भारतीय बीमांकक संस्थान परिषद्, केंद्रीय सरकार के पूर्व अनुमोदन से, बीमांकक अधिनियम, 2006 (2006 का 35 ) की धारा 56 की उपधारा (2) के खंड (ट) , खंड ( ठ) और खंड (ड) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित विनियम बनाती है, अर्थात्--

1. संक्षिप्त नाम और प्रारंभ--

( 1) इन विनियमों का संक्षिप्त नाम भारतीय बीमांकक संस्थान ( रजिस्टर का रखरखाव, सूची का प्रकाशन और रजिस्टर में सदस्योंके नामों की पुनः प्रविष्टि) विनियम, 2010 है ।

सं. एम-19012/03/2008-बीमा- III-निम्नलिखित प्रारूप विनियम, जिसका भारतीय बीमांकक संस्थान परिषद्, केंद्रीय सरकार के पूर्व अनुमोदन से प्रस्ताव करती है, बीमांकक अधिनियम, 2006 (2006 का 35 ) की धारा 56 की उपधारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है, जिनके उससे प्रभावित होने की संभावना है; और यह सूचना दी जाती है कि उक्त प्रारूप विनियम पर, उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, पैंतालीस दिन की समाप्ति के पश्चात् विचार किया जाएगा;

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं--

(1) इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो,-- आक्षेप या सुझाव, महासचिव, भारतीय बीमांकक संस्थान परिषद्, 302 , इन्डियन ग्लोब चैम्बर्स, 142 , फोर्ट स्ट्रीट, मुम्बई-400001 को भेजे जा सकेंगे;

(क) " अधिनियम" से बीमांकक अधिनियम, 2006 ( 2006 का 35) अभिप्रेत है;

(ख) " परिषद् से संस्थान की परिषद् अभिप्रेत है;

ऐसे आक्षेपों या सुझावों पर, जो उक्त प्रारूप विनियम की बाबत किसी व्यक्ति से, उक्त अवधि की समाप्ति के पूर्व प्राप्त किए जा सकेंगे, भारतीय बीमांकक संस्थान परिषद् द्वारा विचार किया जाएगा ।

(ग) " प्रारूप " से इन विनियमों से संलग्न प्रारूप अभिप्रेत है; 1-179 GI/2010

(क) सदस्य का नाम

(ख) सदस्य की अर्हता

(घ) "संस्थान " से अधिनियम की धारा 3 के अधीन गठित भारतीय बीमांकक संस्थान अभिप्रेत है;

(ग ) सदस्यता प्रास्थिति ( अध्येता या अवैतनिक अध्येता या सहयुक्त)

(घ ) सदस्यता प्रास्थिति प्राप्त करने का वर्ष

(ङ) " सदस्यों की सूची " से इन विनियमों के अधीन प्रत्येक वर्ष की 1 अप्रैल को संस्थान द्वारा प्रकाशित सदस्यों की सूची अभिप्रेत है;

(ङ) सदस्यता संख्या

(च) " रजिस्टर" से संस्था द्वारा पोषित सदस्यों का रजिस्टर अभिप्रेत है।

(च) अभिलेख पर यथा विद्यमान पत्र व्यवहार का पता और संपर्क ब्यौरे (जिनके अंतर्गत टेलीफोन और मोबाइल नंबर तथा ई- मेल आईडी भी है)

(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त किए गए हैं और जिन्हें परिभाषित नहीं किया गया है, परंतु अधिनियम में परिभाषित हैं, क्रमशः वही अर्थ होंगे जो उनके अधिनियम में हैं ।

3. रजिस्टर में प्रविष्टि:--

(4) यदि कोई सदस्य, सदस्यों की सूची की प्रति के लिए लिखित में अनुरोध करता है तो वह उसे दो हजार पांच सौ रुपए से अनधिक ऐसी रकम , को परिषद्द्वारा समय- समय पर अवधारित की जाए, के संदाय पर उपलब्ध कराईजाएगी।

