7. और जबकि, दिनांक 30.09.2009 के मामले में विश्वविद्यालय अनुदान आयोग की सिफारिशें केन्द्र सरकार को दिनांक 05.10.2009 को प्राप्त हुई थीं तथा सम विश्वविद्यालय संस्थाओं के संबंध में यूजीसी के दिशा-निर्देश ( 2000 ) के अन्तर्गत सावधानीपूर्वक जांच करने के बाद सरकार द्वारा टिप्पणियां दिनांक 14.12.2009 को यूजीसी को भेजी गई थीं जिनमें विचाराधीन सम विश्वविद्यालय संस्था से स्पष्टीकरण हेतु अनुरोध किया गया था, जिसमें इसके प्रस्तावित कैम्पस से बाहर के केन्द्रों में छात्रों का प्रवेश शामिल था;
सं. एफ. -10-4/2009 यू. -3 ए जबकि विश्वविद्यालय अनुदान आयोग (यूजीसी) अधिनियम , 1956 की धारा 3 में यह उल्लेख किया गया है " केन्द्र सरकार , आयोग की सलाह पर, सरकारी राजपत्र में अधिसूचना के द्वारा यह घोषणा कर सकती है कि उच्चतर शिक्षा की कोई संस्था, विश्वविद्यालय के अलावा , इस अधिनियम के प्रयोजन के लिए सम विश्वविद्यालय होगा तथा उक्त घोषणा कर दिए जाने के बाद इस अधि नियम के समस्तप्रावधान उक्त संस्था पर उसी प्रकर लागू होंगे जैसे कि वह धारा 2 के खंड (च ) के निहितार्थ एक विश्वविद्यालय है" ;
8. और जबकि, यूजीसी ने सम विश्वविद्यालय संस्था द्वारा उपलब्ध कराया गया स्पष्टीकरण अग्रेषित कर दिया था जिसमें अन्य बातों के साथ- साथ यह उल्लेख किया गया था कि तिरूचिरापल्ली स्थित चेन्नई मेडिकल कॉलेज को तमिलनाडु डॉ. एमजीआर चिकित्सा विश्वविद्यालय से सम्बद्ध किया गया था तथा तिरूचिरापल्ली स्थित उक्त मेडिकल कॉलेज ने 2009-10 केसत्र में छात्रों को प्रवेश दिया;
2. और जबकि, केन्द्र सरकार को जनवरी, 2009 में एसआरएम इंस्टीट्यूट ऑफ साइंस एण्ड टेक्नोलॉजी ( एसआरएम विश्वविद्यालय ) , जो एक सम विश्वविद्यालय संस्था है, से एक प्रस्ताव प्राप्त हुआ था जिसमें परिसर से बाहर ( ऑफ कैम्पस ) केन्द्र खोलने के लिए अनुमोदन प्रदान करने तथा इसके द्वारा एसआरएम कॉलेज ऑफ इंजीनियरिंग एण्डटेक्नोलॉजी , इरूंगलूर ( तिरूचिरापल्ली ) और इरूंगलूर ( तिरूचिरापल्ली ) स्थित चेन्नई कॉलेज एण्डहॉस्पिटल को इसके विस्तार में शामिल करने का अनुरोध किया गया था;
9. और जबकि, एसआरएम इंस्टीट्यूट ऑफ साइंस एंड टेक्नोलॉजी मद्रास उच्चन्यायालय में चला गया ( डब्ल्यूपी 10952/2010 ) तथा माननीय उच्चन्यायालय ने अपने दिनांक 15.06.2010 के आदेश के द्वारा सरकार को निदेश दिया कि यदि प्रार्थी का आवेदन पत्र सही है तो विचाराधीन संस्थान को तिरुचिरापल्ली स्थित इसके कैम्पस से बाहर के केन्द्रों को चालू करने के लिए अनुमोदन/स्वीकृति प्रदान करे;
3. और जबकि, यूजीसी अधिनियम , 1956 की धारा 3 के प्रावधानों के तहत् यथा अपेक्षित आयोग की सिफारिशों को प्राप्त करने के लिए प्रस्ताव को03.03.2009 विश्वविद्यालय अनुदान आयोग भेजा गया था;
10. और जबकि, सरकार ने मद्रास उच्च न्यायालय के ऊपर उल्लिखित आदेश के विरुद्ध अपील कर दी ( डब्ल्यू पी 1982/2010 ) तथा माननीय उच्चन्यायालय ने अपील के संदर्भ में अपने 22.09.2010 के आदेश के द्वारा अपने आदेश में संशोधन कर दिया तथा सरकार को विचाराधीन समविश्वविद्यालय संस्था के आवेदन पत्र पर, जिसमें कैम्पस से बाहर केन्द्र शुरू करने के लिए अनुमोदन/स्वीकृति प्रदान करने का अनुरोध किया गया है, विश्वविद्यालय अनुदान आयोग के नियमों और विनियमों के अनुसार विचार करे तथा आदेश की तारीख से चार सप्ताह के अंदर निर्णय लिया जाए;
4. और जबकि, सरकार ने 04.06.2009 को सम विश्वविद्यालय संस्थाओं की पुनरीक्षा करने का आदेश दे दिया , जिसके अंतर्गत सरकार द्वारा गठित पुनरीक्षा समिति द्वारा एसआरएम इंस्टीट्यूट ऑफ साइंस एण्ड टेक्नोलॉजी, समविश्वविद्यालय संस्था, को सारणी- II ( द्वितीय श्रेणी ) में रखा गया अर्थात् संस्थामें कुछ पहलुओं की दृष्टि से कमियां पाई गईं जिन्हें अपने को प्रथम श्रेणी में लाने के लिए और सम विश्वविद्यालय संस्था बने रहने के लिए तीन वर्ष की अवधि के दौरान दूर करना आवश्यक था;
