सा.का.नि. 82. भारत के माननीय उच्चतम न्यायालय द्वारा विशाखा बनाम राजस्थान राज्य - ए.आई.आर. 1997 एस.सी. 3011 मामले में दिए गए निर्णय में न्यायालय के आदेशों के अनुसरण में , लोक सभा अध्यक्ष ने आदेश दिया है कि लोक सभा सचिवालय की महिला कर्मचारियों की कार्यस्थल पर यौन उत्पीड़न संबंधी शिकायतों के निवारण हेतु सचिवालय में एक शिकायत निवारण समिति होगी । 2. शिकायत निवारण समिति की सभापति कोई महिला होगी , जो लोक सभा सचिवालय की कोई महिला अधिकारी अथवा इस क्षेत्र में कार्यरत किसी प्रतिष्ठित गैर - सरकारी संगठन की कोई महिला सदस्य होगी , जैसाकि लोक सभा अध्यक्ष समय - समय पर विनिश्चित

करेगा । भारत सरकार की कोई वरिष्ठ सेवारत अथवा सेवानिवृत्त महिला अधिकारी भी इस पद हेतु पात्र होगी ।
3. शिकायत निवारण समिति की सभापति और सदस्यों का कार्यकाल एक वर्ष का होगा ।
4. लोक सभा अध्यक्ष द्वारा शिकायत निवारण समिति का हर वर्ष पुनर्गठन किया जाएगा ।
होंगे :- 5. शिकायत निवारण समिति के निदेश- पद इस प्रकार (एक ) लोक सभा सचिवालय की महिला कर्मचारियों की कार्यस्थल पर यौन उत्पीड़न संबंधी शिकायतों/ आरोपों की जाँच करना;
(दो ) शिकायतों के निवारण तथा यौन उत्पीड़न की रोक - थाम हेतु उपयुक्त उपायों का सुझाव देना;

(तीन ) यह सुनिश्चित करना की कार्यस्थल पर यौन उत्पीड़न संबंधी शिकायतों की सुनवाई के समय पीड़ित महिलाओं या साक्षियों का उत्पीड़न न हो अथवा उनके साथ पक्षपात न हो । लोक सभा सचिवालय में यौन उत्पीड़न की शिकार महिलाओं को उत्पीड़क के स्थानांतरण अथवा स्वयं के स्थानांतरण की मांग करने का विकल्प होगा;
( चार ) यह सुनिश्चित करना कि यौन उत्पीड़न की रोक - थाम के संबंध में उच्चतम न्यायालय द्वारा अधिकथित दिशानिर्देशों का लोक सभा सचिवालय में अनुपालन हो; और
( पांच ) कोई मामला विद्यमान न होने पर भी तिमाही बैठक करना और विशाखा मामले में निर्णय की सभी अपेक्षाओं को पूरा करने हेतु की गई तैयारी की समीक्षा करना । 6. लोक सभा सचिवालय द्वारा दिनांक 26-12-1997 के आर. एण्ड सी.एस. आदेश सं . पीडीए 945/97 द्वारा यथाअंगीकृत तथा समय - समय पर यथासंशोधित , केंद्रीय लोक सेवाएँ ( वर्गीकरण , नियंत्रण और अपील ) नियम , 1965 के प्रयोजनार्थ शिकायत निवारण समिति को जाँच प्राधिकरण माना जाएगा ; तथा वह इन नियमों में अधिकथित प्रक्रियाओं के अनुसार यथाव्यवहार्य जाँच करेगी ।

G.S.R. 82. In pursuance of the orders of the Hon'ble Supreme Court of India in its judgement given in the case of Vishaka v . State of Rajasthan- AIR 1997 SC 3011 , the Speaker is pleased to order that there shall be a Complaints Committee in the Lok Sabha Secretariat for redressal of complaints of sexual harassment of women employees of the Secretariat at workplace .
2. The Chairperson of the Complaints Committee will be a woman , either a woman officer of the Lok Sabha Secretariat or a woman member of a reputed NGO working in this field , as decided from time to time by the Speaker . Even a senior serving or retired woman officer of Government of India will be eligible .
3. The term of Members of the Complaints Committee including the Chairperson will be one year .
4. The Complaints Committee will be reconstituted by the Speaker every year .
5. The terms of reference of the Complaints Committee will be as under :.
(i) To examine complaints / allegations of sexual harassment of women employees of the Lok Sabha Secretariat workplace ;
[ PART II - SIC . 3 (i ) ] (ii) recommend appropriate measures for redressal of grievances and prevention of sexual harassment;
(iii) to ensure that victims or witnesses are not victimized or discriminated against while dealing with complaints of sexual harassment at the workplace . The victims of sexual harassment in Lok Sabha Secretariat should have the option to seek transfer of the perpetrator or their own transfer;
( iv) to ensure that the guidelines laid down by the Supreme Court on prevention of sexual harassment are being followed in the Lok Sabha Secretariat ; and
(v) to meet once in a quarter even if there are no live cases and review the preparedness to fulfill all requirements of the Vishaka Case Judgement;
6. The Complaints Committee shall be deemed to be the Inquiring Authority for the purpose of Central Civil Services ( Classification , Control and Appeal ) Rules , 1965 as duly adopted by the Lok Sabha Secretariat vide R & CS Order No.PDA 945/97 dated 26-12-1997 and as amended from time to time ; and shall hold the inquiry as far as practicable in accordance with the procedures laid down in these Rules .