(1) अधिनियम की धारा 3 की उपधारा ( 1 ) के उपबंधों के अधीन रहते हुए उसमें निर्दिष्ट व्यक्तियों के नाम रजिस्टर में प्रविष्ट किए जाएंगे ।

(5 ) सदस्योंकी सूची की एक प्रति लिखित में अनुरोध प्राप्त होने पर दो सौपचास रुपए से अनधिक की ऐसी रकम , जो परिषद् द्वारा समय - समय पर अवधारित की जाए, के संदाय पर डिस्केट की फ्लापी में सदस्यों को उपलब्ध कराई जाएगी ।

(2 ) कोई व्यक्ति अधिनियम की धारा 6 के अधीन अधिकथित अपनी पात्रता पूरी करने और अन्य शर्तों तथा इस निमित्त संस्थान द्वारा तदधीन बनाए गए विनियमों के अधीन रहते हुए रजिस्टर में अपना नाम प्रविष्ट करवाने के लिए हकदार होगा ।

5. वार्षिक सदस्यता फीस: --

4. रजिस्टर का रखरखाव: --

( 1 ) परिषद् प्ररूप में संस्थान के सदस्यों का एक रजिस्टर रखेगा ।

सदस्यों द्वारा संदेय वार्षिक सदस्यता फीस प्रतिवर्ष दस हजार रुपए से अनधिक की ऐसी रकम होगी जो परिषद् द्वारा समय- समय पर अवधारित कीजाए:

(2) रजिस्टर में अधिनियम की धारा 23 की उपधारा ( 2 ) में निर्दिष्ट संस्थान के प्रत्येक सदस्य की विशिष्टियां सम्मिलित होंगी ।

परंतु ऐसे सदस्योंद्वारा , जिनका रजिस्टर में पत्र व्यवहार का पता भारत से बाहर का है , संदेय वार्षिक सदस्यता फीस संयुक्त राज्य के चार सौ डालर प्रतिवर्ष से अनधिक की ऐसी रकम होगी जो परिषद् द्वारा समय - समय पर अवधारित कीजाए।

6. सदस्यों के नाम में पुनः प्रविष्टि:--

(3 ) रजिस्टर साफ्ट प्ररूप में अंकीय रूप से रखा जाएगा जिसमें रजिस्टर में भंडारित आंकड़ों और विशिष्टियों की संरक्षा के लिए और परिषद् के समाधानप्रद रूप में उसमें अंतर्विष्ट जानकारी के उचित अद्यतन, भंडारण तथा सुधार के लिए पर्याप्त अंतनिर्मित सुरक्षा विशेषताएं होंगी ।

( 1 ) परिषद् आदेश द्वारा , किसी ऐसे सदस्य का नाम पुनःप्रविष्ट कर सकेगी जिसका नाम इस विनियम में विनिर्दिष्ट शर्तों और अपेक्षाओं का पूरा होने के पश्चात् अधिनियम की धारा 24 के खंड ( ख ) , ( ग ) , ( घ ) और (ङ) में निर्दिष्ट किसी आधार पर, कारणवश रजिस्टर से हटा दिया गया है । (4) रजिस्टर को समय - समय पर अद्यतन किया जाएगा जिससे उसमें सदस्योंके पते, टेलीफोन नम्बर, ई- मेल पहचान में परिवर्तन तथा रजिस्टर मेंअंतर्विष्ट सदस्यों की बाबत ऐसी अन्य जानकारी को परिलक्षित किया जा सके।

(2) परिषद्किसी ऐसे सदस्य का, जिसका नाम रजिस्टर से हटाया गया है, यदि वह उप विनियम ( 3 ) में विनिर्दिष्ट फीस के संदाय पर रजिस्टर में अपना नाम प्रविष्ट करने के लिए अन्यथा पात्र है, तो ऐसे सदस्य से लिखित में आवेदन पर उसका नाम पुनः प्रविष्ट कर सकेगी । (5) सदस्य, संस्थान को रजिस्टर में अंतर्विष्ट अपनी विशिष्टियों के किसी भी परिवर्तन को सूचित करेगा और ऐसी जानकारी की प्राप्ति पर, परिषद् ऐसी सूचना की प्राप्ति की तारीख से दो मास की अवधि के भीतर रजिस्टर की विशिष्टियों को अद्यतन कराएगी ।