5. और जबकि, पुनरीक्षा समिति की रिपोर्ट सरकार द्वारा सिद्धांत रूप में स्वीकार कर ली गई थी और इसलिए, ऐसी सम विश्वविद्यालय संस्था के विस्तार में और संस्थाओं को शामिल करने से इसका शैक्षिक स्तर खराब हो जाएगा;
11. और आगे जबकि, यूजीसी ( सम विश्वविद्यालय संस्थाएं ) विनियम 26.05.2010 से लागू हो गए हैं तथा विनियम के अनुच्छेद 23 में यह शर्त लगाई गई है कि सभी लंबित प्रस्ताव, आवेदक सम विश्वविद्यालय संस्था के विस्तार में कैम्पस से बाहर के केन्द्रों को शामिल करने सहित, इन विनियमों के द्वारा शासित होंगे;
12. और जबकि , यूजीसी ने अपनी सिफारिशें 09.11.2010 को भेजी हैं जिनमें अन्य बातों के साथ- साथ यह उल्लेख किया गया है कि विचाराधीन "सम विश्वविद्यालय संस्था से तिरूचिरापल्ली स्थित इसके कैम्पस से बाहर के 6. और जबकि, सम विश्वविद्यालय संस्थाओं की पुनरीक्षा संबंधी मामला भारत के माननीय उच्चतम न्यायालय में न्यायाधीन है । [ विप्लव शर्मा बनाम भारत सरकार रिट याचिका ( सी ) 2006 की 142] ;

केन्द्रों को शामिल करने के लिए नए सिरे से आवेदन करने के लिए कहा जाए क्योंकि आयोग ने 27.09.2010 को यह निर्णय लिया है कि तिरुचिरापल्ली स्थित इसके कैम्पस से बाहर के केन्द्रों को शामिल करने के लिए अनुमोदन प्राप्त करने के एसआरएम इंस्टीट्यूट ऑफ साईंस एण्ड टेक्नोलॉजी के प्रस्ताव सहित सभी प्रस्तावों पर यूजीसी ( सम विश्वविद्यालय संस्था ) विनियम 2010 के अनुसार कार्रवाई की जानी चाहिए ।
13. अतः अब, उपर्युक्त परिस्थितियों को ध्यान में रखते हुए और यूजीसी अधिनियम, 1956 की धारा 3 के तहत् अंर्तनिहित शक्तियों का प्रयोग करते हुए और सभी तथ्यों पर विचार करने के बाद सरकार एतद्वारा यूजीसी की दिनांक 09.11.2010 की सिफारिश को स्वीकार करती है और तदनुसार, सम विश्वविद्यालय संस्था यूजीसी ( सम विश्वविद्यालय संस्था) विनियम, 2010 के प्रावधानों के अनुसार एसआरएम कॉलेज ऑफ इंजीनियरिंग एण्ड टेक्नोलॉजी और चेन्नई मेडिकल कॉलेज, दोनों इरूंगलूर ( तिरूचिरापल्ली ) स्थित, को अपने विस्तार में शामिल करने के लिए नए सिरे से आवेदन करे ।
14. यह आदेश सक्षम प्राधिकारी के अनुमोदन से जारी किया जाता है ।

समिति का कार्यकाल इसके गठन की तारीख से तीन वर्ष के लिए होगा । संसद सदस्य, जो इस समिति के सदस्य हैं , सदन भंग होने अथवा उनका कार्यकाल समाप्त होने पर या अन्यथा सदन का सदस्य न रहने पर, समिति के सदस्यनहीं रहेंगे । समिति में स्थान खाली होने पर यदि किसी व्यक्ति को सदस्य नामित किया जाता है तो वह शेष अवधि के लिए ही सदस्य रहेगा । विशेष परिस्थितियों में समिति का कार्यकाल घटाया या बढ़ाया जा सकता है।

deemed to be university wherein it was mentioned inter alia that the Chennai Medical College at Tiruchirapalli was affiliated to Tamil Nadu Dr. MGR Medical University and that the Medical College admitted students in the academic session 2009-2010 ;
9. And whereas , SRM Institute of Science and Technology approached the Madras High Court [WP No. 10952/2010 ] and the Hon'ble High Court vide its order dated 15.06.2010 directed the Government to grant approval/ sanction to the institution in question for starting its off- campus centres at Tiruchirapalli, if the application of the petitioner was in order;
No. F. 10-4/2009- U-3A- Whereas Section 3 of the University Grants Commission ( UGC) Act , 1956 states "The Central Government may, on the advice of the Commission , declare by notification in the Official Gazette, that any institution for higher education , other than a University, shall be deemed to be a University for the purposes of this Act, and on such a declaration being made , all the provisions of this Act shall apply to such institution as if it were a University within the meaning of clause (f) of section 2 " .
2.And whereas , a proposal was received by the Central Government in January 2009 from SRM Institute of Science & Technology (SRM University) , an institution deemed to be university, seeking approval for opening of off-campus centres and thereby seeking inclusion of SRM College of Engineering & Technology , Irungalur (Tiruchirapalli) and Chennai Medical College & Hospital , Irungalur (Tiruchirapalli ) under its ambit ;
10. And whereas , the Government appealed against the aforementioned order of the Madras High Court [ WA No. 1982/2010 ] and the Hon'ble High Court was pleased to modify its order, vide its order in Appeal dated 22.09.2010 and directed the Government to consider the application of the institution deemed to be university in question seeking approval /sanction to start the off- campus centres in accordance with Rules and Regulations of the University Grants Commission and take a decision within four weeks from the date of the order ;
3. And whereas , the proposal was sent to University Grants Commission on 3.3.2009 seeking the Commission's recommendations as required under the provisions of Section 3 of the UGC Act , 1956 ;
11. And further whereas , the UGC (Institutions deemed to be universities) . Regulations have already come into forcewith effect from 26.05.2010 and Regulation 23 therein stipulates that all pending proposals , including those seeking inclusion of off- campus centres under the ambit of the applicant institution deemed to be universities , shall be governed by these Regulations ;
4.And whereas , the Government ordered a review of the institutions deemed to be universities on 04.06.2009 wherein SRM Institute of Science & Technology, an institution deemed to be university, was placed in Table - II (second category) , i.e. , institutions found to be deficient in some aspects which need to be rectified over a three year period for them to transit into the first category for their continuation as institutions deemed to be universities , by the Review Committee constituted by the Government ;
5. And whereas , the Report of the Review Committee was accepted , in principle , by the Government and therefore , bringing further institutions under the ambit of such an institution deemed to be university would weaken its academic standard;
12.And whereas , UGC has sent its advice to the Central Government on 09.11.2010 stating inter alia that the institution deemed to be university in question may be asked to apply afresh for inclusion of its proposed off- campus centres at Tiruchirapalli in accordance with the decision of the Commission on 27.09.2010 that all proposals , including the present proposal from SRM Institute of Science & Technology seeking approval for inclusion of its off-campus centres , viz . , SRM College of Engineering & Technology and Chennai Medical College & Hospital , at Tiruchirapalli , should be processed as per the UGC (Institutions deemed to be universities ) Regulations , 2010;
6. And whereas, the matter regarding the review of institutions deemed to be universities is sub judice in the Supreme Court of India [Viplav Sharma Vs. UoI WP (C) 142 of2006];
13. Now, therefore , in view of the above circumstances and in terms ofthe provisions of Section 3 of the UGC Act, 1956, the Central Government, after considering all relevant facts, hereby accepts the advice of UGC dated 09.11.2010 . Accordingly, the institution deemed to be university may apply afresh for inclusion of SRM College of Engineering & Technology and Chennai Medical College , both located at Irungalur (Tiruchirapalli ) , under its ambit, in accordance with the UGC ( Institutions deemed to be universities ) Regulations , 2010.
14. This order issues with the approval of the Competent Authority.
7: And whereas, the recommendations of the University Grants Commission (UGC) in the matter dated 30.09.2009 were received by the Central Government on 05.10.2009 and after careful examination under the UGC Guidelines (2000) in respect of institutions deemed to be universities , observations were communicated by the Government to the UGC on 14.12.2009 seeking clarifications from the institution deemed to be university in question including admission of students in the proposed off- campus centres thereof;

If a vacancy arises in the Samiti , the member nominated against that vacancy shall hold office for the remaining period . Under special circumstances the tenure of the Samiti may be curtailed or extended .
