सा.का.नि. 97.-संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा नागर विमानन एवं पर्यटन मंत्रालय (नागर विमानन विभाग ) (नागर विमानन सुरक्षा ब्यूरो ) सुरक्षा उपायुक्त भर्ती नियम, 1994 के अधिक्रमण में , सिवाय उन कार्यों के जो ऐसे अधिक्रमण से पूर्व किए गए अथवा अधिक्रमण किए जाने हेतु हैं , राष्ट्रपति एतद्वारा नागर विमानन मंत्रालय के नागर विमानन सुरक्षा ब्यूरो में सुरक्षा उपायुक्त ( नागर विमानन ) के पद की भर्ती की प्रणाली को विनियमित करते हेतु निम्नलिखित नियम बनाते हैं :-
1. संक्षिप्त शीर्षक और प्रारंभ. ( 1 ) इन नियमों को नागर विमानन मंत्रालय , नागर विमानन सुरक्षा ब्यूरो , सुरक्षा उपायुक्त ( नागर विमानन ) भर्ती नियम , 2010 कहा जाएगा ।
(2 ) ये नियम सरकारी राजपत्र में उनके प्रकाशित होने की तारीख से लागू होंगे ।
2. पद संख्या, वर्गीकरण तथा पे बैंड एवं ग्रेड पे या वेतनमान. पदों की संख्या , इसका वर्गीकरण तथा इससे सम्बद्ध पे बैंड एवं ग्रेड पे या वेतनमान इन नियमों के लिए संलग्न अनुसूची के कॉलम (2 ) से ( 4 ) में उल्लिखित अनुसार होंगे ।
3. भर्ती की प्रणाली , आयु-सीमा , अन्य अर्हताएं आदि. उक्त पद की भर्ती की प्रणाली , आयु- सीमा ,अर्हताएं तथा इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम ( 5 ) से ( 14 ) में उल्लिखित अनुसार होंगे ।
4. अयोग्यताएं.-ऐसा कोई व्यक्ति,
( क) जिसने ऐसे व्यक्ति , जिसका पति/पत्नी जीवित हो , के साथ विवाह या विवाह का करार किया हो; अथवा ( ख ) जिसने जीवित पति/पत्नी के होते हुए विवाह किया हो या विवाह का करार किया हो,
उक्त पद के लिए नियुक्ति का पात्र होगाः
बशर्ते कि केन्द्र सरकार यदि ऐसे विवाह को उक्त व्यक्ति तथा विवाह के दूसरे पक्ष पर लागू पर्सनल लॉ के अंतर्गत अनुमति योग्य मानती हो तथा यह कि ऐसा करने के लिए वहां अन्य आधार हों , जिनसे किसी व्यक्ति को इस नियम के प्रभाव से मुक्त रखा जा सके । 5. छूट की शक्ति . जहां केन्द्र सरकार की राय यह हो कि ऐसा करना आवश्यक अथवा व्यावहारिक है , इन नियमों के किसी श्रेणी या व्यक्तियों के वर्ग से संबंधित प्रावधानों में कोई छूट लिखित रूप में रिकार्ड किए जाने वाले कारणों की वजह से, आदेश द्वारा अथवा संघ लोक सेवा आयोग से परामर्श करके दी जा सकती है ।
6. अपबाद.- केन्द्र सरकार द्वारा समय -समय पर इस संबंध में जारी आदेशों और उद्देश्यों के अनुसार अनुसूचित जातियों , अनुसूचित जन- जातियों , पूर्व सैनिकों तथा अन्य विशेष श्रेणियों से संबंधित व्यक्तियों को दिए जाने वाले आरक्षण, आयु सीमा में छूट तथा अन्य अपेक्षित छूटों को ये नियम प्रभावित नहीं करेंगे ।

नोट : पदोन्नति के लिए न्यूनतम पात्रता सेवा की गणना के लिए 1 जनवरी , 2006 की तारीख , जिस तारीख से छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर संशोधित वेतन ढांचे को लागू किया गया है , से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा को अनुवर्ती वेतनमान में की गई सेवा या वेतन आयोग की सिफारिशों के आधार पर प्रदान किये गये वेतनमान में की गई सेवा माना जाएगा ।

