आ.अ. 87.-यतः भारत निर्वाचन आयोग का समाधान हो गया है कि त्रिपुरा विधानसभा 2008 के साधारण निर्वाचन के लिए 56- धर्मानगर विधानसभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री अंजन शुक्ल बैध लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए नियमों एवं आदेशों द्वारा अपेक्षित अपने निर्वाचन - व्ययों का लेखा दाखिल करने में असफल रहे ; और
यतः , उक्त अभ्यर्थी श्री अंजन शुक्ल बैध ने सम्य्क सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण या स्पष्टीकरण नहीं दिया है , और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः अब, निर्वाचन आयोग , लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10 - क के अनुसरण में, श्री अंजन शुक्ल बैध , को संसद के 3697 GI /2010
किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।

आ.अ. 92.-यतः आयोग ने 212 - भभुआ विधान सभा निर्वाचन क्षेत्र से वर्ष 2005 ( जनवरी - फरवरी ) में हुए बिहार विधान सभा के साधारण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री रामयश सिंह , ग्राम- कोहारी , पो. दरौली , थाना- भभुआ , जिला- कैमूर भभुआ , बिहार द्वारा अपने निर्वाचन व्ययों का लेखा विधि द्वारा अपेक्षित रीति से दाखिल नहीं करने के कारण लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अधीन अपने दिनांक 7 मार्च , 2008 के आदेश संख्या 76/बिहार- वि.स. /2006 द्वारा संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने के लिए अथवा होने के लिए और आयोग के दिनांक 8 जून , 2007 के नोटिस संख्या बिहार- वि.स ./212 / 2005 प्राप्त होने के बाद भी लेखा दाखिल करने में हुई त्रुटियों का परिशोधन नहीं करने के कारण निरर्हित कर दिया है ;
और , यतः उक्त श्री रामयश सिंह ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन उक्त आदेश के विरूद्ध एक अपील दिनांक 16-07-2010 दायर की है और अपनी उस अपील में बताए गए कारणों के आधार पर निरर्हता हटाने के लिए अनुरोध किया है । यतः लोक प्रतिनिधित्व अधिनियम , 1951 के अधीन की गई अपील को सुनने और निर्णय करने के लिए सक्षम प्राधिकारी ने निर्णय किया है कि दिनांक 7 मार्च , 2008 के आदेश संख्या 76/बिहार - वि.स. /2006 के द्वारा श्री रामयश सिंह पर लगाई गई निरर्हता 24-9-2010 से हटा दी जाएगी ।
अतः , अब आयोग के तारीख 7 मार्च , 2008 के आदेश संख्या 76/बिहार- वि.स./2006 के साथ संलग्न सारणी की क्रम संख्या 12 पर स्थित श्री रामयश सिंह का नाम 24-9-2010 से हटा दिया जाएगा ।

Whereas , the Commission , Vide it's Order No. 76/BR - LA/2006 dated 7th March 2008 , had disqualified under Section 10A of the Representation of the People Act , 1951 , Shri Ram Yash Singh , Village- Kohari , Post - Darauli , P.S. -Bhabua , Distt- Kaimur (Bhabua) , Bihar , a contesting candidate for the General Election to the Bihar Legislative Assembly from 212 - Bhabua Assembly Constituency , held in the year (January- February) 2005 , for being chosen as , and for being a member of the either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from 7th March , 2008 , for not lodging the account of his election expenses in the manner required by law and not corrected/ amended or removed the defects in the accounts even after receipt of a notice No. BR - LA/ 212 / 2005 dated 08-06-2007 , by the Commission in this regard :
And Whereas ,, the said Shri Ram Yash Singh has preferred an appeal under Section 11 of the Representation of the People Act , 1951 against the said order and has requested for the removal of the disqualification for the reasons stated in the said appeal dated 16-07-2010 .
Whereas , the competent authority to hear to decide the appeal under Section 11 of the R.P. Act , 1951 has vide its order dated 24th September , 2010 has decided that the disqualification imposed on said Shri Ram Yash Singh vide order No. 76/BR - LA/ 2006 dated 7th March , 2008 , shall be removed with effect from 24-09-2010 onwards .
Now, therefore , the name of Shri Ram Yash Singh appearing at Serial No. 12 of the Table appended with Commission's order no . 76/ BR- LA/ 2006 dated 7th March , 2008 shall be omitted w.e.f. 24th September , 2010 .

