सा.का.नि. 122.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विध् िऔर न्याय मंत्राालय, विध् िकार्य विभाग ;स्टापफ कार चालकद्ध भर्ती नियम 2002 का संशोध्न करने के लिए निम्नलिखित नियम बनाती हैंऋ अर्थात् :—
1. ;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विध् िकार्य विभाग ;स्टापफ कार चालकद्ध भर्ती संशोध्न नियम, 2011 है ।
;2द्ध ये 1 जनवरी, 2006 से प्रवृत्त हुए समझे जाएंगे ।
2. विध् िऔर न्याय मंत्राालय, विध् िकार्य विभाग ;स्टापफ कार चालकद्ध भर्ती नियम, 2002 की अनुसूची के स्तंभ 4 में —
;कद्ध स्तंभ के शीर्षक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :—
फ्वेतन बैंड और ग्रेड वेतन या वेतनमानय्ऋ
;खद्ध स्टापफ कार चालक विशेष श्रेणी के पद के सामने, फ्5000-150-8000 रफ.य् प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात् :-
फ्वेतन बैंड-2 : 9300-34800 रफ. ध्न ग्रेड वेतन 4,200 रफ.य्ऋ

फ्वेतन बैंड-1ः 5,200-20,200 रफ. ध्न ग्रेड वेतन 1900 रफ.य्ऋ
स्पष्टीकरण ज्ञापन—भारत के राजपत्रा, असाधरण, भाग II, खंड 3, उपखंड ;iद्ध में सा.का.नि. 622 ;अद्ध तारीख 29 अगस्त, 2008 द्वारा प्रकाशित केंद्रीय सिविल सेवा ;पुनरीक्षित वेतनद्ध नियम, 2008 के अनुसार, नई वेतन संरचना के निबंध्नों में विध् िऔर न्याय मंत्राालय, विध् िकार्य विभाग ;स्टापफ कार चालकद्ध भर्ती नियम, 2002 में एकरूपता लाने के लिए इन नियमों को भूतलक्षी प्रभाव दिया जाना आवश्यक है । यह प्रमाणित किया जाता है कि इन नियमों को भूतलक्षी प्रभाव देने से किसी व्यक्ति पर प्रतिकूल प्रभाव नहीं पड़ेगा ।

G.S.R. 122.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Law and Justice, Department of Legal Affairs, (Staff Car Drivers) Recruitment Rules, 2002 namely :—
1. (1) These rules may be called the Ministry of Law and Justice, Department of Legal Affairs, (Staff Car Drivers) Recruitment Amendment Rules, 2011.
(2) They shall be deemed to have come into force with effect from the 1st January, 2006.
2. In the Ministry of Law and Justice, Department of Legal Affairs, (Staff Car Drivers) Recruitment Rules, 2002, in the Schedule, in column 4,—
(a) for the column heading, the following shall be substituted, namely :—
"Pay Band and Grade Pay or Pay Scale";
(b) against the post of the Special Grade Staff Car Driver, for the entry "Rs.5000-150-8000", the following entry shall be substituted, namely :—
"Pay-Band-2 : Rs. 9,300—34,800 plus Grade Pay of Rs. 4,200";
(c) against the post of Grade I Staff Car Driver, for the entry "Rs.4500-125 7000", the following entry shall be substituted, namely :—
"Pay-Band-1 : Rs. 5,200—20,200 plus Grade Pay of Rs. 2,800";
(d) against the post of Grade II Staff Car Driver, for the entry "Rs.4000-100 6000", the following entry shall be substituted, namely :—
"Pay-Band-1 : Rs. 5,200—20,200 plus Grade Pay of Rs. 2,400";
(e) against the post of Ordinary Grade Staff Car Driver, for the entry "Rs. 3050-75-3950-80-4590", the following entry shall be substituted, namely :—
"Pay-Band-1: Rs. 5,200—20,200 plus Grade Pay of Rs. 1,900".
Explanatory Memorandum :—In order to bring uniformity in the Ministry of Law and Justice, Department of Legal Affairs, (Staff Car Drivers) Recruitment Rules, 2002 in terms of the new pay structure as per the Central Civil Services (Revised Pay) Rules, 2008, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i), vide number G.S.R. 622(E), [भाग IIखण्ड 3(i)] भारत का राजपत्रा : अप्रैल 16 2011/चैत्रा 26, 1933 447 dated the 29th August, 2008, retrospective effect is required to be given to these rules. It is certified that no person is being adversely affected by giving this retrospective effect to these rules.

सा.का.नि. 123.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विध् िऔर न्याय मंत्राालय, ;विध् िकार्य विभागद्ध पुस्तकालय सूचना सहायक भर्ती नियम, 1991 का और संशोध्न करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् :—
1. ;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय ;विध् िकार्य विभागद्ध पुस्तकालय सूचना सहायक भर्ती ;संशोध्नद्ध नियम, 2011 है ।
;2द्ध ये 1 जनवरी, 2006 से प्रवृत्त हुए समझे जाएंगे ।
2. विध् िऔर न्याय मंत्राालय ;विध् िकार्य विभागद्ध पुस्तकालय सूचना सहायक भर्ती ;संशोध्नद्ध नियम, 2011 की अनुसूची के स्तंभ 4 में,—
(i) फ्वेतनमानय् शीर्षक के स्थान पर फ्वेतन बैंड और ग्रेड वेतन या वेतनमानय् शीर्षक रखा जाएगा ऋ
;iiद्ध फ्1400-40-1600-50-2300-द.रो.-60-2600 रफ.य् प्रविष्टि के स्थान पर फ्वेतन-बैंड-2, 9300-34800 रु. ध्न ग्रेड वेतन 4200 रु.य् प्रविष्टि रखी जाएगी ।
स्पष्टीकारक ज्ञापन—छठे केंद्रीय वेतन आयोग की सिपफारिशों के क्रियान्वयन के परिणामस्वरूप, पुस्तकालय सूचना सहायक पद से संबंध्ति सुसंगत वेतनमान को 1 जनवरी, 2006 से पुनरीक्षित किया गया है । तदनुसार, सुंसगत भर्ती नियम को पुनरीक्षित वेतनमान के अनुरूप बनाने के लिए भूतलक्षी प्रभाव से संशोध्न करना आवश्यक हो गया है । यह प्रमाणित किया जाता है कि ऐसे भूतलक्षी प्रभाव से किसी पर भी प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

1. (1) These rules may be called the Ministry of Law and Justice (Department of Legal Affairs), Library Information Assistant Recruitment (Amendment) Rules, 2011.
(2) They shall be deemed to have come into force on the 1st day of January, 2006.
2. In the Schedule to the Ministry of Law and Justice (Department of Legal Affairs), Library Information Assistant Recruitment Rules, 1991, in column 4,
(i) for the heading, "Scale of pay", the heading
"Pay Band and Grade Pay or Pay Scale", shall be substituted;
(ii) for the entry, "Rs.1400-40-1600-50-2300-EB-60-2600", the entry
"Pay-Band-2 Rs. 9300-34800 plus Grade Pay Rs. 4200", shall be substituted.
Explanatory Memorandum.—Consequent upon the implementation of the recommendations of the Sixth Central Pay Commission, the relevant pay scale attached to the post Library Information Assistant has been revised with effect from 1st January, 2006. Accordingly, it has become necessary to amend the relevant recruitment rules with retrospective effect for making them in conformity with the revised pay scale. It is certified that none is likely to be adversely affected by such retrospectivity.
