3. इस तदर्थ नियुक्ति से वे सहायक विधि सलाहकार के ग्रेड में नियमित नियुक्ति हेतु किसी प्रकार का कोई दावा नहीं कर सकेंगी और न ही उनके द्वारा की गई उक्त सेवा की गणना उच्चतर ग्रेड में वरिष्ठता के प्रयोजन के लिए की जाएगी ।

सं. 16013/29/2008- आई पी एस II- जबकि, श्री राहुल राय सूर , आई पी एस ( महाराष्ट्र: 81 ) को न्यूयार्क स्थित संयुक्त राष्ट्र के संगठन, अंतर्राष्ट्रीय प्रवासी सेवा के कार्यालय में 15.7.1997 को छः महीने की अवधि के लिए प्रतिनियुक्ति आधार पर, अन्वेषक के रूप में नियुक्त किया गया था। उनकी प्रतिनियुक्ति की अवधि को समय - समय पर बढ़ाया गया तथा प्रतिनियुक्ति की अंतिम विस्तारित अवधि 31.05.2004 तक थी । 31.05.2004 के बाद उनकी प्रतिनियुक्ति को बढ़ाने हेतु उनके द्वारा किए गए अनुरोध पर गृह मंत्रालय द्वारा विचार किया गया और इसे स्वीकार नहीं किया गया है । उन्हें दिनांक 04.09.2004 के पत्र के तहत् इस मंत्रालय द्वारा 31.10.2004 तक अपना कार्यभार ग्रहण करने को कहा गया;

और जबकि, श्री राहुल राय सूर ने उपर्युक्त पत्र का कोई उत्तर नहीं दिया है, उन्हें दिनांक 02.03.2005 को इस बारे में एक नोटिस जारी किया सं. के. 11019/2/2010- यू.एस.- II-- राष्ट्रपति, भारत के संविधान के अनुच्छेद 223 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, पंजाब एवं 76
गया कि उनकी विदेश सेवा की अनुमोदित अवधि के बाद उनकी अनाधिकृत अनुपस्थिति के लिए अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7 (2 ) ( ग ) के उपबंध अर्थात् मानित त्याग - पत्र उन पर क्यों न लागू किए जाएं ;
और जबकि, उक्त श्री राहुल राय सूर ने उपर्युक्त नोटिस का कोई उत्तर 'नहीं दिया है, इस मंत्रालय के दिनांक 20.05.2005 के पत्र के तहत्, उनसे स्पष्टीकरण भेजने को कहा गया । उन्हें उक्त पत्र के प्राप्त होने की तारीख से 10 दिन के अन्दर अपना उत्तर प्रस्तुत करने का एक अंतिम अवसर दिया गया जिसके न होने पर , पूर्वोक्त नियमों के उपबंधों के तहत् उनके विरुद्ध कार्रवाई की जाएगी;
और जबकि, उक्त श्री राहुल राय सूर , आई पी एस ने उक्त पत्र पर भी ध्यान नहीं दिया;
और जबकि, मामले पर आगे विचार किया गया और उनकी निरंतर अनाधिकृत अनुपस्थिति तथा इस मंत्रालय के पत्रों का उत्तर न देने को ध्यान में रखते हुए उनके मामले में उक्त नियम के नियम 7 ( 2 ) ( ग) के उपबंधों को लागू करना वांछनीय पाया गया;
और जबकि, राष्ट्रपति ने उक्त नियम के नियम 7 ( 2 ) (ग) के उपबंधों द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए दिनांक 26.09.2005 को उनके माने गए त्याग - पत्र की अधिसूचना जारी की । श्री राहुल राय सूर अधिसूचना की तारीख से भारतीय पुलिस सेवा से कार्यमुक्त हो गए;

आई पी एस को दिनांक 31.10.2004 से सरकारी सेवा से स्वैच्छिक रूप से सेवानिवृत्त समझा जाए तथा उन्हें आवश्यक पेंशन संबंधी देय राशि का भुगतान कर दिया जाए;
अतः अब सक्षम प्राधिकारी यह आदेश देते हैं कि श्री राहुल राय सूर, आई पी एस ( महाराष्ट्र 81 ) को दिनांक 31.10.2004 से सरकारी सेवा से स्वैच्छिक रूप से सेवानिवृत्त हुआ माना जाए । वह इस तारीख से भारतीय पुलिस सेवा से कार्यमुक्त हो गए हैं । इसे तद्नुसार अधिसूचित किया जाता है ।

और जबकि , इस मंत्रालय ने अधिकरण के उपर्युक्त आदेशों के विरुद्ध दिल्ली उच्च न्यायालय के समक्ष अपील ( रिट याचिका सं. 6512/ 2008) दायर की थी;

और जबकि, उच्च न्यायालय ने दिनांक 08.11.2010 के अपने आदेशों के तहत् यह टिप्पणी की कि दिनांक 04.09.2004 के पत्र की तामीली न होना श्री राहुल राय सूर के लिए प्रतिकूल प्रभाव डालने वाला सिद्ध हुआ है । उच्च न्यायालय ने आशोधन के साथ दिनांक 26.9.2005 के आदेश को खारिज कर दिया तथा निदेश दिया कि श्री राहुल राय सूर को दिनांक 31.10.2004 से स्वैच्छिक रूप से सेवानिवृत्त समझा जाये । उच्च न्यायालय ने यह भी निदेश दिया कि आदेश की तारीख से तीन माह की अवधि के अन्दर उन्हें आवश्यक पेंशन संबंधी देय राशि का भुगतान कर दिया जाए जिसके न होने पर 3 माह के पश्चात् से भुगतान की तारीख तक 6% वार्षिक की दर से देय राशि पर ब्याज प्रभारित होगा;
और जबकि , उच्च न्यायालय के दिनांक 08.11.2010 के उपर्युक्त आदेशों को ध्यान में रखते हुए सक्षम प्राधिकारी द्वारा मामले की आगे और जांच की गई तथा मामले के सभी पहलुओं पर विचार करते हुए सक्षम प्राधिकारी ने यह निर्णय लिया है कि उक्त श्री राहुल राय सूर ,

