सा.का.नि. 195. भारतीय बॉयलर विनियम , 1950 का और संशोधन करने के लिए कतिपय प्रारूप विनियम , भारतीय बॉयलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 31 की उप - धारा ( 1 ) द्वारा यथाअपेक्षित भारत के राजपत्र , भाग II , खंड 3 , उप - खण्ड ( i ) तारीख 1 मई , 2010 में भारत सरकार के वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) ( केन्द्रीय बॉयलर बोर्ड ) की अधिसूचना संख्यांक सा.का.नि. 80 तारीख 29 अप्रैल , 2010 द्वारा प्रकाशित किए गए थे जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना है , उस तारीख से जिसको उक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं , पैंतालिस दिन की अवधि के अवसान तक आक्षेप और सुझाव आमंत्रित किए गए थे ;

और उक्त राजपत्र की प्रतियां तारीख 17 जून , 2010 को जनता को उपलब्ध करा दी गई थीं;

और कोई आक्षेप या सुझाव प्राप्त नहीं हुए हैं ;

अतः अब , केन्द्रीय बॉयलर बोर्ड , बायलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय बॉयलर विनियम , 1950 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्: -

[PART II- SEC . 3 ( i ) ] 1. संक्षिप्त नाम और प्रारंभ. -( 1 ) इन विनियमों का संक्षिप्त नाम भारतीय बॉयलर दूसरा ( संशोधन ) विनियम , 2010 है । (2) ये राजपत्र में उनके अंतिम प्रकाशन के पश्चात् प्रवृत्त होंगे ।

2. भारतीय बॉयलर विनियम , 1950 ( जिसे इसमें इसके पश्चात् उक्त विनियम कहा गया है ) के विनियम , 282 के उप - विनियम (क ) में खंड ( vi ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: - " ( vi ) मिश्रधातु इस्पात की ढलाइयों में निम्नलिखित अपेक्षाओं का पालन किया जाएगा , अर्थात्: -

तापोपचार : इच्छित विशेषताओं की प्राप्ति के लिए ढलाई को सामान्यकृत्त और मृदुकृत अवस्था में प्रदाय किया जाएगा । सामान्यकृत ढलवा वस्तुएं श्रेणी क के मामले में 595 डिग्री सेंटीग्रेड न्यूनतम और श्रेणी ख के मामले में 675 डिग्री सेंटीग्रेड न्यूनतम तापमान पर पश्चातवर्ती रूप से मृदुकृत किया जाएंगे ।

3. उक्त विनियमों के विनियम 338 में उपविनियम ख की सारणी में , सीवन रहित तण्त के अधीन आने वाले 51 मि.मि. ( 2 " ) से ऊपर 76 मि.मि. ( 2.3 इंच ) तक और 76 मि.मि. ( 3 इंच शामिल ) " अंक , अक्षर और कोष्ठक के स्थान पर " 3.25 मि.मि. ( 0.128 इंच ) " अंक, अक्षर और कोष्ठक रखे जाएंगे ।

4. उक्त विनियमों के विनियम 561 में उपविनियम ( ख ) के खंड ( iv ) के तीसरे पैरा में " परीक्षण 50° सें. ग्रे.. ( 122 ° फा. ) और 100 ° सेंटीग्रेड ( 212 ° डिग्री फा. ) के बीच के ताप पर " शब्दों के स्थान पर " 20 + 2 डिग्री सेंटीग्रेड के ताप पर " शब्द अंक और अक्षर रखे जाएंगे । 5. उक्त विनियमों के विनियम , 611 में उपविनियम (ङ ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्: - " ( च ) सक्षम प्राधिकारी द्वारा अवसर. - सक्षम प्राधिकारी , वैल्डर प्रमाण पत्र की मंजूरी को तब तक अस्वीकृत नहीं करेगा जब तक वह आवेदक को लिखित में सूचना न दे , -

( i ) उन आधारों की सूचना देना जिसमें वैल्डर प्रमाण पत्र मंजूर करने से इंकार करने का प्रस्ताव किया गया है ;

( ii ) उसे सूचना की प्राप्ति की तारीख से तीन सप्ताह की अवधि के भीतर लिखित में अभ्यावेदन करने का युक्तियुक्त अवसर देना और अपनी प्रतिरक्षा में सुने जाने का अवसर देना;

होगा" । ( छ ) सक्षम प्राधिकारी का विनिश्चय, वैल्डर प्रमाण पत्र की मंजूरी की अस्वीकृति पर सक्षम प्राधिकारी का विनिश्चय अंतिम 6. उक्त विनियमों के विनियम 612 के उपविनियम ( घ ) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा अर्थात्: - " ( ङ ) सुने जाने का अवसर. - सक्षम प्राधिकारी वैल्डर प्रमाण पत्र की मंजूरी को तब तक अस्वीकृत नहीं करेगा जब तक वह आवेदक को लिखित में सूचना न दे, -

