इंडियन पर्फार्मिंग राइट सोसायटी लिमिटेड ( आईपीआरएस ) , कम्पनी अधिनियम , 1956 के अंतर्गत एक कम्पनी लिमिटेड बाई गांरटी है । आईपीआरएस लाभ अर्जित नहीं करने वाली एक निकाय है तथा यह रजिस्ट्रार ऑफ कॉपी राइट्स द्वारा जारी पंजीकरण प्रमाणपत्र तिथि 27 मार्च, 1996 के माध्यम से संगीत कार्यों तथा संगीत के साथ गाए, बोले अथवा प्रदर्शित किए जाने वाले किसी शब्दों अथवा किसी एक्शन में कॉपी राइट के व्यवसाय को निष्पादित करने के लिए पंजीकरण सं. सीएस/02 /म्यूजिकल वर्क्स/ 96 के माध्यम से केंद्र सरकार, मानव संसाधन विकास मंत्रालय, दिल्ली में कॉपीराइट अधिनियम, 1957 को धारा 33 ( 3 ) के अंतर्गत कॉपी राइट सोसायटी के रूप में पंजीकृत है । आइपीआरएस के पास 1800 से अधिक सदस्य संगीतकार, गीतकार तथा संगीत प्रकाशक ( म्यूजिक कम्पनीज ) हैं जो लिटरैरी ( गीत ) एवं संगीत कार्यों की पर्याप्त प्रतिष्ठा का स्वामित्व/ नियंत्रण करते हैं । कॉपीराइट अधिनियम , 1957 की धारा 14 ( ए) ( iii ) के अनुसार, संगीत से जुड़े कार्यों केस्वामी ( जैसे कम्पोजर्स , गीत लेखक तथा प्रकाशकों ) के पास लोगों के बीच अपने संगीत कार्यों को प्रदर्शित अथवा प्रसारित करने अथवा किसी अन्य व्यक्ति को ऐसा करने के लिए अधिकृत करने का एकाकी अधिकार प्राप्त है । इस प्रकार, ऐसा कोई भी व्यक्ति जो लोगों में संगीत को निष्पादित करता है अथवा किसी भी रूप में लोगों के बीच संगीत को प्रसारित करता है, चाहे वह लाईव अथवा रिकॉर्ड किया गया हो, को संगीत के स्वामी से उसके लिए प्राधिकार प्राप्त करना पड़ता है । आईपीआरएस , रेसीप्रोकल एग्रीमेन्ट्स के माध्यम से भारत में विदेशी संगीत कार्यों के मामले में प्रदर्शन अधिकार को नियंत्रित एवं प्रयोग करने के लिए अधिकृत है । इस प्रकार आईपीआरएस भारतीय एवं विदेशी संगीत कार्यों दोनों के मामले में व्यापक अधिकार रखता है ।

एतद्वारा सूचित किया जाता है कि आईपीआरएस के सदस्य तथा उनसे जुड़े व्यक्ति जो संगीत कार्यों के स्वामी हैं, ने 29.09.2008 एवं 30.09.2009 को वार्षिक साधारण सभा में अपने लाइसैन्स की सभी श्रेणियों तथा लाइसैन्स शुल्कों को औचित्यपूर्ण बनाया है। तद्नुसार, 01 अक्टूबर, 2009 से/को सार्वजनिक प्रदर्शन एवं प्रसारण (लाइव अथवा रिकॉर्ड किया गया संगीत ) के लिए द इंडियन पर्फार्मिंग राइट सोसायटी लिमिटेड को संगीत के उपयोगकर्ताओं द्वारा भुगतान किए जाने वाले लाइसैन्स शुल्क इस प्रकार होंगे :

1. शुल्क का क्षेत्र

यह शुल्क विमानों , निजी एवं/ अथवा सार्वजनिक विमानों ( घरेलू एवं अंतर्राष्ट्रीय मार्गों ) , चाहे वह सार्वजनिक परिवहन, निजी किराए पर अथवा अन्य रूप में हों तथा चाहे वह स्टाफ के सदस्यों के लिए हो, में रेडियो, टेप, विडियो , टेलीविजन अथवा किसी अन्य यांत्रिक माध्यमों से संगीत के सार्वजनिक प्रदर्शन के लिए लागू होगा । खण्ड-4]

523 2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिए लागू सोसाईटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रॉयल्टी की निम्नलिखित दर लागू होंगी :

(क ) हवाई जहाजों/विमानों में केवल बोर्डिंग /टेक ऑफ/डिस्इम्बार्कमेन्ट/लैंडिंग के दौरान बजाए गए संगीत के लिए: रु . 20,000/ - प्रति विमान प्रति वर्ष

(ख ) फ्लाईट में मनोरंजन सेवा के रूप में प्रयुक्त संगीत के लिए रॉयल्टी का निम्नलिखित दर लागू होगा ।

यह दर रु . 3.00 प्रति दिन, प्रति यात्री, प्रति हवाई जहाज/ विमान की बैठने की क्षमता प्रति 365 दिनों के लिए है । गणना के लिए प्रत्येक विमान द्वारा पूरा किए गए ट्रिप्स की संख्या का कोई महत्व नहीं है ।

इस शुल्क के उद्देश्य से वास्तविक ऑक्युपैन्सी का विचार किए बिना हवाई जहाज/ विमान की लाइसैन्स प्राप्त सम्पूर्ण कैरीइंग क्षमता का विचार किया जाएगा। हवाई जहाज वायुयान के चलने की वास्तविक संख्या का विचार किए बिना दिनों की संख्या 365 दिन होगी ।

उदहारण के लिए: 392 यात्रियों की बैठने की क्षमता से युक्त बॉम्बे एवं दिल्ली के बीच ए747 एयरक्राफ्ट अर्थात् 392 × 3.00 × 365 = रु. 4,29,240/-

इस शुल्क के लिए वास्तविक ऑक्यूपैन्सी का विचार किए बिना हवाई जहाज/विमान की लाइसैन्स प्राप्त सम्पूर्ण कैरीइंग क्षमता का विचार किया जाएगा ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 जनवरी, 2008 से लागू. है तथा इस तिथि को या उसके बाद सभी रॉयल्टीज के लिए लागू है ।

शुल्क-1 बी एयरः विमानपत्तन

1. शुल्क का क्षेत्र

यह शुल्क विमान पत्तनों , कान्कार्सेस, शॉप्स , कॉफी शॉप्स, वेटिंग फोयर्स/ क्षेत्रों अथवा ऐसे अन्य कोई परिसरों जहाँ किसी विमान के यात्री एवं/अथवा कार्गो एकत्र होते हैं एवं/अथवा भारत में अपनी मार्ग में प्रतीक्षा करते हैं , में रेडियो, टेप , विडियो, टेलीविजन अथवा किसी अन्य यांत्रिक/डिजीटल माध्यमों से संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

यह शुल्क घरेलू तथा अंतर्राष्ट्रीय दोनों विमानपत्तनों के लिए लागू है ।

व्यावसायिक परिसरों

1. शुल्क का क्षेत्र

यह शुल्क स्टाफ के सदस्य अथवा आम जनता के लिए इन परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है। 2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिए लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रेडियों एवं/ अथवा टेप एवं/अथवा किसी भी अन्य ऑडियो विडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिए

(क) रॉयल्टी की निम्नलिखित दरें लागू होंगी:

(ग ) इस शुल्क के अंतर्गत न्यूनतम् रॉयल्टी रु. 25,000/- होगा ।

4. शुल्क की प्रयुक्तता

यह शुल्क । जुलाई, 2008 से लागू है तथा इस तिथि को अथवा उसके बाद सभी रॉयल्टी के लिए लागू है ।

शुल्क-3 - एपीः एम्यूजमेन्ट पार्क, म्यूनिसिपल गार्डन्स, पब्लिक पार्क , पब्लिक पोमर्नाडेस

1. शुल्क का क्षेत्र

यह शुल्क एम्यूजमेन्ट पाकों में संगीत के सार्वजनिक प्रदर्शन पर लागू है ।

रॉयल्टी की निम्नलिखित दर से लागू होगी :

(क ) रेडियो, टीवी एवं/अथवा टेप एवं/अथवा अन्य कोई ऑडियो/विडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिए रॉयल्टी रु.7,500/ - प्रति एकड़ ऑपरेशनल होगा ।

(ख) नगरपालिका अथवा अन्य सरकारी प्राधिकरणों के स्वामित्व के गार्डन्स, सार्वजनिक पार्कों, सार्वजनिक पोमर्नाडेस के मामले में केवल वहाँ जहाँ कोई प्रवेश शुल्क नहीं है, ऊपर गणना की गई रॉयल्टी में 50% तक की छूट दी जाएगी ।

(ग) इन परिसरों में लाइव प्रदर्शन शुल्क एलपी के अधीन होगी ।

(घ) इस शुल्क के अंतर्गत रॉयल्टी न्यूनतम रु. 20,000/- होगी ।

( ङ) डिस्कोथेक से शुल्क डिस्को के अंतर्गत शुल्क की वसूली की जाएगी ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 जुलाई, 2008 से लागू है तथा उस तिथि को अथवा उसके बाद सभी रॉयल्टी के लिए लागू है । खण्ड-4]

525 शुल्क-4- बीए: बाउलिंग एलेज/स्नूकर

1. शुल्क का क्षेत्र

यह शुल्क ऐसे किसी भी परिसर जहाँ कथित बाउलिंग एलेज/ पूल टैबल्स में बाउलिंग/स्नूकर का खेल खेला जाता है अथवा इस प्रकार का अन्य कोई परिसर जहाँ स्टाफ सदस्यों अथवा आम जनता द्वारा ऐसा कोई खेल खेला जाता है तथा जहाँ परिसर में प्रवेश के लिए अथवा खेल खेलने के लिए प्रवेश शुल्क लिया जाता है, में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है । संगीत का यह प्रदर्शन रेडियो, टेप, विडियो, टेलिविजन अथवा अन्य कोई यांत्रिक माध्यमों से हो सकता है ।

2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिए लागू सोसायटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रॉयल्टी की निम्नलिखित दर लागू होगी:

रु. 2,400/- प्रति वर्ष प्रति बाउलिंग लेन ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अप्रैल, 2005 से लागू है तथा उस तिथि अथवा उसके बाद सभी रॉयल्टीज के लिए लागू है ।

शुल्क-5- बीओः बैंक तथा कार्यालय

यह शुल्क स्टाफ के सदस्यों अथवा आम जनता के लिए इन परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है।

रॉयल्टी की निम्नलिखित दर लागू होगी :

(क ) रेडियो एवं/अथवा टेप एवं/ अथवा अन्य किसी ऑडियो माध्यम से संगीत के प्रदर्शन/बजाने के लिएः

( ख ) टी.वी. एवं/अथवा विडियो एवं/अथवा अन्य किसी विडियो माध्यम से संगीत के प्रदर्शन/बजाने के लिए प्रति मोनिटर/ सेट रु . 2,500/- ( ग ) इस शुल्क के अंतर्गत न्यूनतम् रॉयल्टी रु . 2,500/- होगी ।

शुल्क-6-सीएलः क्लब्स

यह शुल्क स्टाफ के सदस्यों अथवा आम जनता अथवा क्लब के सदस्यों के लिये क्लब परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिये लागू i

सामान्य शर्तें

3. रॉयल्टी की दर

रॉयल्टी की निम्नलिखित दर लागू होगी :

(क ) क्लब परिसरों के भीतर ( किसी व्यक्ति द्वारा हॉल /परिसरों को किराये पर लेकर कन्सर्ट/शो/ समारोह के आयोजन के अतिरिक्त ) रेडियो एवं/अथवा टेप एवं/अथवा अन्य किसी ऑडियो माध्यम से बैकग्राउन्ड म्यूजिक अथवा रेडियो के द्वारा संगीत के प्रदर्शन/बजाने के लियेः

(ग) लाइव म्यूजिक के सार्वजनिक प्रदर्शन के लिए शुल्क एलपी लागू होगा ।

(घ) डिस्को, पब्स, बैंक्ट हॉल , रेस्टोरेंट एवं बार , हेल्थ क्लब्स, ब्यूटी सैलून आदि में प्रदर्शन के लिए संबंधित शुल्क लागू होगा । (ङ) क्लब परिसरों के भीतर कमरे में ऑडियो/विडियो द्वारा संगीत के प्रदर्शन के लिए रॉयल्टी की दर रु. 100/- प्रति वर्ष प्रति कमरे लागू होगी ।

(च) इस शुल्क के अंतर्गत न्यूनतम रॉयल्टी रु. 5,000/- होगी ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अक्टूबर , 2006 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टीज के लिए लागू है ।

शुल्क-7-सीआरबीः सामुदायिक रेडियो प्रसारण

1. पृष्ठभूमि

सामुदायिक रेडियो स्टेशन से तात्पर्य समुदाय में समुदाय के लिए, समुदाय के विषय में अथवा समुदाय के द्वारा प्रचालित रेडियो स्टेशन है । सामुदायिक रेडियो सेवा क्षेत्र में समुदाय के हित को पूरा करने के उद्देश्य से प्रेरित होता है तथा विकास एवं सामाजिक परिवर्तन से संबंधित मुद्दों पर नागरिक समाज द्वारा वृहत्त भागीदारी को यह सुनिश्चित करता है । प्रसारित किए जाने वाले कार्यक्रम शैक्षणिक, विकासात्मक , समुदाय की सामाजिक एवं सांस्कृतिक जरूरतों के साथ संगीत के माध्यम से मनोरंजन के उद्देश्य से प्रेरित होते हैं । सामुदायिक रेडियो का सामान्य उद्देश्य ऐसे निरीह लोगों की आवाज़ को उठाना होता है जिनके पास मास मीडिया में पहुंचने तथा सामुदायिक विकास पर अपना दृष्टिकोण प्रस्तुत करने के अवसर नहीं होते । सामुदायिक रेडियो स्टेशन की परिधि 5-10 कि.मी. होती है तथा ये सूचना एवं प्रसारण मंत्रालय, भारत सरकार द्वारा निर्धारित नीति एवं दिशानिर्देशों के अनुसार अधिशासित होते हैं ।

2. शुल्क का क्षेत्र

यह शुल्क गैर - लाभकारी उद्देश्यों से गैर- वाणिज्यिक प्रसारण के लिए गैर - लाभकारी संगठनों/विश्वविद्यालयों तथा सुस्थापित शैक्षणिक संस्थानों द्वारा एक निर्दिष्ट भौगोलिक समुदाय के भीतर सामुदायिक रेडियो पर संगीत के सार्वजनिक प्रदर्शन के लिए लागू है । 3. सामान्य शर्तें

संगठन/संस्थान गैर - लाभकारी संस्था होनी चाहिए ।

संगठन/संस्थान द्वारा केंद्र एवं राज्य सरकारों तथा अन्य संगठनों द्वारा सार्वजनिक हित में जानकारी के लिए प्रसारित किए जाने वाले प्रायोजित कार्यक्रमों के अतिरिक्त किसी भी प्रायोजित कार्यक्रमों को प्रसारित नहीं किया जाएगा ।

संगठन/संस्थान स्थानीय समारोहों , स्थानीय व्यवसाय तथा सेवा तथा रोजगार के अवसरों से संबंधित सीमित विज्ञापन एवं उद्घोषणा का कार्य करेंगे तथा इस प्रकार का सीमित विज्ञापन प्रसारण के प्रति घंटे में अधिकतम 5 ( पांच ) मिनट की अवधि का होगा । संगठन/संस्थान एक दिन में संगीत वादन की अधिकतम 120 मिनट की अवधि का उपयोग करेंगे ।

सामुदायिक रेडियो स्टेशन द्वारा प्रसारण 5-10 कि.मी. क्षेत्र की परिधि में सीमित होगा । खण्ड-4]

527 यह लाइसैंस स्वतः एवं तत्काल समाप्त हो जाएगा यदि वह स्टेशन किसी भी व्यावसायिक प्रसारण में संलग्न हो अथवा यदि किसी भी कारण से लाइसेंसी वांछित रूप में अपने सूचना एवं प्रसारण मंत्रालय के लाइसेंस को कायम रखने में विफल होते हैं ।

संस्थान/संगठन का श्रेणीकरण :

श्रेणी ' क'- गैर-लाभकारी संगठन जैसे सिविल सोसाइटी तथा सोसाइटी अधिनियम अथवा किसी अन्य संबंधित अधिनियम के अंतर्गत पंजीकृत स्वैच्छिक संगठन ।

श्रेणी ' ख'- विश्वविद्यालय, मानद विश्वविद्यालय , व्यावसायिक एवं तकनीकी संस्थान/कॉलेज/शोध संस्थान ।

श्रेणी ' ग ' सुस्थापित शैक्षणिक संस्थान ।

4. रॉयल्टी की दर :

श्रेणी ' क' संस्थान/संगठन रु. 1,50,000/- प्रति वर्ष अथवा सकल विज्ञापन राजस्व का 5% इसमें जो भी अधिक हो ।

श्रेणी ' ख ' संस्थान/संगठन रु. 1,00,000/- प्रति वर्ष अथवा सकल विज्ञापन राजस्व का 5 % इसमें जो भी अधिक हो ।

श्रेणी ' ग ' संस्थान/संगठन रु. 50,000/- प्रति वर्ष अथवा सकल विज्ञापन राजस्व का 5 % इसमें जो भी अधिक हो ।

5. शुल्क की प्रयुक्तता

यह शुल्क पूर्व के सभी वर्शन को विस्थापित करते हुए 1 अप्रैल 2005 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टीज के लिए लागू है ।

इस शुल्क के प्रत्येक एक वर्ष पूरा होने पर अगले 3 वर्षों के लिए इसमें 10% का ऊपर पुनरीक्षण किया जाएगा ।

शुल्क-8 डीसीः डॉक्टर का क्लीनिंग कंसल्टिंग रूम्स

(ख ) टीवी एवं/ अथवा विडियो अथवा किसी अन्य वीडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिए प्रति मोनीटर/सेट के लिए रॉयल्टी की दर रु . 1,000/- प्रति वर्ष होगी ।

( ग ) इस शुल्क के अंतर्गत न्यूनतम् देय रॉयल्टी रु. 1,000/- प्रति वर्ष है ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अक्टूबर, 2006 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी पर लागू है ।

शुल्क-9-डिस्को: डिस्कोथेक्स/व्यावसायिक नृत्य हॉल

1. शुल्क का क्षेत्र

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिये लागू सोसाईटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रॉयल्टी की निम्नलिखित दर लागू होगी:

(क) रेडियो एवं/ अथवा किसी अन्य ऑडियो माध्यम/विडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिये 500 वर्ग फीट ( निर्मित क्षेत्र ) के लिये रु . 30,000/- प्रति वर्ष प्रत्येक अतिरिक्त 250 वर्ग फीट अथवा उसके भाग के लिये रु . 12,500/- प्रति वर्ष की दर से रॉयल्टी वसूली जायेगी ।

(ख) प्रत्येक आयोजन के लिये रु.15,000/- प्रति आयोजन की दर से उपरोक्त दर के अतिरिक्त वसूली की जायेगी चाहे वह लाइव आयोजन हो अथवा डीजे हो ।

( ग ) इस शुल्क के अंतर्गत न्यूनतम् रॉयल्टी रु . 30,000/- होगी ।

4. शुल्क की प्रयुक्तता

यह शुल्क । जुलाई, 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टीज के लिये लागू है । शुल्क-10 डीएस- डिपार्टमेन्टल स्टोर्स, शो रूम तथा समान प्रकार के अन्य सभी व्यावसायिक परिसर 1. शुल्क का क्षेत्र

यह शुल्क स्टाफ के सदस्यों तथा आम जनता के लिये इन परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिये लागू है । 2. सामान्य शर्तें

1. यह शुल्क, शुल्कों एवं लाइसैन्सों के लिये लागू सोसायटी की सामान्य शर्तों के अधीन है ।

2. यह शुल्क 501 वर्ग फीट से अधिक के क्षेत्र के लिये ही लागू होगा ।

3. रॉयल्टी की दर

( क) रेडियो एवं/अथवा टेप एवं/अथवा किसी अन्य ऑडियो/विडियो माध्यम से संगीत के प्रदर्शन/बजाने के लिये रॉयल्टी की दर इस प्रकार लागू होगी:

(ग) टी.वी. एवं/अथवा विडियो एवं/अथवा किसी अन्य विडियो माध्यम से इन परिसरों में संगीत के प्रदर्शन /बजाने के लिये प्रति टी.वी. रु. 2000/- की रॉयल्टी वसूली जायेगी ।

(घ) इस शुल्क के अंतर्गत न्यूनतम् रॉयल्टी रु. 3,000/- है।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 जुलाई, 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिये लागू होगा । शुल्क- 11 - डीएससीएचः डांस स्कूल, कॉलेज, कक्षाएँ ( एरोबिक कक्षाओं को छोड़कर ) 1. शुल्क का क्षेत्र

यह शुल्क एरोबिक कक्षाओं को छोड़कर सभी डांस स्कूलों , कॉलेजों तथा कक्षाओं में रेडियो , टेप, टेलीविजन , विडियो अथवा किसी अन्य यांत्रिक माध्यमों से संगीत के सार्वजनिक प्रदर्शन के लिये लागू होगा।

2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिये लागू सोसाईटी की सामान्य शर्तों के अधीन है । 529 खण्ड-4]

1. शुल्क का क्षेत्र

यह शुल्क सामान्य कार्यावधि के दौरान उनके कार्य में कर्मचारियों के लिये इन परिसरों में रेडियो, टेप, टेलीविजन, विडियो अथवा अन्य किसी यांत्रिक माध्यमों से संगीत के सार्वजनिक प्रदर्शन के लिये लागू है ।

2. सामान्य शर्तें

यह शुल्क, शुल्कों तथा लाइसैन्सों के लिये लागू सोसाईटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रॉयल्टी की दर इस प्रकार से लागू होगी:

50 कर्मचारियों की क्षमता तक

रु. 250/- प्रति वर्ष

50 कर्मचारियों के प्रत्येक अतिरिक्त इकाई अथवा उसके भाग के लिये

हेल्थ क्लब, जिम , एरोबिक सेन्टर्स, सोना बाथ, ब्यूटी क्लीनिक तथा समान प्रकार के अन्य सभी व्यावसायिक परिसर 1. शुल्क का क्षेत्र

यह शुल्क स्टाफ के सदस्यों अथवा आम जनता के लिये इन परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिये लागू है । 2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैन्सों के लिये लागू सोसायटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

रेडियो एवं/अथवा टेप एवं/ अथवा अन्य किसी भी ऑडियो/विडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिये । (क ) रॉयल्टी की निम्नलिखित दर लागू होगी:

रॉयल्टी की निम्नलिखित दर लागू होगी:

( ग ) कमरे में टेलीविजन सेट के लिये रु . 100/- प्रति कमरे ।

( घ ) सरकारी अस्पतालों के मामले में उपरोक्त दर में 50 % की छूट दी जायेगी ।

( ङ) इस शुल्क के अंतर्गत देय रॉयल्टी न्यूनतम्1,500/- रु. होगी ।

4. दर की प्रयुक्तता

यह शुल्क 1 जुलाई , 2008 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टी के लिये लागू होगा ।

शुल्क-15- आईएचएलः होटल , गेस्ट हाऊस , कमरे, लॉज, होटल्स, हॉलिडे होम्स तथा बोर्डिंग एवं लॉजिंग के इस प्रकार के अन्य परिसरों 1. शुल्क का क्षेत्र

यह शुल्क रेडियो एवं/अथवा टेप एवं/अथवा अन्य किसी ऑडियो माध्यम/टेलीविजन एवं/अथवा विडियो एवं/ अथवा अन्य किसी विडियो माध्यम से स्टाफ के सदस्यों अथवा आम जनता के लिये इन परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिये लागू है ।

रॉयल्टी की निम्नलिखित दर लागू होगी:

(i ) परिसर के कमरे में संगीत के सार्वजनिक प्रदर्शन के लिये रॉयल्टी की दर रु . 100/- प्रति वर्ष प्रति रूम होगी ।

( ii ) परिसर के रेस्टोरेंट में संगीत के सार्वजनिक प्रदर्शन के लिये आरबी शुल्क लागू होगा ।

( iii ) परिसर के भीतर बैंक्वेट अथवा अन्य क्षेत्रों में लाइव डीजे संगीत के सार्वजनिक प्रदर्शन के लिये एलपी /डीजे शुल्क लागू होगा । ( iv ) परिसर के भीतर प्रदर्शनी के लिये मैकेनिकल माध्यमों/डीवाईसेस से संगीत प्रदर्शित करने के लिये ईएक्सबी शुल्क लागू होगा । ( v ) परिसर के भीतर सामान्य क्षेत्रों जैसे लॉबी, फोयर्स , पैसेजज, टॉयलेट्स तथा समान क्षेत्रों में किसी भी माध्यम से संगीत के सार्वजनिक प्रदर्शन के लिये कमरे के लिये वसूल की जाने वाली रॉयल्टी की दर ही लागू होगी ।

( vi ) परिसर के भीतर डिस्कोथेक में संगीत के सार्वजनिक प्रदर्शन के लिये डिस्को का शुल्क लागू होगा ।

( vii ) डिपार्टमेन्टल स्टोर, रिटेल शॉप, शोरूम, विडियो गेम पार्लर, ब्यूटी पार्लर, हेयर ड्रेसिंग सैलून , साउना बाथ, कियोस्क स्टॉल्स तथा इस प्रकार के अन्य सभी व्यावसायिक परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिये डीएस शुल्क लागू होगा ।

( viii ) कार्यालय अथवा बैंकों के लिये दिये गये स्थानों में संगीत के सार्वजनिक प्रदर्शन के लिये बीओ शुल्क लागू होगा ।

( ix ) टेलीफोन सिस्टम में होल्ड पर संगीत के सार्वजनिक प्रदर्शन के लिये एमएच शुल्क लागू होगा । [खण्ड-4

(x ) गॅपिंग प्लाजा/आर्केड्स मॉल्स, मल्टीप्लेक्सेस में संगीत के सार्वजनिक प्रदर्शन के लिये एएम शुल्क लागू होगा । (xi ) हेत्थ क्ल्बस , जिम, एरोबिक सेन्टर्स में संगीत के सार्वजनिक प्रदर्शन के लिये एचसीएल शुल्क लागू होगा ।

(ख) विवल्प 2

( i ) परिसर के भीतर लाइव प्रदर्शन/समारोह/ थर्ड पार्टीज/बाहरी आयोजक द्वारा प्रदर्शन के लिए संबंधित शुल्क एलपी /डीजे लागू होगा । (ii ) 100 कमरे से कम के होटलों के लिए उसे डिस्को शुल्क के अनुसार डिस्को के लिए अलग लाईसेंस प्राप्त करना होगा । (iii ) 30 कमरे से कम के लिए इस विकल्प की स्वीकृति नहीं है । इस शुल्क के अंतर्गत न्यूनतम रायल्टी रु. 2,500/- प्रति वर्ष होगी । 4. शुल्क की प्रयुक्तता

यह शुल्क 1 जुलाई, 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रायल्टीज के लिए यह लागू होगा ।

शुल्क 16- आईएनटीबी: इंटरनेट प्रसारण ( नान इंटरैक्टिव )

1. शुल्क का क्षेत्र

यह शुल्क वायर अथवा वायरलेस माध्यमों के द्वारा नान इंटरैक्टिव इंटरनेट साईट ( साईटों ) अथवा सेवा ( सेवाओं ) के द्वारा भारतीय संगीत के प्रसारण/स्ट्रीमिंग/प्रदर्शन के लिए लागू है ।

2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसेन्सों के लिए लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर :

इंटरनेट पर प्रसारण / प्रदर्शन के लिए रॉयल्टी की निम्नलिखित दर लागू होगी:

(क) एक चैनल के लिए रु. 5 लाख अथवा कुल राजस्व का 15% इसमें जो भी अधिक हो ।

(ख) अन्य किसी भी अतिरिक्त चैनल के लिए रु. 10,000/- प्रति चैनल के दर से वसूली की जाएगी ।

(ग) अतिरिक्त रूप में रु. 2/ - प्रति गीत प्रति वर्ष की दर से एफेमरल चार्ज की वसूली की जाएगी ( लाइसैंसी को लाइसैंसी के कंप्यूटर सर्वर में लाइसैंस प्राप्त कार्यों के अस्थायी भंडारण के लिए लाइसैंसर भंडारण शुल्क का भुगतान करना होगा ) ( घ ) इस शुल्क के अन्तर्गत न्यूनतम् रॉयल्टी रु. 5 लाख होगी ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अप्रैल 2006 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टीज के लिए लागू है। स्पष्टीकरण : इंटरनेट के माध्यम से रीट्रांसमीशन/ सिमुलकास्ट के लिए प्रत्येक नगर विशेष के एफएम रेडियो स्टेशन को अलग स्ट्रीम माना जाएगा तथा उसे चैनल नहीं माना जाएगा । उस पर लागू होने वाला लाइसैंस शुल्क तदनुसार होगा। इसमें मोबाईल/ सेल्युलर नेटवर्क के माध्यम से प्रसारण /स्ट्रीमिंग सेवाएं शामिल नहीं हैं । 533 भारत का राजपत्र, अगस्त 14 , 2010 ( श्रावण 23, 1932 )

शुल्क-17 आईएनटीआरः इंटरनेट ब्राडकास्ट ( इंटरैक्टिव )

1. शुल्क का क्षेत्र

यह शुल्क वायर अथवा वायरलेस माध्यमों के द्वारा इंटरैक्टिव इंटरनेट साईट ( साईटों ) अथवा सेवा ( सेवाओं ) के द्वारा भारतीय संगीत के प्रसारण/स्ट्रीमिंग/प्रदर्शन के लिए लागू है ।

2. सामान्य शर्तें

यह शुल्क, शुल्कों एवं लाइसैंसों के लिए लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दर

वायर अथवा वायरलेस माध्यमों से इंटरैक्टिव इंटरनेट साईट ( साईटों ) अथवा सेवा ( सेवाओं ) के द्वारा संगीत के प्रसारण/स्ट्रीमिंग /प्रदर्शन के लिए रॉयल्टी की निम्नलिखित दर लागू होगी:

(क ) जहाँ ऐसी सेवा/डैटा बेस के एक्सेस के लिए यूजर से कोई शुल्क नहीं लिया जाता है : रु. 10 लाख अथवा सकल राजस्व का 15%, इसमें जो भी अधिक हो ।

(ख ) जहाँ ऐसी सेवा/डैटा बेस के एक्सेस के लिए यूजर से शुल्क लिया जाता है : रु. 12 लाख अथवा सकल राजस्व का 15 %, इसमें जो भी अधिक हो ।

(ग ) अतिरिक्त रूप में रु. 2/ - प्रति गीत प्रति वर्ष की दर से ऐफमरल चार्ज की वूसली की जाएगी ( लाइसैंसी को लाइसैंसी के कंप्यूटर सर्वर में लाइसैंस प्राप्त कार्यों के अस्थायी भंडारण के लिए लाइसैंसर भंडारण शुल्क का भुगतान करना होगा )

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अप्रैल 2006 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टीज के लिए लागू होगा । शुल्क 44- आरएसटीएसः रेलवे स्टेशन

1. शुल्क का क्षेत्र

यह शुल्क भी रेडियो, टेप , वीडियो तथा टेलीविजन अथवा अन्य किसी यांत्रिक माध्यमों से रेलवे स्टेशनों, कान्कोर्सेस तथा वेटिंग फोयर्स/ क्षेत्रों में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

रॉयल्टी की निम्नलिखित दर लागू होगी:

(क) न्यूनतन रॉयल्टी :

(i ) मेट्रो सिटी स्टेशनों टर्मिनस रु. 50,000/- प्रति वर्ष

( ii ) सेटेलाइट शहर के स्टेशनों रु. 25,000/- प्रति वर्ष

(iii ) सामान्य स्थानीय नगर के स्टेशनों रु. 10,000/- प्रति वर्ष

10000 वर्ग फीट तक के लिए न्यूनत्म रॉयल्टी लागू होगा तथा उसके बाद प्रत्येक वर्ग फीट के लिए मेट्रो के रु. 5/- , सेटेलाइट के लिए रु. 3 /-, सामान्य स्टेशनों के लिए रु. 2/- की दर से वसूली की जाएगी ।

( ख ) परिसरों के भीतर रेस्टोरेंट्स में संगीत के सार्वजनिक प्रदर्शन के लिए ' आर बी ' शुल्क लागू होगा । ( थर्ड पार्टी जैसे कि बैरिस्टा, कैफे कॉफी डे, राजधानी आदि)