2. अनुभाग अधिकारी के रूप में उपरोक्त सहायकों की तदर्थ पदोन्नति निम्नलिखित नियम एवं शर्तों के अधीन होगी :
(क) यह तदर्थ नियुक्ति कामचलाऊ व्यवस्था होने के कारण अधिकारियों को अनिश्चितकाल तक ग्रेड में बने रहने या नियमित नियुक्ति के लिए चयन सूची में उनका नाम शामिल किए जाने या अनुभाग अधिकारी के ग्रेड में वरिष्ठता का दावा पेश करने का कोई अधिकार प्राप्त नहीं होगा। (ख ) यह तदर्थ व्यवस्था तब तक चलती रहेगी जब तक कि वरिष्ठता कोटा या सीमित विभागीय प्रतियोगी परीक्षा ( एलडीसीई ) के जरिए या अगले आदेशों तक अनुभाग अधिकारी ग्रेड में नियमित उम्मीदवार उपलब्ध नहीं होते । अगर तदर्थ रूप से नियुक्त व्यक्ति नियमित नियुक्ति हेतु इन दोनों श्रेणियों में अर्ह नहीं होते, तो उन्हें कार्मिक एवं प्रशिक्षण विभाग द्वारा आबंटित उनके संबंधित संवर्ग में उनके ( नियमित अनुभाग अधिकारी ) द्वारा कार्यभार संभालने की तारीख से सहायक ग्रेड में प्रत्यावर्तित कर दिया जाएगा ।

MINISTRY OF HOME AFFAIRS
New Delhi - 1 , the 31st December 2010 No. 16013 /29/ 2008 - IPS.II- Whereas , Shri Rahul Rai Sur , IPS ( MH : 81 ) was appointed as Investigator in the Office of International Overseas Service , an United Nation Organization, New York, on 15.7.1997 on deputation basis for a period of six months. His deputation period was extended from time to time and the last extended period of deputation was upto 31.05.2004 . The request made by him for extension of his deputation beyond 31.05.2004 was considered by the Ministry of Home Affairs and has not been agreed to . He was advised by this Ministry vide letter dated 04.09.2004 to join his duty by 31.10.2004 ;
And Whereas , Shri Rahul Rai Sur has not responded to the above communication , a notice was issued to him on 02.03.2005 as to why the provisions of Rule 7 (2) (c) of the All India Services ( Leave) Rules , 1965 , i.e. , deemed resignation should not be invoked on him for his unauthorized absence beyond the approve period of his foreign service .
And Whereas , the said Shri Rahul Rai Sur has not replied to the above notice , vide this Ministry's letter dated 20.05.2005 , he was asked to furnish his explanation . He was afforded with a last opportunity to submit his reply within 10 days from the date of receipt of the said letter failing which , action will be taken against him invoking the provisions of the aforesaid Rules ;
And Whereas , the said Shri Rahul Rai Sur , IPS choose to ignore the said communication also ;
And Whereas , the matter was further considered and it was found desirable to invoke the provisions of rule 7(2) (c) ibid in his case in view of his continued unauthorized absence and non-response to this Ministry's communications ;
And Whereas , the President , in exercise of the powers conferred by provisions of Rule 7 (2) ( c) ibid , issued a notification of his deemed resignation on 26.09.2005 . Shri Rahul Rai Sur stood relieved from the Indian Police Service from the date of the notification;
And Whereas , Shri Rahul Rai Sur filed an application ( O.A. No. 1505/2007 ) before the Central administrative Tribunal , New Delhi against the aforesaid notification of his deemed resignation ;
And Whereas , the Hon'ble Tribunal vide its orders dated 01.04.2008 , set aside the above notification and directed the Respondents to proceed against the application in accordance with the law;
And Whereas , this Ministry had filed an appeal ( Writ Petition No. 6512/2008) before the High Court of Delhi against the aforesaid orders of the Tribunal ;
And Whereas , the High Court vide its orders dated 08.11.2010 observed that non- service of letter dated 04.09.2004 has resulted prejudice to Shri Rahul Rai Sur. The High Court has set aside the order dated 26.09.2005 with the modification and direction that Shri Rahul Rai Sur be treated

as having voluntarily retired w.e.f. 31.10.2004. The High Court further directed that the necessary pensionary dues payable to him be paid within a period of three months from the date of the order failing which , the amount payable would be charged interest @ 6% per annum reckoned after three months till the date of payment;
And Whereas , the matter was examined further by the Competent Authority in the light of the aforesaid orders of the High Court dated 08.11.2010 , and after considering all aspects related to the case , the Competent Authority has decided that the said Shri Rahul Rai Sur , IPS be treated as having voluntarily retired from Government service w.e.f. 31.10.2004 and necessary pensionary dues be paid to him;
Now, Therefore , the Competent Authority orders that Shri Rahul Rai Sur, IPS ( MH : 81 ) be treated as having voluntarily retired from Government service with effect from 31.10.2004 . He stood relieved from the Indian Police Service from this date . It is notified accordingly.