( i ) उन आधारों की सूचना देना जिसमें वैल्डर प्रमाण पत्र की मंजूर करने से इंकार किया गया है ;

( ii ) उसे सूचना की प्राप्ति की तारीख से तीन सप्ताह की अवधि के भीतर लिखित में अभ्यावेदन करने का युक्तियुक्त अवसर देना और सुने जाने का अवसर देना;

(च ) सक्षम प्राकिारी का विनिश्चय. वैल्डर प्रमाण पत्र की मंजूरी की अस्वीकृति पर सक्षम प्राधिकारी का विनिश्चय अंतिम होगा" ।

7. उक्त विनियमों के विनियम 619 के विनियम ( क ) में " 22.75 लीटर " अंक और शब्द के स्थान पर " 25 लीटर ( ऐसी क्षमता जो फीडचैक वाल्व से मुख्य स्टीम स्टाप वाल्व तक मापी जाती है ) " अंक , शब्द और कोष्ठक रखे जाएंगे ।

8. उक्त विनियमों के प्ररूप उग में टिप्पण को उसके टिप्पण 1 के रूप में संख्यांकित किया जाएगा और इस प्रकार संख्यांकित टिप्पण 1 के पश्चात् निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , अर्थात्:-

" टिप्पण 2 : सुरक्षा वाल्व के मामले में , प्ररूप 3 की मद सं. 11 के अधीन यथा अपेक्षित ब्यौरे और परीक्षण परिणाम को भी विनिर्माता और निरीक्षण प्राधिकारी द्वारा सम्यक् रूप से हस्ताक्षारित करके प्रस्तुत किया जाएगा । " ।

9. उक्त विनियमों के प्ररूप 18 की मद 7 में " फोटाकापी " शब्दों के स्थान पर " फोटोप्रति " शब्द रखा जाएगा । 10. उक्त विनियमों के परिशिष्ट अंक के अंत में निम्नलिखित टिप्पण अंतःस्थापित किया जाएगा , अर्थात्: - " टिप्पण : जब कभी एच पी और ए पी बॉयलरों को उन्हीं अहातों से परिचालित किया जाता है वहां एचपी को यथा लागू निरीक्षण की प्रक्रिया को भी एल पी बॉयलरों में लागू किया जाएगा । "

New Delhi , the 28th October , 2010

G.S.R. 195.- Whereas certain draft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by sub - section ( 1 ) of Section 31 of the Boilers Act, 1923 ( 5 of 1923 ) , in Part - II , Section 3 , Sub - section ( i ) of the Gazette of India dated 1st May , 2010 , vide notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion ) ( Central Boilers Board ) , number G.S.R. 80 , dated the 29th April , 2010 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the ' period of forty - five days from the date on which the copies of the said Gazette notification were made available to the public ;

And whereas , the copies of the said Gazette were made available to the public on the 17th June , 2010 ;

And whereas , no objections or suggestions have been received ;

Now, therefore , in exercise of the powers conferred by Section 28 of the Boilers Act , 1923 ( 5 of 1923 ) , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950, namely :-

1. Short title and commencement.- ( 1 ) These regulations may be called the Indian Boiler ( Second Amendment ) Regulations , 2010 .

(2) They shall come into force after final publication in the Official Gazette .

2. In the Indian Boiler Regulations , 1950 ( hereinafter referred to as the said regulations ) , in regulation 282 , in sub- regulation ( a) , for clause (vi ) , the following shall be substituted , namely:

"(vi) Alloy steel castings shall comply with the following requirements , namely : -

Heat Treatment : The castings shall be supplied in the normalized and tempered condition to obtain the desired properties . The normalized castings shall be tempered at a temperature of 595 ° C min .

Heat Treatment : The castings shall be supplied in the normalized and tempered condition to obtain the desired properties . The normalized castings shall be subsequently tempered at a temperature of 595 ° C min. in case of Gr . A and 675 ° C min in case of Gr . B ; " .

3. In regulation 338 of the said regulations , in sub - regulation (b ) , in the Table , for the figures , letters and brackets "3.35 mm(0.128 in) " occurring under Seamless Hot finished against Over 51 mm (2 in . ) upto and including 76 mm (3 in. ) , the figures , letters and brackets " 3.25 mm ( 0.128 in ) " shall be substituted .

4. In regulation 561 of the said regulations , in sub - regulation ( b ) , in clause ( iv) , in 3rd paragraph , for the words , figures , brackets and letters " the test being carried out at a temperature between 50 ° C ( 122 ° F ) and 100 ° C ( 212 ° F ) " , the words , figures and letters " the test being carried out at a temperature of 20 ± 2 ° C " shall be substituted.

5. In regulation 611 of the said regulations , after sub - regulations ( e ) , the following shall be inserted , namely:

" ( f) Opportunity by the Competent Authority- The Competent Authority shall not refuse to grant of Welder Certificate unless the applicant is given a notice in writing ,-

(i ) informing him of the grounds on which it is proposed to refuse to grant the Welder Certificate ;

(ii) giving him opportunity of, making a representation in writing within a period of three weeks from the date of receipt of notice and being heard;

(g) Decision of the Competent Authority - The decision of the Competent Authority on refusal to grant Welder Certificate thereon shall be final . " .

6. In regulation 612 of the said regulations , after sub - regulation ( d ) , the following shall be inserted , namely:

" ( e) Opportunity of being heard- The Competent Authority shall not refuse to grant of Welder Certificate unless the applicant is given a notice in writing ,

(1) informing him the grounds of refusal to grant the Welder Certificate ;

(ii) giving him opportunity of, making a representation in writing within a period of three weeks from the date ofreceipt of notice and being heard .

(f) Decision of the Competent Authority- The decision of the Competent Authority on refusal to grant Welder Certificate thereon shall be final . " .

7. In regulation 619 of the said regulations , in sub - regulation ( a ) , for the figures and word " 22.75 litres " the figures , words and brackets " 25 litres ( such capacity being measured from the feed check valve to the main steam stop valve ) " shall be substituted .

8. In Form III - C of the said regulations , the Note shall be numbered as Note - l thereof, and after Note - l as so numbered, the following Note shall be inserted , namely:

"Note- 2: In case of safety valves , details and test results as required under item No. 11 of Form III shall also be furnished duly signed by the manufacturer and Inspecting Authority . " .

सा.का.नि. 196. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और जल संसाधन मंत्रालय , स्टाफ कार ड्राइवर , भर्ती नियम , 2002 को जहां तक उनका संबंध स्टाफ कार ड्राइवर ( विशेष श्रेणी ) के पद से है उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , जल संसाधन मंत्रालय में स्टाफ कार ड्राइवर ( विशेष श्रेणी ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम जल संसाधन मंत्रालय में स्टाफ कार ड्राइवर ( विशेष श्रेणी ) समूह ' ख ' पद भर्ती नियम , 2010 होगा ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण , वेतन बैंड और ग्रेड वेतन या वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण वेतन बैंड और उसका ग्रेड वेतन या वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के कालम ( 2 ) से ( 4 ) में विनिर्दिष्ट है ।

3. भर्ती की पद्धति , आयु सीमा , शैक्षिक अर्हताएं , आदि- उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उक्त पद से संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के कालम ( 5 ) से ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है , 961 [ भाग II- खण्ड 3 (i ) ]

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं , उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

( क ) अंग्रेजी संख्या और अंक पढ़ने के लिए अवश्य समर्थ होना चाहिए। 962

टिप्पणी 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक या

पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्रता सेवा , अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतपूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के

लिए 1 जनवरी , 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना विस्तारित की गई है , से पूर्व किसी अधिकारी द्वारा नियमित आधार पर की गई सेवा उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी सिवाय इसके कि जहां सामान्य ग्रेड वेतन या वेतनमान के साथ एक से अधिक पुनरीक्षित वेतनमान का एक श्रेणी में विलयन किया गया है और जहां यह फायदा केवल उन पदों के लिए विस्तारित किया गया है जिसके लिए श्रेणी वेतन या वेतनमान बिना किसी उन्नयन के सामान्य प्रतिस्थापन ग्रेड है । यदि विभागीय प्रोन्नति समिति विद्यमान है तो उसकी संरचना क्या है

1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Water Resources , Staff Car Driver( SpecialGrade ) Group ' B ' Post Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , its classification , pay band and grade pay or pay scale . The number of said post , its classifi- cation , pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age limit , qualifications , etc.-The method of recruitment , age limit , qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification .-- No person ,

(a) who has entered into or contracted a marriage with a person having a spouse living , or (b) who , having a spouse living , has entered into or contracted a marriage with any person , shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is to permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule .

5. Power to relax .- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may , by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , Scheduled Tribes , ex - serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Note 2: For the purpose of computing minimum qualifying service for

promotion , the service rendered on a regular basis by an officer prior to 1st January , 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post( s) for which that grade pay or pay scale is the normal replacement grade without any upgradation .