(क) 1. प्रमुख संवर्ग या विभाग में नियमित आधार पर समकक्ष पद धारण किये हुए हो; या
2. प्रमुख संवर्ग या विभाग में पे बैण्ड 3 (15,600:39,100/- रुपये ) तथा ग्रेड पे 5400/ - रुपए या समकक्ष में नियमित आधार पर नियुक्तिके पश्चात् उस ग्रेड में 5 वर्ष की नियमित सेवा; और
(ख) निम्नलिखित योग्यताएं एवं अनुभव प्राप्त हो
(i ) मान्यताप्राप्त विश्वविद्यालय से डिग्री
( ii ) संरक्षा/आसूचना के क्षेत्र में 5 वर्ष काअनुभव
नोट 1 : फीडर श्रेणी में विभागीय अधिकारी जो पदोन्नति की प्रत्यक्ष लाइन में हैं , वे प्रतिनियुक्ति पर नियुक्त होने के पात्र नहीं है । इसी प्रकार प्रतिनियुक्तिधारी पदोन्नति द्वारा नियुक्तिके लिए विचार किये जाने हेतु पात्र नहीं है । केन्द्र सरकार के समान या किसी अन्य संगठन या विभाग में इस नियुक्ति से तत्कालपूर्व धारित अन्य बाह्य संवर्ग पद में प्रतिनियुक्ति की अवधि सहित प्रतिनियुक्ति सामान्यतः 3 वर्ष से अधिक नहीं होनी चाहिए । प्रतिनियुक्ति द्वारा नियुक्ति के लिए सर्वाधिक आयु सीमा आवेदन प्राप्ति की अंतिम तारीख को 56 वर्ष से अधिक नहीं होनी चाहिए । नोट 2 : प्रतिनियुक्ति या आमेलन आधार पर नियुक्ति के लिए न्यूनतम पात्रता सेवा की गणना के लिए । जनवरी , 2006 की तारीख , जिस तारीख से छठे केन्द्रीय वेतन आयोग की सिफारिशों के आधार पर संशोधित वेतन ढांचे को लागू किया गया है, से पूर्व अधिकारी द्वारा नियमित आधार पर की गई सेवा को अनुवर्ती वेतनमान में की गई सेवा या वेतन आयोग की सिफारिशों के आधार पर प्रदान किये गये वेतनमान में की गई सेवा माना जाएगा । बशर्ते , जहां समान ग्रेड पे या वेतनमान सहित एक से अधिक पूर्व संशोधित वेतनमानों का विलय किया गया हो , और जहां यह लाभ केवल उन पदों को प्रदान किया गया , जिनके लिए वह ग्रेड पे या वेतनमान किसी स्तरोन्नयन के बिना केवल सामान्य प्रतिस्थापन ग्रेड हो ।

MINISTRY OF CIVIL AVIATION
New Delhi , the 2nd June, 2010
G.S.R. 97.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession oftheMinistry of Civil Aviation and Tourism ( Department of Civil Aviation) (Bureau of Civil Aviation Security ) Deputy Commissioner of Security Recruitment Rules , 1994, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Commissioner of Security (Civil Aviation) in the Ministry of Civil Aviation Security (Bureau of Civil Aviation Security), namely:-
1. Short title and commencement.( 1) These rules may be called the Ministry of Civil Aviation (Burau ofCivil Aviation Security) Deputy Commissioner of Security (Civil Aviation) , Recrutiment Rules, 2010.
(2) They shall come into force on the date of their publication in the Official Gazette .
2.Number ofposts classification and Pay Band and Grade Pay or Pay Scale. The number ofposts , its classification and the Pay Band and Grade Pay or Pay Scale attached thereto , shall be as specified in columns (2) to (4 ) of the Schedule annexed to these rules .
3.Method of recruitment, age limit , other qualifications etc .. The method of recruitment to the said post , age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule.
4. Disqulificcation.- No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or,
(b) who, having a spouse living , has entered into or contracted a marriage with any person ,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .
6. Savings . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for persons belonging to the Scheduled Castes or the Scheduled Tribes , the Ex- servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Deputation or absorption :
Officers ofthe Central Government or State Government or Union- Territory Administration or Central Police Organisation:
(a) (i) holding analogous post on regular basis in the parent cadre or department; or
(ii) with five years service in the grade rendered after appointment thereto on a regular basis in the PayBand-3 (Rs. 15,600-39,100) with GradePay of Rs . 5400 or equivalent in the parent cadre or department; and
(b) possessing the following qualifications and experience ;
(i) Degree from a recognized university.
(ii) Five years experience in security/ intelligence
Note- 1 : The departmental officers in the feeder category who are in thedirect line ofpromotion shall not be eligible for consideration for appointment on deputation .
Similarly, deputationist shall not be eligible for consideration for appointment by promotion. Period of deputation including period of deputation in another ex - cadre post held immediately preceeding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.
Note - 2: For the purpose of appointment on deputation or absorption basis , the service rendered on a regular basis by an officer prior to 1st January, 2006 (date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended) shall be deemed to be service rendered in the 426

corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation .
