अनुच्छेद - 1

श्री चंद्र बल्लभ मैथानी, परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय के मध्यवर्ती क्षेत्र , के वैज्ञानिक अधिकारी/ सी ( ड्रिलिंग ) एवं प्रभारी , एलटी-575 ( 6 ) ड्रिलिंग यूनिट जगदलपुर, बस्तर जिला , छत्तीसगढ़ के रूप में कार्य करते समय , मकान सं. 8 , एसबीआई कालोनी , धरमपुरा रोड, जगदलपुर स्थित कार्यालय- सह-भंडार-सह- आवास को पूर्व योजना के तहत अवैध/अनैतिक गतिविधि यानि देह व्यापार करने के लिए दुरुपयोग किया । इस हेतु उन्होंने दो महिलाओं को, अर्थात कुमारी सीता , आयु 19 वर्ष पुत्री श्री कुमार , कोंडगांव की निवासी और श्रीमती उर्मिला देवांगन, आयु 22 वर्ष , पत्नी श्री रामु देवांगन , नगरनार की निवासी , प्रत्येक को रु.500/- के दर पर दिनांक 19.05.2005 के सायं समय में किराए पर लाकर अपने खुद , तथा अपने और दो मित्रों यानि श्री सुरेन्द्र शर्मा, आयु 38 वर्ष , पुत्र- रामपाल शर्मा, हकीमपुरा का निवासी , जगदलपुर और श्री रामपाल, आयु 42 वर्ष, पुत्र -बल्लूराम पंजाबी, तेलीपारा का निवासी , बिलासपुर, की यौन इच्छाओं को पूरा करने के लिए उक्त परिसर का दुरुउपयोग किया है । उन्होंने दिनांक 19.05.2005 को उक्त सरकारी आवास में शराब का सेवन भी किया था ।

श्री सी.बी.मैथानी कुछ समय से इन अनैतिक गतिविधियों में लिप्त रहे हैं । दूसरे शब्दों में , " देह - व्यापार " की यह अनैतिक गतिविधियाँ उनके सरकारी निवास में उनकी जानकारी और सहमति से ही हो रही हैं और वह खुद भी उक्त "देह - व्यांपार " में शामिल रहे है । यह एक इकलौती घटना नहीं है । खास बात यह है कि केवल इस बार ही यह गतिविधियां सामने आई हैं। इन तथ्यों से कि ( 1 ) वह जानबूझकर सुरक्षा कर्मियों की तैनाती इस प्रकार से टाल देते थे कि कुछ विशेष घंटों पर दोनों सुरक्षा गार्ड सुरक्षा ड्यूटी से अनुपलब्ध हो जाए ताकि वह अपनी अवैध गतिविधि जारी रख सकें और उन पर किसी का ध्यान भी न जाए और ( 2 ) इस मामले को एक मुखाबिर ( इनफार्मर ) द्वारा पुलिस को रिपोर्ट की गई, इससे यह पता चलता है कि उक्त परिसर में यह अवैध/ अनैतिक गतिविधियां काफी कुछ समय से चल रही हैं ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी और घोर नैतिक कदाचार का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है, जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा ( आचरण ) नियमावली , 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) (i ) और (iii) के प्रावधानों का उल्लंघन किया है । 407 भाग III- खण्ड 1]

श्री चंद्र बल्लभ मैथानी, परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय (एएमडी ) , मध्य क्षेत्र के वैज्ञानिक अधिकारी सी ( ड्रिलिंग ) एवं प्रभारी एलटी -575 ( 6 ) जगदलपुर , बस्तर जिला , छत्तीसगढ़ के रूप में कार्य करते समय अपने दो मित्रों के साथ मकान सं . 8 , एसबीआई कालोनी , धरमपुरा रोड, जगदलपुर स्थित कार्यालय- सह-भंडार- सह-आवास में दो महिलाओं को, प्रत्येक को रु .500/- के दर पर किराए पर लाकर देह व्यापार की अवैध अनैतिक गतिविधि चलाई और इसमें वे खुद संलिप्त रहें । इस अवैध/अनैतिक गतिविधि के वारे में पुलिस के ध्यान में आया और कोतवाली पुलिस स्टेशन से पुलिस ने दिनांक 19.05.2005 के 2030 बजे श्री सी.बी. मैथानी के सरकारी आवास पर छापा (रेड ) डालकर चार लोगों अर्थात श्री सुरेन्द्र शर्मा ( सी.बी. मैथानी का दोस्त) , श्री रामपाल (श्री सुरेन्द्र शर्मा का दोस्त ) और दो महिलाएँ कुमारी सीता और श्रीमती उर्मिला को श्री सी.बी. मैथानी के सरकारी आवास से गिरफतार किया और उनके खिलाफ मामले दर्ज किए हैं ।

श्री मैथानी दिनांक 19.05.2005 के सायं समय में अपने सरकारी निवास जो कि ड्रिलिंग यूनिट एलटी -575 (6 ) कार्यालय- सह-भंडार भी है, को अपने परिवार की अनुपस्थिति में और सुरक्षा कर्मियों की अनुपस्थिति में बाहरी लोगों की कस्टडी ( निगरानी ) में छोड़कर गए और इस तरह संगठन ( पखनि) की प्रतिष्ठा, सुरक्षा और संरक्षा को खतरे में डाला गया । सुरक्षा गार्डों की ड्यूटी में भी हेरफेर किया गया ताकि श्री मैथानी के उक्त सरकारी आवास में अवैधअनैतिक कार्य निर्बाध रूप से चलाए जा सके ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी और कर्तव्य के प्रति समर्पण में कमी घोर नैतिक कदाचार का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा (आचरण ) नियमावली, 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) (i ) , ( iii) और (iii) के प्रावधानों का उल्लंघन किया है ।