(ग ) डिस्कोथेक, शॉपिंग आर्केड्स पब में संगीत के सार्वजनिक प्रदर्शन, लाइव प्रदर्शन परिसर के भीतर, आदि के लिए सोसायटी का संबंधित शुल्क लागू होगा ।

4. शुल्क की प्रयुक्तता

यह शुल्क 1 अप्रैल 2009 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू होगा ।

1. शुल्क का क्षेत्र

यह शुल्क सार्वजनिक स्थानों जैसे रेस्टोरेंट्स, कॉफी शाप्स तथा स्थापनाओं तथा इस प्रकार के वाणिज्यिक परिसरों में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

2. सामान्य शर्तें

रॉयल्टी की निम्नलिखित दर लागू होगी:

(क ) ज्यूक बॉक्स ( ऑडियो/विडियो ) के द्वारा संगीत के प्रदर्शन /बजाने के लिए रॉयल्टी रु. 10,000/- प्रति वर्ष प्रति बॉक्स होगा । (ख) परिसर में लाइव प्रदर्शन, एलपी शुल्क के अधीन होगा ।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 अप्रैल 2005 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू होगा । शुल्क-20 एलपी: लाइव डीजे ( रेकार्ड किया गया संगीत ) स्थानों में उसका प्रदर्शन एवं आयोजन 1. शुल्क का क्षेत्र

" डीजे " का अर्थ है किसी ध्वनि प्रणाली के माध्यम से डिस्क जॉकी अथवा किसी व्यक्ति द्वारा रेकॉर्डेड संगीत ( माइनस वन ट्रैक सहित) का प्रदर्शन ।

(ग ) ऐसे मामलों में जहाँ आयोजन /प्रदर्शन , कन्सर्ट/ कार्यक्रम/फैशन शोज को रेकॉर्ड किया जाता है । ( ऑडियो अथवा ऑडियो- विजुअल उद्देश्यों के लिए ) जिसे उस आयोजन/प्रदर्शन/कन्सर्ट/ कार्यक्रम/फैशन शोज को व्यावसायिक प्रयोजन के लिए रिकॉर्ड किया गया हो वहाँ प्रति सीट के लिए रु . 75/ - की रॉयल्टी ली जाएगी तथा प्रति शो के लिए देय रॉयल्टी न्यूनतम रु. 75,000/- होगी ।

टिप्पणी : इसमें टेलीकास्ट लाइसेंस शामिल नहीं है जिसे संबंधित चैनल/प्रसारक द्वारा प्राप्त किया जाएगा ।

(घ ) उपरोक्त शुल्कों के अंतर्गत देय रॉयल्टी ऑक्यूपैन्सी का विचार किए बिना परिसर की कुल क्षमता पर आधारित होगा लेकिन, पर्याप्त स्पष्टीकरण के लिए यदि यह प्रदर्शन विशाल परिसर के भाग ( जैसे खुले मैदान जहाँ क्षमता निर्धारित नहीं है ) में आयोजित होता है, शुल्क के अंतर्गत/विचार की जाने वाली क्षमता किसी भी स्थिति में परिसर की संभावित क्षमता के 40% से कम नहीं होगी ।

(ङ) ऐसे सभी आयोजनों जिसमें सेलिब्रेटी का प्रदर्शन होता है उसे प्रीमियम आयोजन माना जाएगा ।

(च ) सभी लाईव डीजे रेकॉर्डेड संगीत के प्रदर्शन/ आयोजन के लिए उपयोगकर्ताओं को 30% का प्रोत्साहन/ छूट दिया जाएगा बशर्ते उन्होंने कार्यक्रम की तिथि से आठ दिन पूर्व में अग्रिम में लाइसेन्स शुल्क का भुगतान कर लाइसेंस प्राप्त किए हों ।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 जुलाई , 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू है ।

शुल्क 22 एमडीजे : मोबाईल डिस्क जॉकीज

1. शुल्क का क्षेत्र :

यह शुल्क जन्म दिन की पार्टियों, घरेलू/व्यक्तिगत पार्टियों / धार्मिक पार्टियों , कि‌ट्टी पार्टी तथा इस प्रकार की अन्य पार्टी जो सोसाइटी के अन्य शुल्क की परिधि में नहीं आता है, के लिए किसी आवासीय परिसर/ आउटडोर क्षेत्र में ऑडियो माध्यम द्वारा संगीत के सार्वजनिक प्रदर्शन के लिए निजी घरेलू व्यक्तियों को ध्वनि उपकरण/संगीत के प्रदाताओं के लिए लागू है ।

2. सामान्य शर्तें :

यह शुल्क, शुल्कों एवं लाइसेंसों के लिए लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी का दर :

रॉयल्टी की निम्नलिखित दरें लागू होंगी 7500/- प्रति वर्ष ।

टिप्पणी : इस लाइसेंस में एक दिन में किसी भी समय में एक ही प्रदर्शन के आयोजन की स्वीकृति है ।

टिकट पर आधारित शो , प्रायोजित शो , सेटेलाइट चैनल रेकॉर्डिंग आदि को छोड़कर इस शुल्क के लिए एलपी/ डीजे शुल्क लागू होगा । 4. शुल्क की प्रयुक्तता :

यह शुल्क 1 अक्टूबर , 2007 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टी के लिए लागू है।

शुल्क- 23 - एमएच ( घरेलू) म्यूजिक ऑन होल्ड कॉल सेंटर्स/ बीपीओ कार्यालय तथा समान प्रकार के अन्य स्थापना

1. शुल्क का क्षेत्र :

यह शुल्क रेडियो, टेप , टेलीविजन, विडियो अथवा किसी अन्य यांत्रिक माध्यमों से संगीत के सार्वजनिक प्रदर्शन पर उस समय लागू होता है जब उसे टेलीफोन स्विचबोर्ड से जोड़कर किसी यांत्रिक माध्यम से बजाया जाए ताकि वह किसी आंतरिक विस्तार से जुड़ने से पहले इनकमिंग कॉलर्स को सुनाई दे । [खण्ड-4 भारत का राजपत्र , अगस्त 14, 2010 ( श्रावण 23, 1932)

यह शुल्क रेडियो, टेप, टेलीविजन, विडियो अथवा किसी अन्य यांत्रिक माध्यमों से संगीत के सार्वजनिक प्रदर्शन पर उस समय लागू होता है जब उसे टेलीफोन स्विचबोर्ड से जोड़कर किसी यांत्रिक माध्यम से बजाया जाए ताकि वह किसी आंतरिक विस्तार से जुड़ने से पहले इनकमिंग कॉलर्स को सुनाई दे ।

1. शुल्क का क्षेत्र :

यह शुल्क रेडियो, टेप , टेलिविजन , विडियो अथवा अन्य किसी यांत्रिक माध्यम से व्यावसायिक उद्देश्यों से सार्वजनिक परिवहन अथवा निजी किराए के वाहनों के लिए बसों , वैनों , टैक्सियों, ऑटो रिक्शा, मोटर कोचेज तथा इस प्रकार के अन्य व्यावसायिक वाहनों में संगीत के सार्वजनिक प्रर्दशन के लिए लागू होगा ।

2. सामान्य शर्तें :

यह शुल्क, शुल्कों एवं लाइसेन्सों के लिये लागू सोसाईटी की सामान्य शर्तों के अधीन है ।

यह शुल्क रेडियो , टेप , विडियो , टेलिविजन अथवा किसी अन्य यांत्रिक माध्यमों से स्टाफ के सदस्यों अथवा आम जनता के लिए पेट्रोल पम्पों में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

2. सामान्य शर्ते :

यह शुल्क, शुल्कों एवं लाइसेन्सों के लिये लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी की दरें :

रॉयल्टी की निम्नलिखित शर्तें लागू होंगी :

रु. 1,200/- प्रति वर्ष प्रति फिलिंग पोस्ट इस शुल्क के अंतर्गत न्यूनतम रॉयल्टी रु . 1200/- होगा।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 अप्रैल , 2005 से लागू है तथा उस तिथि को या उसके बाद देय सभी रॉयल्टी के लिये लागू होगा ।

शुल्क-26-पब पब

1. शुल्क का क्षेत्र :

यह शुल्क पब ( जहाँ प्रवेश शुल्क लिया जाता है ) में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

रॉयल्टी का निम्नलिखित दर लागू होगाः

(क ) रेकॉर्डेड संगीत , रेडियो एवं/ अथवा अन्य किसी ऑडियो माध्यम से संगीत के सार्वजनिक प्रदर्शन के लिए प्रति 1000 वर्ग फीट के लिए यह दर रु. 15,000/- प्रति वर्ष होगा । इसके अतिरिक्त प्रत्येक अतिरिक्त वर्ग फीट के लिए रु. 10/- प्रति वर्ग फीट प्रति वर्ष की दर से वसूली की जाएगी ।

( ख ) विडियो माध्यम से संगीत के प्रदर्शन/बजाने के लिए दर रु . 5000/- प्रति सेट होगा ।

(ग ) परिसर में लाइव प्रदर्शन/आयोजन के लिए एलपी शुल्क लागू होगा ।

(घ ) जहाँ व्यावसायिक डांस फ्लोर/ नियमित लाइव बैठक ऑर्केस्ट्रा है, यह रॉयल्टी रु. 50/- प्रति वर्ग फीट प्रति वर्ष होगा ।

(ङ) इस शुल्क के अंतर्गत न्यूनत्म रॉयल्टी रु. 15,000/ - होगी ।

यह शुल्क किसी संगीत कार्य के म्यूजिकल कम्पोजिशन अथवा गीत के प्रकाशन के लिए लागू है ।

रॉयल्टी का निम्नलिखित दर लागू होगाः

(क ) संगीत कार्य के म्युज़िकल नोटेशन के प्रकाशन के लिए जहाँ प्रकाशित प्रति के लिए कोई शुल्क नहीं है, रॉयल्टी प्रत्येक हजार प्रतियों के लिए रु . 4,750/- होगी !

