आ.अ. 110.—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि राष्ट्रीय राजधनी राज्य क्षेत्रा दिल्ली से लोकसभा के साधरण निर्वाचन, मई 2009 के लिए 4-नई दिल्ली संसदीय निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी श्री कपिल मित्राा लोक प्रतिनिध्त्वि अध्निियम, 1951, तथा त(ीन बनाए गए नियमों द्वारा यथा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहेऋ और
यतः उक्त अभ्यर्थी ने भारत निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है अथवा उनके द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, पर विचार करने के पश्चात् भारत निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायोचित्य नहीं हैऋ
अतः अब, भारत निर्वाचन आयोग लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10-क के अनुसरण में श्री कपिल मित्राा को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरर्हित घोषित करता है ।

O. N. 110.—Whereas, the Election Commission of India is satisfied that Shri Kapil Mitra, 2860 Hamilton Road, Delhi-110006 a contesting candidate at the General Election to the Lok Sabha of National Capital Territory of Delhi held in May, 2009 from 4- New Delhi Parliamentary Constituency has failed to lodge any account of election expenses as required by the Representation of the People Act, 1951 and to Rules made thereunder; and
Whereas, the said candidate has not furnished any reason or explanation for the said failure even after due notice by the Election Commission of India or after considering the representation made by him, if any, the Election Commission of India is satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declare the said Shri Kapil Mitra to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of three years from the date of this order.

आ.अ. 111.—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तम्भ ;2द्ध में यथा विनिदष्ट राष्ट्रीय राजधनी राज्यक्षेत्रा दिल्ली विधन सभा के लिए नवम्बर, 2008 में हुए साधरण निर्वाचन, जो स्तम्भ ;3द्ध में विनिदष्ट तद्नुरूप निर्वाचन क्षेत्रा से हुआ है स्तम्भ ;4द्ध में उसके सामने विनिदष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों द्वारा यथा अपेक्षित उक्त सारणी के स्तम्भ ;5द्ध में यथादशत अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहेऋ और यतः, उक्त अभ्यथयों ने भारत निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है अथवा उनके द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, पर विचार करने के पश्चात् भारत निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायोचित्य नहीं हैऋ

N. 111.—Whereas, the Election Commission of India is satisfied that the contesting candidates specified in column (4) of the table below at the General Election to the Legislative Assembly of National Capital Territory of Delhi held in November, 2008 as specified in column (2) and held from constituency correspondingly specified in column (3) against their names have failed to lodge account of their election expenses, as shown in column (5) of the table, as required by the Representation of the People Act, 1951, and the Rules made thereunder; and
Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due notice by the Election Commission of India or after considering the representations made by them, if any, the Election Commission of India is satisfied that they have no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares the persons specified in column (4) of the table enclosed to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/ Union Territory for a period of three years from the date of this order.
