Since regular Select List could not be drawn within the period prescribed for such panels , due to protracted litigation, and these panels have gone in arrears , their appointments are to be deemed to have been made with effect from 1.7.2003 for the purpose of approved service and for fixing their pay as Under Secretary on a notional basis . However, actual benefit will be given from the date of appointment to the post of Under Secretary .

3. These officers will also be entitled to arrears on account of re- fixation of their pay from the dates of their, actual appointment to the post of Under Secretary and to exercise the option for fixation of their pay as provided under the provisions of FR- 22 . However , the officers who were promoted as adhoc Under Secretary prior to 1st July, 2003 and had availed of the benefit of split option , shall not be eligible to re- exercise the option .

4. The seniority of the above mentioned officers included in the Select List, will be in the same order in which their names have been arranged in the Select List enclosed to the DOPT O. M. No. 5 / 16/2007 -CS . I dated 25th August, 2009 , irrespective of actual dates of their appointment to Grade I. The appointment of officers included in the aforesaid Select List to the grade of Under Secretary on regular basis shall be subject to the final outcome in the Civil Writ Petition No. 13352/2005 filed in the High Court of Delhi .