(ख ) संगीत कार्य के लिरिक्स के प्रकाशन के लिए तथा जहाँ प्रकाशित प्रति के लिए कोई शुल्क नहीं लिया जाता है, रॉयल्टी प्रत्येक हजार प्रतियों के लिए रु. 3,750/- होगी ।

(ग) संगीत कार्य के म्युजिकल नोटेशन अथवा लिरिक्स के प्रकाशन के लिए जहाँ प्रकाशित प्रति के लिए कोई चार्ज या मूल्य नहीं है, के लिए उपरोक्त रॉयल्टी दर को इस प्रकार से बढ़ाया जाएगा ।

2. सामान्य शर्तें :

यह शुल्क, शुल्कों तथा लाइसेन्सों के लिये लागू सोसाईटी की सामान्य शर्तों के अधीन है ।

3. रॉयल्टी का दर :

रॉयल्टी का निम्नलिखित दर लागू होगा :

रु. 500/- प्रति वर्ष प्रति इकाई ।

4. शुल्क की प्रयुक्तता :

रॉयल्टी का निम्नलिखित दर लागू होगा :

( क ) रेडियो एवं/ अथवा अन्य किसी ऑडियो माध्यम/ज्यूक बॉक्स ( बिना किसी चार्ज के ) विडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिए दर रु. 3,750/- प्रति 500 वर्ग फीट ( परिसर के दीवाल से दीवाल तक कुल फर्श क्षेत्र अथवा उसके भाग के लिए ) प्रति वर्ष होगा। अतिरिक्त प्रत्येक वर्ग फीट के लिए लाइसेंस शुल्क रु. 8/ - प्रति वर्ग फीट प्रति वर्ष होगा ।

( ख ) वहाँ जहाँ व्यावसायिक डांस फ्लोर/रेग्युलर लाइव बैंड ऑर्किस्ट्रा है, यह रॉयल्टी ( क ) में वर्णित दर का दो गुणा होगा ।

( ग ) लाइव डीजे माध्यमों से संगीत के प्रदर्शन /बजाने के लिए, जहाँ प्रवेश शुल्क लिया जाता है , एलपी- शुल्क लागू होगा।

( घ ) इस शुल्क के अंतर्गत न्यूनतम रॉयल्टी रु. 3,750/- होगा ।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 जुलाई, 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टीज के लिए लागू होगा ।

शुल्क-30-आरडीबी: रेडियो प्रसारण

1. शुल्क का क्षेत्र :

यह शुल्क प्रसारण के माध्यम से रेडियो पर संगीत के सार्वजनिक प्रदर्शन के लिए लागू है।

2. सामान्य शर्तें :

1. यह शुल्क, शुल्कों एवं लाइसेन्सों के लिए लागू सोसाइटी की सामान्य शर्तों के अधीन है ।

2. ए+ श्रेणी के नगरों में दिल्ली, मुंबई, कोलकाता, चेन्नई के महानगर शामिल हैं ।

3. नगर की श्रेणी का वर्गीकरण वही होगा जो समय - समय पर यथा- संशोधित वर्तमान में लागू सरकारी मानकों के अनुसार है । 4. सकल राजस्व वही होगा जो समय - समय पर यथा- संशोधित फेज- II निविदा दस्तावेज तिथि 21 सितंबर, 2005 में परिभाषित है । [सकल राजस्व, राजस्व की भागीदारी के लिए भारत सरकार ( जीओ आई ) द्वारा घोषित रूप में उसी के समान होगा ।

5. उसके एफएम स्टेशनों से संगीत बजाने के लिए लाइसेंस प्राप्त करने से संबंधित सार्वजनिक सहयोग उद्घोषणा के 240 सेंकड्स का फ्री एयर टाइम ।

6. क्लॉज़ 2बी में यथा-निर्दिष्ट प्रत्येक नगर में प्रत्येक रेडियो स्टेशन के लिए न्यूनतम वार्षिक रॉयल्टी /लाइसेंस शुल्क का इस बात का विचार किए बिना कि लाइसेंसी के लिए क्लॉज 2ए अथवा क्लॉज 2बी लागू है , अग्रिम में भुगतान किया जाएगा ।

7. सभी रॉयल्टीज सभी वैट/ करों / शुल्कों से रहित हैं ।

3. रॉयल्टी का दर

प्रत्येक रेडियो स्टेशन प्रत्येक नगर के लिए रेडियो ब्रॉडकास्टर ( लाइसेंसी ) द्वारा भुगतान की जाने वाली लाइसेंस शुल्क रॉयल्टी नीचे सब - क्लॉज " क " के अनुसार अथवा नीचे सब -क्लॉज " ख " के अनुसार न्यूनतम वार्षिक रॉयल्टी/लाइसेंस शुल्क, इसमें जो भी अधिक हो, के अनुसार देय सकल राजस्व का प्रतिशत होगा ।

व्याख्या :

किसी नगर में एक रेडियो स्टेशन के लिए कुल वार्षिक रॉयल्टी/ लाइसेंस शुल्क की गणना के लिए निम्नलिखित विवरण को ध्यान में रखा जाएगाः श्रेणी ए+ से संबंधित स्टेशन के लिए :

1. न्यूनतम् वार्षिक रॉयल्टी/लाइसेन्स शुल्क रु. 17,00,000.00

2. जीओआई को यथाघोषित स्टेशन का सकल राजस्व रु. 3,00,00,000

3. संगीत का उपयोग ( प्रतिशत स्लैब ) 51 % से 60%

4. सकल राजस्व का लागू होने वाला दर = 6%

5. सकल राजस्व पर आधारित लाइसेन्स शुल्क = 3,00,00,000.00 *6% = 18,00,000.00

यह शुल्क पूर्व के सभी शुल्कों को स्थानापन्न एवं विस्थापित करते हुए 1 अप्रैल, 2008 से लागू है तथा 1 अप्रैल , 2008 को या उसके बाद देय सभी रॉयल्टीज के लिए लागू होगा ।

शुल्क 40 - एससीपीः स्टैण्ड एलोन व्यावसायिक परिसर किट्टी पार्टी , जन्म दिन पार्टी, घरेलू/व्यक्तिगत पार्टियों, गेट टुगेदर पार्टी जैसे आयोजन तथा इस प्रकार के अन्य समारोहों, आदि के लिए

1. शुल्क का क्षेत्र :

यह शुल्क रेडियो , टेप , टेलीविजन , विडियो द्वारा इन परिसरों में पाइप्ड म्युजिक के सार्वजनिक प्रदर्शन के लिए लागू है । ( इसमें लाइव प्रदर्शन अथवा डीजे/रिकार्ड किए गए प्रदर्शन द्वारा कोई संगीत बजाना/प्रदर्शन शामिल नहीं है ) खण्ड-4]

प्रत्येक अतिरिक्त वर्ग फीट के लिए रु.1/ - प्रति वर्ग फीट की दर से वसूली की जाएगी ।

इस दर में परिसर के भीतर पाइप्ड म्यूजिक अथवा आंतरिक ध्वनि प्रणाली के माध्यम से सार्वजनिक प्रदर्शन शामिल हैं ।

इस शुल्क में टिकट - युक्त आयोजन, प्रायोजित आयोजन, सेटेलाइट चेनल रिकार्डिंग्स, लाइव प्रदर्शन ( लाइव सिंगिंग ) , डिस्क जोकी आदि शामिल नहीं हैं ।

ऐसे आयोजनों के लिए एलपी/डीजे शुल्क लागू होगा ।

इस शुल्क के अंतर्गत न्यूनतम् रॉयल्टी रु. 10,000/- होगा ।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 जुलाई , 2008 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू होगा ।

शुल्क-39 एसबीः सेटेलाइट प्रसारण

1. शुल्क का क्षेत्र :

यह शुल्क दूरदर्शन तथा टेरेस्ट्रियल टेलीविजन स्टेशनों को छोड़कर सेटेलाइट चैनलों पर टीवी शोज/कार्यक्रमों, प्रसारण पर संगीत के सार्वजनिक ' प्रदर्शन के लिए लागू है।

रॉयल्टी का निम्नलिखित दर लागू होगा :

( क ) संगीत आधारित शो के लिए लाइव सिंगिंग अथवा रिकॉर्डेड म्यूजिक के द्वारा संगीत के प्रदर्शन/बजाने के लिए प्रति म्यूजिकल वर्क/गीत/गीत के भाग , प्रति प्रदर्शन के लिए यह रॉयल्टी रु. 10,000/- होगा। बिना संगीत के शोज जैसे क्विज/टॉक शोज/धारावाहिक, आदि के लिए यह रॉयल्टी रु . 5,000/- प्रति म्यूजिकल वर्क/गीत/गीत के भाग, प्रदर्शन होगा ( लाइसेन्स प्राप्त निष्पादित कार्य की अवधि अधिकतम 3 मिनट की होगी )

( ख ) किसी फीचर फिल्म अर्थात् किसी सेटेलाईट चैनल पर फीचर फिल्म के प्रसारण के दौरान संगीत के प्रदर्शन/बजाने के लिए, पार्श्व संगीत तथा फीचर फिल्म के भाग का निर्माण करने वाले गीत के लिए यह रॉयल्टी रु. 3000/- प्रति घंटा अथवा फीचर फिल्म से चैनल को प्राप्त सकल विज्ञापन राजस्व का 3 %, इसमें जो भी अधिक हो, होगा ।

(ग ) किसी टीवी धारावाहिक में शामिल संगीत अर्थात् पार्श्व संगीत/स्कोर के प्रदर्शन के लिए रु . 2000/- प्रति घंटे अथवा टीवी धारावाहिक से चैनल को प्राप्त सकल विज्ञापन राजस्व के 3 %, इसमें जो भी अधिक हो , की रॉयल्टी वसूल की जाएगी ।

( घ) ( ख ) एवं ( ग ) के अंतर्गत लागू रॉयल्टी इस आधार पर है कि सम्पूर्ण सेटेलाइट चैनल एक वर्ष में 24 घंटे प्रति दिन तथा 365 दिनों पर आधारित है ।

(ङ) इस शुल्क के अंतर्गत रॉयल्टी केवल भारत के क्षेत्राधिकार के लिए ही लागू है ।

4. दर की प्रयुक्तता :

यह शुल्क 1 सितम्बर , 2004 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू होगा ।

रॉयल्टी की निम्नलिखित दरें लागू होंगी :

(क) टेलीवीजन व्यावसायिकों/ विज्ञापनों में संगीत के सार्वजनिक प्रदर्शन ( सिन्क्रोनाईजेशन के द्वारा ) के लिए सभी टीवी/ सेटेलाइट चैनल्स के लिए रॉयल्टी रु . 30,000/- प्रति 30 सेकंड प्रति वर्ष होगी ।

(ख) रेडियो जिंगल्स में संगीत के सार्वजनिक प्रदर्शन (सिन्क्रोनाईजेशन के द्वारा ) के लिए सभी एफएम/एयर स्टेशनों के लिए रॉयल्टी रु. 15,000/- प्रति 30 सेकंड प्रति वर्ष होगी ।

(ग) सिनेमा हालों में प्रदर्शित व्यावसायिकों/विज्ञापनों में संगीत के सार्वजनिक प्रदर्शन ( सिन्क्रोनाईजेशन के द्वारा ) के लिए रॉयल्टी रु. 10,000/- प्रति वर्ष होगी ।

(घ ) इस शुल्क के अंतर्गत न्यूनतम रॉयल्टी रु. 10,000/- होगी ।

4. शुल्क की प्रयुक्तता :

यह शुल्क 1 अक्तूबर , 2004 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टीज के लिए लागू होगा ।

शुल्क 41 : एसआरः सेटेलाइट इन्क्रिप्टेड रेडियो

1. शुल्क का क्षेत्र :

