3. केन्द्रीय प्रशासनिक अधिकरण ( कैट ) , की प्रधान पीठ, नई दिल्ली ने अपने दिनांक 17.3.2010 के आदेश द्वारा श्री शैलेश सिंह द्वारा दायर 2009 के ओ.ए. सं . 2806 को अब रद्द कर दिया है । चूंकि यह निराधार है और उक्त ओ.ए. 3. उपर्युक्त चयन सूचियों में शामिल अधिकारियों की नियुक्ति, अनुमोदित सेवा के उद्देश्य के लिए और कल्पित आधार पर अवर सचिव के नाते उनके वेतन के निर्धारण के लिए, चयन सूची वर्ष के समरूप 01 जुलाई से प्रभावी हुई मानी जाएगी । तथापि, वास्तविक भत्ते उसी तारीख से देय होंगे जिस तारीख को अधिकारियों की केन्द्रीय सचिवालय सेवा संवर्ग के अवर सचिव ग्रेड में नियुक्ति हुई है और उन्होंने पद पर कार्यभार संभाला है।
4. अधिकारी , अपने वेतन के पुनः निर्धारण के कारण बकाया लेने के हकदार उन्हीं तारीखों से होंगे जब से उनकी अवर सचिव के पद पर वास्तव में नियुक्तियां हुई हैं । इसके अतिरिक्त, ये अधिकारी अपने वेतन का निर्धारण वर्तमान वेतन नियम के प्रावधानों के अनुसार करवाने का विकल्प चुनने के हकदार भी होंगे । तथापि, ऐसे अधिकारी , जिन्हें चयन सूची वर्ष में शामिल किए जाने के 01 जुलाई से पहले तदर्थ आधार पर अवर सचिव प्रोन्नत किया गया था और सिप्लिट ओप्शन का लाभ ले चुके थे, इस विकल्प को पुनः चुनने के पात्र नहीं होंगे।

2. Shri Shailesh Singh had filed an OA No. 2806/2009 in the Central Administrative Tribunal ( CAT) , Principal Bench , New Delhi , seeking relief of quashing the order dated 25.09.2009 . The CAT, vide its Order dated 7.10.2009 , had stayed the operation of the impugned order. Thereafter, Shri Shailesh Singh was re-appointed as Joint DGFT, Mumbai , vide DGFT Notification No. 14/2009 dated 28.10.2009, till further orders . Shri Shailesh Singh had again assumed the charge as Zonal Joint DGFT, Mumbai .
3. The Principal Bench of CAT, New Delhi has now dismissed the OA No. 2806 of 2009 filed by Shri Shailesh Singh , vide its Order dated 17.3.2010 , being bereft of merits , and also vacated the stay order in the said OA ( vide which the repatriation of Shri Shailesh Singh to his parent Ministry, i.e. , the Ministry of Home Affairs had been stayed ) .
2. The seniority of the officers included in the aforesaid Select List, will be in the same order in which their names have been arranged, irrespective of actual dates of their appointment to the Grade - I . The appointment of officers included in the aforesaid Select List to the Grade of Under Secretary on regular basis , shall be subject to the final outcome in the CWP No. 13352/2005 in the High Court of Delhi ; OA No. 3294/2009 titled Shri P.R. Sharma Vs UOI in CAT, New Delhi ; and OA No. 2674/2009 titled Shri P. S. Bhandari Vs UOI & ors .
4. As the Hon'ble CAT has vacated the stay order and dismissed the OA No. 2806 of 2009 , the Office of DGFT, in pursuance of the DOP& T OM No. 10/ 16/2007 - EO ( MM - II) dated 23rd September, 2009, has issued the Office Order No. 27/2010 dated 22.3.2010 relieving Shri Shailesh Singh , Zonal Joint DGFT, Mumbai and directed him to report to hisparent cadre , i.e. , Ministry of Home Affairs , New Delhi with immediate effect . Vide the same Office Order , Smt . Lata Shukla, Joint DGFT, Mumbai has been nominated as Zonal Joint DGFT, Mumbai with immediate effect , until further orders.
3. The appointment of the officers included in the aforesaid Select Lists may be deemed to have been made effective from the 1st July of the corresponding Select List year, for the purpose of approved service and for fixing their pay as Under Secretary on notional basis . The actual benefits however would be available only from the date, officers are so appointed to the grade of Under Secretary of CSS and assume charge of the post .
