आ.अ. 27.—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि सिक्किम विधन सभा 2009 के साधरण निर्वाचन के लिए 26-अरिथांग विधन सभा निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी, श्री अमित वुफमार प्रधन, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए नियमों एवं आदेशों द्वारा अपेक्षित अपने निर्वाचन-व्ययों का लेखा दाखिल करने में असपफल रहेऋ और यतः, उक्त अभ्यर्थी, श्री अमित वुफमार प्रधन ने सम्य्क सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण या स्पष्टीकरण नहीं दिया गया है, और निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं हैऋ
अतः, अब, निर्वाचन आयोग, लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10-क के अनुसरण में, श्री अमित वुफमार प्रधन को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरहत घोषित करता है ।

यतः, श्री पौल नायक, ने निर्वाचन आयोग द्वारा सम्य्क सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण या स्पष्टीकरण नहीं दिया गया है, और निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ
अतः, अब, निर्वाचन आयोग, एतद्द्वारा लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10-क के अनुसरण में, श्री पौल नायक, को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरहत घोषित करता है ।

ORDER New Delhi, the 17th January, 2011
O. N. 27.—Whereas, the Election Commission is satisfied that Shri Amit Kumar Pradhan, a contesting candidate in the General Election to the Sikkim Legislative Assembly, 2009, from 26-Arithang Assembly Constituency has failed to lodge any account of his election expenses, as required by the Representation of the People Act, 1951 and Rules and Orders made thereunder; and
Whereas, the said candidate, Shri Amit Kumar Pradhan, has not furnished any reason or explanation for the said failure even after due notice and the Election Com- mission is thus satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Com- mission hereby declares Shri Amit Kumar Pradhan, to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union.Territory for a period of three years from the date of this order.