श्री सी.बी. मैथानी, परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय (पखनि ) , मध्य क्षेत्र के वैज्ञानिक अधिकारी /सी ( ड्रिलिंग ) एवं प्रभारी एलटी -575 ( 6 ) जगदलपुर , बस्तर जिला , छत्तीसगढ़ के रूप में कार्य करते समय अपने सरकारी आवास में अवैध अनैतिक गतिविधि करने के लिए दिनांक 19.05.2005 को कोतवाली स्टेशन में पुलिस की हिरासत में रखे गए थे । उन्हें उनके कार्यालय- सह -आवास अर्थात मकान सं. 8 , एसबीआई कालोनी , धरमपुरा रोड, जगदलपुर में मध्यरात्रि लगभग 0045 बजे अर्थात दिनांक 19/ 20.05.2009 को पुलिस की जीप में लाया गया। इस दूसरे छापे के दौरान उन्होंने ( पुलिस ) श्री मैथानी के सरकारी आवास से एक टी.वी. , एक वीसीडी प्लेयर और कुछ किताबों को जब्त किया और श्री मैथानी के साथ पुलिस स्टेशन वापस चले गए । जब दिनांक 19 / 20.05.2005 को दूसरी बार छापा डाला गया तब उक्त परिसर में सुरक्षाकर्मी सर्वश्री गोविंदराम और लक्ष्मण सिंह उपस्थित थे । श्री मैथानी को दिनांक [भाग III-खण्ड 1

20.05.2005 के 12.30 बजे विभागीय गाड़ी सं. एमएच- 31 - एजी -9146 में श्री श्रीराम नेताम . चालक ग्रेड -1 द्वारा पुलिस स्टेशन से वापस लाया गया ।

इस प्रकार से श्री मैथानी की अनैतिक गतिविधि में संलिप्तता और बाद में उनको पुलिस हिरासत लिए जाने के तथ्य से उनकी बेवफाई , सत्यनिष्ठा में कमी और घोर नैतिक कदाचार इंगित होती है ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा (आचरण ) नियमावली, 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) ( i ) और (iii) के प्रावधानों का उल्लंघन किया है ।

अनुच्छेद - IV

श्री सी.वी. मैथानी , परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय ( पखनि ) के मध्यवर्ती क्षेत्र में वैज्ञानिक अधिकारी सी ( ड्रिलिंग ) एवं प्रभारी एलटी -575 ( 6 ) जगदलपुर , बस्तर जिला, छत्तीसगढ़ के रूप में कार्य करते समय , दिनांक 19.05.2005 के सायं समय में ( जब उनका परिवार वहाँ नहीं था ) ड्रिलिंग एकक एलटी-575 ( 6 ) के, मकान सं. 8 , एसबीआई कालोनी, धरमपुरा रोड, जगदलपुर स्थित कार्यालय- सह- भंडार को , पूर्ण रूप से इस बात को जान‌ते हुए कि वहाँ कोई सुरक्षा कर्मी उस विशेष समय में तैनात नहीं था, अनैतिक गतिविधियां चलाने के लिए बाहरी व्यक्तियों के कब्ज़े ( कस्टडी ) में छोड़कर चले गए । इस प्रकार उन्होंने ड्रिलिंग एकक के कार्यालय एवं भंडार की संरक्षा और सुरक्षा को जोखिम में डाल दिया है । यह लापरवाही और कर्तव्यों की उपेक्षा करते हुए किया गया एक गैर जिम्मेदाराना कार्य है ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी , और कर्तव्य के प्रति समर्पण में कमी का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा ( आचरण ) नियमावली, 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) ( i ) , (ii) और (iii ) के प्रावधानों का उल्लंघन किया है ।

अनुच्छेद - V

श्री सी.बी. मैथानी ने परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय ( पखनि), मध्य क्षेत्र के वैज्ञानिक अधिकारी सी ( ड्रिलिंग ) एवं प्रभारी एलटी-575 ( 6 ) जगदलपुर , बस्तर जिला, छत्तीसगढ़ के रूप में कार्य करते समय , उनके परिवार के वहां से बाहर रहने के समय , अपने दो साथियों , जो कि बाहरी व्यक्ति हैं , के सहयोग से, अनैतिक और अवैध गतिविधि का आनंद उठाने के लिए मकान सं.४ , एसबीआई कालोनी , धरमपुरा रोड, जगदलपुर स्थित अपने कार्यालय-सह- भंडार , में दो महिलाओं को किराए पर लाकर, परिसर की सुरक्षा की देखभाल करने वाले दोनों सुरक्षा गार्डों को इस प्रकार से ड्यूटी दी कि वे ड्यूटी पर 2100 बजे से बाद ही आए और वह भी दोनों साथ में । जबकि कर्मियों के इष्टतम उपयोग की दृष्टि से दोनों गार्डों को अलग-अलग समय में तैनात किया जाना चाहिए था । उनके इस आचरण से पता चलता है कि श्री मैथानी 409 भाग III-खण्ड 1 ]

