यद्यपि प्रतिभूति संविदा (विनियम ) अधिनियम , 1956 की धारा 10 ( 4 ) के तहत किसी भी उपविधि में किया जाने वाला संशोधन या परिवर्तन इसके पूर्ववर्ती प्रकाशन में दी गई शर्तों के अनुसार किया जाएगा।
इसलिए अब यह एक्सचेंज इसके साथ इस एक्सचेंज की नियमावली, उपविधि और विनियमावली के उपनियम 252 (2) में संशोधन प्रकाशित करता है ।

मामला दायर करने के लिए परिसीमा अवधि
(2) पंचनिर्णय द्वारा किसी ऐसे दावे , शिकायत, मतभेद या विवाद का तब तक संज्ञान नहीं लिया जाएगा, जबतक कि यह इस एक्सचेंज या भारतीय प्रतिभूति और विनिमय बोर्ड के संबंधित क्षेत्रीय पंचनिर्णय केन्द्र द्वारा विवादित सौदे (दों) के निष्पादन की तिमाही समाप्त होने के छह माह के भीतर , दोनों में से जो भी पहले हो , प्रस्तुत नहीं किया गया हो। कोई दावा, शिकायत , मतभेद या विवाद इस उपबंध के दायरे में आता है या नहीं इस विवाद का निर्णय पंचनिर्णायकों द्वारा किया जाएगा ।
यह प्रावधान किया जाता है कि इस एक्सचेंज के निदेशक बोर्ड या प्रबन्ध निदेशक या मुख्य कार्यपालक अधिकारी द्वारा समय समय पर प्रत्येक क्षेत्रीय पंचनिर्णय केन्द्र के लिए अलग से निवेशक शिकायत निवारण(आइजीआरसी) समिति की नियुक्ति की जा सकेगी ताकि दायर किए जाने वाले सभी दावों , शिकायतों , मतभेदों और विवादों को सर्वमान्य रूप से निपटाया जा सके ।
यह भी प्रावधान किया जाता है कि उक्त आइजीआरसी को दावे, शिकायतें , मतभेद और विवाद भेजने के बाद इन दावों , शिकायतों , मतभेदों और विवदों का सर्वमान्य निपटान करने में लगने वाले समय को परिसीमा अवधि की गणना में शामिल नहीं किया जाएगा ।
यह भी प्रावधान किया जाता है कि उपर्युक्त परंतुक 2 में उल्लिखित अपवाद सहित और पर्याप्त दस्तावेजी प्रमाण के तहत , ट्रेडिंग सदस्य से शिकायत या दावा या मतभेद या विवाद का मामला प्राप्त
होने की तारीख से एक माह की अवधि या ट्रेडिंग सदस्य द्वारा शिकायत या दावा या मलभेद या विवाद प्राप्त करने की तारीख से ट्रेडिंग सदस्य द्वारा लिए गए समय से लेकर शिकायत या दावा या मतभेद या विवाद का समाधान/प्रतिकार करने के लिए ग्राहक द्वारा ट्रेडिंग सदस्य से अंतिम पत्राचार प्राप्त होने की तारीख , जो भी पहले समाप्त हो , को भी इसमें शामिल नहीं किया जाएगा ।
यह भी प्रावधान किया जाता है कि परिसीमन की अवधि को अधिकतम तीन माह के लिए बढ़ाया जा सकेगा, यदि प्रस्तुत किए गए दस्तावेजी प्रमाणों और कारणों के आधार पर पंचनिर्णायक न्यायाधिकरण संतुष्ट हो कि बताए गए कारण संबंधित पक्ष के नियंत्रण से बाहर थे, जिससे परिसीमन अवधि के भीतर पंचनिर्णय हेतु मामला दायर नहीं हो सका और यथास्थिति अनुसार पंचनिर्णय में यह रिकार्ड किया जाएगा कि इस प्रकार सीमा बढ़ाने की अनुमति या मनाही के क्या कारण रहे। [PART IV 98

तथापि यह प्रावधान किया जाता है कि ग्राहक द्वारा विवाद को ट्रेडिंग सदस्य और इस एक्सचेंज के साथ एक ही अवधि में उठाए जाने के परिणामस्वरूप विवाद का समाधान करने में ट्रेडिंग सदस्य और एक्सचेंज द्वारा समयावधि का ओवरलैप हो सकता है तो इस उपविधि के तहत ग्राहक को उपलब्ध परिसीमन अवधि की गणना करने के लिए दोनों में से अधिक लम्बी समयावधि को शामिल नहीं किया जाएगा ।
इसके अलावा यह भी प्रावधान किया जात है कि इस उपविधि के प्रभावी होने की तारीख को या इसके बाद दायर किए गए पंचनिर्णय मामलों में यह उपविधि अनुमेय होगी।

Amendment to Bye- law 252 ( 2 ) of the Rules , Bye Laws and Regulations of the Exchange in respect of limitation period for filing of arbitration reference with the Exchange the
Whereas under Section 10(4 ) of the Securities Contracts (Regulation ) Act , 1956, making or the amendment or revision of any bye - law is subject to the conditions of its previous publication .
Now , therefore , Bombay Stock Exchange Limited (the Exchange ) , hereto publishes the amended Bye-law 252 (2) of the Rules, Bye Laws and Regulations of the Exchange .

Timeperiod for filing of arbitration reference
(2) The Arbitrators shall not take cognizance of any claim , complaint , difference or dispute unless the same has been received by the concerned Regional Arbitration Centre of the Exchange or by the Securities and Exchange Board of India , within six months from the end of the quarter during which the disputed transaction( s) were executed, Any dispute as to whether a claim , complaint , difference or dispute falis within the ambit of this clause shall be decided by the Arbitrators.
Provided that the Board of Directors of the Exchange or the Managing Director and Chief Executive Officer may, from time to time , appoint Investor Grievances Redressal Committees ( IGRCs ) , separately for each Regional Arbitration Centre to amicably settle all claims , complaints , differences and disputes that are referred to it.
Provided further that when such claims , complaints , differences and disputes are referred to the aforesaid IGRC , the time taken in amicable settlement of such claims, complaints , differences and disputes shall be excluded while computing the period of Limitation .
Provided further that , alongwith the exclusion mentioned at proviso 2 above , and subject to sufficient documentary proof, the period of one month from the date of receipt of complaint or claim or difference or dispute by the Trading Member or period taken by the Trading Member from the date of receipt of complaint or claim or difference or dispute by the Trading Member to the date of receipt of the Trading Member's last communication by the client to resolve/counter the complaint or claim or difference or dispute ; whichever ends earlier , shall also be excluded.
Provided further, that the limitation period shall be extendable further subject to a maximum period of three months , if the Arbitral Tribunal , on the basis of reasons and documentary proofs submitted , is convinced that the reasons were beyond the control of the party concerned for not filing arbitration reference within the limitation period and it records in the award , the reasons considered for granting or denying such extension , as the case may be .
Provided however that in the event of the Client pursuing the dispute concurrently with the Trading Member and the Exchange , resulting in an overlap of the durations taken by the Trading Member and the Exchange in redressing the dispute, the longer of the two durations shall be excluded from computation of the period of limitation available to the Client under this Bye - Law.

Provided further that this Bye -law shall be applicable in respect of all Arbitration Cases filed on or after the date when this Bye - Law comes into effect .
