सा.का.नि. 105.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, संघ लोक सेवा आयोग, सहायक निदेशक ;गोपनीयद्ध भर्ती नियम, 2001 का और संशोध्न करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ : ;1द्ध इन नियमों का संक्षिप्त नाम संघ लोक सेवा आयोग, सहायक निदेशक ;गोपनीयद्ध भर्ती संशोधन नियम, 2011 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. संघ लोक सेवा आयोग सहायक निदेशक ;गोपनीयद्ध भर्ती नियम, 2001 में,—

(i) नियम 3 में, फ्वेतनमानय् शब्दों के स्थान पर, फ्वेतन बैंड और ग्रेड वेतन या वेतनमानय् शब्द रखे जाएंगेऋ

(ii) अनुसूची के स्थान पर, निम्नलिखित अनुसूची रखी जाएगी, अर्थात्‌ :—

;खद्ध जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं :—

;iद्ध किसी मान्यताप्राप्त विश्वविद्यालय से बैचलर डिग्री या समतुल्यऋ

;iiद्ध किसी विश्वविद्यालय या संस्थाओं, राज्य या राष्ट्रीय स्तर की परीक्षा या भर्ती निकाय जिसके अन्तर्गत गोपनीय प्रकृति के विषय जैसे परीक्षा अभिलेखों,357 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : अप्रैल 2, 2011/चैत्रा 12, 1933 ;12द्ध

प्रश्नपत्रा, लिपियों, मूल्यांकन संबंध्ी कार्य भी हैं, परीक्षा कार्य के संचालन का तीन वर्ष का अनुभव ।

II. सशस्त्रा बल कामकों के लिए : लेफ्रिटनेंट या समतुल्य रैंक के सशस्त्रा बल के ऐसे कामकों के संबंध् में भी विचार किया जाएगा जो एक वर्ष की अवध् िके भीतर सेवा निवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रतिनियुक्त व्यक्तियों के लिए विहित अर्हताएं और अनुभव हैं । यदि उनका चयन कर लिया जाता है तो ऐसे आपिफसरों को उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना हैऋ तत्पश्चात्‌ उन्हें पुननयोजन पर बने रहने दिया जा सकता है । यदि ऐसे पात्रा ऑपिफसर उस पद पर वास्तविक चयन से पूर्व सेवानिवृत्त हो गए हैं या रिजर्व में स्थानांतरित किए जा चुके हैं, तो उनकी नियुक्ति पुननयोजन के आधर पर की जाएगी । ;सिविल पदों के प्रतिनिर्देश से अध्विषता की आयु-तक पुननयोजनद्ध

टिप्पण 1 : प्रतिनियुक्ति की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा एक जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है नियमित आधर पर की गई सेवा को, सिवाय उसके जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान वाले एक ग्रेड में विलय हो गया है और जहां यह लाभ केवल उन पदों पर, जिसके लिए ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना, सामान्य प्रतिस्थापन ग्रेड है, विस्तारित होगा, वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी । यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

G.S.R. 105.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Union Public Service Commission, Assistant Director (Confidential) Recruitment Rules, 2001, namely :—

1. Short title and commencement.— (1) These rules may be called the Union Public Service Commission, Assistant Director (Confidential) Recruitment Amendment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Union Public Service Commission, Assistant Director (Confidential) Recruitment Rules, 2001,—

(a) in rule 3, for the words "scale of pay", the words "pay band and grade pay or pay scale" shall be substituted; (b) for the Schedule, the following Schedule shall be substituted, namely :—

(iv) with eight years' service in the grade rendered after appointment thereto on a regular basis in the Pay Band-2 of Rs. 9300-34800 with grade pay of Rs. 4200 or equivalent; and

(b) possessing the following educational qualifications and experience :

(i) Bachelor's degree from a recognized University or equivalent;

(ii) three years experience of handling examination work including matters of confidential nature such as those pertaining to examination records, question papers, scripts, evaluation in universities or institutions, examination or recruiting body at State or National level.

II. For Armed Forces Personnel : The Armed Forces Personnel of the rank of Lieutenant or equivalent, who are due to retire or to be transferred to reserve within a period of one year and possessing qualifications and experience prescribed for deputationists shall also be considered. If selected, such officers shall be given deputation terms upto the date on which they are due for release from the Armed Forces. Thereafter they may be continued on re-employment terms. In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on reemployment basis (re- employment upto the age of superannuation with reference to civil posts).

Note 1 : Period of deputation including period of deputation to another ex- cadre post held immediately preceding this appointment in the same or other organizations or departments of the Central Government shall not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of receipt of applications.

Note 2 : For the purpose of appointment on deputation basis the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.

;खद्ध जिनके पास केन्द्रीय सरकार के अध्ीन यानों के उपयोग, देखभाल, अभिरक्षा, मरम्मत और रखरखाव कर्त्तव्य वाले पदों पर मोटर परिवहन कार्य का सात वर्ष का अनुभव है । ;गद्ध जिनके पास मोटर कार चलाने के लिए विध्मिान्य चालन अनुज्ञप्ति है । वांछनीय : किसी औद्योगिक प्रशिक्षण संस्थान से मोटर मैकेनिक का प्रमाण-पत्रा । टिप्पण 1 : प्रतिनियुक्ति की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी । टिप्पण 2 : प्रतिनियुक्ति के आधर पर नियुक्ति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए, किसी अधिकारी द्वारा, 1 जनवरी, 2006 से पहले/उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उसके जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान वाले एक ग्रेड में विलय हो गया है और जहां यह लाभ केवल उस पद ;पदोंद्ध पर, जिसके लिए ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना सामान्य प्रतिस्थापन ग्रेड है, विस्तारित होगा, वेतन आयोग की सिपफारिशों के आधर पर तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से

परामर्श किया जाएगा

इन नियमों के उपबंधें का कोई शिथिलीकरण या संशोध्न करने के लिए संघ लोक सेवा आयोग से परामर्श करना आवश्यक है ।

G.S.R. 106.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Union Public Service Commission (Motor Transport Supervisor) Recruitment Rules, 1995, namely :—

1. Short title and commencement.— (1) These rules may be called the Union Public Service Commission, Motor Transport Supervisor Recruitment (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Union Public Service Commission (Motor Transport Supervisor) Recruitment Rules, 1995,—

(i) in rule 2, for the words "scale of pay", the words "pay band and grade or pay scale" shall be substituted;

(ii) for the existing Schedule, the following Schedule shall be substituted, namely :—

(c) having a valid driving licence for motor cars. Desirable : Motor Mechanic Certificate from an Industrial Training Institute.

Note 1 : Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall not be exceeding fifty-six years as on the closing date of receipt of applications.

Note 2 : For the purpose of computing minimum qualifying service for appointment on deputation basis the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

प्रतिनियुक्ति/पुननयोजन : सशस्त्रा बल कामकों के लिए : सशस्त्रा बल के जूनियर कमीशंड ऑपिफसर या समतुल्य रैंक के ऐसे कामकों के संबंध् में भी विचार किया जाएगा जो एक वर्ष की अवध् िके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रतिनियुक्त व्यक्तियों के लिए विहित अर्हताएं और अनुभव हैं । यदि उनका चयन कर लिया जाता है तो ऐसे ऑपिफसरों को उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना है । तत्पश्चात्‌ उन्हें पुननयोजन के निबंध्नों पर बने रहने दिया जा सकता है । यदि ऐसे पात्रा ऑपिफसर उस पद पर वास्तविक चयन से पूर्व सेवानिवृत्त हो गए हैं या रिजर्व में स्थानांतरित किए जा चुके हैं, तो उनकी नियुक्ति पुननयोजन के आधर पर की जाएगी । ;सिविल पदों के प्रतिनिर्देश से अध्विषता की आयु तक पुननयोजनद्ध । टिप्पण 1 : प्रतिनियुक्ति की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । टिप्पण 2 : प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी । टिप्पण 3 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अधिकारी द्वारा, 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उसके जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान वाले एक ग्रेड में विलय हो गया है और जहां यह लाभ केवल उस पद ;पदोंद्ध पर, जिसके लिए ग्रेड वेतन या वेतनमान किसी उन्नयन के बिना सामान्य प्रतिस्थापन ग्रेड है, विस्तारित होगा, वेतन आयोग की सिपफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

If selected, such officers shall be given deputation terms upto the date on which they are due for release from the Armed Forces. Thereafter they may be continued on re-employment terms. In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment shall be on re-employment basis (re-employment upto the age of superannuation with reference to civil posts). 4. आरंभिक गठन.—इन नियमों में अंतवष्ट किसी बात के होते हुए भी, इन नियमों के प्रारंभ होने की तारीख को वे व्यक्ति जो प्रतिनियुक्ति के आधर पर स्टापफ कार ड्राईवर का पद धरण कर रहे हैं और जो इन नियमों में अध्किथित अर्हताएं और अनुभव रखते हों और जो उपर्युक्त समझे जाते हैं इस शर्त के अध्ीन रहते हुए कि ऐसे व्यक्ति आमेलन के लिए अपने विकल्प का प्रयोग करेंगे वे अपनी-अपनी श्रेणी में आमेलन के पात्रा होंगे और उनके मूल विभागों को केन्द्रीय सूचना आयोग में उनके आमेलित होने पर कोई आपत्ति नहीं होगी । ;2द्ध उप नियम ;1द्ध में उल्लिखित अध्किारियों की ज्येष्ठता संबंध्ति पदों पर उनकी नियमित नियुक्ति की तारीखों के प्रतिनिर्देश से अवधरित की जाएगी ।

5. अनर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति जिसका पति या जिसकी पत्नी जीवित है से विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

सशस्त्रा बल के ऐसे कामकों के संबंध् में भी विचार किया जाएगा जो एक वर्ष की अवध् िके भीतर सेवा निवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना हैऋ तत्पश्चात्‌ उन्हें पुननयोजन पर बने रहने दिया जा सकता है ।

G.S.R. 108.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of the Staff Car Driver in the Central Information Commission, namely :—

1. Short title and commencement.—(1) These rules may be called the Central Information Commission, Staff Car Drivers, Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the above said Schedule.