ने दिनांक 19.05.2005 को अनैतिक गतिविधि करने की पूर्व- योजना इस प्रकार से वनाई कि इन घटनाओं का कोई प्रत्यक्ष गवाह न हो ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी और कर्तव्य के प्रति समर्पण में कमी का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है, जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा ( आचरण ) नियमावली, 1964 के नियम 22 के साथ पठित नियम-3 के उपनियम ( 1 ) (i ) , ( ii ) और (iii ) के प्रावधानों का उल्लंघन किया है ।

अनुच्छेद - VI

श्री सी.बी. मैथानी , परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय ( पखनि ), मध्य क्षेत्र के वैज्ञानिक अधिकारी -सी (ड्रिलिंग ) एवं प्रभारी एलटी-575 ( 6 ) जगदलपुर , बस्तर जिला, छत्तीसगढ़ के रूप में कार्य करते समय दिनांक 19.05.2005 को स्थित अपने कार्यालय-सह-आवास मकान सं .8 , एसबीआई कालोनी , धरमपुरा रोड, जगदलपुर से हुई घटनाओं को पूर्ण रूप से जानते हुए , कि दिनांक 19.5.2005 को उक्त कार्यालय-एवं-आवास पर पुलिस द्वारा छापे डाले जाने और उसमें दो पुरुष एवं दो महिलाओं को गिरफतार किए जाने की बात को, और कोतवाली पुलिस स्टेशन की पुलिस द्वारा अपनी हिरासत के बारे में न तो आपने प्रभारी ( आवासी भूवैज्ञानिक ) को बताया न ही क्षेत्रीय निदेशक , मध्य क्षेत्र , नागपुर को अवगत कराया । उन्होंने अपने सुरक्षा गार्ड और अन्य स्टाफ को सदस्यों को, जो इस विषय के बारे में जानते हैं , को निर्देश दिए थे कि वे दिनांक 19.05.2005 एवं 20.05.2005 की घटनाओं की जानकारी किसी प्राधिकारी एवं अन्य किसी को भी को नहीं देंगे । इसके विपरीत , उक्त श्री मैथानी ने अपने आसन्न अधिकारी श्री अर्जुन सिंह को बताया कि दिनांक 19.05.2005 को कोई पुलिस छापा नहीं पड़ा है और जो दो पुरुष एवं दो महिलाओं को पुलिस द्वारा ले जाया गया है , वह घटना अपने मकान में नहीं बल्कि दिनांक 19.05.2005 की सायं , सामने के मकान में घटित हुई है । इस प्रकार , श्री मैथानी का यह आचरण लापरवाही , अनुशासन के उल्लंघन, कर्तव्यों की उपेक्षा और सत्यनिष्ठा की कमी का कृत्य है ।

उपरोक्त आचरण द्वारा , श्री मैथानी ने सत्यनिष्ठा की कमी और कर्तव्य के प्रति समर्पण में कमी का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा (आचरण ) नियमावली , 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) (i ) , (ii ) और ( iii) के प्रावधानों का उल्लंघन किया है ।

अनुच्छेद – VII

श्री सी.बी. मैथानी , परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय ( पखनि ) , मध्य क्षेत्र के वैज्ञानिक अधिकारी-सी ( ड्रिलिंग ) एवं प्रभारी एलटी-575 ( 6 ) जगदलपुर , बस्तर जिला , छत्तीसगढ़ के रूप में कार्य करते समय दिनांक 19.05.2005 को रात में हुई घटना की सूचना न तो आवासी भूवैज्ञानिक को, और न ही मध्य क्षेत्र के क्षेत्रीय निदेशक को दी । पखनि, मध्य क्षेत्र के क्षेत्रीय निदेशक ने नागपुर से एक समिति का गठन कर जांच करने के लिए आदेश दिया ।

दिनांक 23.05.2005 को जव उक्त समिति ने जगदलपुर स्थित ड्रिलिंग यूनिट एलटी -575 ( 6 ) का दौरा करने की योजना बनाई तो, उन्होंने ( श्री मैथानी ) जीप सं. एमएच- 31-एजी-9146 के चालक श्री श्रीराम नेताम , चालक ग्रेड -1 को छु‌ट्टी जूर किए बगैर कैंप छोड़ने की हिदायत इस एक मात्र इरादे दी कि उसे आनेवाली समिति ( इंपेंडिंग ) से दूर रखा जाएं और वह समिति के सामने न पेश हो ताकि उसका साक्ष्य न लिया जा सकें । आगे श्री मैथानी ने श्री श्रीराम नेताम का छुट्टी आवेदन पत्र जाली रूप से बनाकर उनके नकली हस्ताक्षर किये हैं ।

इसके अलावा, श्री मैथानी ने मई , 2005 माह की डायरी में गलत प्रविष्टि भी की थी जिसके अंतर्गत उन्होंने यह दोहराया था कि दिनांक 20.05.2005 को उन्होंने कार्यालय में उपस्थितहोकर कार्यालय का लेखा और भंडार संबंधी कार्य किया । जवकि दिनांक 19.05.2005 की रात एवं 20.05.2005 के करीब 1230 बजे तक वह कोतवाली पुलिस स्टेशन में थे । उन्होंने उस अवधि के लिए कोई छु‌ट्टी का आवेदन नहीं दिया था और इस घटना से अपने आप को बचाने दूर रखने के लिए दिनांक 20.05.2005 को स्वयं अपने एवं स्टाफ सदस्यों की आवाजाही के लिए सरकारी जीप का इस्तेमाल किया था और दिनांक 20.05.2005 को भूवेधन कार्य से अनुपस्थित रहे थे , जिस काम के लिए उन्हें और अपने स्टाफ सदस्यों को तैनात किया गया है और सुविधाएँ उपलब्ध कराई गई है । ये हेरफेरी का काम है और दिनांक 19.05.2005 एवं 20.05.2005 को हुई घटनाओं को छुपाने के लिए की गई कोशिशें हैं ।

उपरोक्त आचरण द्वारा, श्री मैथानी ने सत्यनिष्ठा की कमी और कर्तव्य के प्रति समर्पण में कमी का प्रदर्शन किया है और सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा उन्होंने केन्द्रीय सिविल सेवा ( आचरण ) नियमावली , 1964 के नियम 22 के साथ पठित नियम -3 के उपनियम ( 1 ) ( i ) , (ii) और (iii ) के प्रावधानों का उल्लंघन किया है ।

श्री सी.बी. मैथानी ने परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय ( पखनि), मध्य क्षेत्र के वैज्ञानिक अधिकारी -सी ( ड्रिलिंग ) एवं प्रभारी एलटी-575 ( 6 ) जगदलपुर , बस्तर जिला, छत्तीसगढ़ के रूप में कार्य करते समय दिनांक 19.05.2005 की रात को सं . 8 , एसबीआई कालोनी, धरमपुरा रोड, जगदलपुर स्थित अपने सरकारी आवास को, जब उनका परिवार आवास में नहीं था, आसपास के गांव में रहनेवाली संदिग्ध चरित्र की दो महिलाओं को लेकर अपने दो मित्रों के साथ अपने आवास में अनैतिक गतिविधियों के लिए इस्तेमाल किया । इस घटना के बारे में पाँच प्रमुख दैनिक समाचार पत्रों यथा ( 1 ) हरिभूमि ( 2 ) दंडकारण्य समाचार ( 3 ) दंतेवाडा हाईवे चैनल , जगदलपुर ( 4 ) नवभारत समाचार (सभी हिन्दी में ) ( 5 ) द हितवाद (अंग्रेजी) में किए गए प्रचार से इस संगठन की छवि धूमिल हो गई थी और इससे कर्मचारियों के मनोबल में गिरावट आई और इन सबके लिए केवल श्री मैथानी अकेले जिम्मेदार हैं । इस प्रकार का आचरण संगठन की प्रतिष्ठा और हित के लिए नुकसानमंद है । 411 "भाग III-खण्ड 1]

उपरोक्त आचरण द्वारा , श्री मैथानी ने सरकारी कर्मचारी के लिए अशोभनीय कार्य किया है , जिसके द्वारा सीसीएस (आचरण ) नियमावली , 1964 के नियम 3 के उपनियम ( 1 ) (iii) के प्रावधानों का उल्लंघन किया है ।

और जबकि श्री मैथानी को दिनांक 24.10.2005 के आदेश सं . 1/15 ( 5 ) : 2005- सतः 7866 द्वारा निलंबित रखा गया था । इस निलंबन की समय - समय पर समीक्षा की गई और पुनरीक्षण समिति द्वारा विस्तार किया गया था ।

और जबकि श्री मैथानी को दिनांक 04.05.2006 के ज्ञापन सं 1/15 ( 5 )/ 2005 - सत.: 3476 द्वारा उनके विरुद्ध लगाए गए आरोपों और केन्द्रीय सिविल सेवाएँ ( वर्गीकरण , नियंत्रण और अपील ) के नियम 14 के तहत उनके विरुद्ध प्रस्तावित कार्रवाई किए जाने की सूचना दी गई थी ।

और जबकि उक्त श्री मैथानी ने अपने दिनांक 12.06.2006 के लिखित बचाव बयान में उनके ऊपर लगाए गए सभी आरोपों से इंकार कर दिया था ।

और जबकि दिनांक 18.08.2006 के आदेश सं. 1/15 ( 5 ) /2005- सत/वा . 11/6555 और दिनांक 18.08.2006 के सं. 1/15 ( 5 ) / 2005 - सत/वा . 11/6556 द्वारा केन्द्रीय सिविल सेवाएँ (वर्गीकरण, नियंत्रण और अपील ) नियमावली के नियम 14 के तहत एक जांच का आदेश दिया गया था व जांच करने के लिए क्रमशः जांच प्राधिकारी और प्रस्तुतकर्ता अधिकारी की नियुक्ति की गई थी ।

और जबकि जांच की कार्यवाही पूरी होने के बाद जांचकर्ता प्राधिकारी ने , दिनांक 31.10.2007 को जांच रिपोर्ट प्रस्तुत की थी जिसमें मद II , IV और VI ठोस कारण के साथ सावित होने और धारा I , III, V, VII और VIII के सिद्ध नहीं होने का निष्कर्ष दिया था ।

और जबकि जांच रिपोर्ट और मामले के अन्य संबंद्ध रिकार्डों को सावधानी पूर्वक परखने के बाद , अनुशासनिक प्राधिकारी मद II, IV , VI और VII के संबंध में सहमत हुए थे और मद I , III , V और VIII के संबंध में आरोप नहीं साबित होने के जांच प्राधिकारी के निष्कर्ष से सहमत नहीं हुए थे ।

और जबकि अनुशासनिक प्राधिकारी की जांच रिपोर्ट की एक प्रति, अनुशासन प्राधिकारी की असहमति/टिप्पणियों सहित, उक्त श्री मैथानी को जांच रिपोर्ट एवं अनुशासनिक प्राधिकारी के निष्कर्षों के खिलाफ अपने लिखित प्रतिवेदन , यदि हो तो , प्रस्तुत करने के लिए दिनांक 01.02.2008 के ज्ञापन सं. 1/15 ( 5 )/2005-सत/खंड . 11/835 के साथ संलग्न कर भेजी गई थी ।