परंतु किसी परिवर्तन को अद्यतन करने में हुई कोई आकस्मिक या अवधानता , कोई त्रुटि या चूक रजिस्टर को अविधिमान्य नहीं करेगी ।

5. सदस्यों की सूची का प्रकाशन:--

परंतु परिषद् , उसकी दशा में , जहां किसी सदस्य का नाम अधिनियम की धारा 24 के खंड ( ग ) के अधीन हटाया था, वहां उसी वर्ष में जिसमें नाम हटाया गया था, सभी बाबत संपूर्ण आवेदन प्राप्त होने पर रजिस्टर में ऐसे सदस्यका नाम उस तारीख से जिसको, उसे हटाया गया था, पुनः प्रविष्ट कर सकेगी ।

( 1 ) परिषद्, प्रत्येक वर्ष आगामी 30 जून को या उसके पूर्व 1 अप्रैल को यथाविद्यमान सदस्यों की एक सूची प्रकाशित करेगी ।

(2) सदस्यों की सूची संस्थान की वेबसाइट पर प्रकाशित की जाएगी ।

(3) पुनः प्रविष्टिके लिए संदेय फीस उस वर्ष के लिए वार्षिक अभिदाय कीरकम के बराबर होगी जिसके दौरान उसका नाम उस वर्ष के लिए जिसमें नाम हटाया गया था वार्षिक अभिदाय सहित रजिस्टर में पुनः प्रविष्ट किया गया है।

(3) सदस्यों की सूची में निम्नलिखित जानकारी अंतर्विष्ट होगी, अर्थात्: -- भाग III-खण्ड4]

7061 (4) ( क) जहां ऐसा नाम अधिनियम की धारा 11 के खंड ( क) और खंड ( घ ) के अधीन हटाया गया था वहां परिषद् रजिस्टर में नाम की पुनः प्रविष्टिके लिए आवेदन प्राप्त होने पर उस मामले को अधिनियम की धारा 26 की उपधारा ( 1 ) के अधीन गठित अनुशासनिक समिति को निर्दिष्ट करेगी ।

सं. एम-18012/03/2008- बीमा- III--निम्नलिखित प्रारूप विनियम, जिसका भारतीय बीमांकक संस्थान परिषद्, केंद्रीय सरकार के पूर्व अनुमोदन से प्रस्ताव करती है, बीमांकक अधिनियम, 2006 (2006 का 35 ) की धारा 56 की उपधारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है, जिनको उससे प्रभावित होने की संभावना है; और यह सूचना दी जाती है कि उक्त प्रारूप विनियम पर, उस तारीख से, जिसको उस राजपत्र की प्रतियां, जिसमें अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, पैंतालीस दिन की समाप्ति के पश्चात् विचार किया जाएगा;

(ख) परिषद्, खंड ( क ) में निर्दिष्ट अनुशासनिक समिति की रिपोर्ट प्राप्त होने पर यदि वह अनुशासनिक समिति द्वारा उसे सुलझा दिया जाता है और शर्तों के पूरा किए जाने पर तथा ऐसी समिति द्वारा अधिरोपित शास्ति के संदाय पर उप नियम ( 3 ) में विनिर्दिष्ट फीस के संदाय पर ऐसे सदस्य का नाम रजिस्टर में पुनः प्रविष्ट करेगी ।

आक्षेप या सुझाव, महासचिव, भारतीय बीमांकक संस्थान परिषद्, 302, इन्डियन ग्लोब चैम्बर्स, 142, फोर्ट स्ट्रीट, मुम्बई-400001 को भेजे जा सकेंगे;

ऐसे आक्षेपों या सुझावों पर, जो उक्त प्रारूप विनियम की बाबत किसी व्यक्तिसे, उक्त अवधि की समाप्ति के पूर्व प्राप्त किए जा सकेंगे, भारतीय बीमांकक संस्थान परिषद् द्वारा विचार किया जाएगा ।

4. परिषद् का विशेष अधिवेशन: --

ऐसे अधिवेशन में छोड़े गए अधूरे कार्यों से भिन्न कोई कार्य किसी स्थगित अधिवेशन में नहीं किया जाएगा ।

( 1 ) अध्यक्ष या उसकी अनुपस्थिति में उपाध्यक्ष किसी भी समय परिषद् काविशेष अधिवेशन बुला सकेगा ।

(2 ) किसी आस्थगित अधिवेशन की कोई सूचना तब तक नहीं दी जाएगी जब तक आस्थगन के लिए संकल्प द्वारा ऐसा कोई निदेश न दिया जाए ।

9. कारबार के संव्यवहार की प्रक्रिया:--

(2 ) परिषद् का विशेष अधिवेशन तत्समय परिषद् के एक चौथाई से अन्यून सदस्यों द्वारा सचिव को लिखित में भेजे गए अनुरोध पर किसी भी समय बुलाया जा सकेगा ।

( 1 ) परिषद् का कार्य सामान्यतः परिषद् के अधिवेशन में किया जाएगा । परंतु इस उपविनियम में निर्दिष्ट विशेष अधिवेशन ऐसे अनुरोध की प्राप्ति कीतारीख से पैंतालीस दिन के भीतर बुलाया जाएगा ।

(2) उपविनियम ( 1 ) में अंतर्विष्ट किसी बात के होते हुए, अध्यक्ष या उसकी अनुपस्थिति में उपाध्यक्ष समुचित मामले में, किसी प्रश्न के विनिश्चय के लिए परिषद् के सदस्यों को या सुसंगत कागजपत्रों सहित संकल्प का. परिचालन करवा सकेगा :

(3) उपविनियम (2 ) में निर्दिष्ट अनुरोध उस विचारार्थ कारबार का, जिसका विशेष अधिवेशन बुलाया जाना है, एक विवरण उपवर्णित करेगा और यह ऐसे विशेष अधिवेशन की कार्य सूची होगी ।

परंतु इस प्रकार बुलाए गए विशेष अधिवेशन में, कार्य सूची में उल्लिखित कारबारों से भिन्न कोई कारबार नहीं किया जाएगा ।

5. परिषद्के अधिवेशन की सूचना:--

परंतु यदि परिषद् के एक चौथाई सदस्य यह अपेक्षा करते हैं कि परिचालित किया गया किसी संकल्प का अधिवेशन में विनिश्चय किया जाए तो यथास्थिति अध्यक्ष या उपाध्यक्ष परिचालन से सुसंगत कागजपत्रों सहित संकल्प को वापस ले लेगा और परिषद् के अधिवेशन में संकल्प पर विचार कराएगा ।

( 1 ) अधिवेशन के समय और स्थान की सूचना परिषद् के प्रत्येक सदस्य के रजिस्ट्रीकृत पते पर या तो प्रमाणित डाक के अधीन या इलैक्ट्रोनिक रूप से डाक द्वारा ऐसे अधिवेशन की तारीख से कम से कम सात दिन पहले भेजी जाएगी और ऐसी सूचना में अधिवेशन में संव्यवहार किए जाने वाले कारबार का विवरण अंतर्विष्ट होगा ।

(3) जहां किसी प्रश्न से संबंधित संकल्प सदस्यों में परिचालित किया जाता है, वहां ऐसे संकल्प के परिचालन की तारीख से आरंभ होने वाली पंद्रह दिन से अन्यून की अवधि इस प्रश्न पर कोई विनिश्चय किए जाने पूर्व व्यपगत हो जाएगी ।

