बैंपविवि. सं. आरईटी बीसी. 70/12.01.001/2009-2010-- भारतीय रिज़र्व बैंक अधिनियम, 1934 की धारा 42 की उप - धारा ( 1 ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए तथा 2 जनवरी 2009 को पूर्व में जारी अधिसूचना बँपविवि. सं. आरईटी बीसी. 102 / 12.01.001 / 2008-09 में आंशिक संशोधन करते हुए, भारतीय रिज़र्व बैंक एतद्वारा यह अधिसूचित करता है कि प्रत्येक अनुसूचित वाणिज्य बैंक द्वारा रखा जाने वाला औसत आरक्षित नकदी निधि अनुपात ( सीआरआर ) नीचे उल्लिखित तारीखों से, उनके सामने निर्दिष्ट प्रतिशत अंक होगा : --

एस.ओ. : पीएडी/पेंशन/001/2009 -- खण्ड 19, बैंकिंग कम्पनीज [उपक्रमों का अधिग्रहण एवं स्थानान्तरण) अधिनियम, 1970 ( 1970 का 5वां ) के खण्ड 12 के उप- खण्ड ( 2 ) के साथ पठनीय , के द्वारा दिए गए अधिकारों का प्रयोग करते हुए, इण्डियन ओवरसीज बैंक के निदेशक मंडल भारतीय रिज़र्व बैंक से परामर्श कर एवं सरकार की पूर्व स्वीकृति के अनुरूप एतद्वारा इण्डियन ओवरसीज बैंक [ कर्मचारी] पेंशन विनियम, 1995 में आगे संशोधन हेतु निम्नलिखित विनियम बनाते हैं :--
1. ( 1 ) इन विनियमों को इण्डियन ओवरसीज बैंक [कर्मचारी] पेंशन संशोधन विनियम , 2009 के नाम से जाना जाएगा । (2) ये विनियम राजकीय गज़ट में प्रकाशन की तिथि से प्रभावी होंगे ।
2. इण्डियन ओवरसीज बैंक [ कर्मचारी] पेंशन विनियम, 1995 ( अब से उपरोक्त विनियम के रूप में सन्दर्भित ) में विनियम 2 में खण्ड ( ओ ) में उप -खण्ड ( सी ) के लिए निम्नलिखित उप - खण्ड को निम्नलिखित नाम से प्रतिस्थापित किया जाएगा : --
" ( सी) पुत्र या पुत्री ( विधवा या तलाकशुदा पुत्री सम्मिलित ) जब तक उनकी आयु 25 वर्ष नहीं होती है या उनका विवाह या पुनर्विवाह नहीं होता है, इसमें विधिवत् गोद लिए पुत्र या पुत्री भी सम्मिलित हैं, इसमें जो भी पहले हो । "
3. उक्त विनियमों में , विनियम 8 में उप- विनियम ( 3 ) के बाद निम्नलिखित उप - विनियम को निम्न प्रकार सम्मिलित किया जाएगा : -- " [4] न्यासी की नियुक्ति तीन वर्षों की अवधि के लिए होगी एवं बैंक उस न्यासी को फिर से नियुक्त कर सकता है, जिनका कार्यकाल पहले ही समाप्त हो चुका है, बशर्ते कि किसी भी न्यासी का कार्यकाल 2 बार से अधिक नहीं हो । "
4. उक्त विनियमों में, विनियम 9 में निम्नलिखित प्रावधान सम्मिलित किया जाएगा--
" बशर्ते कि ऐसे सभी निर्देश लिखित रूप में दिए जाएं और उद्देश्य या लक्ष्य का उल्लेख करें । "
5. उक्त विनियमों में उप - विनियम ( 2 ) में विनियम 10 से प्रारंभिक भाग में वर्णित शब्दों " प्रत्येक वित्तीय वर्ष की समाप्ति से एक सौ अस्सी दिनों के भीतर " को " बैंक के तुलन- पत्र के प्रकाशन की तिथि से 60 दिनों के भीतर " से प्रतिस्थापित किया जाएगा ।