3. शिकायत निवारण समिति के निदेश पद और उसका कार्यकरण दिनांक 22-4-2010 की अधिसूचना सं. एफ.7 /52 / 2009 /एएन -1 ( डीएम एंड सीसी ) /जीएन-6413/ 2010 में अंतर्विष्ट उपबंधों द्वारा शासित होंगे ।
4. वर्तमान समिति केवल अपर निदेशक और उनके समकक्ष स्तर तक के अधिकारियों के मामलों पर ही विचार करेगी । 5. यह आदेश तत्काल प्रभाव से लागू होगा ।

4. The present Committee will deal with the cases only up to the level of Additional Director and equivalent .

संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम तकनीकी लिपिक (आर्थिक ) भर्ती ( संशोधन ) नियम , 2010 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. अर्थ एवं सांख्यिकी निदेशालय , तकनीकी लिपिक ( आर्थिक ) भर्ती नियम , 2008 की अनुसूची के स्तंभ ( 4 ) में स्तंभ , शीर्षक और उससे संबंधित प्रविष्टियों के सथान पर निम्नलिखित रखी जाएगी , अर्थात्:-

G.S.R. 84. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Directorate ofEconomics and Statistics , Technical Clerk ( Economics ) Recruitment Rules , 2008 , namely :-
1. ( 1 ) These rules may be called the Technical Clerk (Economics ) Recruitment ( Amendment) Rules , 2010 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Schedule to the Directorate of Economics and Statistics Technical Clerk ( Economics ) Recruitment Rules , 2008 , in column (4 ) , for the column heading and entries thereunder the following shall be substituted namely :-
" Pay Band and Grade Pay /Pay Scale

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मत्स्य, नौचालन और इंजीनियरी प्रशिक्षण संस्थान , कोचीन , ज्येष्ठ अनुदेशक ( मत्स्य जीव विज्ञान ) भर्ती ( संशोधन ) नियम , 2010 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. अनुसूची का संशोधन. केन्द्रीय मत्स्य, नौचालन और इंजीनियरी प्रशिक्षण संस्थान , कोचीन , ज्येष्ठ अनुदेशक ( मीन उद्योग जीव विज्ञान ) भर्ती नियम , 2009 की अनुसूची में, -
( क ) स्तंभ संख्या 7 , के पैरा 2 में " अंदमान और निकोबार द्वीप समूह और लक्षद्वीप " , शब्दों के स्थान पर " अंदमान और निकोबार द्वीप अथवा लक्षद्वीप ' शब्द रखे जाएंगे । ( ख ) स्तंभ संख्या 8 में , आवश्यक उपशीर्ष आवश्यक के अधीन मद ( ii ) में अथवा स्वायत्त या अन्य प्रतिष्ठित संस्थान शब्दों के स्थान पर " अथवा स्वायत्त संगठन " शब्द रखे जाएंगे ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules to amend the Central Institute of Fisheries , Nautical and Engineering Training , Cochin , Senior Instructor ( Fishing Biology ) Recruitment Rules , 2009 , namely :-
1. ( 1 ) Short title and commencement.- These rules may be called the Central Institute of Fisheries , Nautical and Engineering Training , Cochin , Senior Instructor (Fishing Biology ) Recruitment ( Amendment ) Rules, 2010 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Amendment of Schedule . In the Central Institute of Fisheries , Nautical and Engineering , Cochin , Senior Instructor ( Fishery Biology ) Recruitment Rules , 2009 , in the Schedule ,-
(a) in column No.7 , in para 2 , for the words " Andaman and Nicobar Islands and Lakshadweep " , the words " Andaman and Nicobar Islands or Lakshadweep " shall be substituted .
(b) in column No. ( 8 ) , under sub - heading Essential , in item ( ii ) for the words " or Autonomous or other reputed institutions " the words " or Autonomous bodies ". shall be substituted .
