संदर्भ: 7 (70)/2007/सतर्कता/7590--जबकि यह आरोपित किया गया कि श्री पी. जे म्हात्रे, हेल्पर/ए ( टी ) , सीएसयू डीपीएस ( i ) ने बाहरवालों से भाप अ केन्द्र में नौकरी उपलब्ध करवाने के वादे पर धन ग्रहण किया; ( ii) दिनांक 03.04.2007 से ड्यूटी से अनअधिकृत रूप से अनुपस्थित हैं ( iii) को डयूटी से अनअधिकृत रूप से अनुपस्थित रहने की आदत है । उनके उपर्युक्त आचरण द्वारा उक्त श्री म्हात्रे ने अपने कार्य के प्रति निष्ठा की कमी को दर्शाया हैं एवं ऐसा आचरण किया है जो एक सरकारी कर्मचारी के लिए अशोभनीय है तथा यह केन्द्रीय सिविल सेवाएं ( आचरण ) नियमावली, 1964 केनियम 3 के उपनियम 1 (i ) , 1 (ii) एवं 1 ( iii) के प्रावधानों का उल्लंघन है;

सं6212/एसपी/ए-32013/4-निदे (वेधन) ( च.श्रे. ) /98/19बी--विभागीय पदोन्नति समिति की संस्तुति पर राष्ट्रपति जी श्री आर. डी. एच. त्यागी, निदेशक ( वेधन ) , भारतीय भूवैज्ञानिक सर्वेक्षण को निदेशक ( वेधन ) (अ-कार्यात्मक चयन श्रेणी ) के पद पर, इसी विभाग में वेतन बैंड-4 के वेतनमान रुपए 37,400--67,000/- में ग्रेड वेतन रुपए 8,700/ - में आगामी आदेशों तक 01.05.2008 से प्रभावित पदोन्नति पर नियुक्त करते हैं ।

2. और जबकि उक्त श्री म्हात्रे को दिनांक 02.11.2007 के ज्ञापन संख्या 7(70) /2007/सतर्कता/9250 द्वारा उनके विरुद्ध लगाए गए आरोप तथा केन्द्रीय सिविल सेवाएं ( वर्गीकरण, नियंत्रण एवं अपील ) नियमावली, 1965 के नियम 14 के अंतर्गत कार्रवाई किए जाने की सूचना दी गई थी;

3. और जबकि उक्त श्री म्हात्रे ने दिनांक 14.11.2007 को ज्ञापन प्राप्त करने की अभिस्वीकृति दी, परन्तु अपने बचाव में कोई विवरण प्रस्तुत करने में वे असफल रहे;

(१) उनका वेतन निदेशक ( यांत्रिक अभियंत्रण ) , अकार्यात्मक चयन श्रेणी में नियमानुसार नियत किया जाएगा । तथापि, अधिकारी एफ. आर. - 22( 1 ) ( ए) ( 2 ) के अंतर्गत अपने वेतन निर्धारण के लिए ऊपर प्रत्येक के सामने यथा उल्लिखित अकार्यात्मक चयन श्रेणी के पद पर नियुक्ति की तिथि से अथवा निदेशक ( यांत्रिक अभियंत्रण) के पद पर वेतनवृद्धि की तिथि से प्रभावित विकल्प का प्रयोग कर सकते हैं । इस अधिसूचना के जारी होने की तिथि से एक माह के भीतर वेतन निर्धारण हेतु विकल्प का प्रयोग किया जाना है ।

4. और जबकि उक्त श्री म्हात्रे के विरुद्ध दिनांक 12.12.2007 को जांच का आदेश दिया गया;

(ii ) अकार्यात्मक चयन श्रेणी में नियुक्ति के परिणामस्वरूप निदेशक (यांत्रिक अभियंत्रण ) की श्रेणी में उनकी परस्पर वरिष्ठता नहीं बदलेगी ।