आवास वित्त कम्पनी ( रा.आ. बैंक ) निर्देश , 2001
निर्देश सं. एन.एच.बी. एच.एफ.सी. निर्देश 28/सी.एम.डी./2010-- राष्ट्रीय आवास बैंक अधिनियम, 1987 की धारा 30ए और 31 द्वारा प्रदत्त एवं इस संबंध में सामर्थ्यकारी अन्य सभी शक्तियों का प्रयोग करते हुए, राष्ट्रीय आवास बैंक देश में , आवास वित्त प्रणाली को विनियमित करने में सशक्त होने के प्रयोजनार्थ एवं इस बात से संतुष्ट होकर कि जनहित में ऐसा करना आवश्यक है, एतद्वारा निर्देश देता है कि आवास वित्त कम्पनी ( रा.आ. बैंक ) निर्देश , 2001 ( अब के बाद जिन्हें " प्रमुख निर्देश " संदर्भित किया जाएगा ) में, इसके अतिरिक्त संशोधन तत्काल प्रभाव से लागू होंगे, यथा :
1. धारा ( घ ) के बाद अनुच्छेद 2 के उप-अनुच्छेद ( 1 ) में, निम्नलिखित धारा शामिल की जाएगी, यथा :
" (डीए) " नियंत्रण " का वही अर्थ होगा जैसे कि भारतीय प्रतिभूति एवं एक्सचेंज बोर्ड ( शेयरों का पर्याप्त अधिग्रहण और समामेलन ) विनियमावली 1997 के विनियम 2 के उप- विनियम ( 1 ) की धारा ( सी ) के तहत् निहित है । "
2. अनुच्छेद 18 के बाद प्रमुख निर्देशों में निम्नलिखित अनुच्छेद जोड़े जाएंगे, यथा :
" जमा राशियां स्वीकार करने वाली आवास वित्त कम्पनियों का अधिग्रहण या नियंत्रण हस्तांतरण करने के मामलों में राष्ट्रीय आवास बैंक का पूर्व अनुमोदन
18क. जमा राशियां स्वीकार करने वाली आवास वित्त कम्पनी के अधिग्रहण या नियंत्रण हस्तांतरण करने पर, चाहे शेयरों के अधिग्रहण से हो या अन्यथा हो, या जमा राशियां स्वीकार करने वाली आवास वित्त कम्पनी का किसी अन्य के साथ विलयन या समामेलन , या किसी संस्थान की जमा राशियां स्वीकार करने वाली आवास वित्त कम्पनी के साथ विलयन या समामेलन होने पर राष्ट्रीय आवास बैंक से पूर्व लिखित अनुमति लेनी होगी ।
अन्य कानून लागू होने पर रोक नहीं
18ख. अनुच्छेद 18 क के प्रावधान किसी अन्य कानून, नियमों, विनियमों या निर्देशों, जो उस समय लागू हों , के अतिरिक्त होंगे , न कि उनके विरुद्ध होंगे । "

INDIAN OVERSEAS BANK

S.O. PAD /PEN/001/2009-In exercise of the powers conferred by section 19 , read with sub- section (2 ) of section 12 of the Banking Companies [Acquisition and Transfer of Undertakings ] Act, 1970 (5 of 1970) , the Board of Directors of the Indian Overseas Bank in consulation with the Reserve Bank of India and with the previous sanction of the Government, hereby makes the following regulations further to amend the Indian Overseas Bank [Employees ' ] Pension Regulations , 1995 , namely :-
1. ( 1 ) These regulations may be called the Indian Overseas Bank [ Employees ' ] Pension ( Amendment ) Regulations , 2009 . (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Indian Overseas Bank [ Employees' ] Pension Regulations , 1995 (hereinafter referred as the said regulation) , in regulation 2, in cause (o) , for sub- clause (c) , the following sub- clause shall be substituted, namely :-- "(c) son or daughter including widow or divorced daughter till he or she attains the age of twenty- five years or upto his or her marriage or re - mariage , whichever is earlier including such son or daughter adopted legally; "
3. In the said regulations , in regulation 8 after sub - regulation (3 ) , the following sub - regulation shall be inserted namely : ---
"[4] The term of appointment of trustee shall be for a period of three years and the Bank may re - appoint a trustee who has already completed his term; provided that no trustee shall be appointed for more than two terms . "
4. In the said regulations , in regulation 9 , the following proviso shall be inserted, namely:-

"Provided that all such directions shall be given in writing and shall specify the purpose or objective . "
5. In the said Regulations , regulation 10 , in sub - regulation (2) , in the opening portion, for the words " Within one hundred and eighty days from the closing of each financial year " , the words "Within sixty days from the date of publication of the Balance Sheet of the Bank " shall be substituted.

NATIONAL HOUSING BANK

THE HOUSING FINANCE COMPANIES (NHB ) DIRECTIONS , 2001
Direction No. NHB.HFC.DIR.28 /CMD/2010--In exercise of the powers conferred by sections 30A and 31 of the National Housing Bank Act , 1987 (53 of 1987) and all the powers enabling it in this behalf, the National Housing Bank having considered it necessary in the public interest and being satisfied that for the purpose of enabling it to regulate the housing finance system to the advantage of the country, it is necessary so to do , hereby directs that the Housing Finance Companies (NHB) Directions , 2001 (hereinafter referred to as the Principal Directions) , shall , with immediate effect, be further amended in the following manner, narnely :
1. In sub -paragraph ( 1 ) of paragraph 2 after clause (d) , following clause shall be inserted , namely :
"(da) " control " shall have the same meaning as is assigned to it under clause (c ) of sub- regulation ( 1 ) of regulation 2 of Securities and Exchange Board of India ( Substantial Acquisition of Shares and Takeovers ) Regulations , 1997 : " .
2. In the Principal Directions after paragraph 18 , following paragraphs shall be insterted, namely
"Prior approval of National Housing Bank in cases of acquisition or transfer of control of deposit taking housing finance companies.
18A. Any takeover of acquisition of control of a deposit taking housing finance company, whether by acqusition of shares or otherwise, or any merger or amalgamation of a deposit taking housing finance company with another entity, or any merger or amalgamation of an entity with a deposit taking housing finance company; shall require prior approval of the National Housing Bank in writing.
Application of other laws not barred
18B. The provisions of paragraph 18A shall be in addition to , and not in derogation of the provisions of any other law rules , regulations or directions , for the time being in force . " .