प्रतिनियुक्ति:

केन्द्रीय सरकार के अधीन ऐसे अधिकारी-

प्रतिनियुक्ति ( सशस्त्र बल कार्मिकों ) के लिए प्रतिनियुक्ति/पुनर्नियोजन

( क ) ( i ) जो मूल काडर/विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं , या

( ii ) जिन्होंने मूल काडर/ विभाग में वेतन बैंड 3 के 15600-39100 रु + ग्रेड वेतन 5400 रु. या समतुल्य के वेतनमान वाले पदों पर नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में पांच वर्ष नियमित सेवा की है, और

( ख ) जिनके पास प्रशासन , स्थापन और लेखा संबंधी विषयों में पांच वर्ष का अनुभव है ।

प्रतिनियुक्ति/पुनर्नियोजन :

( सशस्स्त्रबल कार्मिक )

कैप्टन या मेजर या समतुल्य रैंक के सशस्त्र बल के ऐसे कार्मिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानान्तरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव 967 [ भाग II खण्ड 3 ( i ) ]

आक्र विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है; तत्पश्चात् उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है यदि ऐसे पात्र अधिकारी पद पर वास्तविक चयन से पूर्व सेवा निवृत्त हो गए हैं या रिजर्व में स्थानान्तरित हो गए हैं तो उनकी नियुक्ति पुनर्नियोजन आधार पर होगी ( सिविल पदों के प्रतिनिर्देश से अधिवर्षिता की आयु तक पुनर्नियोजन ) ।

टिप्पण 1 : प्रतिनियुक्ति की अवधि , जिसके अंतर्गत केन्द्रीय सरकार के उसी

या किसी अन्य संगठन / विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर नियुक्ति की अवधि है, साधारणतया चार वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से पहले ( उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है , नियमित आधार पर की गई सेवा को , सिवायं उस दशा के जहां एक के अनधिक पूर्व पुनरीक्षित वेतन का साधारण ग्रेड वेतन/ वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद (उन पदों) पर विस्तारित होगा जिसके लिए ग्रेड वेतन /वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है , आयोग की सिफारिशों के आधार पर विस्तारित उत्स्थानी ग्रेड वेतन/वेतनमान पर की गई सेवा समझी जाएगी ।

G. S. R. 198.- In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Labour Bureau ( Administrative Officer ) Recruitment Rules , 1992 except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules , regulating the method of recruitment to the post of Administrative Officer in the Labour Bureau , an attached Office of the Ministry of Labour and Employment, namely :-

[ PART II - SEC . 3 (i ) ] 1. Short title and commencement .- ( 1 ) These rules may be called the Labour Bureau ( Administrative Officer) , Recruitment Rules , 2010 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of pay . The number of the said post , its classification and the pay band and grade pay attached thereto , shall be as specified in columns (2) to (4) of the Schedule annexed thereto .

3. Method of recruitment , age limit and qualifications , etc. -The method of recruitment , age limit , qualifications and other matters relating to the said post shall be as specified in columns ( 5 ) to ( 14 ) of the said Schedule .

4. Disqualification .-No person, -- (a) who has entered into or contracted a marriage with a person having a spouse living , or

(b) who , having a spouse living , has entered into or contracted a marriage withany person , shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage , and there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may by order , for reasons to be recorded in writing and in consultation with Union Public Service Commission , relax any of the provision of these rules with respect to any class or category of persons .

6. Saving .- Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen , Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Officers under the Central Government-

Deputation ( for Armed Forces Personnel - Deputation/Re-employment )

(a) ( i ) holding analogous post on regular basis in the parent Cadre/Department ;

(ii) with five years regular service in the grade rendered after appointment thereto on a regular basis in posts in pay band - 3 in the scale ofpay of Rs.15600-39100 with grade pay of Rs . 5400 or equivalent in the parent cadre/ department ; and

(b) possessing five years of experience in administration , establishment and accounts matters .

Deputation / Re -employment

(Armed Forces Personnel )

The Armed Forces Personnel of the rank of Captain or Major or equivalent rank who are due to retire or to be transferred to reserve within a period of one year and have the experience prescribed for deputationists under this column shall also be considered. Such officers , will be given deputation terms up to the date on which they are due for release from the armed forces ; thereafter they may be continued on re - employment terms . In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on re - employment basis . ( Re -employed up to the age of superannuation with reference to the civil posts) .

Note 1 : Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation / department of the Central Government shall ordinarily not exceed four years . The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of applications .

Note 2 : For the purposes of appointment on deputation basis , the service rendered on a regular basis by an officer prior to Ist day of January , 2006 ( date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be demed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the pay commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay /pay scale , and where this benefit will extend only for the post (s ) for which that grade pay / pay scale is the normal replacement grade without any upgradation .
