नई दिल्ली , 3 अगस्त, 2010 आ.अ. 49.-यतः, निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से लोक सभा के लिए सामान्य निर्वाचन , 2009 में 35 - लखनऊ लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री मो. इरशाद , 414/143 क सराय माली खां कंघीटोला चौक, लखनऊ , उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं ;
और जबकि अभ्यर्थी श्री मो. इरशाद ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः , अब , निर्वाचन आयोग एतद्वारा उक्त अधिनियम की धारा 10क के अनुसरण में श्री मो . इरशाद को संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के 3014 G1/ 2010

आ.अ. 51.-यतः, निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से लोक सभा के लिए सामान्य निर्वाचन , 2009 में 35 - लखनऊ लोक सभा निर्वाचन क्षेत्र में निर्वाचन लड़ने वाले अभ्यर्थी श्री प्रवीण कुमार मिश्रा , 269/251 बिरहाना , लखनऊ , उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम, 195। तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं ;
आ.अ. 50.-यतः , निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से लोक सभा के लिए सामान्य निर्वाचन , 2009 में 35 - लखनऊ लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री दशरथ , 642/109 , ग्राम व पोस्ट जरहरा , थाना चिनहट , लखनऊ , उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;
और जबकि अभ्यर्थी श्री प्रवीण कुमार मिश्रा ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है:

आ.अ. 57.-यतः निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से लोक सभा के लिए सामान्य निर्वाचन 2009 में 35 - लखनऊ लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री बाल मुकुन्द तिवारी , ग्राम चौडिया भज्जूपुर , पो.- कबरा , जिला सीतापुर , उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;
और जबकि अभ्यर्थी श्री बाल मुकुन्द तिवारी ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ;
अतः , अब , निर्वाचन आयोग एतद्वारा उक्त अधिनियम की धारा 10क के अनुसरण में श्री बाल मुकुन्द तिवारी को संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।

Whereas , the Election Commission is satisfied that Shri Bal Mukund Tiwari , Vill .- Chaudiya Bhajjupur , Post - Kabra , Distt . - Sitapur , Uttar Pradesh, a contesting candidate for the General Election to the Lok Sabha, 2009from 35 - Lucknow Parliamentary Constituency in the State of Uttar Pradesh has failed to lodge any account ofhis election expenses as required by the Representation of the People Act , 1951 and Rules and Order made thereunder; and
Whereas , Shri Bal Mukund Tiwari has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure;

Now, therefore , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Com- mission hereby declares the said Suman Lata Dixit to be disqualified for being chosen as , and for being , a member ofeither House of the Parliament or of the Legislative As- sembly or Legislative Council of a State for a period of three years from the date of this order.
Now, therefore , in pursuance of Section 10A of the Representation of the People Act , 1951 , the Election Com- mission hereby declares the said Shri Bal Mukund Tiwari to be disqualified for being chosen as , and for being, a member of cither House ofthe Parliament or of the Legisla- tive Assembly or Legislative Council of a State for a period of three years from the date of this order .

आ.अ. 59. यतः निर्वाचन आयोग का समाधान हो गया है कि2- कन्नूर संसदीय निर्वाचन क्षेत्र से लोकसभा के साधारण निर्वाचन , 2009 के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री पट्टाथील राघवन लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा यथा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा; और
आ.अ. 58.-यतः निर्वाचन आयोग का समाधान हो गया है कि उत्तर प्रदेश राज्य से लोक सभा के लिए सामान्य निर्वाचन 2009 में 35 - लखनऊ लोक सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी सुमन लता दीक्षित , ए-2 /62 , विशाल खण्ड, गोमती नगर , लखनऊ, उत्तर प्रदेश लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं;
यतः उक्त अभ्यर्थी ने उक्त नियम के अधीन अपने निर्वाचन व्यय का कोई अभ्यावेदन/लेखा प्रस्तुत नहीं किया;
और यतः , जिला निर्वाचन अधिकारी और कलेक्टर, कन्नूर ने अपने अनुपूरक रिपोर्ट में कहा है कि उन्होंने अब तक अपने निर्वाचन व्ययों का लेखा प्रस्तुत नहीं किया है;
और जबकि अभ्यर्थी सुमन लता दीक्षित ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः अब लांक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्वारा श्री पट्टाथील राघवन को संसद के किसी सदन या किसी राज्य या संघ राज्य क्षेत्र की विधान सभा/विधान परिषद् के सदस्य चुने जाने और होने के लिए, इस आदेश कीतारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।
अतः , अब , निर्वाचन आयोग एतद्वारा उक्त अधिनियम की धारा 10क के अनुसरण में सुमन लता दीक्षित को संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए , इस आदेश की तारीख से तीन वर्ष कीकालावधि के लिए निरर्हित घोषित करता है ।

O. N. 58. Whereas , the Election Commission is satisfied that Suman Lata Dixit , A2 / 62 , Vishal Khand, Gomti Nagar, Lucknow , Uttar Pradesh , a contesting candidate for the General Election to the Lok Sabha, 2009 from 35- Lucknow Parliamentary Constituency in the State of Uttar Pradesh has failed to lodge any account of his election expenses as required by the Representation of the People Act, 1951 and Rules and Order made thereunder ; and
And whereas , the said candidate could not submit hisrepresentation /account of election expenditure till date under the said rule .
And whereas , in the supplementary report of the DistrictElection Officer and Collector . Kannur has stated that he has not yet filed his account of election expenses;
Whereas , Suman Lata Dixit has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure;