परंतु कोई विनिश्चय ऐसी अवधि की समाप्ति से पूर्व किया जा सकेगा , यदि तत्समय पदासीन परिषद् के कम से कम तीन चौथाई सदस्यों की राय कार्यालय को पहले प्राप्त हो जाती है ।

(2) परिषद्विशेष अधिवेशन से भिन्न अपने किसी अधिवेशन में , यदि परिषद् के दो तिहाई सदस्य अधिवेशन में उपस्थित हैं तो अध्यक्ष की अनुमति से कार्यसूची में वर्णित कारबार से भिन्न ऐसे कारबार पर, जिसकी परिषद्के सदस्यों को पूर्व सूचना नहीं दी गई थी, विचार कर सकेगी ।

(4) सभी सुसंगत कागजपत्रों सहित संकल्प का परिचालन परिषद् के सभी सदस्योंको या तो इलैक्ट्रोनिक ढंग से या प्रमाणित डाक के अधीन डाक द्वारा भेजा जा सकेगा ।

(3 ) परिषद् के बुलाए गए अधिवेशन में विचार किए गए किसी मद पर परिषद्के किसी विनिश्चय की विधिमान्यता को केवल इस कारण से प्रश्नगत नहीं किया जाएगा कि उक्त मद की सूचना उन सदस्यों को नहीं दी गई थी जिन्होंने उक्त अधिवेशन में भाग नहीं लिया था ।

6. बैठक का अध्यक्ष:--

(5 ) परिचालन द्वारा पारित प्रत्येक संकल्प परिषद् के सभी सदस्यों को संसूचित किया जाएगा और परिषद् के अगले अधिवेशन में नोट किया जाएगा ।

10. अधिवेशन का विनिश्चय: --

अध्यक्ष या उसकीअनुपस्थिति में उपाध्यक्ष या दोनों की अनुपस्थिति में, विद्यमान सदस्यों में से निर्वाचित सदस्य परिषद् के अधिवेशन की अध्यक्षता करेगा ।

7. बैठक की गणपूर्ति : --

परिषद् के अधिवेशन में , विनिश्चय उपस्थित सदस्यों के बहुमत से लिया जाएगा और मतों के बराबर होने की दशा में ऐसे अधिवेशन के अध्यक्ष का मत निर्णायक होगा ।

11. परिषद् के अधिवेशन का कार्यवृत्त: -- (1) परिषद्के कुल सदस्यों के एक बटा चार सदस्य परिषद् के अधिवेशन के लिए गणपूर्ति का गठन करेंगे ।

(2) यदि, अधिवेशन के लिए नियत समय से आधे घंटे के भीतर गणपूर्ति नहीं होती है तो अधिवेशन ऐसे समय, तारीख और स्थान के लिए स्थगित कर दिया जाएगा जो बैठक का अध्यक्ष नियत करे ।

( 1 ) परिषद् के प्रत्येक अधिवेशन का कार्यवृत्त सचिव द्वारा अभिलिखित कियाजाएगा, और सचिव की अनुपस्थिति में, कार्यवृत्त परिषद् के ऐसे अन्य सदस्य द्वारा , जैसा अधिवेशन के अध्यक्ष द्वारा विनिश्चय किया जाए, अभिलिखित किया जाए ।

(3 ) उपविनियम (2 ) के अधीन स्थगित अधिवेशन के लिए कोई गणपूर्ति अपेक्षित नहीं होगी ।

8. अधिवेशन का स्थगन:--

(2) ऐसे अधिवेशन का कार्यवृत्त सदस्यों द्वारा अनुमोदित किए जाने और अगले अधिवेशन के अध्यक्ष द्वारा हस्ताक्षरित किए जाने के पश्चात् अधिवेशन की कार्यवाहियों का पर्याप्त साक्ष्य होगा ।

3. Entry in the Register :-

(1) Subject to the provisions of Sub- section ( 1 ) of Section 3 of the Act, the names of persons referred therein shall be entered in the register.

