ऊपर उप - विधियों में उल्लिखित सभी दावे, मतभेद या विवाद सदस्य तथा उसके ग्राहक के बीच अथवा एक्सचेंज के दो सदस्यों के बीच किए गए अंतिम लेन - देन या डिलीवरी या भुगतान की तारीख से एक वर्ष के भीतर विवाचन को प्रस्तुत किए जाएंगे , बशर्ते जहां किसी दावे का निपटान या समाधान दावा या शिकायत के प्राप्त होने के तीन महीने के भीतर एक्सचेंज द्वारा सुलह प्रक्रिया के जरिए नहीं किया जाता है, एक्सचेंज ऐसे मामलों से संबंधित ग्राहक को मामला विवाचन को संदर्भित करने के लिए सूचित करेगा । माध्यस्थम तथा सुलह अधिनियम के प्रावधानों और इन उप - विधियों के अनुसार शुरू की गई तथा संचालित विवाद समाधान तथा/या सुलह कार्यवाही, यदि कोई है, में लगे समय और दावों, मतभेदों या विवादों को प्रशासनिक रूप से समाधान करने में प्रबंध निदेशक या सम्बद्ध प्राधिकारी को लगे समय को एक्सचेंज की उप - विधियों, नियमों तथा विनियमों के अंतर्गत एक वर्ष की परिसीमा अवधि का निर्धारण करने के प्रयोजनार्थ शामिल नहीं किया जाएगा । इसमें इसके ऊपर निर्दिष्ट समय सीमा की समाप्ति के बाद किसी शिकायतकर्ता या व्यथित व्यक्तियों द्वारा किया गया कोई दावा या उठाया गया कोई मतभेद या विवाद एक्सचेंज कीउप-विधियों, नियमों तथा विनियमों के अंतर्गत उपचार प्राप्त करने के प्रयोजनार्थ कालातीत हो जाएगा और तथापि उपर्युक्त सिविल कानूनों के अंतर्गत उपचार प्राप्त करने के लिए अवैध नहीं होगा । सूचना : -- अंग्रेजी पाठ और हिंदी अनुवाद में किसी विसंगति के मामले में अंग्रेजी पाठ अभिभावी होगा ।

1. Short Title and Commencement
1. This Bye law may be called the Multi Commodity Exchange of India Ltd. (Amendment) Bye Law, 2010 .
2. It shall come into force with effect from the date of its publication in the Gazette of India .

1. For Clause 11 of By Law 15, the following clause shall be substituted , namely :--
"Limitation Period for Reference to Arbitration : All Claims , differences or disputes referred to in the Bye- Laws above shall be submitted to arbitration within one year from the last transaction or delivery or payment effected between the member and his client or between two members of the Exchange , provided where the claim/ complaint is not settled/ resolved through the process of conciliation by the Exchange within three months of the receipt of the claim/complaint , the Exchange shall in such cases advise the concerned client to refer the case to arbitration . The time taken in dispute resolution and/ or conciliation proceedings , if any, initiated and conducted in accordance with the provisions of the Arbitration and Conciliation Act and these Bye-Laws and the time taken by the Managing Director or Relevant Authority to administratively resolve the claims , differences or disputes shall be excluded for the purpose of determining the limitation period of one year under the Bye - Laws , Rules and Regulations of the Exchange. Any Claim made or any difference/dispute raised by any complainant/ aggrieved person , after expiry of the time limit specified herein , shall become time-barred for the purpose of availing of the remedy under the Bye - Laws , Rules and Regulations of the Exchange and may not, however, be invalid for seeking remedy under appropriate civil laws . "
