2. माननीय केन्द्रीय प्रशासनिक अधिकरण प्रधान पीठ, दिल्ली के दिनांक 30.06.2009 और 18.11.2009 के आदेशों के अनुपालन में श्री यू. के. झा की अनुभाग अधिकारी के रूप में सेवाओं की दिनांक 10.08.2007 से सभी उद्देश्यों के लिए गणना की जायेगी जो दिल्ली उच्च न्यायालय में इस मामले में दायर की जाने वाली याचिका के परिणाम के अध्यधीन होगी क्योंकि यह प्रोन्नति केन्द्रीय प्रशासनिक अधिकरण , प्रधान पीठ, नई दिल्ली द्वारा आरंभिक आवेदन सं. 1074/2008 में दिये गये निर्देशों के तहत् की गयी है ।

दिनांक 19 जनवरी 2010 बनाम भारत संघ, केन्द्रीय प्रशासनिक अधिकरण , नई दिल्ली और ओ. ए. सं. 2674/2009 शीर्षक श्री पी. एस . भंडारी बनाम भारत संघ और अन्य के अंतिम निष्कर्ष के अधीन होगी ।

सं. 09: (फा.सं. ए. 19013/02/2010 - प्रशा.1)--राष्ट्रपति, सुश्री अल्का गौतम ( भारतीय राजस्व सेवा आयकर ) को दिनांक 01.01.2010 ( पूर्वाह्न ) से तीन वर्षों की अवधि के लिए अथवा अगले आदेशों तक, इनमें से जो भी पहले हो , राजस्व विभाग , केन्द्रीय प्रत्यक्ष कर बोर्ड में अवर सचिव के रूप में नियुक्त करते हैं ।

वी. श्रीकुमार, अवर सचिव 3. जबकि नोशनल आधार पर मूल नियम 22 I ( ए) ( i ) के तहत् अवर सचिव ग्रेड में इनके वेतन निर्धारण के लिए अनुमोदित सेवा के उद्देश्यों के लिए पूर्वोक्त चयन सूची में शामिल उपर्युक्त अधिकारी की नियुक्ति1.7.2004 से प्रभावी की हुई की तरह मानी जाएगी , फिर भी ग्रेड में वेतन निर्धारण के वास्तविक लाभ इन्हें केन्द्रीय सचिवालय सेवा के अवर सचिव ग्रेड में वास्तविक रूप में कार्य करने की तिथि से ही मिलेंगे ।

4. मूल नियम 22 के प्रावधानों के अनुसार श्री हवा सिंह वेतन निर्धारण हेतु विकल्प देने के लाभ के हकदार होंगे । फिर भी, यदि उनकी पहली जुलाई , 2004 से पूर्व तदर्थ अवर सचिव के रूप में प्रोन्नति हुई थी और यदि उन्होंने खंडित विकल्प का लाभ ले लिया था, वे पुनः विकल्प देने के पात्र नहीं होंगे ।

3. नोशनल आधार पर मूल नियम 22 1 ( ए) ( i ) के तहत् अवर सचिव ग्रेड में इनके वेतन निर्धारण के लिए अनुमोदित सेवा के उद्देश्यों के लिए पूर्वोक्त चयन सूची में शामिल उपर्युक्त अधिकारी की नियुक्ति यद्यपि1-7-2006 से प्रभावी की हुई मानी जाएगी , फिर भी ग्रेड में वेतन निर्धारण के वास्तविक लाभ इन्हें केन्द्रीय सचिवालय सेवा के अवर सचिव ग्रेड में वास्तविक रूप में कार्य करने की तिथि से ही मिलेंगे । 3. जबकि नोशनल आधार पर मूल नियम 22 I ( ए) ( i ) के तहत् अवर सचिव ग्रेड में इनके वेतन निर्धारण के लिए अनुमोदित सेवा के उद्देश्यों के लिए पूर्वोक्त चयन सूची में शामिल उपर्युक्त अधिकारी की नियुक्ति 1.7.2005 से प्रभावी की हुई की तरह मानी जाएगी , फिर भी ग्रेड में वेतन निर्धारण के वास्तविक लाभ इन्हें केन्द्रीय सचिवालय सेवा के अवर सचिव ग्रेड में वास्तविक रूप में कार्य करने की तिथि से ही मिलेंगे ।

4. वित्तीय नियम 22 के प्रावधानों के अनुसार ये अधिकारी वेतन निर्धारण हेतु विकल्प देने के लाभ के हकदार होंगे । तथापि वे अधिकारी जिनकी पहली जुलाई, 2007 से पूर्व तदर्थ अवर सचिव के रूप में प्रोन्नति हुई थी और यदि उन्होंने खंडित विकल्प का लाभ ले लिया था, वे पुनः विकल्प देने के पात्र नहीं होंगे ।

4. मूल नियम 22 के प्रावधानों के अनुसार श्री प्रमोद कुमार वेतन निर्धारण हेतू विकल्प देने के लाभ के हकदार होंगे । फिर भी, यदि उनकी पहली जुलाई, 2005 से पूर्व तदर्थ अवर सचिव के रूप में प्रोन्नति हुई थी और यदि उन्होंने खंडित विकल्प का लाभ ले लिया था, वे पुनः विकल्प देने के पात्र नहीं होंगे ।