4. Initial Constitution.—(1) Notwithstanding anything contained in the provisions of these rules, the persons holding the post of Staff Car Driver on the date of commencement of these rules on deputation basis and who fulfil the qualifications and experience laid down in these rules and who are considered suitable, shall be eligible for absorption in the respective grade subject to condition that such persons exercise their option for the absorption and that their parent Departments do not have any objection to their being absorbed in the Central Information Commission.

(2) The seniority of officers mentioned in sub-rule (1) shall be determined with reference to the dates of their regular appointment to the posts concerned.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

failing which from officials holding analogous posts in other Ministries or Departments of the Central Government who fulfill the necessary qualifications as prescribed for direct recruits.

Note 1 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years.

Note 2 : For the purpose of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post or posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.

Note 3 : The maximum age limit for appointment to deputation/ absorption shall be "not exceeding 56 years" as on the closing date of the receipt of applications.

(ii) For Ex-servicemen :

Deputation/Re-employment :

The Armed Forces Personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualifications prescribed shall also be considered. Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter, they may be continued on re-employment.

सा.का.नि. 109.—कतिपय नियमों को निम्नलिखित प्रारूप केन्द्रीय सरकार वायुयान अध्निियम, 1934 ;1934 का 22द्ध की धरा 5 के साथ पठनीय धरा 4 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अध्निियम की धरा 14 की अपेक्षानुसार, इन नियमों द्वारा प्रभावित होने वाले सभी संभावित व्यक्तियों की सूचनार्थ, एतद्‌द्वारा प्रकाशित किया जाता है और एतद्‌द्वारा यह सूचना दी जाती है कि उक्त प्रारूप पर सरकारी राजपत्रा में प्रकाशन की तिथि से पैंतालीस दिन की अवध् िके बाद विचार किया जाएगा ।

इस प्रकार विनिदष्ट अवध् िकी समाप्ति से पहले उक्त प्रारूप के संबंध् में किसी भी व्यक्ति की ओर से प्राप्त होने वाले किसी भी सुझाव या आपत्ति पर केन्द्र सरकार द्वारा विचार किया जाएगा ।

;डद्ध फ्डाकय् से डाक प्रशासन द्वारा और उनके वितरण के लिए आशयित पत्राकार का संवाद और अन्य वस्तुएं अभिप्रेत हैंऋ ;ढद्ध फ्आवागमन क्षेत्राय् से किसी विमान का वह क्षेत्रा अभिप्रेत है जो किसी वायुयान के भूतल आवागमान के लिए आशयित है और जिसके अन्तर्गत मैन्यूवरग एरिया तथा एप्रन भी हैंऋ

;णद्ध फ्राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रमय् से केन्द्रीय सरकार के पूर्वानुमोदन से अभिसमय के किसी भी उपाबंध् को प्रभावी बनाने के निमित्त केन्द्रीय सरकार द्वारा प्राध्कृित किसी अध्किारी द्वारा ऐसा कोई कार्यक्रम अभिप्रेत हैऋ

;ध्द्ध फ्विनियमित अभिकर्ताय् से कोई अभिकर्ता, माल अग्रेषक या कोई अन्य अस्तित्व अभिप्रेत है जो किसी प्रचालक के साथ कारबार करता है और वे सुरक्षा नियंत्राण उपलब्ध् कराता है, जो वायु द्वारा परिवहन के संबंध् में कार्गो, कूरियर तथा एक्सप्रैस पार्सल या डाक के संबंध् में आयुक्त द्वारा स्वीकृत या अपेक्षित होऋ

;नद्ध स्क्रीनग से तकनीकी या अन्य माध्यम का अनुप्रयोग अभिप्रेत है जो शस्त्राों, विस्पफोटकों या अन्य खतरनाक युक्तियों की पहचान करने या पता लगाने के लिए अभिप्रेत हो जिनका प्रयोग नागर विमानन में विध्वििरु( हस्तक्षेप के लिए उपयोग किया जा सकता होऋ

;पद्ध फ्सुरक्षाय् से विध्वििरु( हस्ताक्षेप की कार्रवाइयों के विरु( नागर विमानन रक्षोपाय के आशय से उपायों, मानवीय तथा भौतिक संसाध्नों का संयोजन अभिप्रेत हैऋ

;पफद्ध फ्सुरक्षा निर्वाध्नय् से किसी वायुयान, व्यक्ति या वस्तु के संबंध् में राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम में विनिदष्ट सुरक्षा नियंत्राणों का अनुपालन अभिप्रेत हैऋ

;बद्ध फ्सुरक्षा दुर्घटनाय् से कोई ऐसी घटना जिसका परिणामस्वरूप किसी व्यक्ति की मृत्यु या गंभीर उपहति या सम्पत्ति की प्रमुख क्षति अभिप्रेत हैऋ

स्पष्टीकरण : इस खंड के प्रयोजन के लिए फ्गंभीर उपहतिय् का आशय वही होगा जो भारतीय दंड संहिता 1860 में हैऋ ;भद्ध फ्सुरक्षा घटनाय् से नागर विमानन सुरक्षा के संबंध् में कोई घटना अभिप्रेत है जो भूमि या उड़ान के दौरान हुई जिसके परिणामस्वरूप—

;iद्ध किसी व्यक्ति को चोट लगे, सम्पति को क्षति हो, आग से या किसी प्रकार की क्षति होऋ

;iiद्ध सुरक्षा नियमों, विनियमों, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम और अध्निियम के उपबंधें के अध्ीन केन्द्रीय सरकार द्वारा जारी आदेशों के उल्लंघन तथा भंग हुई होऋ

;मद्ध फ्सुरक्षा नियंत्राणय् से वह प(ति अभिप्रेत है जिसके द्वारा, आयुध्, विस्पफाटकों तथा अन्य खतरनाक युक्तियां, वस्तु या प्रदार्थों, जिन्हें किसी विध्वििरु( हस्तक्षेप के कृत्य के लिए प्रयोग किया जा सकता है, को रोका जा सकेऋ ;यद्ध फ्सुरक्षा कार्यक्रमय् से आयुक्त द्वारा लिखित विशिष्ट उपाय अभिप्रेत है जिन्हें विध्वििरु( हस्तक्षेप के कृत्य के विरु( नागर विमानन को सुरक्षा प्रदान करने के लिए किसी अस्तित्व द्वारा अंगीकृत किया जाना हैऋ

;यकद्ध फ्टमनलय् से वह भवन या भवनों का ऐसा समूह अभिप्रेत है जहां यात्रिायों, सामान, कार्गो, कूरियर बैगों आदि की स्क्रीनग और वायुयानों में बोडग की जाती है और इसके अन्तर्गत आगमन भवन भी हैऋ

;यखद्ध फ्लावारिस सामानय् से किसी विमान क्षेत्रा पर सामान टैग लगा हुआ या उसके बिना सामान अभिप्रेत है जिसे किसी यात्राी या किसी अन्य व्यक्ति द्वारा उठाया या पहचाना नहीं गया हैऋ

;शद्ध फ्अत्यावश्यक संस्थापनय् से विमान क्षेत्रा पर या उससे जुड़ी हुई कोई सुविध यदि क्षतिग्रस्त या नष्ट होने पर विमान क्षेत्रा का कार्यकलाप गंभीर रूप से हृासित हो जाएंगे ।

;2द्ध उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अध्निियम में परिभाषित हैं, वही अर्थ होंगे जो उस अधिनियम में हैं ।

3. आयुक्त के कर्तव्य.—;1द्ध आयुक्त—

;कद्ध उड़ानों की संरक्षा, नियमितता और कार्यकुशलता को ध्यान में रखते हुए विध्वििरु( कृत्यों तथा खतरे की संभावनाओं के विरु( नागर विमानन प्रचालनों के रक्षोपाय से संबंध्ति अभिसमय के उपब(-17 के उपबंधें के संगत राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम को स्थापित, विकसित, क्रियान्वित, अनुरक्षित और पुनरीक्षित करनाऋ

;खद्ध राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम क्रियान्वित करने के लिए आवश्यक आदेश जारी करनाऋ

;गद्ध किसी भी बढ़ते हुए सुरक्षा संबंध्ी खतरे का सामना करने के लिए त्वरित जवाबी कार्रवाई करनाऋ

;घद्ध राज्य सरकार के विभागों, अभिकरणों और अन्य संगठनों, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के विभिन्न पहलुओं के क्रियान्वयन से संबंध्ति या इसके लिए उत्तरदायी विमान क्षेत्रा तथा वायुयान प्रचालकाें और अन्य अस्तित्वों के मध्य क्रियाकलापों को परिभाषित करना तथा इन्हें कार्य आबंटित करना और उनके मध्य समन्वय स्थापित करनाऋ ;घद्ध देश के विभागों, अभिकरणों और अन्य संगठनों, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के विभिन्न पहलुओं के क्रियान्वयन से संबंध्ति या इसके लिए उत्तरदायी विमान क्षेत्रा और वायुयान प्रचालकाें तथा अन्य अस्तित्वों के बीच सुरक्षा गतिविध्यिों का समन्वय स्थापित करने के उद्देश्य से एक राष्ट्रीय विमानन सुरक्षा समिति की स्थापना करना या ऐसे ही समान व्यवस्थाएं इंतजाम करनाऋ

;चद्ध राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के विभिन्न पहलुओं के क्रियान्वयन में अंतर्वलित या इसके लिए उत्तरदायी सभी अस्तित्वों के कामकों के लिए राष्ट्रीय नागर विमानन सुरक्षा प्रशिक्षण कार्यक्रम को स्थापित, विकसित तथा क्रियान्वित करना जिन्हें उक्त सुरक्षा कार्यक्रम की प्रभावशीलता को सुनिश्चित करने के लिए अभिकल्पित किया गया हैऋ ;छद्ध नागर विमानन क्षेत्रा में सेवारत प्रत्येक विमान क्षेत्रा पर एक ऐसे प्राध्किारी को पदानित करना जो सुरक्षा नियंत्राणों के क्रियान्वयन का समन्वय करने के लिए उत्तरदायी होगाऋ

