आ. अ. 10.—लोक प्रतिनिध्त्वि अध्निियम, 1950 ;1950 का 43द्ध की धरा 13-क की उप-धरा ;1द्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग पश्चिम बंगाल सरकार के परामर्श से एतद्‌द्वारा श्री देबाशीष सेन, आई.ए.एस. ;प.बं. : 85द्ध के स्थान पर श्री सुनील कुमार गुप्ता, आई.ए.एस ;1987द्ध को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए पश्चिम बंगाल राज्य के मुख्य निर्वाचन अध्किारी के रूप में नामित करता है ।

2. श्री सुनील कुमार गुप्ता, पश्चिम बंगाल सरकार के अध्ीन सभी पदभार या किसी कार्य के पदभारों को तत्काल साैंप देंगे या धरण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धरण कर रहे थे ।

3. श्री सुनील कुमार गुप्ता, मुख्य निर्वाचन अध्किारी, पश्चिम बंगाल के रूप में कार्य करते हुए पश्चिम बंगाल सरकार के अध्ीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जायेगा ।

ELECTION COMMISSION OF INDIA

New Delhi, the 2nd March, 2010

O. N. 10.—In exercise of the powers conferred by Sub-section (1) of Section 13A of the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India, in consultation with the Government of West Bengal, hereby nominates Shri Sunil Kumar Gupta, IAS(1987) as the Chief Electoral Officer for the State of West Bengal with effect from the date he takes over charge and until further orders, vice Shri Debashis Sen, IAS (WB:85).

2. Shri Sunil Kumar Gupta, shall cease to hold and hand over forthwith the charge of all or any charge of work under the Government of West Bengal, which he may be holding before such assumption of office.

3. Shri Sunil Kumar Gupta, while functioning as the Chief Electoral Officer, West Bengal shall not hold any additional charge, whatsoever under the Government of West Bengal, except that he should be designated as Secretary of the Government in charge of Election Department in the State Secretariat.

आ.अ. 11.—यतः निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तंभ ;2द्ध में यथा विनिदष्ट मई, 2009 में उत्तराखंड राज्य से हुए लोक सभा के साधरण निर्वाचन के लिए जो स्तम्भ ;3द्ध में तद्‌नुरूपी विनिदष्ट निर्वाचन क्षेत्रा से हुआ है, के स्तम्भ ;4द्ध में उसके सामने विनिदष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा तद्‌ध्ीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ;5द्ध में यथा दशत अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहा हैऋ

और, यतः उक्त अभ्यथयों ने निर्वाचन आयोग द्वारा सम्यव्‌फ सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है अथवा उनके द्वारा दिए गए अभ्यर्थी, यदि कोई हो पर विचार करने के पश्चात्‌ निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं हैऋ

अतः अब, निर्वाचन आयोग उक्त अध्निियम की धरा 10-क के अनुसरण में नीचे की सारणी के स्तम्भ ;4द्ध में विनिदष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद्‌ के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए एतद्‌द्वारा निरहत घोषित करता है :—