और जबकि श्री मैथानी ने अपने दिनांक 17.03.2008 के अभ्यावेदन के जरिए जाँच रिपोर्ट तथा अनुशासन प्राधिकारी की टिप्पणियों के विरुद्ध अपना पत्र प्रस्तुत किया था ।

और जवकि दिनांक 17.03.2008 के अपने अभ्यावेदन द्वारा श्री मैथानी ने निम्नलिखित मुद्दे उठाए थे [भाग III-खण्ड 1 412

1. आरोप की केवल उन मदों के संबंध में , जो जांच प्राधिकारी की रिपोर्ट में सावित नहीं होना ठहराया गया है , अनुशासनिक प्राधिकारी द्वारा असहमत की गई, और आगे की जांच की जा सकती थी ।

2. दिनांक 24.08.2005 के पत्र के साथ लगे का अनुलग्नक ( एस -3 ) उनसे संबंधित नहीं है , अतः इसे आरोप को सावित करने में उनका उपयोग नहीं किया जा सकता ।

3. यह अनिवार्य प्रावधान है कि प्रारंभिक जांच के समय गवाहों का वयान रिकार्ड किया और गवाह को पढ़कर सुनाया जाता है और तत्पश्चात ही इसे साक्ष्य को स्वीकार किया जाता है और उसके बाद सीधे गवाह का प्रति- परीक्षण किया जाता है , जो इस पूरी जांच में नहीं हुआ था ।

4. यद्यपि उन्होंने अपने व्यक्तिगत सामान जैसे टी.वी. और वीसीडी पुलिस को देकर पुलिस की जांच में स्वेच्छा से सहयोग किया था ।

और जबकि श्री मैथानी के उपरोक्त प्रतिवेदन को सावधानी पूर्वक परखने के बाद अनुशासनिक प्राधिकारी निम्नलिखित निष्कर्ष पर पहुँचे थे

1. चूँकि श्री मैथानी को, जाँच प्राधिकारी के निष्कर्षों पर असहमति की, टिप्पणियों के बारे में सूचित किया जा रहा है अतः इस मामले में आगे की जांच की कोई जरूरत नहीं है । 2. श्री मैथानी को आवास सं . 8 को कार्यालय- सह- आवास के रूप में उपयोग के लिए आवंटित किया गया था । उक्त क्वार्टर से पुलिस ने दो पुरुष एवं दो महिलाओं को अनैतिक गतिविधियों में लिप्त पाये जाने के कारण पकड़ा गया था , जिसके बारे में एस -3 के दस्तावेज में उल्लेख किया गया । अतः, श्री मैथानी इस मामले में शामिल रहे है । 3. जांच के दौरान गवाहों के बयानों को पढ़कर सुनाया गया था और प्रक्रिया के अनुसार की सभी संबद्ध वयानों को अभिलेख में लिया गया । प्रस्तुतकर्ता अधिकारी अपने विवेक से किसी भी गवाह को छोड़ सकता है ।

4. यद्यपि श्री मैथानी ने अपनी टी.वी. , वीसीडी आदि देकर पुलिस के साथ सह्योग किया, लेकिन उनकी यह जिम्मेदारी थी कि इस बारे में अपने वरिष्ठ अधिकारियों को सूचित करें , जबकि उन्होंने ऐसा नहीं किया ।

5. चूँकि श्री मैथानी ने कोई पहले के निष्कर्षों में विचलन की अपेक्षा में नया सबूत/दस्तावेज़ नहीं दिया अतः निष्कर्षों को बदलने का कोई कारण नहीं दिखाई देता है । 413 भाग III-खण्ड 1 ]

और जबकि, सभी संबद्ध तथ्यों और मामले की परिस्थितियों एवं श्री मैथानी के अभ्यावेदन को ध्यान में रखते हुए अनुशासनिक प्राधिकारी पूरी तरह संतुष्ठ थे कि मद VII को छोड़कर , आरोपों की संभी अन्य मदों साबित हो चुकी हैं और वह इस बात से भी संतुष्ट रहे हैं कि सीसीएस ( सीसीए ) नियमावली के अनुसार विहित प्रकियाओं का पालन किया गया है और वह इस नतीजे पर पहुँचे हैं कि श्री मैथानी सरकारी सेवा में बनाए रखने के लिए योग्य व्यक्ति नहीं है और इस मामले में सभी सेवानिवृत्ति लाभों सहित , "अनिवार्य सेवा निवृत्ति " का दंड दिया जाना न्यायोचित होगा ।

और जबकि, इस मामले में संघ लोक सेवा आयोग से परामर्श किया गया और आयोग ने सभी संबद्ध रिकार्डों एवं अन्य पहलुओं पर विचार करने के उपरांत दिनांक 31.03.2009 के पत्र सं. एफ3 /208 / 2008- एसआई ( प्रति संलग्न) के द्वारा सलाह दी है कि उक्त श्री मैथानी पर "सेवा से पदच्युति ( बर्खास्तगी ) " की शास्ति ( दंड ) लगाई जाए ।

और जबकि अनुशासनिक प्राधिकारी ने अपराध की प्रकृति के मद्दे नज़र संघ लोक सेवा आयोग द्वारा दिनांक 31.03.2009 के पत्र द्वारा दी गई सलाह पर गौर किया और संघ लोक सेवा आयोग की सलाह को स्वीकार कर लिया ।