;जद्ध विमान क्षेत्रा सुरक्षा कार्यक्रम में यथानिदष्ट सुरक्षा नियंत्राणों और कार्यवाहियों के क्रियान्वयन के समन्वय के लिए नागर विमानन क्षेत्रा में सेवारत प्रत्येक विमान क्षेत्रा पर विमान क्षेत्रा सुरक्षा समिति स्थापित करनाऋ

;झद्ध राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम की प्रभावी अनुपालन अवधरित करने और इसे विध्मिान्यवरण करने के लिए एक राष्ट्रीय नागर विमानन सुरक्षा गुणवत्ता नियंत्राण कार्यक्रम विकसित, क्रियान्वित तथा अनुरक्षित करनाऋ

;टद्ध राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अनुपालन सत्यापन करने और किसी भी कमी का तत्काल तथा प्रभावी रूप से सुधर करने के लिए नियमित आधर पर सुरक्षा संपरीक्षा, जांच सर्वेक्षणों तथा निरीक्षणों के लिए व्यवस्था करनाऋ377 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : अप्रैल 2, 2011/चैत्रा 12, 1933 ;ठद्ध संदभत राष्ट्रीय सुरक्षा अभिकरणों द्वारा किए गए किसी सुरक्षा जोखिम आकलन के आधर पर इसके राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के संदभत कारकों के सामंजस्य की नीतियों और कार्यान्वयन तथा प्रक्रिया की स्थापनाऋ 4. अपील.—इन नियमों के अध्ीन प्रदत्त शक्तियों का प्रयोग करते हुए किसी अध्किारी द्वारा पारित किसी आदेश द्वारा यदि व्यथित कोई व्यक्ति इस संबंध् में केन्द्रीय सरकार के पास अपील कर सकेगा ।

भाग-2 विमान क्षेत्रा पर सुरक्षा उपाय

5. विमान क्षेत्रा सुरक्षा अपेक्षाएं का नियोजन, डिजाईन तथा ले-आउट.—;1द्ध विमान क्षेत्रा का नियोजन, डिजाइन और अभिविन्यास राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम में उपबंध्ति विनिर्देशों के अनुरूप होगा जिसके अन्तर्गत निम्नलिखित है,—

;कद्ध यात्रिायों, यात्राी सामान, स्थोरा, कुरियर तथा त्वरित पार्सल, डाक और खान-पान भंडार तथा प्रदाय के लिए अनुप्रयुक्त सुरक्षा नियंत्राणऋ

;खद्ध वायु पाश्र्व पर पहुंच, सुरक्षा प्रतिबंध्ति क्षेत्राों तथा अन्य संवेदनशील विमान क्षेत्राों और सुविधओं का संरक्षण तथा नियंत्राणऋ ;गद्ध सुरक्षा उपस्करों का उपयोगऋ और

;घद्ध स्थापत्य तथा अवसंरचना संबंध्ी अपेक्षाएं ।

;2द्ध प्रत्येक विमान क्षेत्रा प्रचालक आयुक्त द्वारा किए गए सुरक्षा जोखिम मूल्यांकन के अनुसार नागर विमानन के सेवारत विमान क्षेत्रा पर सुरक्षा प्रतिबंध्ति क्षेत्रा स्थापित करेगा ।

;3द्ध विमान क्षेत्रा प्रचालक नई सुविधओं के डिजाइन तथा निर्माण के एकीकरण द्वारा राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम में उल्लिखित विमान क्षेत्रा डिजाइन बनाएगा और आयुक्त से लिखित अनुमोदन प्राप्त करने के पश्चात विमान क्षेत्रा के विद्यमान डिजाइन तथा सुविधाओं में परिवर्तन करेगा ।

6. विमान क्षेत्रा परिध्.ि—प्रत्येक विमान क्षेत्रा प्रचालक, विमान क्षेत्रा के आसपास के चारों ओर 0.457 मीटर ;डेढ़ पुफटद्ध की ऊपर वाली कंटीली तार युक्त 2.438 मीटर ;8 पुफटद्ध की ऊंचाई की परिध् िका निर्माण करेगा ।

परन्तु आयुक्त किसी प्रकार के खतरे या किसी अन्य कारणों को ध्यान में रखते हुए परिध् िदीवार के विनिर्देशनों को वृ(ि कर सकेंगे । 7. गश्त और परिवेक्षण चौकियों के लिए प्रकाश तथा सड़क का उपबंध्.—विमान क्षेत्रा प्रचालक पर निम्नलिखित सुरक्षा व्यवस्थाएं करेगा, अर्थात :

;कद्ध परिध् िऔर किसी अन्य संवेदनशील क्षेत्रा के लिए प्रकाशऋ

;खद्ध सुरक्षा कामकों के गश्त के लिए सभी मौसमों के लिए सड़कऋ तथा

;गद्ध सुरक्षा कामकों के संप्रेषण तथा कमांड चौकियों की व्यवस्था :

परन्तु आयुक्त, सुरक्षा बोध् को ध्यान में रखते हुए सुरक्षा व्यवस्थाओं के लिए जो उपयुक्त समझें, लिखित रूप में आदेश करेगा । 8. विमान क्षेत्रा सुरक्षा कार्यक्रम.—आयुक्त के अनुमोदन से प्रत्येक विमान क्षेत्रा प्रचालक, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अपेक्षाओं के अनुसरण में विमान क्षेत्रा सुरक्षा कार्यक्रम तैयार करेगा और उसको कार्यान्वित करेगा तथा ऐसे कार्यक्रम में कोई संशोध्न आयुक्त से अनुमोदन के पश्चात्‌ होगा ।

9. विमान क्षेत्रा पर प्रचालन के लिए सुरक्षा क्लियरेंस.—;1द्ध कोई भी विमान क्षेत्रा प्रचालक, आयुक्त से सुरक्षा व्यवस्थाओं अनापत्ति और विमान क्षेत्रा सुरक्षा कार्यक्रम के लिए अनुमोदन प्राप्त किए बिना किसी भी विमान क्षेत्रा पर प्रचालन आरंभ नहीं करेगा । ;2द्ध जहां आयुक्त का यह समाधन हो जाता है कि किसी विमान क्षेत्रा के प्रचालक ने इन नियमों के उपबंधें का उल्लघंन किया है या वह इनका अनुपालन करने में असपफल रहा है, तो वह सुनवाई का अवसर देने के पश्चात्‌ और कारणों को अभिलिखित करके उसके द्वारा प्रदत्त या अनुमोदित सुरक्षा अनापत्ति तथा सुरक्षा कार्यक्रम को निलंबित या निरस्त कर सकेगा ।

10. लावारिस व संदेहास्पद यात्राी सामान की उठाई-ध्राई.—;1द्ध यह विमान क्षेत्रा प्रचालक—

;कद्ध संदिग्ध् या लावारिस यात्राी सामान को रखने के लिए सुरक्षित या पार्थक्य क्षेत्रा का संनिर्माण ओैर अनुरक्षण करना, और ;खद्ध उसका अन्वेषण करना और इसका निपटान करना ।378 THE GAZETTE OF INDIA : APRIL 2, 2011/CHAITRA 12, 1933 [PART II—SEC. 3(i)] 11. विमान क्षेत्रा पर कारबार स्थापना.—;1द्ध कोई विमान क्षेत्रा प्रचालक, आयुक्त से इस संदर्भ में सुरक्षा अनापत्ति प्राप्त के बिना विमान क्षेत्रा के सुरक्षा निर्बंध्ति क्षेत्रा में किसी कारबार स्थापन की स्थापना करने के लिए अनुमति नहीं देगा ।

;2द्ध पंरतु, जहां कोई कारबार स्थापन, आयुक्त के अनुमोदन के पश्चात सुरक्षा निर्बंध्ति क्षेत्रा में स्थापित है, कारबार स्थापन का स्थायी राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अनुसरण में कारबार स्थापना सुरक्षा कार्यक्रम बनाएगा और अनुपालन करेगा ।

12. विमान क्षेत्रा प्रचालक के स्वामित्व की सुविधओं का संरक्षण.—प्रत्येक विमान क्षेत्रा प्रचालक उसके स्वामित्व की अति आवश्यक संस्थापनाएं जिसके अन्र्तगत तकनीकी और रखरखाव, विद्युत आपूत, विद्युत उप गृह, नियंत्राण टावर्स और दूसरे भवनों जो वायुयातायात सेवाओं और संचार सुविधओं द्वारा उपयोग में लाए जाते हैं, को चिर्तििं करना और उनकी रक्षा करना ।

13. विमानन सुरक्षा समूह.—;1द्ध प्रत्येक विमान क्षेत्रा प्रचालक, सरकारी सुरक्षा अभिकरण के कामकों की ऐसी संख्या में नियोजित करेगा जो इन नियमों के अध्ीन समनुदेशित सुरक्षा कर्तव्यों के अनुपालन के लिए आयुक्त द्वारा अवधरित की जाए ।

;2द्ध उप-नियम ;1द्ध के अध्ीन नियुक्त कामक विमानन सुरक्षा समूह के रूप में अभिहित होंगे और ऐसे समूह के मुख्य विमान क्षेत्रा सुरक्षा अध्किारी के रूप में अभिहित होंगे ।

;3द्ध विमानन सुरक्षा समूह विमान क्षेत्रा प्रभारी के साधरण पर्यवेक्षण और निर्देशन के अध्ीन कार्य करेगा ।

;4द्ध विमान क्षेत्रा प्रचालन, विमानन सुरक्षा समूह को ऐसी सुविधएं और सहायता उपलब्ध् कराएगा जो आयुक्त द्वारा अनुमोदित की जाएं ।

;5द्ध आपात परिस्थितियों में, आयुक्त, विमानन सुरक्षा समूह की तैनाती में आवश्यक परिवर्तन कर सकेगा ।

14. मुख्य विमान क्षेत्रा सुरक्षा अध्किारी के कार्य.—मुख्य विमान क्षेत्रा सुरक्षा अध्किारी को निम्नलिखित कर्तव्यों का अनुपालन करना होगा, अर्थात्‌ :—