5. और जबकि श्री म्हात्रे जांच कार्यवाही में उपस्थित नहीं हुए और इसलिए एकपक्षीय कार्यवाही की गई और जांच प्राधिकारी ने दिनांक 04.05.2009 को अपनी रिपोर्ट प्रस्तुत की जिसमें श्री म्हात्रे के विरुद्ध लगाए गए आरोपों को सही पाया;

6. और जबकि उक्त श्री म्हात्रे को जांच रिपोर्ट की प्रतिलिपि उनके अंतिम ज्ञात स्थानीय एवं स्थायी पतों पर अग्रेषित की गई ताकि वे अपना प्रस्तुतीकरण/अभ्यावेदन , यदि कोई हो तो , प्रस्तुत कर सकें;

7. और जबकि श्री म्हात्रे के स्थानीय पते पर भेजी गई जांच रिपोर्ट की पावती प्राप्त हुई और उनके स्थायी पते पर भेजी गई जांच रिपोर्ट अवितरित वापस आ गई;

( कनि. )/90/ 19बी/खण्ड- III-- विभागीय पदोन्नति समिति की संस्तुति पर राष्ट्रपति जी वेधक श्रेणी- I की कोदिं में भारतीय भूवैज्ञानिक सर्वेक्षण के निम्नलिखित अधिकारियों की नियुक्ति वेधनं अभियंता ( कनिष्ठ) के रूप में भारतीय भूवैज्ञानिक सर्वेक्षण में वेतन बैंड-3 के वेतनमान रुपए 15,600--39,100/- ग्रेड वेतन रुपए 5,400/- में नियमानुसार वेतन पर, नियमित आधार पर प्रत्येक के सामने उल्लिखित तिथि से प्रभावित आगामी आदेशों तक पदोन्नति पर अनुमोदित करते हैं --

9. और जबकि श्री म्हात्रे के अभिलेखों को देखने पर पाया गया कि वे दिनांक 03.04.2007 से ड्यूटी से अनअधिकृत रूप से अनुपस्थित हैं और उनके द्वारा उनके स्थानीय एवं स्थायी पतों पर भेजे गये अनेक पत्रों का उन्होंने कोई उत्तर नहीं दिया। जैसाकि श्री म्हात्रे द्वारा आरोपपत्र प्राप्ति की अभिस्वीकृति दी गई थी अतः उन्हें मालूम था कि उनके विरुद्ध विभागीय कार्यवाही आरम्भ की गई है । उनके विरुद्ध सिद्ध हुए आरोपों की गंभीरता को देखते हुए, अधोहस्ताक्षरी के विचारानुसार श्री म्हात्रे सरकारी सेवा में बने रहने के लिए भाग III-खण्ड 1 ]

उपयुक्तव्यक्ति नहीं है और इस मामले में , यह न्यायसंगत होगा कि उक्त श्री म्हात्रे पर सेवा से बर्खास्त करने की शास्ति लगाई जाए;

10. अतः अब अधोहस्ताक्षरी , परमाणु ऊर्जा विभाग के दिनांक 13 अक्तूबर, 2005 के आदेश संख्या 1/6 ( 1 )/2002 सतर्कता/7613 के साथ पठित केन्द्रीय सिविल सेवाएं ( सीसीए ) नियमावली 1965 के नियम 12के उपनियम ( 2 ) के खण्ड (ख ) के अंतर्गत निहित शक्तियों का प्रयोग करते हुए एतद्वारा तत्काल प्रभाव से उक्त श्री म्हात्रे को सेवा से बर्खास्त करते हैं;

11. श्री म्हात्रे को सूचित किया जाता है कि उपर्युक्त आदेश के विरुद्ध अध्यक्ष, कार्मिक प्रभाग, अपीलीय प्राधिकारी के पास अपील कीजा सकती है । यदि कोई अपील करनी हो तो वह इस आदेश की प्राप्ति की तारीख से 45 ( पैंतालीस ) दिनों के भीतर अपीलीय प्राधिकारी के पास करनी होगी।