अतः अब राष्ट्रपति संघ लोक सेवा आयोग की उक्त सलाह को स्वीकार किए जाने तथा केन्द्रीय सिविल सेवा ( वर्गीकरण, नियंत्रण और अपील ) नियमावली , 1965 के नियम 15 ( 4 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, श्री सी.बी. मैथानी , वैज्ञानिक अधिकारी/सी , परमाणु खनिज अन्वेषण एवं अनुसंधान निदेशालय , मध्यवर्ती क्षेत्र, नागपुर पर तत्काल प्रभाव से , सेवा से पदच्युति का दंड अधिरोपित करते हैं ।

Shri Chandra Ballabh Maithani , while functioning as Scientific Officer/ C (Drilling) and Incharge of LT - 575( 6 ) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh of Central Region of Atomic Minerals Directorate for Exploration & Research ( AMD) has misused the office- cum- stores- cum- residence at House No. 8 , SBI Colony , Dharampura Road , Jagdalpur with pre -plan for illegal / immoral activity i.e. ' flesh trade ' by hiring two women at the rate of Rs.500 / - each viz . , Kum . Sita , aged 19 years , daughter of Shri Kumar , resident of Kondagaon and Smt . Urmila Devangan , aged 22 years , wife of Shri Ramu Devangan, resident of Nagarnar for fulfillment of sexual desires of himself and his two friends viz . , Shri Surendra Sharma aged 38 years , son of Shri Rampal Sharma , a resident of Hakimpura , Jagdalpur and Shri Rampal aged 42 years , son of Shri Ballooram Panjabi , a resident of Telipara , Bilaspur on the evening hours of 19.05.2005 . They also consumed liquor in the said Government accommodation on 19.05.2005 .

Shri C.B. Maithani has been indulging in these immoral activities for some time . In other words these immoral activities of flesh trade ' have been happening in his official residence with his knowledge and his consent and he has also been involved in the said ' flesh trade ' . This is not an isolated incident . Only that this time the activities have come into the open . The facts that ( i) he has been deliberately avoiding deploying the security personnel in such a way that both the security guards are not available for security duty at certain hours to suit his requirement to enable him to carry 428

on the illegal activity unnoticed , and ( ii) the matter has been reported to police by an informer ' , suggests that these immoral / illegal activities have been going on in the said premises fo quite some time now.

By the above act , Shri Maithani has displayed lack of integrity and gross moral misconduct and behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub - rule ( 1 ) ( i) and (iii) of Rule 3 read with Rule 22 of CCS ( Conduct ) Rules , 1964.

Maithani , while functioning as Scientific Officer / C (Drilling) and Incharge of LT - 575 (6 ) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) has involved himself along with his two friends in gross illegal / immoral activity of conducting flesh trade' by hiring two women at the rate of Rs.500 /- each for sexual activities at his office cum residence , at House 8. , SBI Colony , Dharampura Road , Jagdalpur. This illegal / immoral activity having come to their notice , the Police from Kotwali Police Station conducted a raid on the said official residence of Shri C.B. Maithani at about 2030 hours of 19.5.2005 and arrested four persons viz . , Shri Surendra Sharma (friend of Shri C.B.Maithani ) , Shri Rampal ( friend of Shri Surendra Sharma ) and two women viz . , Kum . Sita and Smt . Urmila from the said official residence of Shri C.B. Maithani and registered cases against them.

Shri Maithani had left his official residence which is also the office cum stores ofLT - 575 (6 ) Drilling Unit in the custody of outsiders during the absence of his family and also in the absence of the security personnel on 19.5.2005 during the evening hours . Also the duties of the Security Guards were so manipulated as to ensure smooth conduct of the illegal/ immoral activity in the said official residence of Shri Maithani , endangering the safety, security and the reputation of the organization ( AMD) .

By the above said act , the said Shri Maithani has displayed lack of integrity, devotion of duty and behaved in a manner unbecoming of a Government servant, thus contravened the provisions of sub - rule ( 1 ) ( i ) , ( ii ) and ( iii ) of Rule 3 of CCS ( Conduct) Rules , 1964 .

Article- III

Shri C.B. Maithani , while functioning as Scientific Officer/ C ( Drilling) and Incharge of LT - 575 ( 6) Drilling Uit , Jagdalpur, Bastar Dist. , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) was detained in the Police custody of Kotwali Station on 19.5.2005 for illegal / immoral activity at his official residence . He was brought to his office- cum- residence i.e. House No. 8 , SBI Colony , Dharampura Road, Jagdalpur by the police in their jeep at about 0045 hours i.e. the midnight of 19 / 20.5.2005 . During this second raid they seized one TV , one VCD player and some books from the said official residence of Shri Maithani and went back to police station alongwith Shri Maithani . When the second raid was conducted at midnight of19 / 20.5.2005 , S / Shri Govindram and Laxman Singh , Security Guards were present at the said premises . Shri Maithani was brought back from police station on 20.5.2005 at around 12.30 hours by Shri Sriram Netam , Driver Gr.l in the departmental vehicle No MH - 31- AG -9146.

Thus , Shri Maithani's involvement in the immoral activity and the consequent detention in the police custody indicates his infidelity , lack of integrity and gross moral misconduct.

By the above said act , Shri Maithani exhibited lack of integrity and behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub - rule ( 1 ) ( i) and ( iii) of Rule 3 of CCS( Conduct) Rules , 1964 .

Article - IV

Shri C.B. Maithani , while working as Scientific Officer / C ( Drilling) and Incharge of LT - 575 ( 6) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh of Central Region of Atomic Minerals Directorate for Exploration & Research (AMD) had (while his family was away) left the office- cum- stores of LT- 575(6 ) Drilling Unit at House No. 8 , SBI Colony , Dharampura Road , Jagdalpur on the evening hours of 19.5.2005 in the custody of outsiders for immoral activities knowing fully well that no security guard was deployed on duty during that particular time . He thereby risked the safety and security of the 431 PART III-SEC . 1 ]

This is an irresponsible act of office and stores of the drilling unit . negligence and dereliction of duty .

By the above said act , Shri Maithani has displayed lack of integrity , devotion of duty and behaved in a manner unbecoming of a Government servant, thereby contravening the provisions of sub - rule ( 1) ( i) , ( ii ) and ( iii ) of Rule 3 of CCS ( Conduct) Rules , 1964.

Article -V

Shri C.B. Maithani , while working as Scientific Officer / C ( Drilling) and Incharge of LT - 575( 6) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) , in order to enjoy the immoral and illegal activity , by hiring two women , at his office- cum- residence at House No. 8 , SBI Colony, Dharampura Road , Jagdalpur along with his two accomplices , who are outsiders , during the time when his family was away, had detailed the watch and ward staff in such a way that both the security guards attended to their duties only from 2100 hours , that too both of them together , though he should have detailed the security guards during separate timings for optimum utilization of the security guards . This act on his part shows that Shri Maithani had pre - planned to have the immoral activity on 19.5.2005 in such a way that there was no eye witness to the happenings .

By the above said act , Shri Maithani has displayed lack of integrity , devotion of duty and behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub - rule ( 1 ) ( i) , ( ii ) and ( iii ) of Rule 3 of CCS ( Conduct) Rules , 1964 .

Article -VI

Shri C.B. Maithani , while working as Scientific Officer/ C ( Drilling) and Incharge of LT- 575(6) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) having been fully aware of the incidents of 19.5.2005 at his office- cum- residence i.e. House No. 8 , SBI Colony , Dharampura Road , Jagdalpur did not inform the incident of the police raid on 19.5.2005 during which two men and two women were arrested from the said office- cum- residence and his detention by the Police from Kotwali Station either to his Incharge [PART III-SEC . 1 432

(Resident Geologist) or to the Regional Director , CR, Nagpur . He had further instructed his security guards and other staff members who were in the know- of- the- things not to divulge th. incident of 19.5.2005 and 20.5.2005 to any authority or to others. On the contrary , the said Shri Maithani told Shri Arjun Prasad , his Immediate Superior that there was no police raid and the two men and the two women were picked up not from his residence but from in front of his residence in the evening hours of 19.5.2005 . Thus , this act of Shri Maithani is of irresponsibility , subversion of discipline , dereliction of duty and lack of integrity as well .

By the above said act , Shri Maithani has displayed lack of integrity , devotion to duty and behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub- rule ( 1 ) ( i) , ( ii ) and ( iii ) of Rule 3 of CCS( Conduct) Rules , 1964 .

Article -VII

Shri C.B. Maithani , while working as Scientific Officer/ C ( Drilling) and Incharge of LT - 575 ( 6) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) did not inform immediately the Resident Geologist or the Regional Director , Central Region about the incident that occurred on the night of 19.5.2005 . The Regional Director , CR had ordered for an inquiry by constituting a Committee from Central Region , AMD , Nagpur. When the said Committee planned to visit the Drilling Unit LT - 575 ( 6 ) at Jagdalpur , on 23.5.2005 , he had instructed Shri Sriram Netam , Driver Gr.I of Jeep No. MH - 31 - AG - 9146 to leave camp without sanctioning the leave with the sole intention of keeping him away from the impending Committee so that his deposition is avoided . He also made the leave application of Shri Sriram Netam fabricated by forging his signature.

Further , Shri Maithani also had made a false diary entry for the month of May, 2005 showing that he attended office account and stores work ' on 20.5.2005 , whereas , he was in Kotwali Police Station on the night of 19.5.2005 and 20.5.2005 up to around 12.30 hours. He had not applied for any leave for that period and used the Government jeep for the movement of himself and the staff members and to cover up the incident by 433 PART III-SEC . 1]

abstaining from conducting the drilling work on 20.5.2005 for which he and his staff members are posted and facilities provided . These are acts of manipulation and attempt to cover up the incidents on 19.5.2005 and 20.5.2005 .

By the above said act , Shri Malthani has displayed lack of integrity , devotion to duty and behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub - rule ( 1) ( i ) , ( ii) and ( iii ) of Rule 3 of CCS ( Conduct) Rules , 1964.

Article -VIII

Shri C.B. Maithani , while working as Scientific Officer / C (Drilling) and Incharge of LT- 575 (6 ) Drilling Unit , Jagdalpur , Bastar Dist . , Chattisgarh ofCentral Region of Atomic Minerals Directorate for Exploration & Research (AMD) has allowed his official residence at House No. 8 , SBI Colony , Dharampura Road , Jagdalpur for immoral activities by engaging two women of dubious character belonging to nearby villages along with two of his friends when his family was away from his residence , on the night of 19.5.2005 . The occurrence of this incident and its publicity in five leading daily newspapers viz . , ( 1 ) Haribhoomi (2 ) Dhandakaranya Samachar ( 3 ) Dhantewada Highway Channel , Jagdalpur (4) Navbharath Samachar (All in Hindi ) & (5) The Hithavada (English) have tarnished the image of this esteemed organization and lowered the morale of its staff for which the said Shri Maithani alone is responsible . Thus this act is prejudicial to the interests and reputation of the organization (AMD) .