;iद्ध उसे यात्रिायों, कर्मीदल, भू-कामकों और अन्य विमान क्षेत्रा प्रयोक्ताओं, वायुयान, विमान क्षेत्रा तथा अत्यावश्यक संबंध्ति सुविधओं जिसके अन्तर्गत अत्यावश्यक संस्थापन भी हैं, की सुरक्षा करनाऋ

;iiद्ध विमान क्षेत्रा के प्रतिबंध्ति क्षेत्राों में पहुंच नियंत्राण उपायों को लागू करनाऋ

;iiiद्ध परिध् िकी सुरक्षाऋ

;ivद्ध यात्रिायों तथा उनके हाथ के यात्राी सामान की स्क्रीनग करनाऋ

;vद्ध विमान क्षेत्रा के भीतर तथा आसपास के क्षेत्रा की निगरानी करनाऋ

;viद्ध कार पार्क, दृश्य गैलरी, विमान क्षेत्रा जलपान गृह आदि तथा संचलन क्षेत्रा के समीप के क्षेत्राों सहित सुरक्षा उपायों को लागू करनाऋ

;viiद्ध सुरक्षा उपायों को लागू करनाऋ

;viiiद्ध विमान क्षेत्रा परिसरों में व्यवस्था और अनुशासन को बनाए रखनाऋ

;ixद्ध प्रतिबंध्ति क्षेत्राों में व्यक्तियों के आवागमन का पर्यवेक्षण करनाऋ

;xद्ध स्थानीय पुलिस तथा आसूचना एजेंसियों के साथ संपर्क बनाए रखनाऋ और

;xiद्ध आयुक्त द्वारा सौंपा गया कोई अन्य कर्तव्यों को करनाऋ

15. भूमि उठाई-ध्राई सेवा.—किसी विमान क्षेत्रा में भी भूमि उठाई-ध्राई सेवा प्रदाता को आयुक्त से सुरक्षा अनापत्ति प्राप्त किए बिना और अपने सुरक्षा कार्यक्रम के अनुमोदन के बिना भूमि उठाई-ध्राई सेवाएं उपलब्ध् कराने की अनुमति नहीं हो ।

16. आकस्मिक योजना.—;1द्ध विमान क्षेत्रा प्रचालक विध्वििरु( हस्तक्षेपों के कृत्यों से निपटने के लिए आयुक्त के अनुमोदन से आकस्मिक योजना बनाएगा ।

;2द्ध आकस्मिक योजना का परीक्षण आयुक्त द्वारा विनिदष्ट किए अनुसार नियमित अवध्यिों पर किया जाएगा ।

17. उच्छृंखल यात्रिायों को वायुयान से उतारना.—मुख्य विमान क्षेत्रा सुरक्षा अध्किारी या उसके द्वारा इस निमित्त प्राध्कृित विमानन सुरक्षा समूह का कोई अन्य अध्किारी समादेशक पायलेट के किसी लिखित अनुरोध् पर यात्रिायों तथा कर्मीदल की सुरक्षा तथा संरक्षा के जोखिम के आधर पर किसी व्यक्ति को वायुयान से नीचे उतार सकता है ।379 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : अप्रैल 2, 2011/चैत्रा 12, 1933

भाग-3 विमान क्षेत्रा पहुंच नियंत्राण

18. विमान क्षेत्रा में प्रवेश.—;1द्ध विमान क्षेत्रा में केवल प्रवेश टिकट या विमान क्षेत्रा प्रवेश परमिट धरक व्यक्तियों को ही विमान क्षेत्रा में प्रवेश की अनुमति होगी ।

;2द्ध विमान क्षेत्रा में प्रवेश करने का टिकट विमान क्षेत्रा प्रचालक द्वारा जारी होंगे ।

;3द्ध आयुक्त द्वारा विमान क्षेत्रा परमिट संभव रूप से सत्यापन करने के पश्चात जारी किया जाएगा ।

;4द्ध केन्द्रीय सरकार, आयुक्त या विमान क्षेत्रा प्रचालक या किसी अन्य व्यक्ति को ऐसे प्रवेश टिकट या विमान क्षेत्रा प्रवेश परमिट जारी करने का निदेश दे सकेगी ।

;5द्ध किसी व्यक्ति को प्रवेश टिकट या विमान क्षेत्रा प्रवेश परमिट प्राप्त किए बिना विमान क्षेत्रा में प्रवेश करने की अनुमति नहीं होगी । ;6द्ध धरक द्वारा विमान क्षेत्रा प्रवेश परमिट को ड्‌यूटी के दौरान प्रत्येक समय कमर से ऊपर के स्तर पर सहज दृश्य रूप से प्रदशत करेगा ।

;7द्ध कोई व्यक्ति—

;कद्ध किसी पशु, पक्षी या वस्तु को न छोड़ेगा या न पेंफकेगा और न ही किसी से फिकवाएगा,

;खद्ध न ही अपने कब्जे या नियंत्राण के अध्ीन किसी पशु को भ्रमण कराएगा, और

;गद्ध संचलन क्षेत्रा में आयुक्त से प्रवेश परमिट लिए बिना किसी वाहन को प्रचालन नहीं करेगा :

पंरतु, इसके अलावा वायुयान में सवार होने वाले, वायुयान से उतरने वाले या ट्रांजिट की प्रक्रिया के समय वायुयान टिकट धरकों या कोई व्यक्ति जो विमान क्षेत्रा में नियमित ड्‌यूटी पर नियोजित है और आयुक्त द्वारा जारी विमान क्षेत्रा प्रवेश परमिट रखता है, को प्रवेश टिकट या प्रवेश परमिट प्राप्त करने की अपेक्षा नहीं होगी ।

;8द्ध आयुक्त या केन्द्रीय सरकार द्वारा इस निमित्त प्राध्कृित किसी व्यक्ति को, विमान क्षेत्रा प्रवेश परमिट की समाप्ति या निरस्त होने या व्यक्ति को सेवा के पर्यवसान पर, जिसे यह जारी किया गया है विमान क्षेत्रा प्रवेश परमिट वापस करना होगा ।

;9द्ध इस नियम में किसी भी बात के होते हुए भी, विमान क्षेत्रा प्रचालक या आयुक्त, को यदि यह समाधन हो जाता है कि उसे ऐसा करना सुरक्षा के हित में अपेक्षित या समीचीन है :

;iद्ध किसी व्यक्ति को विमान क्षेत्रा में प्रवेश करने के लिए इंकार कर सकेगाऋ

;iiद्ध किसी व्यक्ति को विमान क्षेत्रा से बाहर करना अपेक्षित है ।

19. सुरक्षा निर्बंध्ति क्षेत्रा में प्रवेश.—;1द्ध विमान क्षेत्रा प्रचालक, प्रत्येक विमान क्षेत्रा पर सुरक्षा निर्बंध्ति क्षेत्राों में वायुयान से या तक व्यक्तियों तथा यानों के संचलन के लिए व्यवस्था करेगा ।

;2द्ध सुरक्षा निर्बंध्ति क्षेत्राों में पहुंच की अनुज्ञा देने से पूर्व, विमानन सुरक्षा समूह द्वारा प्रत्येक व्यक्ति, यान, यात्राी सामान, माल-असबाब या प्रदाय की स्क्रीनग की जाएगी ।

;3द्ध सुरक्षा प्रतिबंध्ति क्षेत्रा में यानों के प्रवेश की अनुमति प्रवेश परमिट या आयुक्त से विशेष अनुमति प्राप्त करने के पश्चात ही होगी । 20. शस्त्रा या विस्पफोटकों को ले जाने पर प्रतिषेध्.—;1द्ध किसी व्यक्ति को विमान क्षेत्रा या वायुयान में आयुध्, गोला-बारूद या विस्पफोटकों को ले जाने की अनुमति नहीं होगी :

परंतु इस उपनियम के उपबंध् निम्नलिखित को लागू नहीं होंगे,—

;iद्ध विमानन सुरक्षा समूह, सशस्त्रा बल और पुलिस कामक को आयुध् या गोला-बारूद अपने कर्तव्योें के निर्वहन में अपेक्षित होऋ और

;iiद्ध आयुक्त किसी व्यक्ति को नकली शस्त्रा, विस्पफोटक, या विस्पफोटक युक्ति या कोई अन्य नकली प्रतिबंध्ति वस्तु को, विमानन सुरक्षा की कुशलता की जांच करने के उद्देश्य से, सम्यक रूप से प्राध्कृित कर सकेगा ।

भाग-4 आरोहण पूर्व सुरक्षा जांचें

21. आरोहण से पूर्व सुरक्षा जांच.—;1द्ध आरोहण पूर्व, किसी वायुयान में यात्राा आरंभ करने वाले प्रत्येक यात्राी और आंतरिक यात्राी तथा हस्त यात्राी सामान, यदि कोई हो, विमानन सुरक्षा समूह के किसी अध्किारी या आयुक्त द्वारा इस निमित्त प्राध्कृित किसी अध्किारी द्वारा स्क्रीनग किए जाएंगे ।380 THE GAZETTE OF INDIA : APRIL 2, 2011/CHAITRA 12, 1933 [PART II—SEC. 3(i)] ;2द्ध उपनियम ;1द्ध के उपबंध् केवल पारगमन यात्रिायों पर ही लागू होंगे यदि वे वायुयान से उतर रहे हैं :

परन्तु उपनियम ;1द्ध और इस नियम के उपबंध् ऐसे व्यक्तियों पर लागू नहीं होगा जिन्हें विशेष आदेश द्वारा आयुक्त द्वारा विनिदष्ट करें । ;3द्ध विमानन सुरक्षा समूह तथा विमान क्षेत्रा प्रचालक यात्राी और उनका केबिन यात्राी सामान की स्क्रीनग बिन्दु से उसके वायुयान में पहुंचाने तक किसी प्रकार अप्राध्कृित हस्तक्षेप से संरक्षित रखेंगे ।

