सं. सी-छूट/ई- III/ 16 ( 14 ) /99/बीकेपी/डब्ल्यूबी/सी ई/ ई जैड चूंकि मैसर्स ऑकलैंड इंटरनेशनल लि. इकाई: ऑकलैंड जूट मिल्स, डब्ल्यू बी/22जिसका पंजीकृत कार्यालय जगतदल -743125 , नार्थ 24 परगना, पश्चिम बंगाल में है ( इसके पश्चात स्थापना के रूप में संदर्भित ) को कर्मचारी भविष्य निधि योजना एवं प्रकीर्ण उपबंध अधिनियम, 1952 ( इसके पश्चात अधिनियम के रूप में संदर्भित ) की धारा 17 ( 1 ) ( क ) के अंतर्गत केन्द्रीय भविष्य निधि आयुक्त के द्वारा अधिसूचना संख्या ई-102 ( 19 )/ई/ए-57 दिनांक 17.10.57 के द्वारा छूट प्रदान की गई थी ।
एवं चूंकि स्थापना ने कर्मचारी भविष्य निधि योजना 1952 के अनुच्छेद 27 क क के अंतर्गत वर्णित छूट प्रदान करने की शर्त संख्या 18 ( क ) , 6, 24( ग ) , 17, 3 एवं 26 का उल्लंघन किया है ।
एवं चूंकि केन्द्रीय भविष्य निधि आयुक्त के द्वारा अधिनियम की धारा 17 ( 1 ) ( क ) के अंतर्गत प्रदान की गई छूट को निरस्त करने के लिए दिनांक 11.01.2011 को कारण बताओ नोटिस जारी किया गया है । एवं चूंकि स्थापना द्वारा पत्र संख्या पी.एफ-109-1011 दिनांक 22.01.2011 के माध्यम से दिया गया उत्तर सारहीन एवं असंतोषजनक पाया गया है । एवं चूंकि स्थापना ने कारण बताओ नोटिस के उत्तर में सहायक भविष्य निधि आयुक्त ( बैरकपुर ) को भेजे गए अपने पत्र दिनांक 20.11.2009 का संदर्भ दिया है , जिसमें छूट के लाभों को बनाए रखने में हो रही कठिनाई को देखते हुए छूट निरस्त करने का अनुरोध किया था। अतः अब, मैं, एस. चटर्जी, केन्द्रीय भविष्य निधि आयुक्त, कर्मचारी भविष्य निधि एवं प्रकीर्ण उपबंध अधिनियम 1952 की धारा 17 ( 4 ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए इस अधिसूचना के प्रकाशन की तिथि से उपर्युक्त स्थापना को प्रदान की गई छूट को निरस्त करता हूं।

भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण

सं. भा.अ.जा.प्रा./कार्गो/184/2009--भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण अधिनियम, 1985 ( 1985 का 82 ) की धारा 35 के द्वारा , धारा 17 को पढ़ते हुए, प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण, केन्द्रीय सरकार के पूर्व अनुमोदन से, एतद्वारा निम्नलिखित विनियम बनाता है, अर्थात्: --
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का संक्षिप्त नाम भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण ( शुल्क एवं प्रभार उग्रहण और संग्रहण ) विनियम, 2011 है ।
(2) ये विनियम सरकारी राजपत्र में प्रकाशन की तिथि से लागू होंगे ।
2. परिभाषा-इन विनियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो--
(क) " अधिनियम " से भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण अधिनियम, 1985 अभिप्रेत है;
(ख) " अध्यक्ष " से प्राधिकरण का अध्यक्ष अभिप्रेत है;
( ग ) " शुल्क " से राष्ट्रीय जलमार्गों के उपयोग हेतु और प्राधिकरण द्वारा सृजित अवसंरचना के उपयोग हेतु कार्गो स्वामियों अथवा जलयान को दी गई सेवा के लिए अनुसूची में विनिर्दिष्ट प्रभार है;
(घ ) " अनुसूची " से प्राधिकरण द्वारा उपलब्ध कराई गई सेवा के लिए शुल्क को विनिर्दिष्ट करने वाले विनियम के साथ संलग्न अनुसूची अभिप्रेत है;
(ङ) " जलयान " से अन्तर्देशीय जलयान अधिनियम, 1917 ( 1917 का 1 ) में यथा परिभाषित एक अन्तर्देशीय जलयान अभिप्रेत है;
( च ) इसमें प्रयुक्त शब्द और अभिव्यक्ति जो परिभाषित नहीं हैं, किन्तु अधिनियम में परिभाषित हैं, का अर्थ अधिनियम में क्रमशः निर्दिष्ट अर्थ होगा । 3. शुल्क का वर्गीकरण- प्राधिकरण द्वारा उपलब्ध कराई गई सेवाओं के लिए लगाए जाने वाले शुल्क का वर्गीकरण निम्न श्रेणियों में होगा, अर्थात्-- (क) जलमार्ग उपयोग प्रभार
(ख) जलयान से संबंधित प्रभार
(ग) कार्गो से संबंधित प्रभार
( घ) संयुक्त प्रभार
(ङ ) विविध प्रभार, और यथा अनुसूची में विनिर्दिष्ट।
4. शुल्क का भुगतान--प्रत्येक जलयान अथवा कार्गो स्वामी विनिर्दिष्ट शुल्क का भुगतान ' भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण निधि ' के पक्ष में देय डिमांड ड्राफ्ट द्वारा प्राधिकरण के क्षेत्रीय कार्यालय के निदेशक को करेगा ।
5. लेखा का रखरखाव प्राधिकरण के क्षेत्रीय कार्यालय का निदेशक प्राप्त शुल्क का लेखा जोखा रखेगा ।
6. शुल्क के भुगतान से छूट ( 1 ) देशी जलयानों को शुल्क के भुगतान से छूट होगी ।
( 2 ) भारतीय अन्तर्देशीय जलमार्ग प्राधिकरण के जलयानों ( कार्गो जलयानों को छोड़कर ) , सैन्य जलयानों , अर्ध सैनिक जलयानों और पुलिस जलयानों को केवल विनियम 3 के खण्ड ( क ) में दिए गए जलमार्ग उपयोग प्रभार के भुगतान से छूट होगी ।
(3) आपदाओं के लिए राहत अभियान सहित आपदा प्रबंधन से संबद्ध जलयानों के परिचालन को केवल विनियम 3 के खण्ड (क ) में दिए गए जलमार्ग उपयोग प्रभार के भुगतान से छूट होगी । 4647 भाग III-खण्ड 4]

3. उपर्युक्त श्रेणियों के अतिरिक्त किसी अन्य जलयान का संचलन
0.02 प्रति सकल पंजीकृत टनेज (जी आर टी) प्रति किलोमीटर राष्ट्रीय जलमार्ग और भारतीय सीमा के भीतर भारत - बांग्लादेश प्रोटोकॉल मार्ग के उपयोग के लिए ।
(ख) जलयान से संबद्ध प्रभार

No. C- Ex/E- III/ 16 ( 14 )/ 99 /BKP /WB/CE/EZ-Whereas M/s Auckland International Ltd. , Unit : Auckland Jute Mills , WB/22 having its registered office at Jagatdal - 743125 , North 24 Parganas , West Bengal (hereinafter referred to as the establishment) has been granted exemption u/ s 17( 1 ) ( a) of the Employees ' Provident Fund & Miscellaneous Provisions Act, 1952 (hereinafter referred to as the Act) vide Notification No. E - 102( 19 )/ E/A- 57 dated 17.10.57 by the Central Provident Fund Commissioner .
And whereas the establishment had violated condition No. 18 (a) , 6 , 24(c) , 17, 3 & 26 for grant of exemption as delineated under para 27AA of the EPF Scheme, 1952 .
And whereas a Show Cause Notice for cancellation of Exemption granted under section 17 (1 ) ( a) of the Act was issued on 11.01.11 by the Central Provident Fund Commissioner .
Andwhereas the reply submitted by the establishment vide their letter no . PF109-1011 dated 22.01.11 was devoid of any merits and was found to be unsatisfactory.
And whereas the establishment in its reply to the Show Cause Notice had referred to its letter dated 20.11.09 submitted to APFC (Barrackpore) , wherein it had requested for cancelling the exemption granted to the establishment in view of the difficulty in continuing the benefits of exemption.
Now, therefore , in exercise of the powers conferred under section 17(4) of the EPF & MP Act , 1952, I, S. Chatterjee, Central Provident Fund Commissioner hereby cancel the exemption granted to the abovesaid establishment with effect from the date of publication of this notification .

No. IWAI/ Cargo/ 184/ 2009-In exercise of the powers conferred by section 35, read with section 17 of the Inland Waterways Authority of India Act, 1985 (82 of 1985) , the Inland Waterways Authority of India, with the previous approval of the Central Government, hereby makes the following regulations , namely :-
1. Short Title and Commencement. ( 1 ) These regulations may be called the Inland Waterways Authority ofIndia (Leavy and Collection of fees and charges) Regulations , 2011.
(2) They shall come into force on the date of their publication in the Official Gazette .
2.Definitions-In these regulations , unless the context otherwise requires ,-
(a) "Act " means the Inland Waterways Authority of India Act , 1985 ;
(b) " Chairman " means the Chairman of the Authority;
(c) "Fees " means charges specified in the Schedule for services provided to the vessel or cargo owners for usage of infrastructure created by the Authority and for use of national waterways ;
(d) " Schedule " means the Schedule annexed to these regulations specifying the fees for services provided by theAuthority;
(e) "Vessel " means an Inland Vessel as defined in the Inland Vessels Act , 1917 ( 1 of 1917) ;
(f) Words and expressions used herein and not defined, but defined in the Act, shall have the meanings respectively assigned to them in the Act .
3. Classification of Fees-Fees to be charged for the services provided by the Authority shall be classified under the following categories , namely :-
(a) Waterways usage charges
(b) Vessel related charges
(c) Cargo related charges
(d) Composite charges
(e) Miscellaneous charges, and as specified in the Schedule .
4. Payment of Fees-Every vessel or cargo owner shall pay the fees specified and the same shall be payable to the Director of Regional Office of the Authority by way of a demand draft drawn in favour of ' Inland Waterways Authority of India, Fund' .
5.Maintenance ofAccounts Director of Regional Office of the Authority shall maintain an account of the fees received.
6. Exemption from payment of Fees ( 1 ) The country crafts shall be exempted from payment of fees.
(2) The Inland Waterways Authority of India Vessels (other than cargo vessels ) , Defense Vessels , Para-Military Vessels and Police Vessels shall be exempted only from payment of waterway usage charges referred to in tause (a) of regulation 3.
2) The vessels related with disaster management including relief operations for calamities shall be exempted aly from payment of waterway usage charges referred to in clause (a) of regulation 3 .