By the above said act , Shri Maithani behaved in a manner unbecoming of a Government servant , thereby contravening the provisions of sub - rule ( 1 ) ( iii ) of Rule 3 of CCS ( Conduct) Rules , 1964 ;

AND WHEREAS the said Shri Maithani was placed under suspension vide order no . 1/15( 5 ) / 2005 - Vig / 7866 dated 24.10.2005 . The suspension was reviewed and extended from time to time by the Review Committee ;

AND WHEREAS the said Shri Maithani was informed of the charges and of the action proposed to be taken against him under Rule 14 of the Central Civil Services ( Classification , Control and Appeal ) Rules , 1965 , vide Memorandum No. 1/15 (5 ) / 2005- Vig /3476 dated 4.5.2006 ;

AND WHEREAS the said Shri Maithani denied all the articles of charge vide his written statement of defense dated 12.6.2006 ;

AND WHEREAS an inquiry under Rule 14 of the Central Civil Services (Classification , Control and Appeal ) Rules , 1965 was ordered appointing an Inquiring Authority and a Presenting Officer vide Orders No. 1/15 ( 5) / 2005- Vig /Vol.II / 6555 dated 18.8.2006 and No. 1/15 ( 5 ) /2005-Vig/Vol.II/6556 dated 18.8.2006 respectively ;

AND WHEREAS after completion of the inquiry proceedings , the Inquiring Authority submitted his report dated 31.10.2007 concluding Article II , IV and VI as proved with cogent reasons and Articles I , III , V , VII and VIII as not proved ;

AND WHEREAS after careful consideration of the inquiry report and other relevant records of the case , the Disciplinary Authority while agreeing with the findings of the Inquiring Authority in respect of Articles II , IV , VI and VII , disagreed with his findings in respect of Articles I , III , V and VIII which were held as not proved by the Inquiring Authority ;

AND WHEREAS a copy of the inquiry report along with points of disagreement / observations of the Disciplinary Authority was sent to the said Shri Maithani vide memorandum no . 1/15 ( 5 ) /2005-Vig/Vol.II/835 dated 1.2.2008 for submitting his written representation , if any , against the Inquiry Report and the findings of the Disciplinary Authority ;

AND WHEREAS the said Shri Maithani submitted his representation dated 17.3.2008 against the inquiry report and observations of Disciplinary Authority;

AND WHEREAS , the points raised by the said Shri Maithani in his representation dated 17.3.2008 are as follows:

1. The Disciplinary Authority disagreed with the report of the Inquiring Authority only in respect of the articles of charge which were not proved by Inquiring Authority and that further inquiry could be conducted.

2. The enclosure to letter dated 24.8.2005 ( S - 3 ) is not related to him and therefore cannot be used to prove the charge .

3. It is mandatory provision that statement of witness recorded at the preliminary inquiry/ investigation to be read out to the witness and got admitted as evidence and thereafter , expose the witness for cross- examination straightaway , which is missing in the enquiry .

4. He gave his personal articles like TV and VCD and cooperated with the police investigation voluntarily.

AND WHEREAS the Disciplinary Authority after careful consideration of the abovesaid representation of Shri Maithani came to the following

conclusions : -

1. Further inquiry is not warranted in the case since the observations in disagreeing with IA were communicated to the said Shri Maithani.

2. Shri Maithani was allotted Quarter No. 8 for use as Office- cum- residence . The Police seized two men and women involved in immoral activities from the said quarter which is mentioned in the document S-3 . Hence , Shri Maithani is involved in the matter .

3. The statement of witnesses were read out during inquiry and those relevant were taken on record as per procedure . The PO has the discretion to drop any witnesses if felt so .

4. Although Shri Maithani cooperated with Police in giving away TV , VCD etc. he was duty bound to inform this to his superiors , whereas he did not do so .

5. There is no reason to alter the findings as Shri Maithani did not bring out any new evidence/ documents which calls for deviation from earlier findings .

AND WHEREAS after taking all relevant facts and circumstances of the case and the representation of the said Shri Maithani , the Disciplinary Authority is convinced that all the articles of charge except Article VII stand fully proved and is also convinced that the procedure laid down in the CCS (CCA) Rules have been fully complied with and has come to the conclusion that Shri Maithani is not a fit person to be retained in service and that [PART III-SEC . 1 436

imposition of the penalty of Compulsory Retirement' with full retirement benefits would meet the ends of justice in this case;

AND WHEREAS UPSC was consulted in the matter and the Commission after considering all relevant records and other aspects of the case advised vide its letter No.F.3 / 208 / 2008 - S1 dated 31.3.2009 (copy enclosed) imposition of the penalty of 'dismissal from service ' on the said Shri Maithani ;

AND WHEREAS, the disciplinary authority after considering the advice of UPSC contained in the letter dated 31.3.2009 vis - à- vis the nature ofthe offence committed , accepted the advice of UPSC;

NOW , THEREFORE , the President on acceptance of the said advice of UPSC and in exercise of the powers conferred on him under Rule 15( 4 ) of Central Civil Services ( Classification , Control and Appeal ) Rules , 1965 hereby imposes the penalty of dismissal from service ' on the said Shri C.В. Maithani , Scientific Officer / C , Atomic Minerals Directorate for Exploration and Research , Central Region , Nagpur with immediate effect ;