22. स्क्रीनरों का प्रमाणन.—स्क्रीनग कर्तव्य का ऐसे अध्किारी द्वारा अनुपालन होगा जिसे आयुक्त द्वारा प्रमाणित किया गया हो । 23. कतिपय माल को ले जाने पर प्रतिषेध्.—;1द्ध आयुक्त, कतिपय माल के व्यक्ति पर या किसी यात्राी या कर्मीदल सदस्य द्वारा केबिन यात्राी सामान में ले जाने के लिए लिखित में प्रतिबंध्ति कर सकेगा, जो कि उसकी राय में जिसे नागर विमानन में विध्वििरु( हस्तक्षेप के लिए उपयोग किए जाने की सम्भावना है ।

;2द्ध जहां स्क्रीनग के दौरान किसी प्रतिबंध्ति माल के होने का पता चलता है ता ऐसे यात्राी को वायुयान में प्रवेश की अनुज्ञात नहीं होगा और इन नियमों तथा तत्समय प्रवृत किसी अन्य विध् िके अध्ीन उसके विरु( कार्रवाई की जाएगी ।

भाग-5 वायुयान प्रचालकों द्वारा सुरक्षा उपाय

24. सुरक्षा कार्यक्रम.—प्रत्येक वायुयान प्रचालक, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अनुसरण में, आयुक्त के अनुमोदन से वायुयान प्रचालक सुरक्षा कार्यक्रम तैयार करेगा तथा उसका अनुपालन ऐसे करेगा और कार्यक्रम में कोई भी संशोध्न आयुक्त के अनुमोदन के पश्चात किया जाएगा ।

25. प्रचालन के लिए सुरक्षा निर्वाध्न.—;1द्ध कोई वायुयान प्रचालक किसी विमान क्षेत्रा पर सुरक्षा इंतजामों के निर्वाध्न और आयुक्त से नियम 24 के अध्ीन विमान प्रचालन सुरक्षा कार्यक्रम की स्वीकृति प्राप्त किए बिना प्रचालन नहीं करेगा ।

;2द्ध जहां आयुक्त का यह समाधन हो जाता है कि कोई वायुयान प्रचालक इन नियमों के उपबंधें का उल्लंघन कर रहा है या अनुपालन करने में असपफल है, वह उसे सुनवाई का अवसर देने के पश्चात और कारणों को लेखब( करके उसे अनुदत्त या अनुमोदित सुरक्षा निर्वाध्न और सुरक्षा कार्यक्रम को निलंबित या रद्द कर सकेगा ।

26. स्टापफ की तैनाती.—कोई वायुयान प्रचालक, उन्हीं कामकों को सुरक्षा कर्तव्यों के लिए नियुक्त करेगा जो पूर्णकालिक कर्मचारी हो, जिसके चरित्रा और पूर्ववृत्त को सत्यापन किया जा चुका हो और जिन्हें, राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अनुसरण में उचित प्रशिक्षण, चयन प्रक्रिया और प्रमाणन के पश्चात नियुक्त किया गया हो ।

27. वायुयान की सुरक्षा तलाशी.—कोई वायुयान प्रचालक निम्नलिखित में अपने वायुयान की सुरक्षा तलाशी करेगा—

;कद्ध सुरक्षा निर्बंध्ति क्षेत्रा में ले जाने से पहले, और

;खद्ध अवरोहण के बाद यात्रिायों के प्रवेश कराने से पहले तथा अवरोहण के पश्चात ।

28. वायुयान में पहुंच नियंत्राण.—;1द्ध वायुयान प्रचालक वायुयान में पहुंच और प्रस्थान को सुरक्षा जांच से निगरानी बनाए रखेगा । ;2द्ध वायुयान प्रचालक निम्न द्वारा गैर-प्रचालिक वायुयान का नियंत्राण रखेगा—

;iद्ध केबिन का दरवाजा बंद करकेऋ

;iiद्ध एयरोब्रिजेज और अध्र सीडिया को सुरक्षित करके, वापस लाकर और पीछे करकेऋ और

;iiiद्ध हस्तक्षेप सुस्पष्ट मुद्रांकित दरवाजे ।

29. चालक स्थान के दरवाजे को बन्द करना.—प्रत्येक वायुयान प्रचालक :—

;कद्ध उड़ान की सभी दशाओं में वायुयान के चालक स्थल के दरवाजे बंद रखेगा, जब तक कि इसे प्रचालन कारणों के लिए खोला जाना अपेक्षित न होऋ

;खद्ध केबिन कर्मीदल और उड़ान के दौरान उड़ान कर्मीदल के बीच संचार प्रणाली की स्थापना तथा अनुरक्षणऋ और ;गद्ध चालक स्थान की पहुंच नियंत्राण का उत्तरदायित्व समादेशक पाइलेट को समनुदेशित करना ।

30. उड़ान में सुरक्षा अध्किारी की तैनाती.—;1द्ध वायुयान प्रचालक, किसी यात्राी वायुयान में इतनी संख्या में उड़ान सुरक्षा अधिकारी को ले जा सकेंगे जितने आयुक्त द्वारा लिखित में विनिदष्ट किए जाएं ।

;2द्ध वायुयान प्रचालक समादेशक पायलेट को सशस्त्रा कामकों की संख्या तथा उनकी सीट स्थिति के बारे में घोषणा करेंगे ।381 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : अप्रैल 2, 2011/चैत्रा 12, 1933 31. धरित यात्राी सामान के सुरक्षा नियंत्राण.—वायुयान प्रचालक या वायुयान क्षेत्रा प्रचालक, धरित यात्राी सामान की स्क्रीनग और सुरक्षा इस प्रकार करेंगे जो समय-समय पर आयुक्त द्वारा विनिदष्ट की जाए ।

32. धरित यात्राी सामान की पहचान तथा पुनमलाप.—धरित यात्राी सामान की पहचान तथा पुनमलाप ऐसी रीति में करेगा जो कि समय-समय पर आयुक्त द्वारा लिखित रूप में आदेश द्वारा विनिदष्ट की जाए ।

33. अंतरित यात्राी सामान.—वायुयान प्रचालक अंतरित धरित यात्राी सामान को वायुयान में लाये जाने से पहले स्क्रीनग करेगा : परंतु उद्‌भव के बिन्दु पर धरित यात्राी सामान की स्क्रीनग की जाएगी और तत्पश्चात उसे उद्‌भव वायुयान क्षेत्रा से प्रस्थानकर्ता वायुयान में विध्वििरु( हस्तक्षेप से सुरक्षित करके स्क्रीनग के अध्यध्ीन न रहते हुए अंतरित वायुयान क्षेत्रा को ले जाया जाएगा ।

34. वायुयान में कैदियों का वहन.—वायुयान प्रचालक किसी कैदी को ऐसी रीति से वहन करेगा जो कि आयुक्त द्वारा लिखित आदेश द्वारा विनिदष्ट की जाए ।

35. स्थोरा, डाक, खान-पान के पद और अन्य भंडार.—वायुयान प्रचालक उड़ान में स्थोरा, डाक, खान-पान मदों और अन्य भंडार तथा प्रदाय ऐसी रीति से स्वीकृत करेगा जो आयुक्त द्वारा विनिदष्ट की जाए ।

36. वायुयान का निरोध्.—आयुक्त या केन्द्रीय सरकार द्वारा इस निमित्त प्राध्कृित को कोई अन्य व्यक्ति, कारणों को लेखब( करके, किसी वायुयान का निरोध् कर सकेगा यदि उसकी राय में,—

;कद्ध वायुयान पर उड़ान में अनाध्कृित शस्त्रा, विस्पफोटक या अन्य विध्वंसक युक्तियाँ हों जिनसे उस वायुयान की सुरक्षा को कोई खतरा उत्पन्न होने की संभावना होऋ या

;खद्ध वायुयान पर उड़ान में कोई ऐसा व्यक्ति है जिसने अनध्कृित रीति से वायुयान में प्रवेश प्राप्त किया है या जिससे नागर विमानन प्रचालनों के साथ विध्वििरु( हस्तक्षेप होने की संभावना हैऋ या

;गद्ध इन नियमों के किसी उपबंध् का अनुपालन सुनिश्चित करने के लिए निरोध् आवश्यक है ।

भाग-6 स्थोरा, कूरियर थैले, डाक और विनियमित अभिकर्ता

37. स्थोरा और कूरियर थैलों के लिए सुरक्षा नियंत्राण.—;1द्ध किसी वायुयान पर वहन करने के आशय से कोई स्थोरा पर यात्रिायों के किसी भी त्वरित स्थोरा या कूरियर थैलों को उन नियमित कर्मचारियों द्वारा प्राप्त, प्रसंस्कृत और उठाई-ध्राई की जाएगी, जिन्हें वायुयान प्रचालक के या आयुक्त द्वारा लिखित रूप से आदेश द्वारा किसी अन्य एजेंसी द्वारा राष्ट्रीय नागर विमानन सुरक्षा कार्यक्रम के अनुसरण में प्रशिक्षित किया गया है ।

;2द्ध सुरक्षा नियंत्राण किए बिना, जिसके अन्तर्गत एक्स रे स्क्रीनग या भौतिक तलाशी जांच भी है, किसी स्थोरा को वायुयान में लादा नहीं जाएगा :

परंतु आयुक्त लिखित आदेश द्वारा किसी भी स्थोरा, त्वरित स्थोरा या कूरियर थैलों को उस नियम के उपबंध् से छूट दे सकेगा । 38. कूरियर अभिकरण की रजिस्ट्री.—कोई वायुयान प्रचालक किसी भी अभिकरण से परिवहन के लिए कोई भी कूरियर थैले स्वीकार नहीं करेगा जब तक ऐसा अभिकरण,—

;कद्ध अपने वायुयान प्रचालक के साथ रजिस्ट्रीकृत न होऋ और

;खद्ध आयुक्त द्वारा कोई सुरक्षा कार्यक्रम न बना करके और इसको अनुमोदित करवाकर अनुपालन न कर ले । 39. साथ ले जाए जा रहे थैलों की पहचान या पुनमलाप.—साथ ले जाए जा रहे कूरियर थैलों की पहचान या पुनमलाप का कार्य किसी वायुयान प्रचालक द्वारा इस रीति से किया जाएगा जो विनिदष्ट आयुक्त द्वारा समय-समय पर किया जाए ।