आ.अ. 93 ,-यतः आयोग ने अपने दिनांक 9 फरवरी , 2009 के आदेश सं 76/बिहार- वि.सं. /2006 द्वारा लोक प्रतिनिधित्व अधि नियम , 1951 की धारा 10 क के अधीन श्री अनजार अहमद खां , ग्राम पो.- तुलापतगंज , थाना- घोघरडिहा , जिला- मधुबनी , बिहार जिन्होंने वर्ष ( जनवरी - फरवरी ) 2005 में बिहार विधान सभा के लिए हुए साधारण निर्वाचन में 80- झंझारपुर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ा था को विधि द्वारा अपेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल नहीं करने और इस संबंध में आयोग के दिनांक 01-09-2006 के नोटिस सं. बिहार - वि.सं./80/2005 प्राप्त करने के पश्चात् भी अपने लेखा की त्रुटियों में सुधार/ संशोधन नहीं करने के कारण संसद के किसी भी सदन या किसी राज्य की विधान [भाग II- खण्ड 3 (iii) ]
सभा या विधान परिषद् का सदस्य चुने जाने और होने के लिए 9 फरवरी , 2009 से तीन वर्ष की अवधि के लिए निरर्हित कर दिया था । और, यतः कथित श्री अनजार अहमद खां ने उक्त आदेश के विरुद्ध लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 के अधीन एक अपील प्रस्तुत की है तथा दिनांक 29-07-2009 की उक्तअपील में बजाए गए कारणों के लिए निरहर्ता को हटाने का अनुरोध किया है!
यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 के अधीन आयोग ने श्री अनजार अहमद खां द्वारा प्रस्तुत की गई दिनांक 29-07-2009 की अपील पर उनके द्वारा उच्च न्यायालय की पटना पीठ के समक्ष दर्ज की गई सी डब्लू जे सी सं. 13987/2010 ( इनजार अहमद खां बनाम भारत संघ) , इसकी एक प्रति आयोग को अग्रेषित की गई थी , में अपील द्वारा उल्लिखित तथ्यों के प्रकाशन में विचार किया है, उक्त याचिका में उल्लिखित मामले के तथ्यों का ध्यान में रखते हुए तथा इस मामले के सभी पक्षों पर विचार करते हुए , आयोग आदेश सं. 76/बिहार- वि.सं./2006 , दिनांक 09-02-2009 द्वारा लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अधीन श्री अनजार 'अहमद खां पर आरोपित निरर्हता की अवधि पहले से ही , अर्थात् 09-02-2009 से 23-09-2010 तक की अवधि घटाने पर सहमत हो गया था तथा शेष अवधि अर्थात् 24-09-2010 से 08-02-2012 तक के लिए निरर्हता को हटा लिया गया है ।
अतः , अब आयोग के आदेश संख्या 76/बिहार- वि.स./2006 दिनांक 09-02-2009 से संलग्न सारणी के कम संख्या 02 पर दर्शाया गया श्री अनजार अहमद खां का नाम 24-9-2010 से हटा दिया जाएगा ।

AND WHEREAS, the said Shri Anzar Ahmad Khan has preferred an appeal under Section 11 of the Representation of the People Act, 1951 against the said order and has requested for the removal of the disqualification for the reasons stated in the said appeal dated29-07-2009 .
WHEREAS , under section 11 of the R.P. Act , 1951 the Commission considered the appeal dated 29-07-2009 submitted by Shri Anzar Ahmad Khan in the light of the facts mentioned by the appellant the CWJC No. 13987/ 2010 (Anzar Ahmad Khan Vs. Union of India) filed by him before the High Court of Judicature at Patna, a copy of which was forwarded to the Commission . Having regard to the facts ofthe case mentioned in the said writ petition and taking into account ali aspects of the matter Commission was pleased to reduce the period of disqualification imposed on Shri Anzar Ahmad Khan under Section 10A of the R. P. Act , 1951 vide order No. 76/BR- LA/2006 dated 09-02-2009 to the period already undergone by him , i.e. from 09-02-2009 to 23-09-2010 and remove the disqualification for the remaining period i.e. from 24-09- 2010 to 08-02-2012 .
Now, therefore, the name of Shri Anzar Ahmad Khan appearing at Serial no. 2 of the Table appended with Commission's order no . 76/BR- LA/2006 dated 09-02-2009 shall be omitted w.e.f24-09-2010 .

आ.अ. 94.-लोक प्रतिनिधित्व अधिनियम , 1950 ( 1950 का 43 ) की धारा 13 - क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग राजस्थान सरकार के परामर्श से एतद्वारा श्री विनोद जुत्शी , आई.ए.एस. के स्थान पर श्री अशोक जैन , आई. ए. एस. ( आर. आर. 81 ) को उनके कार्यभार ग्रहण करने कीतारीख से आगामी आदेशों तक के लिए राजस्थान राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. श्री अशोक जैन , आई. ए. एस. राजस्थान सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
3. श्री अशाके जैन , आई. ए. एस मुख्य निर्वाचन अधिकारी; राजस्थान के रूप में कार्य करते हुए राजस्थान के अधीन किसी भी प्रकार काकोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार का सचिव पदभिहित किया जायेगा ।

3. Sh . Ashok Jain , IAS while functioning as the Chief Electoral officer , Rajasthan shall not hold any additional charge whatsovever under the Government of Rajasthan except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat .

In exercise of the powers conferred by sub section ( 1 ) of Section 13A of the Representation of the People Act , 1950 ( 43 of 1950 ) the Election Commission of India in consultation with the Government of Rajasthan hereby nominates Sh . Ashok Jain , IAS , ( RR: 81 ) as the Chief Electoral Officer for the State of Rajasthan with effect from the date he takes over charge and until further orders vide Sh . Vinod Zutshi , IAS .