(2) A person shall be entitled to have his name entered in the register subject to his fulfilling the eligibility and other conditions laid down under Section 6 of the Act and regulations made thereunder by the Institute in this behalf.

4. Maintenance of the Register :-

No. M - 19012/03/2008 - Ins.III- The following draft regulation which the Council of the Institute of Actuaries of India, proposes with the previous approval of the Central Government is hereby published as required under sub- section (1 ) of Section 56 of the Actuaries Act , 2006 ( 35 of 2006), for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulation will be taken into consideration after the expiry of the forty- five days from the date on which the Official Gazette in which the notification is published are made available to the public;

(1) The Council shall maintain a register of the members of the Institute in the Form .

Objections or suggestions may be forwarded to the Secretary General , Council of the Institute of Actuaries of India , 302, Indian Globe Chambers , 142 , Fort Street, Mumbai-400001 .

(2) The register shall include the particulars of every member of the Institute referred to in Sub - section (2) of Section 23 of the Act .

Objections or suggestions which may be received from any person in respect of the said draft regulation before the expiry of the said period, will be taken into consideration by the Council of the Institute of Actuaries of India .

DRAFT REGULATION

(3) The register shall be maintained digitally in soft form with adequate in built safety features for the protection of the data and particulars stored in the register and for proper updation, storage and retrieval of information contained therein to the satisfaction of the Council.

(4) The Register shall be updated from time to time so as to reflect therein the changes of postal address , telephone number, e -mail identity of the members and such other information in respect of members contained in the register.

In exercise of the powers conferred by clauses (k) , (1 ) and (m) of Sub- section (2) of Section 56 of the Actuaries Act, 2006 (35 of 2006) , the Council of the Institute ofActuaries of India, with the previous approval of the Central Government, hereby makes the following regulations , namely:---

1. Short Title and Commencement :--

(5) Amember shall inform the Institute any change of his particulars contained in the register and on receipt of such information, the Council shall cause the updation of particulars in the register within a period of two months from the date of receipt of such information;

(1) These regulations may be called the Institute of Actuaries of India (Maintenance of Register, Publication of List, and Re-entry of names in Register, of Members) Regulations , 2010.

Provided that any accidental or inadvertent error or omission to update any change shall not invalidate the register.

5. Publication of List of Members :----

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions :-

(1) The Council shall publish , each year , a list of members as on the 1st day of April , on or before the following 30th day of June .

(1) In these regulations , unless the context otherwise requires,-

(a) "Act " means the Actuaries Act, 2006 (35 of 2006) ;

(2) The list of members shall be published on the website of the Institute .

(b) "Council " means the Council of the Institute;

(3) The list of members shall contain the following information, namely:---

(a) Name of member

(b) Qualification of member (d)." Institute " means the Institute of Actuaries of India constituted under Section 3 of the Act;

(e) "List of members " means the list of members published by the Institute as on the 1st day of April of each year under these Regulations;

(d) Year of attaining the membership status

(f) "Register " means the register of the members maintained by the Institute .

(2) A special meeting of the Council may at any time be called at the request in writing addressed to the Secretary by not less than one- fourth of the members of the Council for the time being:

Provided that a special meeting referred to in this Sub- regulation shall be called within forty- five days of the date of the receipt of the such request.

Government is hereby published as required under Sub- section ( 1 ) of Section 56 of the Actuaries Act , 2006 (35 of 2006), for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulation will be taken into consideration after the expiry of the forty- five days from the date on which the Official Gazette in which the notification is published are made available to the public;

(3) The request referred to in Sub - Regulation (2 ) shall set out a statement of the business for consideration of which the special meeting is to be called and shall be the agenda of such special meeting:

5.Notice of meeting of Council :

DRAFT REGULATION

Anotice of the time and place of a meeting shall be sent to the registered address of every member of the Council , either by post under certificate of posting or electronically, not less than seven days before the date of such meeting and such notice shall contain a statement of the business to be transacted at the meeting .

