर्युक्त तीनों कॉलेजों के समग्र निष्पादन का वार्षिक अनुवीक्षण करेगा । ' सम विश्वविद्यालय ' संस्था और इसकी संघटक शिक्षण इकाइयां दोनों ही प्रबंधन, अकादमिक विकास और सुधार के संबंध में इस प्रकार की समीक्षाओं के बाद विश्वविद्यालय अनुदान आयोग द्वारा दिए गए निर्देशों को पालन करने के लिए बाध्य होंगे ।

6. उपर्युक्त पैरा 5 में की गई घोषणा इस अधिसूचना के पृष्ठांकन की क्रम संख्या 9 में उल्लिखित शर्तों को पूरा करने के भी अधीन होगी । 7. न तो भारत सरकार और न ही विश्वविद्यालय अनुदान आयोग दत्ता मेघे आयुर्विज्ञान संस्थान अथवा इसकी किसी संघटक शिक्षण इकाई को योजनागत अथवा योजनेतर सहायता अनुदान प्रदान करेंगे ।

2. बोर्ड की बैठक वर्ष में एक बार होगी, बैठक की तिथि एवं स्थान अध्यक्ष द्वारा निर्धारित किया जाएगा ।

3. बोर्ड के लिए चुने जाने वाले संसद सदस्यों का कार्यकाल सदन की सदस्यता के उनके कार्यकाल तक सीमित होगा , जिसमें उन्हें चुना गया है । 4. राष्ट्रपति सहर्ष यह आदेश करते हैं कि केन्द्रीय पुरातत्व सलाहकार बोर्ड निम्नलिखित संरचना एवं कार्यों के लिए स्थायी समिति गठित करेगा ।

सामान्यतया यह स्थायी समिति इस बोर्ड को देश में पुरातत्वीय निष्पादन के उन्नयन में सलाह देगी एवं इसे भेजी गई सभी रिपोर्टों एवं मदों पर विचार करेगी और बोर्ड की बैठक की कार्य सूची पर अपने विचार व्यक्त करने के साथ - साथ सरकार अथवा समिति के अध्यक्ष के ऐसे कार्य करेगी जो इसे सौंपे गए हों । यह, जब कभी आवश्यक होगा, सहयोजित करने के अधिकार के साथ उपसमितियां गठित कर सकती है । इसकी बैठकें वर्ष में दो बार से अधिक नहीं होंगी ।

No. F-9-48/2004-U.3-Whereas the Central Government is empowered under Section 3 ofthe University Grants Commission (UGC) Act, 1956 to declare , on the advice of the UGC, an institution of higher learning as a deemed- to -be - university:

2.Andwhereas , on the advice of the UGC, Datta Meghe Institute ofMedical Sciences , Nagpur, Maharashtra, comprising ( i) Jawaharlal Nehru Medical College, Wardha and ( ii ) Sharad Pawar Dental College, Wardha , was declared as an' Institution Deemed- to-be- University' , for the purposes of the aforesaid Act , provisionally for a period of five years , vide this Ministry's notification ofeven number dated the 24th May, 2005 , subject to certain conditions;

3.And further whereas, the Institution " Deemed - to -be- University " had submitted a proposal in February, 2007 for inclusion of few institutions, which included ( i ) Mahatma Gandhi Ayurvedic College , Hospital & Research Centre , Wardha, ( ii ) Ravi Nair Physiotherapy College , Wardha and ( iii) Smt . Radhikabai Meghe Memorial College of Nursing , Wardha , under its ambit ;

4.And whereas, the UGC vide its communication bearing No. F. 6-98/2004 (CPP - I) dated the 14th May, 2008 had recommended to the Ministry of Human Resource Development that the following three colleges may be included under the ambit of Datta Meghe Institute ofMedical Sciences , an institution 'Deemed- to-be - University' , subject to a condition that the Overall performance of these colleges shall be monitored annually, initially for three years , and subsequently after every five years , by the UGC;

( i ) Ravi Nair Physiotherapy College, Wardha

( ii) Smt . Radhikabai Meghe Memorial College of Nursing , Wardha.

( iii) Mahatına Gandhi Ayurved College, Wardha .

5.Now, therefore , in exercise of the powers conferred by Section 3 of the UGC Act, 1956 , the Central Government, on the advice of the UGC,do hereby include ( i) Ravi Nair Physiotherapy College, Wardha, ( ii) Smt . Radhikabai Meghe Memorial College ofNursing, Wardha and ( iii ) Mahatma Gandhi Ayurvedic College , Hospital & Research Centre Wardha , under the ambit of Datta Meghe Institute of Medical Sciences , an institution 'Deemed - to -be - University' , Nagpur , Maharashtra as the latter's constituent teaching units for the purposes of the aforesaid Act , subjectto the following conditions:

(1) It shall be permissible for Datta Meghe Institute of Medical Sciences , an institution 'Deemed- to- be -University' , Nagpur, to admit students to the academic courses /programmes of the aforesaid three colleges (as approved by the respective Statutory Councils ) , under its enrolment, only with effect from the next academic year, i.e. 2009-2010 .

(ii) The declaration of ( i) Ravi Nair Physiotherapy College , Wardha and ( ii) Smt . Radhikabai Meghe Memorial College of Nursing , Wardha, as the constituent teaching units of the institution ' Deemed- to - be - University concerned shall take effect from the date of their disaffiliation from their affiliating university, namely, Maharashtra University ofHealth Sciences , Nashik , Maharashtra;

(iii) DattaMeghe Institute of Medical Sciences , Nagpur, as an institution ' Deemed - to -be -University' , shall award degrees in respect of the academic courses /programmes of the aforesaid colleges only to those students who shall be admitted to these colleges from the academic year 2009-2010 onwards ;

(iv) As for the students who were already admitted to (i) Ravi Nair Physiotherapy College, Wardha and ( ii ) Smt . Radhikabi Meghe Memorial College of Nursing , Wardha, they shall continue to pursue their academic courses /programmes of study under the enrolment and affiliation of the Maharashtra University of Health Sciences , Nashik ( affiliating university), which shall conduct their examinations and award degrees to them upon successful completion of the courses/ programmes of study they are pursuing at these colleges presently.

(v) The declaration as made in Para 5 above shall cover only those academic courses that are conducted at present by (i) Ravi Nair Physiotherapy College, Wardha and ( ii ) Smt . Radhikabai Meghe Memorial College of Nursing , Wardha , under affiliation to the Maharashtra University of Health Sciences , Nashik and those courses that the ' Institution ned -to-be -University ' concerned ( such as the Indian Council ofNursing, etc.) and the UGC;

(vi) The declaration as made in para 5 for inclusion of Mahatma Gandhi Ayurvedic College , Hospital & Research Centre , Wardha , under the 'Institution Deemed- to - be - University' concerned shall presently cover only the B.A.M.S. course which is conducted at the said College with the approval of Ministry of Health and Family Welfare and as per the norms of the Central Council for Indian Medicine , New Delhi ;

(vii) The overall performance of the aforesaid three colleges shall be monitored by the UGC, annually , through an Expert Review Committee , initially for three years , and subsequently, after every five years . The directions that shall be given by the UGC upon such 'reviews ' in the matter of management , academic development and improvement shall be binding on both the 'Institution Deemed- to -be - University' and its constituent teaching units .

6. The declaration as made in Para 5 above is further subject to fulfillment of the conditions mentioned at Sr. No. 9 of the endorsement to this notification;

7.Neither the Government of India nor the UGC shall provide any Plan or Non - Plan grant- in -aid to Datta Meghe Institute ofMedical Sciences or any of its constituent teaching units .