यह शुल्क भारत में उपयोगकर्ताओं/ श्रोताओं /ग्राहकों के लिए ( डायरेक्ट टू होम- डीटीएच ) प्लेटफॉर्म सहित लेकिन उतना ही नहीं के साथ वायर एवं वायरलेस माध्यमों/युक्तियों से इन्क्रिप्टेड अथवा सीमित सिग्नलों द्वारा बीम्ड के माध्यम से सेटेलाईट अथवा अन्य माध्यमों द्वारा संगीत के सार्वजनिक प्रदर्शन ( नान- इंटरैक्टिव ) के लिए लागू है । खण्ड-4]

रॉयल्टी का निम्नलिखित दर लागू होगा :

1. यह रॉयल्टी रु. 2.50 प्रति माह रु. 30 प्रति वर्ष प्रति ग्राहक/रिसीवर प्रति म्यूजिक, प्रति म्यूजिक चैनल/बीम्ड अथवा सकल राजस्व (सब्सक्रिप्शन/विज्ञापन/प्रायोजन आदि सहित ) का15% इसमें जो भी अधिक हो , होगी । न्यूनतम रॉयल्टी रु . 6 लाख प्रति म्यूजिक चैनल प्रति वर्ष होगी ।

अथवा

2. यह रॉयल्टी रु. 30/- प्रति माह/रु. 360 प्रति ग्राहक/रिसीवर प्रति वर्ष , सभी चैनल प्रसारण/बीम्ड के लिए अथवा सकल राजस्व (सब्सक्रिप्शन/विज्ञापन/प्रायोजन आदि सहित ) का15 % , इसमें जो भी अधिक हो, होगी ।

सभी म्युज़िक चैनलों के लिए न्यूनतम रॉयल्टी रु. 100 लाख प्रति वर्ष होगी ।

4. शुल्क की प्रयुक्तता :

यह शुल्क पूर्व के सभी वर्शन्स को विस्थापित करते हुए 1 अप्रैल, 2007 से लागू है तथा उस तिथि को अथवा उसके बाद देय सभी रॉयल्टी के लिए लागू होगा ।

शुल्क 43 : एसआरएसः रिटेल शॉप्स , वीडियो गेम पार्लर ( 500 वर्ग फीट तक ) , ब्यूटी पार्लर्स, हेयर ड्रेसिंग सैलून, कियोस्क स्टॉल्स तथा समान प्रकार के अन्य सभी व्यावसायिक परिसरों

1. शुल्क का क्षेत्र :

1. यह शुल्कों, शुल्कों एवं लाइसेन्सों के लिए लागू सोसायटी की सामान्य शर्तों के अधीन है ।

2. यह शुल्क केवल वहीं लागू है जहाँ वर्ग फीट क्षेत्र अधिकतम 500 वर्ग फीट है ।

3. रॉयल्टी का क्षेत्र :

रॉयल्टी का निम्नलिखित दर लागू होगा :

(क) इन परिसरों में अथवा गैंगवेज , पैसेजेज , फोयर्स आदि तथा समान क्षेत्र में रेडियो एवं/अथवा टेप एवं/अथवा अन्य किसी ऑडियो माध्यम से संगीत के प्रदर्शन /बजाने के लिए

ऐसे परिसरों जहाँ ट्रेड डिस्प्लेज के लिए टीवी सेट्स/वीडियो प्लेयर/ वीडियो उपकरण का व्यवसाय होता है, में टी.वी. एवं/अथवा वीडियो एवं/अथवा अन्य किसी वीडियो माध्यम से संगीत के प्रदर्शन/ बजाने के लिए रॉयल्टी रु. 2,500/- प्रति वर्ष होगा ।

(ग ) जहाँ किसी परिसर के स्वामी द्वारा इस तरह से संगीत का प्रदर्शन /बजाया जाता है जिससे परिसर के बाहरी भाग में डिफ्यूजन होता हो, यह रॉयल्टी दो गुणा होगा क्योंकि व न सिर्फ परिसर में प्रवेश करने वाले व्यक्तियों बल्कि सामान्य आने-जाने वाले लोगों को भी कवर करता है ।

( घ ) इन परिसरों में लाइव प्रदर्शन के लिए एलपी/डीजे शुल्क लागू होगा ।

( ङ) इसके अंतर्गत न्यूनतम रॉयल्टी रु. 1750/- है ।

शुल्क 34: एसटीडी स्पोर्ट्स, सर्कस, मैजिक अथवा एक्रोबेटिक प्रदर्शन

1. शुल्क का क्षेत्र :

यह शुल्क रेडियो, टेप, वीडियो, टेलीविजन अथवा किसी अन्य यांत्रिक माध्यमों से सामान्य मनोरंजन के शो के पूर्व तथा उसके बाद पार्श्व संगीत के रूप में सार्वजनिक प्रदर्शन के लिए लागू है ।

यह शुल्क सिनेमा थिएटर्स में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

शुल्क 36 : टीएसः ट्रैवलिंग शोमेन

1. शुल्क का क्षेत्र :

यह शुल्क रेडियो , टेप , टेलीविजन, वीडियो अथवा अन्य किसी यांत्रिक माध्यमों से अथवा लाईव माध्यमों से प्रदर्शन के किसी निर्धारित स्थान के बिना गतिशील यात्रा करने वाले शोमैन द्वारा अथवा राउंड एबाउट्स, राइडिंग डिवाईसेस, शाईड शोज आदि के सिलसिले में संगीत के सार्वजनिक प्रदर्शन के लिए लागू है ।

आईपीआरएस शुल्कों की सामान्य शर्तें :

1. संगीत ( चाहे लाईव एवं/ अथवा रिकॉर्ड किया गया संगीत हो ) के सभी यूज़र्स को शुल्कों की श्रेणी के अनुसार लाईसेन्स शुल्क का भुगतान करना होगा ।

2. सभी वार्षिक लाईसेंस शुल्कों का भुगतान अग्रिम में अथवा शुल्क में वर्णित समय सीमा अर्थात् एक माह के भीतर अथवा अनुबंध में वर्णित समय सीमा में किया जाएगा ।

3. स्वीकृत किए गए सभी लाइसेंस को आईपीआरएस द्वारा/ उसकी ओर से निष्पादित किया जाएगा तथा इस प्रकार से स्वीकृत लाइसेंस उसमें वर्णित नियमों एवं शर्तों के अधीन होगा तथा उसे लाईसेंसी द्वारा स्वीकार किया गया माना जाएगा ।

4. यदि वार्षिक लाईसेंस शुल्क का भुगतान निर्धारित अवधि में नहीं किया जाता है तो वास्तविक लाईसेंस शुल्क के साथ 18 % ब्याज तथा 18% दंड की वसूली की जाएगी ।

5. अनुपालन नही करने वाले लाईसेंसीज़ जो पूर्व के गतिरोधों/उल्लंघनों/सोसाईटी के अधिकारों एवं लाईसेंसों के उल्लंघन के मामले को नियमित करना चाहते हों, सोसाईटी की इच्छा पर वर्तमान शुल्क के ऊपर 30% का दंड लगाया जाएगा । जबकि अनुपालन करने वाले लाइसेंसी से सोसाईटी की इच्छा पर 5% के छूट की दर पर लाईसेंस शुल्क वसूल किया जाएगा ।

6. शुल्क के प्रत्येक एक वर्ष पूरा होने पर इस शुल्क में आगे 10 % की वृध्दि की जाएगी ।

7. सभी रॉयल्टीज सभी लागू होने वाले वैट/ करों/लेवीज से रहित हैं तथा 12 माह की अवधि के लिए अग्रिम में वसूले जाते हैं तथा उनका भुगतान अवधि के शुरू में किया जाएगा ।

8. यह शुल्क कापीराईट धारकों से कार्य एवं/अथवा ध्वनि रिकॉर्डिंग्स के संदर्भ में ' सिन्क्रोनाईज़ेशन लाईसेंस ' लाईसेंसी द्वारा प्राप्त किए जाने के अधीन है ।

शुल्क की प्रयुक्तता :

1. संगीत ( चाहे लाईव एवं/अथवा रिकॉर्ड किया गया संगीत हो ) के सभी यूजर्स को शुल्कों की श्रेणी के अनुसार लाईसेंस शुल्क का भुगतान करना होगा ।

2. परिसरों को लाईसेंस देते समय , बजायी/ प्रदर्शित की जा रही संगीत की श्रवण क्षमता की सीमा महत्वपूर्ण है । दूसरे शब्दों में यदि संगीत परिसर के किसी खंड में बजाया जाता है, लेकिन वह इस तरह से बजाया जाता है कि परिसर के अन्य खंडों में भी वह सुनाई दे , तो देय लाईसेंस शुल्क की गणना के लिए संपूर्ण क्षेत्र का विचार किया जाएगा ।

3. परिसर के फर्श क्षेत्र/वर्ग फीट का अर्थ है परिसर के दीवार से दीवार तक का क्षेत्र/कार्पेट क्षेत्र ।

4. हल्के एवं भारी वाहनों का वही अर्थ होगा जो आरटीओ प्राधिकरणों द्वारा निर्दिष्ट किया गया है ।

5. ओपन शोज/कंसर्ट आदि के मामलों में 40% स्कीम का लाभ उठाने के लिए ग्राउंड प्लान जमा किया जाना चाहिए । परमिट के लिए आवेदन प्रदर्शन की तिथि से 8 दिन पूर्व में किया जाना चाहिए ।

6. एल.पी. शुल्क के लिए लाईसेंस/परमिट के लिए आवेदन करते समय निरीक्षण के लिए दो पासेज का प्रावधान किया जाएगा ।

(B) For Music played as Inflight Entertainment Service . The following Royalty Rates shall apply:

The Rate is Rs . 3.00 per day per passenger per Plane/Aircraft Seating Capacity per 365 Days . For calculation the number of trips made by each Aircraft is immaterial .

(B) In cases of Gardens Public Parks , Public Pomernades owned by Municipal or other Government Authorities/Bodies the Royalty so calculated above shall be discounted by 50% only where there is no entrance fee .

(D) The Royalty under this Tariff is subject to a minimum of Rs . 20,000/-.

(E) DISCOTHEQUE WILL BE CHARGED AS PER TARIFF DISCO.

4. APPLICABILITY OF TARIFF

TARIFF - 7 - CRB : COMMUNITY RADIO BROADCAST

1. BACKGROUND

Community radio station is one that is operated in the community, for the community, about the community and by the community. Community Radio broadcasts with the objective of serving the cause of the community in the service area and allows greater participation by the civil society on issues relating to development & social change . Programmes for broadcast are relevant to the educational , developmental , social and cultural needs of the community along with some entertainment through playing Music . General objectives of the community radio is to give voice to the people who normally have no access to the mass media nor opportunity to express their views on community development . Community Radio station is aimed at covering an area of 5-10km radius and is governed as per policy and guidelines setby Ministry of Information & Broadcasting, Government of India.

2. SCOPE OF TARIFF

This Tariff Applies to the Public Performance of Music on Community Radio within a specified geographical community by Non -profit Organizations /Universities and well established educational Institutions for non- commercial broadcast with a non profit objective.

3. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

The Institution/Organization shall be ' Non- Profit ' entity.

The Institution/Organization shall not undertake transmission of sponsored programmes except the programmes sponsored by Central & State Governments and other organizations to broadcast public interest information .

The Institution/Organization shall undertake limited advertising and announcements relating to local events , local businesses and services and employment opportunities and the maximum duration of such limited advertising shall not exceed 5 (Five) minutes per hour of broadcast .

The Institution/Organization shall not exceed 120 minutes of playtime of music in a day.

Broadcast by Community Radio station shall be restrictedto an area of 5-10 km radius .

This licence will terminate automatically and immediately if the station engages in any commercial broadcasting ; or if, for any reason , licencee fails to maintain its Ministry of Information and Broadcasting licence as required.

Categorization of Institution/Organization:

Category 'A' -' Non - profit organizations like Civil Society and voluntary organizations registered under the societies act or any other relevant act .

Category 'B'- Universities , Deemed Universities , Professional & Technical Institutes /Colleges , Research Institutes.

Category ' C'- Well established educational institutions.

4. ROYALTY RATES

The following Royalty Rates shall apply for:

Category ' A' Institution/ Organization- Rs 1,50,000 per annum or 5 % of Gross Advertising Revenue which ever is higher .

Category 'B ' Institution/Organization- Rs 1,00,000 per annum or 5 % of Gross Advertising Revenue which ever is higher.

Category ' C' Institution/Organization- Rs 50,000 per annum or 5 % of Gross Advertising Revenue which ever is higher.

5. APPLICABILITY OF TARIFF

On each anniversary of this Tariff there will be an upward revision by 10% for the next 3 years .

(B) Each and every events will be charged @ Rs . 15,000/- per event. Whether Live or DJ levied apart from the above rate.

(1) For Public Performance of Music in Rooms within the Premises , the Royalty Rate shall be Rs . 100 /- p.a. per Room.

(ii) For Public Performance of Music in Restaurants within the Premises , Tariff RB shall apply.

(iii) For Public Performance of Live/DJ Music in Banquet or other areas within premises , Tariff LP /DJ shall apply.

(v) For Public Performance of Music by any means in common areas within the premises , such as in the Lobby, Foyers , Passages , Toilets and the like, the same is covered under the Royalty Rate for Rooms .

(vi) For Public Performance of Music in Discotheques within the Premises , Tariff DISCO shall apply.

(vii) For Public Performance of Music in Departmental Stores , Retail Shops , Showrooms , Video Game Parlour Beauty Parlours , Hair Dressing Saloons , Sauna Baths , Kiosk Stalls and all other Commercial Premises of such nature, Tariff DS shall apply.

TARIFF - 16 - INTB : INTERNET BROADCAST ( NON - INTERACTIVE)

1. SCOPE OF TARIFF

This Tariff Applies to the Broadcast/Streaming/Performance of Indian Music by way of Non- Interactive Internet site(s) or service(s ) through wire or wireless medium/ (s) .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply for Broadcast/Performance on the Internet : -

(A) Rs 5 lakhs for single channel or 15% of Gross Revenue whichever is higher .

(B) Any Additional Channel will be charged at the rate of Rs 10,000/- per such channel ,

(C) Additionally, an EPHEMERAL charge (the Licencee shall pay to the Licencor Storage Fees for the temporary storage of Licenced Works on the Licencee's computer servers ) of Rs 2/- per song per annum will be charged.

(D) The Minimum Royalty under this tariff shall be Rs 5 lakhs .

4. APPLICABILITY OF TARIFF

TARIFF - 17 - INTR : INTERNET BROADCAST ( INTERACTIVE)

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences.

3. ROYALTY RATES

The following Royalty Rates shall apply for Broadcast/ Streaming/ Performance of Music by way of Interactive Internet site/(s) or service/(s) through wire or wireless medium: -

(A) Where there is no charge being levied on the user for the access to such Service/Database . Rs 10 Lakhs OR 15% of Gross Revenue whichever is higher.

(B) Where there is a charge being levied on the user for access to such Service/Database .

Rs12 Lakhs OR 15% of Gross Revenue whichever is higher.

(C) Additionally, an EPHEMERAL charge (the Licensee shall pay to the Licensor storage fees for the temporary storage of licensed Works on the Licensee's computer servers ) of Rs 2 /- per song per annum will be charged.

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1st April , 2006 and appliesto all Royalties falling due on or after that date .

TARIFF - 44 - RSTS : RAILWAYS STATIONS

1. SCOPE OF TARIFF

This Tariff also applies to the Public Performance of Music at Railway Stations , Concourses , and Waiting Foyers /Areas by way of Radio, Tape , Video , and Television or by any other mechanical means .

2. GENERAL, CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply:

(A) Minimum Royalty

(i) Metro City Stations/ Terminus - Rs . 50000/- p.a.

(ii) Satellite Town Stations Rs . 25000/- р.а.

(iii) Normal Local City Stations - Rs . 10000/- p.a.

Up to 10000 sq.ft. Minimum Royalty shall apply beyond that each sq.ft. Shall be charged @ Rs . 5/- for Metro , Rs . 3 /- Satellite , Rs . 2/- for Normal Stations .

(B) For Public Performance of Music in Restaurants within the Premises , Tariff "RB " shall apply. (Third Party for e.g. Barista, Café Coffee Day, Rajdhani etc.)

(C) For Public Performance of Music in Discotheques , Shopping Arcades Pub , Live Performances etc. within the Premises, Society's respective Tariff shall apply.

4. APPLICABILITY OF TARIFF

This l'ariff comes into force from 1st April , 2009 and applies to all Royalties falling due on or after that date.

TARIFF - 19 : JB : JUKE - BOX

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music at Public Places like Restaurants , Cafés , Shops and Establishments and such Commercial Premises .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences.

This Tariff comes into force from 1 April , 2005 and applies to all Royalty falling due on or after that date . TARIFF - 20 - LP: LIVE/DJ ( Recorded Music) PERFORMANCES/EVENTS AT VENUES

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music by way of Live Performance , DJ Music & Live with the DJ (Recorded Music) means at any Premises whatsoever .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply:

"LP" means Live Performance i.e. where- in the Performance /Show/Event is happening with a Singer singing on the stage along with musicians playing as Orchestra and also solo Performance .

"DJ" means playing of recorded music (including minus one tracks ) by a Disc Jockey or any person through a sound system.

(C) In case where the Event/Performance /Concert/Program/Fashion shows is being recorded (whether for Audio or Audio Visual purposes) of charges for the purposes of commercial exploitation of that Event/Performance/Concert / Program/Fashion shows/or Recording of that Event/Performance / Concert/Program/Fashion shows, the Royalty shall be Rs . 75/ - per seat , subject to minimum royalty payable Rs . 75,000/- per show.

NOTE : This does not include the Telecast license which will be obtained by the respective channel/broadcaster.

(D) Royalty payable under above Tariffs shall be on the Total Capacity of the Premises irrespective of the occupancy. TARIFF - 22 - MDJ : MOBILE DISC JOCKEYS

1. SCOPE OF TARIFF

This Tariff applies to the providers of Sound Equipments /Music to private Domestic Individuals for Public Performance ofMusic by Audio Medium at any Residential Premise/Outdoor Areas for purposes of Birthday Parties , Domestic/Personal Parties, Religious Parties , Kitty Parties and the like and which do not fall within the scope of other Tariffs of the Society.

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply :

Rs . 7,500/- p.a.

Note: At any point of time this License permits to perform only one performance in a day.

This Tariff excluding Ticketed shows , sponsored shows , satellite channel recordings etc. but such performance Tariff LP/ DJ shall apply.

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1 " October , 2007 and applies to all Royalties falling due on or after that date .

TARIFF - 23 - MH : ( DOMESTIC) MUSIC ON HOLD CALL CENTRES /BPO / OFFICES AND OTHER SIMILAR ESTABLISHMENTS

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music when played by Mechanical Means attached to a Telephone Switchboard so as to be audible to incoming callers before they are connected to an internal extension by way of Radio , Tape, Television , Video or any other Mechanical Means .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply :

This Tariff applies to the Public Performance of Music in Buses , Vans , Taxis , Autorickshaws , Motor Coaches and such other Commercial Vehicles whether for public transportation or private hire for the purposes of business by way of Radio, Tape , Television, Video or by any other Mechanical Means .

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music at PUB (where there is an admission charge) .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3.ROYALTY RATES

The following Royalty Rates shall apply:

(A) For performing /playing of music by way of Recorded Music , Radio and/ or any other Audio Medium the Rate shall be upto 1000 sq. ft . Rs . 15,000/- p.a. each additional square feet will be charged @ Rs . 10/ -per sq . ft . p.a. (B) For Performing/playing music by way of Video Medium the Rate shall be Rs . 5000/ - per set .

(D) Where there is a Commercial Dance Floor/Regular Live band/Orchestra , the Royalty shall be Rs . 50/ - per sq.ft. p.a. (E) The Minimum Royalty under this tariff shall be Rs . 15,000/-.

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1 July , 2008 and applies to all Royalties falling due on or after that date .

TARIFF - 27 - PUBL : PUBLICATIONS

1. SCOPE OF TARIFF

This Tariff applies to the Publication of either the Musical Composition or the Lyrics of a Musical Work .

2. GENERAL CONDITIONS

This Tariff is subjectto the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply :

(A) For Publication of Musical Notation of the Musical Work and where there is no charge for the Published copy , the Royalty shall be Rs . 4,750/- per thousand copies .

(B) For Publication of Lyrics of the Musical Work and where there is no charge for the Published copy , the Royalty shall be Rs . 3,750/- per thousand copies .

(C) For Publication of Musical Notation or Lyrics of the Musical Work and where there is a charge or price for the Published copy, the Royalty Rate as above shall be enhanced as follows :

TARIFF - 29 - RB : RESTAURANTS , BARS, LUNCH HOMES , COFFEE SHOPS, DINING ROOMS , LOUNGES , CAFES, OFFICE CANTEENS , EATING HOUSES AND ALL PREMISES OF SIMILAR NATURE .

ThisTariff applies to the Public Performance of Music at Restaurant .

This Tariff is subject to the society's General Conditions Applicable to Tariffs and Licences .

The following Royalty Rates shall apply:

(A) For Performing/Playing of Music by way of Radio and/ or any other Audio Medium/Juke Box ( without any charge)/ Video Medium the rate shall be Rs3750/-p.a. per 500 sq.ft. (Total wall to wall floor area of the Premises ) or part thereof (B) For each additional sq . ft . the license fee shall be Rs . 8/- per sq. ft.p.a.

Where there is a Commercial Dance Floor/Regular Live band/Orchestra, the Royalty shall be twice the rate mentioned in(A).

(D) The Minimum Royalty under this tariff shall be Rs . 3750/-.

APPLICABILITY OF TARIFF

TARIFF - 30 - RDB : RADIO BROADCAST

SCOPE OF TARIFF

This Tariff Applies to the Public Performance of Music on Radio through Broadcast .

1. This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licenses.

Forcalculation of Total Annual Royalty/License fee for a radio station in a city following illustration can be taken into consideration:

For a Station belonging to Category A+:

1. Minimum annual royalty/ license fee = Rs . 17,00,000.00

2. Gross revenue of station as declared to GOI Rs . 3,00,00,000.00

3. Music usage (percentage slab ) 51 % to 60 %

4. Applicable Rate of gross revenue = 6%

5. License fee based on gross revenue = 3,00,00,000.006% Rs . 18,00,000.00

Total Annual Licensee Fee (either minimum annual license fee ( 1 ) or license fee based on gross revenue (5) whichever is greater ) = Rs . 18,00,000.00

Difference of License fees based on gross revenue subject to minimum annual royalty/license fee (if excess ) payable =Rs . 1,00,000.00

4. It is clarified that this Tariff concerns Radio Broadcast only and does not cover Network or Re - Broadcast .

5. APPLICABILITY OF TARIFF

This Tariff replaces and supersedes all previous tariffs and comes into force from 1st April , 2008 and applies to all royalties falling due on or after 1 " April , 2008 .

TARIFF - 40 - SCP : STAND ALONE COMMERCIAL PREMISES FOR EVENTS LIKE KIDDIES PARTIES , BIRTHDAY PARTIES DOMESTIC/ PERSONAL PARTIES GET- TOGETHER PARTIES AND ALL OTHER SIMILAR FUNCTIONS , ETC. 1. SCOPE OF TARIFF

ThisTariff applies to the Public Performance of Piped Music at this Premises by way of Radio , Tapes , Television, Video . (excludes any playing/performance of music by Live performance or DJ /Recorded Performance. )

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The Royalty under this Tariff is subject to a minimum of Rs . 10,000/-.

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1st July, 2008 and applies to all Royalty falling due on or after that date.

TARIFF - 39 : SB : SATELLITE BROADCAST

1. SCOPE OF TARIFF

This tariff applies to the Public Performance of Music on TV shows /Programmes , broadcast on Satellite Channels, excluding Doordarshan and Terrestrial Television stations.

2. GENERAL CONDITIONS

This tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty rates shall apply :

a) For performing/ playing of Music by way of live singing or recorded music , for Music based shows , the Royalty shall be Rs . 10,000/- per Musical work/song/ part of a song, per performance. For non music based shows like quiz/ talk shows /serials etc , the royalty shall be Rs . 5,000/- per Musical work/song/part of a song, per performance . (The duration of licensed work performed is upto a maximum of 3 minutes .

b) Forperforming/playing of music included in a feature film i.e. during the telecast of a feature film on a Satellite Channel, the background music and the songs that form a part of the feature film, the royalty shall be Rs . 3000/- per hour or 3% of the Gross advertising revenue of the Channel from feature films , whichever is higher.

c) For performing of music i.e. background music/score included in a TV serial , the royalty shall be Rs . 3000/- per hour or 3% Gross advertising revenue of the channel from TV serials , whichever is higher .

d) The Royalty applicable under (b ) and ( c) is on the basis that the entire Satellite Channel is licenced on a 24hr per day and 365 days in a year.

e) The Royalty under this tariff is only applicable for the territory of India.

This Tariff applies to the Public Performance of Music on Ships , Catamarans , Boats and such other vessels by way of Radio and/ or any other audio / video medium/Live Band/Orchestra.

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences.

3. ROYALTY RATE

(A) The following Royalty Rates shall apply:

This Tariff applies to the Public Performance of Music in TV Commercials / Radio Jingles and Films or any Audio Medium .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply:

(A) For Public Performance (by way of Synchronisation) of Music in Television Commercials /ads , the Royalty shall be Rs. 30,000/- per 30 Second for all TV/ Satellite Channels , per annum .

(B) For Public Performance (by way of Synchronisation ) of Music in Radio Jingles , the Royalty shall be Rs . 15,000/ - per30 Second for all FM /AIR Stations , per annum.

(C) For Public Performance (by way of Synchronisation ) of Music in Commercials/Ads exhibited in Cinema Halls , the Royalty shall be Rs . 10,000/- per annum .

(D) The Minimum Royalty under this tariff shall be Rs . 10,000/- .

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1st October, 2004 and applies to all Royalties falling due on or after that date .

TARIFF - 41 : SR : SATELLITE/ ENCRYPTED RADIO

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music (Non - interactive ) by Satellite or any other means (beamed by encrypted or restricted signals through wire or wireless means /devices including but not limited to Direct to Home-DTH platform) to users / listeners /subscribers in India.

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

565 3. ROYALTY RATES

The following Royalty Rates shall apply:

1. The Royalty will be Rs . 2.50 per month/Rs . 30 Per annum per Subscriber/Receiver per music per music channel broadcast/beamed or 15% of Gross Revenue (including Subscription/Advertisement/ Sponsorship etc. ) whichever is higher. The minimum royalty will be Rs . 6 lacs per music channel per annum.

2. The Royalty shall be Rs . 30 Per month/Rs . 360 Per Subscriber/Receiver per annum for all channels broadcast/beamed or 15% of Gross Revenue ( including Subscription/Advertisement/ Sponsorship etc. ) whichever is higher. The minimum Royalty willbe Rs . 100 lacs for all music channel per annum.

4. APPLICABILITY OF TARIFF

ThisTariff replaces all previous versions and comes into force from 1st April , 2007 and applies to all Royalties falling due on or after that date.

TARIFF - 43 : SRS : RETAIL SHOPS, VIDEO GAME PARLOURS ( up to 500 Sq. Ft. ), BEAUTY PARLOURS, HAIR DRESSING SALOONS, KIOSKS, STALLS AND ALL OTHER COMMERCIAL PREMISES OF SIMILAR NATURE .

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music at the premises either for the staff members or for the general public.

2. GENERAL CONDITIONS

1. This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licenses.

2. This Tariff applies only where the sq.ft area is not exceeding 500 sq. ft.

3. ROYALTY RATES

The following Royalty Rates shall apply :

(A) For Performing/Playing of Musicby way of Radio and/ or Tape and/ or any other Audio Medium whether within the premises or in Gangways , Passages , Foyers etc. and the like:

FLOOR AREA

ROYALTY RATE

Upto 500 Square Feet (Built up)

Rs. 1750/- p . a.

(B) For Performing/Playing of Music by way of T.V. and/ or Video and/or any other video Medium :

1 to 10 T.V. Sets

Rs . 2000/- per set

11 to 50 T.V. Sets

Rs. 750/- per set

ForPerforming/Playing of Music by way of T.V. and/or Video and/ or any other video Medium at Premises which deal in the sale of T.V. sets/Video Player /Video Equipment for the trade displays the Royalty shall be Rs . 2500/- p. a. (C) Where a premise owner is playing/performing Music in such a way that the diffusion is to the outside of the premises , the Royalty will be double, since he is not only covering people who are entering the premises but also common passers -bye .

(D) Live Performance at the Premises Tariff LP/DJ Shall apply.

(E) The Minimum Royalty under this tariff shall be Rs. 1750/-.

ThisTariff comes into force from 1st July, 2008 and applies to all royalties falling due on or after that date .

TARIFF - 34 : STD : SPORTS , CIRCUSES, MAGIC OR ACROBATIC PERFORMANCES

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences.

The following Royalty Rates shall apply:

Rs. 3/- per seat on total capacity.

For calculation, the number of seats actually occupied is immaterial . The rate is charged on the total capacity of the Premise.

ForLive Performances , Tariff LP shall apply.

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1st April , 2005 and applies to all Royalties falling due on or after that date.

TARIFF - 35 : THS : CINEMA THEATRES

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music in Cinema Theatres .

2. GENERAL CONDITIONS

This Tariff is subject to the Society's General Conditions Applicable to Tariffs and Licences .

3. ROYALTY RATES

The following Royalty Rates shall apply:

Rs. 1,200/- p.a. per theatre

4. APPLICABILITY OF TARIFF

ThisTariff comes into force from 1st April , 2005 and appliesto all Royalties falling due on or after that date .

TARIFF - 36 : TS : TRAVELLING SHOWMEN

1. SCOPE OF TARIFF

This Tariff applies to the Public Performance of Music by Travelling Showmen moving around without any fixed place ofPerformance or in connection with roundabouts , riding devices, side shows etc. on open spaces or temporary fairgrounds by way of Radio , Tape , Television , Video or any other Mechanical Means or by Live Means .

2. GENERAL CONDITIONS

This Tariff is subjectto the Society's General Conditions Applicable to Tariffs and Licences.

3. ROYALTY RATES

The following Royalty Rates shall apply :

The Royalty shallbe Rs . 1,500/- per show at any one Static Place .

4. APPLICABILITY OF TARIFF

This Tariff comes into force from 1st April, 2005 and applies to all Royalties falling due on or after that date .

GENERAL CONDITIONS ON IPRS TARIFFS

1. All the users of the music ( Whether Live and/or Recorded Music ) should pay the licence fees as per the category of thetariffs.

2. All the Annual Licence fees should be paid in advance or within the stipulated time mentioned in the tariff i.e. within a month or as mentioned in the Agreement .

3. All Licences granted shall be executed by/ on behalf of IPRS and the licence so granted shall be subject to the terms contained therein and shall be deemed to be accepted by the licencee .

4. If the Annual licence fees are not paid within the stipulated period , then an 18% Interest and 18% Penalty will be charged together with the Actual Licence fees .

5. With regard to Non- Compliant Licencees who seek to regularise past infringements /violations /breach of Society's rights and licences (including non- compliance with agreements , usage without licence , vexatious litigation , etc. ) , a penalty of 30% over the existing tariff shall be applied at the discretion of Society, where as compliant licencees will be charged the licence fees at a rate discounted at 5% at the discretion of the Society.

6. On each anniversary of the Tariffs there will be an upward revision of 10 % .

567 7. All Royalties are exclusive of all applicable VAT/taxes /levies and are charged in advance for the period of 12 months and are to be paid at the beginning of the period.

8. This tariff is subject to the Licencee's obtaining the " Synchronization Licence " with regards the work and/ or sound recordings from the copyright holders .

APPLICABILITY OF TARIFF

1. All the users of the music ( Whether Live and/or Recorded Music ) should pay the licence fees as per the category of the tariffs.

2. While Licensing any Premises, the extent of audibility of Music being played/performed is material . In other words , even if music is being played in a section of the premises , but it is in such a manner that the same can be heard in other sections of the premises as well, the entire area has to be considered for calculation of the Licence Fees payable .

3. Floor Area/ Square Feet of the Premises means the Wall to Wall Area/Carpet Area of the Premises .

4. Light & Heavy Vehicles shall have the same meaning as assigned by the R.T.O. Authorities .

5. In cases of open Shows/Concerts etc. Ground Plan should be submitted to avail the 40 % Scheme . The Application for the permit should be made 8 days prior to the date of the performance.

6. Two passes should be provided for the inspection while applying for a Licence/Permit for the LP Tariff.
