करने और जांच शुरू करने के प्रस्ताव की सूचना को दिनांक 02.02. 2010 को मुंबई के दि टाइम्स ऑफ इंडिया और लोकसत्ता में प्रकाशित किया गया;

भाभा परमाणु अनुसंधान केन्द्र मुंबई-400085 , दिनांक 11 अप्रैल 2011 सं. 7 (44)/2008 /सतर्कता/21--जबकि यह आरोपित किया गया था कि--

9. और जबकि दिनांक 26.02.2010 को उक्त श्री पाटिल के आवास के सामने वाले दरवाजे पर दिनांक 08.06.2009 के आरोप वाले ज्ञापन कोचिपकाने का प्रयास किया गया परंतु उन्होंने इसे दरवाजे पर नहीं चिपकाने दिया;

(i ) श्री आर. पी. पाटिल, वैज्ञानिक सहायक ( सी ) , अनुसंधान रिएक्टर अनुरक्षण प्रभाग, भापअ केन्द्र को दिनांक 06.03.2009 के आदेश सं. आरआरएमडी/पीईआर/ 484109 द्वारा तुरंत प्रभाव से अप्सरा में तैनात किया गया था परंतु उन्होंने अप्सरा में ड्यूटी पर रिपोर्ट नहीं किया और दिनांक 09.03.2009 से 28.05.2009 तक अनधिकृत रूप से ड्यूटी से अनुपस्थित रहे ।

10. और जबकि उक्त श्री पाटिल जांच में शामिल नहीं हुए और जांच की कार्यवाही एकपक्षीय पूरी की गई । जांच प्राधिकारी ने दिनांक 18.01.2011 को अपनी रिपोर्ट प्रस्तुत की जिसमें उन्होंने उक्त श्री पाटिल के विरूद्ध लगाए गए आरोपों को सही पाया;

( ii ) श्री आर. पी. पाटिल, वैज्ञानिक सहायक ( सी ) , अनुसंधान रिएक्टर अनुरक्षण प्रभाग , भापअ केन्द्र को अपने वरिष्ठ अधिकारियों तथा सहकर्मियों के साथ दुर्व्यवहार करने और गाली गलौज करने की आदत है ।

11. और जबकि उक्त श्री पाटिल को दिनांक 31.01.2011 की टिप्पणी सं. 7 (44 )/2008 /सतर्कता/ 742 द्वारा जांच रिपोर्ट की प्रतिलिपि अग्रेषित की गई ताकि वे अपना अभ्यावेदन/निवेदन, यदि कोई हो, प्रस्तुत कर सकें;

(iii ) श्री आर. पी. पाटिल, वैज्ञानिक सहायक ( सी ) , अनुसंधान रिएक्टर अनुरक्षण प्रभाग, भापअ केन्द्र ने उनको जारी कार्यालयीन पत्र लेने से इनकार कर दिया है ।

12. और जबकि जांच रिपोर्ट वाला लिफाफा अवितरित वापस आ गया और इसलिए दिनांक 07.03.2011 को उक्त श्री पाटिल के आवास के सामने वाले दरवाजे पर रिपोर्ट चिपका दी गई;

13. और जबकि उक्त श्री पाटिल ने जांच रिपोर्ट पर अपना निवेदन/अभ्यावेदन प्रस्तुत नहीं किया;

अपने उक्त आचरण द्वारा उक्त श्री पाटिल ने ड्यूटी के प्रति निष्ठा में कमी दर्शायी है और इस तरह का व्यवहार किया है जो सरकारी कर्मचारी के लिए अशोभनीय है और इससे केन्द्रीय सिविल सेवा ( आचरण ) नियमावली, 1964 के नियम 3 केउप- नियम 1 के खण्ड ( ii ) तथा ( iii ) उल्लंघन हुआ है;