In exercise of the powers conferred by clauses (k) , (1 ) and (m) of Sub - section (2) of Section 56 of the Actuaries Act , 2006 (35 of 2006) , the Council of the Institute ofActuaries of India , with the previous approval of the Central Government , hereby makes the following regulations , namely:-

1. Short Title and Commencement :--

(2) The Council may in any of its meeting , other than a special meeting , consider any business other than those mentioned in the agenda, with the permission of the Chairman of which no prior notice had been given to the members of theCouncil, if atleast two-third of the members of the Council are present at the meeting.

(1) These regulations may be called the Institute of Actuaries of India ( Maintenance of Register, Publication of List, and Re -entry of names in Register, of Members) Regulations, 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette.

(3) The validity of any decision of the Council on any item considered at a validity convened meeting of the Council shall not be called in question merely because notice of the said item had not been given to the members who did not attend the said meeting .

2.Definitions : ---

6. Chairman of meeting :-

(1) In these regulations , unless the context otherwise requires,--

(a) "Act " means the Actuaries Act, 2006 (35 of 2006 ) ;

The President or in his absence , the Vice- President , or in absence of both , a member elected from amongst the members present, shall preside over the meeting of the Council .

(b) " Council " means the Council of the Institute;

7. Quorum at meeting

(1) One- fourth of the total members of the Council shall constitute the quorum for a meeting of the Council .

(d) "President " means the President of the Council .

(2) If, the quorum is not present within half an hour from the time appointed for the meeting , the meeting shall stand adjourned to such time , date and place as the Chairman of the meeting may appoint .

(2) Words and expressions used herein and not defined, butdefined in the Act , shall have the meanings respectively assigned to them in the Act .

3.Meetings of Council :---

(3) No quorum shall be required for the meeting adjourned under sub - regulation (2) .

8.Adjournment of meeting:---

The Council shall meet atleast four times in every year at such time and place as the President may decide:

Provided that the time gap between two meetings shall not exceed one hundred twenty days .

4.Special meeting of Council :----

(1) Subject to the provisions of these regulations, the Chairman of a meeting of the Council , may, with the consent of majority of members present at a meeting , adjourn the meeting from time to such time and place as he may decided and no business shall be transacted at any adjourned meeting other than the business left unfinished at such meeting .

(1) The President or in his absence the Vice-President may, at any time, call a special meeting of the Council .

(2) No notice may be given of an adjourned meeting unless it is so directed by the resolution for adjournment.

9. Procedure for Transaction of Business :--

( 1) The business of the Council shall ordinarily be transacted at a meeting of the Council .

(2) Notwithstanding any thing contained in Sub- Regulation ( 1 ) , the President, or in his absence the Vice- President, may, in an appropriate case , circulate a resolution alongwith all relevant papers to the members of the Council for decision of any question .

Provided that if one- fourth of the members of Council require that any resolution circulated be decided at a meeting, the President, or the Vice- President, as the case may be, shall withdraw the resolution alongwith the relevant papers from circulation and have the resolution considered at a meeting of the Council .

(3) Where the resolution relating to any question are circulated among the members , a period of not less than fifteen days, commencing from the date of circulation of such resolution shall elapse before any decision is taken on the question:

Provided that a decision may be taken before the expiry of such period if the opinion of not less than three fourth ofthe members of the Council of the time being in office is received earlier.

(4) The circulation of resolution alongwith all relevant papers may be sent to members of the Council either in electronic mode or by post under certificate of posting.

(5) Every resolution passed by circulation shall be communicated to all the members of the Council and shall be noted at the next meeting of the Council .

10. Decision in a Meeting :--

Ata meeting of the Council, the decision shall be taken by a majority of votes of members present and in case of equality of votes , the Chairman of such meeting shall have a casting vote.

11. Minutes of Council Meetings :--

(1) The minutes of every meeting of the Council shall be recorded by the Secretary, and in the absence of the Secretary, the minutes shall be recorded by such other member of the Council as may be decided by the Chairman of the meeting .
