आ.अ. 62.—यतः, निर्वाचन आयोग का समाधन हो गया है कि 12-कृष्णानगर संसदीय निर्वाचन क्षेत्रा से, पश्चिम बंगाल से लोक सभा के लिए साधरण निर्वाचन, 2009 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री मो. नियामतुल्लाह मलिक, ग्राम बोस्तोपोथा पो. आ. उन्तिया. पु.था.-मेमारी जिला वर्ध्मान, लोक प्रतिनिध्त्वि अध्निियम, 1951 एवं उसके अध्ीन बनाए गए नियमों एवं आदेशों द्वारा अपेक्षित निर्वाचन-व्ययों का लेखा दाखिल करने में असपफल रहे हैंऋ तथा यतः, उक्त अभ्यर्थी, श्री मो. नियामतुल्लाह मलिक ने सम्यक् नोटिस दिए जाने के बाद भी उक्त असपफलता का कोई कारण या स्पष्टीकरण नहीं दिया है, और इस प्रकार निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ

आ.अ. 70.—यतः, निर्वाचन आयोग का समाधन हो गया है कि लोक सभा के साधरण निर्वाचन 2009 में 12-उत्तर कन्नड़ लोकसभा निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी, श्री एलिश कोटियाल, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा तद्ध्ीन बनाए गए नियमों और आदेशों द्वारा अपेक्षित निर्वाचन व्ययों के लेखे को प्रस्तुत करने में असमर्थ रहे हैंऋ तथा 58 THE GAZETTE OF INDIA : FEBRUARY 19, 2011/MAGHA 30, 1932 [PART II—SEC. 3(iii)] गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ
अतः, अब, लोकप्रतिनिध्त्वि अध्निियम,1951 की धरा 10 ;कद्ध के अनुसरण में, निर्वाचन आयोग एतद्द्वारा श्री एलिश कोटियाल को इस आदेश की तारीख से तीन वर्ष तक की कालावध् िके लिए उन्हें संसद के किसी भी सदन या राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य होने या चुने जाने के लिए निरहत घोषित करता है ।

Whereas, the said candidate, Shri Elish Kotiyal has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he/she has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the said Representation of the People Act, 1951, the Election Commission hereby declares Shri Elish Kotiyal to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/ Union Territory for a period of three years from the date of this order.