40. कतिपय मालों के वहन का प्रतिबंध्.—;1द्ध आयुक्त, लिखित आदेश द्वारा कतिपय मालों को स्थोरा, या कूरियर थैलों या डाक माध्यम से वहन को प्रतिबंध् कर सकेगा ।

;2द्ध प्रतिबंध्ति वस्तुओं वाले परेषणों को वायुयान में लादा नहीं जाएगा ।

41. सुरक्षा से निर्वाध्न स्थोरा या डाक या कूरियर थैलों आदि का संरक्षण.—वायुयान प्रचालक या वायुयान क्षेत्रा प्रचालक या कोई अन्य अभिकरण जो इसमें से किसी के लिए कार्य कर रहा हो, स्थोरा या कूरियर थैलों की स्क्रीनग और संरक्षण इस रीति से करेगा जो आयुक्त द्वारा समय-समय पर विनिदष्ट किया जाए ।

42. विनियमित अभिकर्ता.—वायुयान प्रचालक, वायु द्वारा वहन को स्थोरा, कूरियर या डाक के लिए विनियमित अभिकर्ता नियुक्त कर सकेंगे, जो समय-समय पर आयुक्त द्वारा अध्क्रिमित प्रक्रिया के अनुसार कृत्य करेगा ।382 THE GAZETTE OF INDIA : APRIL 2, 2011/CHAITRA 12, 1933 [PART II—SEC. 3(i)]

भाग-7 खान-पान, प्रदाय और भंडारण

43. खान-पान प्रदाय.—;1द्ध कोई व्यक्ति, आयुक्त से सुरक्षा कार्यक्रम के अनुमोदन प्राप्त किए बिना, वायुयान में लादने के लिए कोई भी खान-पान मदों का प्रदाय नहीं करेगा ।

;2द्ध जहां आयुक्त द्वारा यह समाधन हो जाता है कि खान-पान संस्थापनों के स्वामी या प्रचालक, उपनियम ;1द्ध का उनके सुरक्षा कार्यक्रम को, उल्लघंन करता हो, उनके अवसर प्रदान करने के पश्चात रद्द कर दिया जाएगा ।

44. अन्य भंडारणों का प्रदाय.—कोई वायुयान प्रचालक, सुरक्षा स्क्रीनग किए बिना वायुयान में उपयोग के लिए किसी मद को वायुयान में नहीं लादेगा ।

भाग-8 सुरक्षा दुर्घटनाएं/घटनाएं

45. सुरक्षा दुर्घटना या घटनाओं की रिपोटग.—प्रत्येक वायुयान प्रचालक, विमानन सुरक्षा समूह, वायुयान क्षेत्रा प्रचालक, विनियमित अभिकर्ता, खान-पान संस्थापनों के स्वामी या प्रचालक को, सुरक्षा दुर्घटना या सुरक्षा घटनाओं के घटने पर, तत्काल आयुक्त को सुरक्षा दुर्घटना या सुरक्षा घटना की रिपोर्ट करनी होगी ।

46. सुरक्षा दुर्घटना या घटना की जांच.—;1द्ध आयुक्त किसी सुरक्षा दुर्घटना या सुरक्षा घटना की जांच का आदेश दे सकेगा और सुरक्षा जांच अध्किारी नियुक्त करेगा जो सहायक सुरक्षा आयुक्त की पंक्ति से नीचे का नहीं होगा ।

;2द्ध जांच अध्किारी, चूककर्ता व्यक्ति को सुनवाई का अवसर देने के पश्चात और इसकी रिपोर्ट आयुक्त को देगा, जो उसे केन्द्रीय सरकार को भेजेगा ।

47. जांच अध्किारी की शक्तियां.—जांच के प्रयोजन के लिए, किसी जांच अध्किारी को निम्न शक्तियां प्राप्त होंगी,—

;कद्ध सूचना द्वारा, किसी व्यक्ति की अपेक्षित उपस्थितिऋ

;खद्ध किसी भी ऐसे व्यक्ति की अपेक्षा, जो उसके द्वारा दिए गए कथन की सही प्रकृति की बाबत घोषणा कर सके तथा उस पर हस्ताक्षर करेंऋ

;गद्ध बहियां, कागजातों, दस्तावेजों तथा वस्तुओं को तैयार करने की अपेक्षा करनाऋ

;घद्ध किसी वायुयान या स्थान की जांच तथा पहुंच रखना ।

भाग-9 साधरण

48. निरीक्षण.—आयुक्त द्वारा लिखित रूप से प्राध्कृित कोई व्यक्ति, सभी उपयुक्त समय पर किसी भी स्थान या वायुयान में जहां पहुंच आवश्यक है प्रवेश कर सकेगा, तथा वह इन नियमों के उपबंधें के सुरक्षा अनुपालन के प्रयोजन के लिए, सुविधओं, सेवाओं, उपस्करों दस्तावेजों और रिकार्डों का निरीक्षण करेगा ।

G.S.R. 109.—The following draft of certain rules, which the Central Government proposes to make in exercise of the powers conferred by Section 4 read with Section 5 of the Aircraft Act, 1934 (22 of 1934), is hereby published as required by Section 14 of the said Act, for information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after a period of forty five days from the date of its publication in the Official Gazette.

Any objection or suggestion which may be received from any person with respect to the said draft before the expiry of a period so specified shall be considered by the Central Government.

Objections and suggestions, if any, may be addressed to the Secretary, Ministry of Civil Aviation, Rajiv Gandhi Bhavan, Safdarjang Airport, New Delhi-110003.

PART I - PRILIMINARY

1. Short title and commencement.— (1) These rules may be called the Aircraft (Security) Rules, 2011.

(2) They shall extend to whole of India and apply also to—

(a) an aircraft registered in India, and to persons on an aircraft operated by an operator who has his principal place of business or permanent residence in India, wherever they may be;

(b) all aircrafts in India;

(3) They shall come into force on the date of their final publication in the Official Gazette.

2. Definitions.— (1) In these rules, unless there is anything repugnant in the subject or context,—

(a) "Act" means the Aircraft Act, 1934 (22 of 1934);

(b) "aerodrome operator" means a person, organisation or enterprise responsible for operation and management of an aerodrome;

(c) "aerodrome entry permit" means the photo identity card, smart card or temporary permit issued by the Commissioner of Security (Civil Aviation), Bureau of Civil Aviation Security, Ministry of Civil Aviation or any person authorised by the Central Government for entry into the aerodrome or part of an aerodrome,;

(d) "aircraft operator" means a person, organisation or enterprise engaged in or offering to engage in an aircraft operation;

(e) "acts of unlawful interference" means acts or attempted acts to jeopardise the safety of civil aviation and air transport, including,—

(i) unlawful seizure of aircraft in flight;

(ii) unlawful seizure of aircraft on the ground;

(iii) hostage-taking on board aircraft or on aerodromes;

(iv) forcible intrusion on board an aircraft, at an aerodrome or on the premises of an aeronautical facility;

(v) introduction on board an aircraft or at an aerodrome of a weapon or hazardous device or material intended for criminal purposes;

(vi) communication of false information with a view to jeopardise the safety of an aircraft in flight or on the ground, of passengers, crew, ground personnel or the general public, at an aerodrome or on the premises of a civil aviation facility;

(f) "airside" means the movement area of an aerodrome, adjacent terrain and buildings or portions thereof access to which is controlled;

(g) "Commissioner" means the Commissioner of Security (Civil Aviation), Bureau of Civil Aviation Security, Ministry of Civil Aviation who shall be appropriate authority for the requirements of Annex 17;

(h) "Aviation Security Group" means an unit of specialised Government agency authorised by the Commissioner to safeguard civil aviation against acts of unlawful interference and protection of property at the aerodrome handling civil aviation;

(i) "cabin baggage" means a baggage intended for carriage in the cabin of an aircraft;

(j) "Convention" means the Convention relating to International Civil Aviation signed at Chicago on the 7th day of December, 1944;

(k) "express cargo" means goods other than mail and accompanied or baggage involuntarily or inadvertently separated from passengers or crew which is required to be carried on priority basis by an aircraft operator;

(1) "In-flight security officer" means Government security personnel deployed on board an aircraft for maintaining security of aircraft against any acts of unlawful interference;

(m) "mail" means dispatches of correspondence and other objects tendered by and intended for delivery to postal administrations;

(n) "movement area" means the area of an aerodrome which is intended for the surface movement of an aircraft and includes the maneuvering area and aprons;

(o) "national civil aviation security programme" means such programme established by any officer authorised by Central Government in this behalf to give effect to any annex of the Convention with the prior approval of Central Government;

(p) "officer" means a person appointed or employed in any office by Government of India;

(q) "prohibited article" means an object which can be used to commit an act of unlawful interference and which has not been properly declared;

(r) "public aerodrome" means an aerodrome which has been licensed for use by public at large;

(s) "regulated agent" means an agent, freight forwarder or any other entity who conducts business with an operator and provides security controls that are accepted or required by the Commissioner in respect of cargo, courier and express parcels or mails to be transported by air;

(t) "screening" means the application of technical or other means which are intended to identify or detect weapons, explosives or other dangerous devices which may be used to commit an act of unlawful interference with civil aviation;

(u) "security" means a combination of measures, human and material resources intended to be used to safeguard civil aviation against acts of unlawful interference;

(v) "security clearance" means compliance with the security controls specified in the national civil aviation security programme with regard to any aircraft, person or object;

(w) "security accident" means an occurrence which results in death or grievous hurt to a person or major damage to the property;

Explanation :— For the purposes of this clause "grievous hurt" shall have the meaning assigned to it in Indian Penal Code 1860;

(x) "security incident" in relation to civil aviation security means an occurrence, which takes place either on the ground or in flight, which results—

(i) in injury to a person, damage to property, fire and breakage;

(ii) contravention or breach of security laws, regulations, national civil aviation security programme and orders issued by the Central Government under the provisions of the Act;

(y) "security control" means the method by which the introduction of weapon, explosive or other dangerous device, article or substance, which may be used to commit an act of unlawful interference, can be prevented;

(z) "security programme" means written measures specified by the Commissioner to be adopted by an entity to safeguard civil aviation against acts of unlawful interference;

(za) "terminal" means the building or group of buildings and includes arrival building where screening of passenger, baggage, cargo and courier bag is done and boarding on aircraft takes place;

(zb) "unattended baggage" means baggage at an aerodrome with or without a baggage tag which is not picked up by or identified by a passenger or any other person;

(zc) "vital installation" means any facility on or connected with an aerodrome, which, if damaged or destroyed, would seriously impair the functioning of the aerodrome.

