आ.अ. 105.—यतः निर्वाचन आयोग का समाधन हो गया है कि कर्नाटक राज्य की विधन सभा के साधरण निर्वाचन, 2008, में 208-मादीकेरी विधन सभा निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी, श्री एच.ई. सन्नपा, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों एवं आदेशों द्वारा अपेक्षित निर्वाचन-व्ययों के लेखे को प्रस्तुत करने में असमर्थ रहे हैंऋ तथा

अथवा विधन परिषद्‌ के सदस्य होने या चुने जाने के लिए निरहत घोषित करता है ।

ORDER

यतः, उक्त अभ्यर्थी, श्री एच.ई. सन्नपा, ने सम्यक्‌ सूचना दिए जाने पर भी उक्त असपफलता का कोई कारण अथवा स्पष्टीकरण नहीं दिया है, और इस प्रकार निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ

और यतः, उक्त अभ्यथयों ने सम्यक्‌ सूचना दिए जाने पर भी उक्त असपफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है । या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात्‌ निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ
