3. 01.07.2003 से अवर सचिव के रूप में अधिकारियों की नुियक्ति अनुमोदित सेवा के प्रयोजन और सैद्धान्तिक आधार पर अवर सचिव के रूप में उनके वेतन के निर्धारण के लिए होगी । तथापि, अधिकारियों को वास्तविक लाभ सीएसएस के अवर सचिव के ग्रेड में नियुक्ति की तारीख से ही प्राप्त होंगे ।

वी रवीन्द्रन , अवर सचिव 4. अधिकारी अवर सचिव के पद पर अपनी वास्तविक नियुक्ति की तारीख से अपने वेतन के पुनः निर्धारण के कारण बकाया राशि के हकदार होंगे । इसके अतिरिक्त, ये अधिकारी एफआर 22 के उपबंधों के अनुसार अपने वेतन के निर्धारण के लिए विकल्प का लाभ लेने के भी पात्र होंगे । तथापि, वे अधिकारी जिन्हें अपनी चयन सूची वर्ष की पहली जुलाई से पहले तदर्थ अवर सचिव के रूप में पदोन्नत किया गया था और जिन्होंने विभाजित विकल्प का लाभ उठा लिया था, वे विकल्प देने के पात्र नहीं होंगे ।

The seniority of the officers included in the Select List annexed to DoPT's aforesaid O.M. will be in the same order in which their names have been arranged, irrespective of actual dates of their appointment to the Grade - I . The appointment of the abovementioned officers. as Under Secretaries on regular basis shall be subject to the final outcome in the CWP No. 13352/2005 in the High Court of Delhi.
3. The appointment of the officers as Under Secretaries w.e.f. 01.07.2003 would be for the purpose of approved service and for fixing their pay as Under Secretary on notional basis . 4. The officers would be entitled to arrears on account of re - fixation of their pay from the dates of their actual appointment to the post of Under Secretary. The actual benefits , however, would be available only from the date, officers are appointed to the grade of Under Secretary of CSS .

In addition, these officers shall also be entitled to exercise the benefit of option for fixation of their pay as per the provisions of FR 22. However , such officers , who were promoted as ad- hoc Under Secretary prior to 1st July, of their Select List Year and had availed the benefit of split option, shall not be eligible to re - exercise the option .