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning as is assigned to them in the Act.

3. Duties of Commissioner.—The Commissioner shall,—

(a) establish, develop, implement, maintain and review the national civil aviation security programme consistent with the provisions of Annex-17 to the convention to safeguard civil aviation operations against acts of unlawful interference and threat perception taking into account the safety, regularity and efficiency of flights;

(b) make order necessary to carry out the national civil aviation security programme;

(c) respond immediately to meet any increased security threat;

(d) define and allocate tasks and coordinate activities between the departments, agencies and other organisations of the State Government, aerodrome and aircraft operators and other entities concerned with or responsible for the implementation of various aspects of the national civil aviation security programme;

(e) establish a national aviation security committee or similar arrangements for the purpose of coordinating security activities between the departments, agencies and other organisations, aerodrome and aircraft operators and other entities concerned with or responsible for the implementation of various aspects of the national civil aviation security programme;

(f) establish, develop and implement national civil aviation security training programme for personnel of all entities involved with or responsible for the implementation of various aspects of the national civil aviation security programme which shall be designed to ensure the effectiveness of the said security programme;

(g) designate an authority at each aerodrome serving civil aviation who shall be responsible for coordinating the implementation of security controls;

(h) establish aerodrome security committee at each aerodrome serving civil aviation for coordinating the implementation of security controls and procedures as specified in the aerodrome security programme;

(i) develop, implement and maintain a national civil aviation security quality control programme to determine compliance with and validate the effectiveness of its national civil aviation security programme;

(j) arrange for security audit, test, survey and inspection to be conducted on a regular basis, to verify compliance with the national civil aviation security programme and to provide for immediate and effective rectification of any deficiency;

(k) establish and implement policy and procedure to adjust relevant element of its national civil aviation security programme accordingly, based upon a security risk assessment carried out by the national security agencies.

4. Appeals.—If any person is aggrieved by an order passed by an officer in exercise of a powers conferred on him by these rules, he may prefer an appeal to the Central Government.

PART II - SECURITY MEASURES AT AERODROMES

5. Planning, design and layout of the Aerodrome security requirement.—(1) The planning, design and layout of the aerodrome shall be according to the specifications provided in the national civil aviation security programme including,—

(a) security control applied to passenger, baggage, cargo, courier, express parcel, mail, catering store and supply;

(b) protection and control of access to airside, security restricted area and other sensitive aerodrome area and facility;

(c) the use of security equipment; and

(d) architectural and infrastructure related requirements.

(2) Every aerodrome operator shall establish security restricted area at aerodrome serving civil aviation in accordance with the security risk assessment carried out by the Commissioner.

(3) Aerodrome operator shall make aerodrome design mentioned in the national civil aviation security programme by integrating the design and construction of new facilities and alterations to existing design and facilities at aerodromes shall be carried out after obtaining in writing the approval of the Commissioner.

6. Aerodrome perimeter.—Every aerodrome operator shall construct a perimeter wall of the height of 2.438 meter (8 ft) with overhung fence of 0.457 meter (1.5 ft) around the aerodrome:

Provided that the Commissioner, keeping in view the threat or any other reason, may by order, increase the specification of the perimeter wall.

7. Provision of lighting, road for patrolling and observation post.—The aerodrome operator shall make the following security arrangements at the aerodrome, namely:

(a) lighting for perimeter and any other sensitive area;

(b) all-weather road for patrolling by the security personnel; and

(c) observation or command posts for the security personnel :

Provided that the Commissioner may, taking into consideration the security perceptions make such order in writing as may be deemed appropriate for security arrangements.

8. Aerodrome security programme.—Every aerodrome operator shall, with the approval of Commissioner, make and comply with aerodrome security programme in accordance with the national civil aviation security programme and any amendment to such programme shall be made after the approval of the Commissioner.

9. Security clearance for operations at aerodrome.—(1) No aerodrome operator shall commence operation at aerodrome without obtaining the clearance of security arrangements and the approval of the aerodrome security programme from the Commissioner.

(2) Where the Commissioner is satisfied that any aerodrome operator has contravened or failed to comply with the provision of these rules, he may, after giving him an opportunity of being heard, and for reasons to be recorded in writing, suspend or cancel the security clearance and security programme granted or approved by him.

10. Handling of unattended or suspect baggage.—The aerodrome operator shall—

(a) construct and maintain a protected and isolated area for placing a suspect or unattended baggage; and (b) get the same investigated and disposed off.

11. Business establishment at aerodrome.—No aerodrome operator shall allow the setting up of any business establishment in the security restricted area of aerodrome without obtaining security clearance in this regard from the Commissioner :

Provided that where any business establishment is established in the security restricted area after the approval of the Commissioner, the owner of the business establishment shall make and comply with business establishment security programme in accordance with the national civil aviation security programme.

12. Protection of facilities owned by aerodrome operator.—Every aerodrome operator shall demarcate and protect all vital installations owned by him including technical and maintenance, power supplies, electrical sub-stations, control towers and other buildings used by air traffic services and communication facilities.

13. Aviation Security Group.—(1) Every aerodrome operator shall engage such number of personnel of Government security agency as may be determined by the Commissioner for performing security duties assigned to it under these rules.

(2) The personnel engaged under sub-rule (1) shall be designated as Aviation Security Group and chief of such group shall be designated as Chief Aerodrome Security Officer.

(3) The Aviation Security Group shall work under the general supervision and direction of the aerodrome in- charge.

(4) The aerodrome operator shall provide such facility and support to the Aviation Security Group as may be approved by the Commissioner.

(5) In emergent situations, the Commissioner may make necessary changes in the deployment of Aviation Security Group.

14. Duties of the Chief Aerodrome Security Officer.—The Chief Aerodrome Security Officer shall perform following duties, namely :—

(i) safeguarding of passengers, crew, ground personnel and other aerodrome users, aircraft, aerodrome and related facilities including vital installations;

(ii) enforcement of access control measures into the restricted area of the aerodrome;

(iii) security of perimeter;

(iv) screening of passengers and their hand baggage;

(v) surveillance within and around aerodrome area;

(vi) enforcement of security measures including car parks, viewing gallery, aerodrome restaurant and areas close to movement area;

(vii) enforcement of security measures;

(viii) maintenance of order and discipline in the aerodrome premises;

(ix) supervise the movement of persons in the restricted areas;

(x) maintenance of liaison with local police and intelligence agencies; and

(xi) any other duty assigned by the Commissioner.

15. Ground handling service.—No ground handling service provider shall be allowed to provide ground handling services at any aerodrome without obtaining the security clearance and the approval of its security programme from the Commissioner.

16. Contingency Plan.—(1) The aerodrome operator shall make contingency plans to deal with acts of unlawful interference with the approval the Commissioner.

(2) The contingency plan shall be tested at such regular intervals as may be specified by the Commissioner. 17. Disembarkation of unruly passenger.—The Chief Aerodrome Security Officer or any other officer of Aviation Security Group authorised by him in this behalf shall, on a written request of the Pilot-in- Command, disembark any person from the aircraft on grounds of risk to safety and security of the passengers and the crew.

PART III - AERODROME ACCESS CONTROL

18. Entry into aerodrome.—(l) The entry into aerodrome shall be permissible only to the persons having admission ticket or aerodrome entry permit.

(2) The entry ticket to the aerodrome shall be issued by the aerodrome operator.

(3) The aerodrome entry permit shall be issued by the Commissioner after due verification.

(4) The Central Government may direct the Commissioner or aerodrome operator or any other person to issue such admission ticket or aerodrome entry permit.

(5) No person shall enter into aerodrome without obtaining an admission ticket or aerodrome entry permit.

(6) The aerodrome entry permit shall be displayed by the holder conspicuously above waist level at all times while on duty.

(7) No person shall—

(a) leave or throw or cause to be thrown any animal, bird or object,

(b) cause any animal under his possession or control to stray, and

(c) operate any vehicle without entry permit from the Commissioner in the movement area :

Provided that a passenger in the process of embarking, disembarking or in transit holding an air ticket or any person who is engaged on regular duty at an aerodrome and holds an aerodrome entry permit issued by the Commissioner shall not be required to obtain the admission ticket or entry permit.

(8) The aerodrome entry permit shall be surrendered to the Commissioner or to any person authorised by the Central Government in this behalf, upon its expiry or cancellation or upon termination of employment of the person to whom it is issued.

(9) Notwithstanding anything contained in this rule, the aerodrome operator or the Commissioner, may, if he is satisfied that it is necessary or expedient so to do in the interest of security,—

(i) refuse admission to any person in the aerodrome; or

(ii) require any person to leave the aerodrome.

19. Entry into security restricted area.—(1) The aircraft operator shall make arrangement for movement of person and vehicles to and from the aircraft in security restricted areas at each aerodrome.

(2) Before granting access to security restricted areas, the aviation security group shall screen every person, vehicle, baggage, belongings or supplies.

(3) The entry of vehicles in the security restricted area shall be permissible after obtaining entry permit or special permission from the Commissioner.

20. Prohibition to carry weapons or explosive.—(1) No person shall enter aerodrome or the aircraft with any arm, ammunition or explosive :

Provided that the provisions of this sub-rule shall not be applicable,—

(i) to the Aviation Security Group, Armed Forces and Police personnel required to carry their arms or ammunition in connection with the performance of their duties; and

(ii) to such dummy weapon, explosive, explosive device or any other dummy prohibited item, duly authorised by the Commissioner, for the purpose of testing the efficacy of aviation security.

PART IV - PRE-EMBARKATION SECURITY CHECKS

21. Security check before embarkation.—(1) Before embarkation, every originating passenger and transfer passenger boarding an aircraft and his hand baggage, if any, shall be screened by an officer of the Aviation Security Group or an officer duly authorised in this behalf by the Commissioner.

(2) The provisions of sub-rule (1) shall be applicable to the transit passengers only if they disembark from the aircraft :

Provided that the provisions of sub-rule(1) and this rule shall not be applicable to such persons as may be specified by the Commissioner by a special order.

(3) Aviation Security Group and aircraft operator shall protect the passenger and cabin baggage from unauthorised interference from the point of screening to boarding the aircraft.

22. Certification of screener.—The screening duty shall be performed by such officer who has been certified by the Commissioner.

23. Prohibition on carriage of certain goods.—(1) The Commissioner may by an order in writing prohibit the carriage of certain goods on person or in cabin baggage of a passenger and crew member which, in his opinion, is likely to be used for committing unlawful interference with civil aviation.

(2) Where prohibited goods are detected during screening, the passenger shall not be allowed to board the aircraft and action may be taken against him in accordance with the provisions of these rules or any other law for the time being in force.

PART V - SECURITY MEASURES BY AIRCRAFT OPERATORS

24. Security Programme.—Every aircraft operator shall, with the approval of Commissioner, make and comply with aircraft operator security programme in accordance with the national civil aviation security programme and any amendment to such programme shall be made after the approval of the Commissioner.

25. Security clearance for operation.—(1) No aircraft operator shall commence operation at aerodrome without obtaining the clearance of security arrangements and the approval of the aircraft operator security programme under rule 24 from the Commissioner.

(2) Where the Commissioner is satisfied that any aircraft operator has contravened or failed to comply with the provisions of these rules, he may, after giving him an opportunity of being heard, and for reasons to be recorded in writing, suspend or cancel the security clearance and security programme granted or approved by him.

26. Deployment of staff.—An aircraft operator shall engage only those personnel for security duties who are whole time employees whose character and antecedents have been verified and who is employed after proper training, selection procedure and certification in accordance with national civil aviation security programme.

27. Security search of aircraft.—An aircraft operator shall carry out the search of his aircraft—

(a) before taking it to security restricted area; and

(b) before boarding of passengers after disembarkation and after disembarkation.

28. Access control to aircraft.—(1) The aircraft operator shall control access to aircraft and maintain surveillance from the security check to the departure.

(2) The aircraft operator shall control the non-operational aircraft by keeping,—

(i) cabin doors closed;

(ii) aerobridges and ventral stairs secured, withdrawn or retracted; and

(iii) tamper evident sealed doors.

29. Closing of cockpit door.—Every aircraft operator shall ,—

(a) lock cockpit doors of aircraft during all phases of flight, unless required to be opened for operational reasons;

(b) establish and maintain communication system between the flight crew and cabin crew during flight; and (c) assign responsibility of access control of cock-pit to Pilot-in-command.

30. Deployment of In-flight security officer.—(1) Air craft operator shall carry such number of In-flight security officer on board a passenger aircraft, as the Commissioner may specify by an order in writing.

(2) Aircraft operator shall declare to the Pilot-in-command the number of armed persons and their seat location.

31. Security control for hold baggage.—(1) The aircraft operator or the aerodrome operator shall screen and protect the hold baggage in such manner as may be specified by the Commissioner from time to time.

32. Identification and reconciliation of hold baggage.—An aircraft operator shall carry out the identification and reconciliation of hold baggage in such manner as may be specified by the Commissioner by an order in writing from time to time.

33. Transfer baggage.—The aircraft operator shall screen the transfer hold baggage before loading into an aircraft :—

Provided that the hold baggage screened at the point of origin and subsequently protected from unauthorised interference from the originating aerodrome to the departing aircraft at the transfer aerodrome shall not be subject to screening.

34. Carriage of prisoners in aircraft.—(1) The aircraft operator shall carry any prisoner, in such manner as may be specified by an order in writing by the Commissioner.

35. Carriage of cargo, mail, catering items and other stores.—The aircraft operator shall accept on board any cargo, mail, catering items and other stores and supplies in such manner as may be specified by Commissioner. 36. Detention of aircraft.—The Commissioner or any other person authorised in this behalf by the Central Government may, for reasons to be recorded in writing, detain an aircraft if in his opinion,

(a) the aircraft has on board unauthorised arms, explosives or other sabotage devices which are likely to cause danger to the security of that aircraft; or

(b) the aircraft has on board a person who has gained entry in unauthorized manner or is likely to cause unlawful interference with civil aviation operations; or

(c) the detention is necessary to secure compliance with any of the provisions of these rules.

PART VI — CARGO, COURIER BAGS, MAIL AND REGULATED AGENT

37. Security control for cargo and courier bag.—(1) Any cargo, express cargo or courier bag intended to be carried on any aircraft, shall be received, processed and handled by regular employees who are trained in accordance with the national civil aviation security programme of aircraft operator or any other agency authorised by an order in writing by the Commissioner.

(2) No cargo shall be loaded on aircraft without making security controls including X-ray screening or physical search :—

Provided that the Commissioner may by an order in writing exempt any cargo, express cargo or courier bag from the provisions of this rule.

38. Registration of courier agency.—No aircraft operator shall accept any courier bag for transportation from any agency unless such agency,—

(a) has registered as such with the aircraft operator; and

(b) has made and complied with a security programme approved by the Commissioner.

39. Identification or reconciliation of the accompanied courier bags.—The identification or reconciliation accompanied courier bag shall be made by air craft operator in such manner as may be specified by the Commissioner from time to time.

40. Prohibition on carriage of certain goods.—(1) The Commissioner may, by order in writing, prohibit the carriage of certain items through cargo or courier bags or mail.

(2) The consignment containing prohibited article shall not be loaded on aircraft.

41. Protection of security cleared cargo or mail or courier bag etc.—The aircraft operator or airport operator or any other agency working for any of them shall screen and protect the cargo or mail or courier bag in such manner as may be specified by Commissioner from time to time.

42. Regulated agent.—The aircraft operator may engage Regulated Agent for carriage of cargo, courier or mail to be carried by air, who shall function as per the procedure laid down by the Commissioner in writing from time to time.

PART VII — CATERING SUPPLIES AND STORES

43. Catering supplies.—(1) No person shall supply any catering item for loading in the aircraft without obtaining the approval of its security programme from the Commissioner.

(2) Where the Commissioner is satisfied that owner or operator of catering establishment has contravened the provisions of sub-rule (1), his security programme shall, after affording an opportunity of being heard, be cancelled 44. Supply of other stores.—No aircraft operator shall load on the aircraft any item for use on the aircraft without security screening.

PART VIII — SECURITY ACCIDENTS/INCIDENTS

45. Reporting of security accident or incident.—Every aircraft operator, aviation security group, aerodrome operator, regulated agent and owner or operator of catering establishment shall report the security accident or security incident to the Commissioner immediately on the occurrence of the security accident or security incident.

46. Investigation of security accident or incident.—(1) The Commissioner may order investigation of any security accident or security incident and appoint an officer not below the rank of Assistant Commissioner of Security as Inquiry Officer.

(2) The Inquiry Officer shall, after affording an opportunity of being heard to the defaulting person, make a report to the Commissioner who should forward the same to the Central Government.

47. Powers of the Inquiry Officer.—For the purpose of inquiry an Inquiry Officer shall have power—

(a) to require, by notice, the attendance of any person;

(b) to require any such person to make and to sign a declaration regarding the true nature of the statements made by him;

(c) to require the production of books, papers, documents and articles;

(d) to have access to and examine any aircraft or place.

P ART IX — GENERAL

48. Inspection.—Any person, authorised by the Commissioner in writing may, at all reasonable times, enter any place or aircraft to which access is necessary and to inspect the facilities, services, equipment, documents and records for the purpose of securing compliance with the provisions of these rules.

सा.का.नि. 111.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय जल और विद्युत अनुसंधन केन्द्र, पुणे ;परा-चिकित्सा कर्मचारिवृंद, समूह 'ग' पदद्ध भर्ती नियम, 1988 को, जहां तक उसका संबंध् भेषजज्ञ के पद से है, उन बातों के सिवाय अध्क्रिान्त करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, जल संसाध्न मंत्राालय के केन्द्रीय जल और विद्युत अनुसंधन शाला, पुणे में भेषजज्ञ के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम जल संसाध्न मंत्राालय, केन्द्रीय जल और विद्युत अनुसंधन शाला, पुणे, भेषजज्ञ, समूह 'ग' पद, भर्ती नियम, 2011 है ।

G.S.R. 111.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of Central Water and Power Research Station, Pune, (Para Medical Staff, Group 'C' Posts) Recruitment Rules, 1988, in so far as they relate to the post of Pharmacist, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Pharmacist in the Ministry of Water Resources, the Central Water and Power Research Station, Pune, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, the Central Water and Power Research Station, Pune, Pharmacist, Group 'C' Post, Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scales attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 113.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of Ministry of Agriculture, (Department of Agriculture and Cooperation) (Group 'D' Posts) Recruitment Rules, 1989, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to certain Group 'C' posts, in the Ministry of Agriculture (Department of Agriculture and Cooperation), namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation (Group 'C' posts), Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Essential : (i) Master's degree in Zoology or Marine Biology or Fisheries Science or Oceanography or Industrial Fisheries from a recognized university or equivalent OR Post Graduate Diploma in Fisheries Science of the Central Institute of Fisheries Education, Mambai (ii) Ten years experience in survey or research of Marine Fisheries including Cruise Planning and participation in voyages, modern fishing methods, fishery development. Desirable :

Doctorate Degree in Zoology or Marine Biology/Oceanography/ Fisheries Science or a recognized university or equivalent. The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Period of deputation (including short-term contract) including period of deputation (including short-term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation/Department of the Central Government shall ordinarily not exceed four years. The maximum age limit for appointment by deputation (including short-term contract) shall be not exceeding 56 years as on the closing date of the receipt of applications.