14. और जबकि अधोहस्ताक्षरी ने जांच रिपोर्ट, मामले के अभिलेखों तथा सेवा अभिलेखों को ध्यानपूर्वक पढ़ा । अभिलेखों से यह पता चलता है कि श्री पाटिल ने उनको संबोधित कोई भी पत्र प्राप्त नहीं किया तथा उनके विरूद्ध की गई जांच कार्यवाहियों में वे शामिल नहीं हुए और इसलिए जांच प्राधिकारी ने एकपक्षीय जांच की । दस्तावेजी साक्ष्यों और जांच के दौरान प्राप्त साक्ष्य के आधार पर, जांच प्राधिकारी ने उक्त श्री पाटिल के विरूद्ध लगाए गए सभी तीन आरोपों को सही पाया;

2. और जबकि उक्त श्री पाटिल को दिनांक 08.06.2009 के ज्ञापन संख्या 7 ( 44 ) 2008/सतर्कता /52550 द्वारा उनके विरूद्ध लगाए गए आरोप तथा केन्द्रीय सिविल सेवाएं ( वर्गीकरण, नियंत्रण एवं अपील ) नियमावली, 1965 के नियम 14 के अंतर्गत प्रस्तावित कार्रवाई किए जाने की सूचना दी गई थी;

3. और जबकि उक्त श्री पाटिल ने दिनांक 08.06.2009 के आरोप वाले ज्ञापन को दिनांक 10.06.2009 को पढ़ा और उसे लेने से इन्कार कर दिया;

15. और जबकि सेवा अभिलेखों से पता चलता है कि उक्त श्री पाटिल पर एक स्टाफ सदस्य के साथ उपद्रवी और अनुशासनहीनतापूर्ण व्यवहार करने , गाली गलौच करने और दूसरों को धमकाते हुए प्रभाग में कार्य के वातारण को बिगाड़ने के कारण अनिवार्य सेवानिवृत्ति का दंड लगाया गया था । अपील करने पर उन्हें सेवा में पुनः बहाल किया गया था । परंतु यह देखा गया है कि उक्त श्री पाटिल अपना व्यवहार सुधारने में असफल रहे ;

4. और जबकि दिनांक 02.07.2009 को आरोप वाले ज्ञापन को उक्त श्री पाटिल को पुनः देने का प्रयास किया गया जिसे उन्होंने लेने से एक बार फिर इन्कार कर दिया;

5. और जबकि उक्त आरोप वाले ज्ञापन को उक्त श्री पाटिल के अंतिम ज्ञात स्थानीय पते पर पंजीकृत डाक द्वारा भेजा गया जो " बेदावा प्रेषक को वासस" अभ्युक्ति के साथ वापस अवितरित प्राप्त किया गयाः

6. और जबकि दिनांक 14.09.2009 के आदेश द्वारा उक्त श्री पाटिल के विरूद्ध लगाए गए आरोपों की जांच करने का आदेश दिया गया;

16. और जबकि अधोहस्ताक्षरी ने मामले के सभी तथ्यों और परिस्थितियों पर विचार किया । उक्त श्री पाटिल जानबूझकर अनधीनता, अवज्ञा तथा अनुशासन भंग करने में लिप्त रहे हैं तथा अपने सहकर्मियों के साथ गाली गलौज करते हुए और उन्हें धमकाते हुए कार्यस्थल पर गड़बडी पैदा की है । यह भी देखा गया है कि उक्त श्री पाटिल ने उन्हें भेजे गए पत्रों को लेने से बार- बार इन्कार किया । इस अनुसंधान केन्द्र जैसे संवेदनशील संगठन में अनुशासन विध्वंसक कृत्यों को प्रोत्साहित नहीं किया जा सकता है। इसलिए, अधोहस्ताक्षरी का मानना है कि उक्त श्री पाटिल सेवा में रखने हेतु योग्य व्यक्ति नहीं है;

7. और जबकि उपर्युक्त आदेश वाला लिफाफा अवितरित वापस आ गया, अतः उसे उक्त श्री पाटिल के आवास ( 47 , मंदाकिनी , अणुशक्तिनगर, मुंबई -94 ) के सामने वाले दरवाजे पर चिपका दिया गया;

17. और जबकि इस तथ्य पर विचार करते हुए कि उक्त श्री पाटिल 20 वर्ष से अधिक सेवा पूरी कर चुके हैं, नरमी का दृष्टिकोण अपनाया 8. और जबकि दिनांक 22.01.2010 के संदर्भ सं. 7 (44)/2008/ सतर्कता/8607 द्वारा उक्त श्री पाटिल के विरूद्ध अनुशासनिक कार्रवाई प्रारंभ 2730

गया है और अधोहस्ताक्षरी का मत है कि इस मामले में यह न्यायोचित होगा यदि उक्त श्री पाटिल पर अनिवार्य सेवानिवृत्ति का दंड लगाया जाए;

18. अतः अब, परमाणु ऊर्जा विभाग के दिनांक 13 अक्तूबर, 2005 के आदेश संख्या1/6 ( 1 ) /सतर्कता/ 7613 के साथ पठित केन्द्रीय सिविल सेवाएं ( वर्गीकरण , नियंत्रण एवं अपील ) नियमावली 1965 के नियम 12 के उपनियम ( 2 ) क खण्ड ( ख ) के अंतर्गत निहित शक्तियों का प्रयोग करते हुए अधोहस्ताक्षरी, एतद्वारा , उक्त श्री पाटिल को अनिवार्य रूप से सेवानिवृत्त करते हैं ।

दिनांक 09.03.2009 से 28.05.2009 तक की अनधिकृत अनुपस्थिति की अवधि को ' अकार्य दिवस ' माना जाएगा ।

19. श्री पाटिल को सूचित किया जाता है कि उपर्युक्त आदेश के विरुद्ध निदेशक, भापअ केन्द्र, अपीलीय प्राधिकारी के सम्मुख अपील की जा सकती है । यदि कोई अपील करनी हो तो अपीलीय प्राधिकारी के सम्मुख इस आदेश की प्राप्ति की तारीख से पैंतालीस दिनों के भीतर की जानी चाहिए ।

(i) Shri R.P. Patil , Scientific Assistant (C) , Research Reactor Maintenance Division , BARC , posted to Apsara with immediate effect, vide order No. RRMD/ Per/484109 dated 6.3.2009 did not report for duty at Apsara and remained absent from duty unauthorisedly from 9.3.2009 to 28.5.2009 .

12. AND WHEREAS the envelope containing the inquiry report was received back undelivered and therefore the report was pasted on the front door of the residence of the said Shri Patil on 7.3.2011 ;

(ii) Shri R.P. Patil , Scientific Assistant (C) , Research Reactor Maintenance Division, BARC is in the habit of misbehaving with his superiors and colleagues and using abusive language.

13. AND WHEREAS the said Shri Patil did not submit his submission/ representation on the Inquiry Report ;

(iii) Shri R.P. Patil, Scientific Assistant (C) , Research Reactor Maintenance Division , BARC has refused to accept the official communications issued to him.

16. AND WHEREAS the undersigned has applied his mind to all the facts and circumstances of the case . The said Shri Patil has indulged in willful insubordination , disobedience and acts subversive to discipline and also created disturbances at the workplace by abusing and threatening his colleagues . It is also seen that the said Shri Patil has repeatedly refused to accept any of the communications sent to him . Acts subversive to the discipline cannot be countenanced in a sensitive organisation like this Research Centre . The undersigned is , therefore , of the view that the said Shri Patil is not a fit person to be retained in service;

AND WHEREAS considering the fact that the said Shri Patil has put in more than 20 years of service , a lenient view is taken and the undersigned is of the opinion that ends of justice would meet in this case , if the penalty of compulsory retirement from service is imposed on the said Shri Patil ;

NOW THEREFORE, the undersigned in exercise of the powers conferred on him under clause (b) of Sub Rule (2) of Rule 12 of the Central Civil Services (Classification, Control & Appeal ) Rules , 1965 read with Department of Atomic Energy Order No. 1/6( 1 )/2002 -Vig/ 7613 dated October 13 , 2005 hereby compulsorily retires the said Shri Patil .

The period of unauthorised absence from 9.3.2009 to 28.5.2009 is treated as ' Dies -non' .

19. Shri Patil is informed that an appeal against the above order lies with Director , BARC, the Appellate Authority. The appeal , if any, should be submitted to the Appellate Authority within forty- five days from the date of receipt of this order .
