176 ए चैम्बर के बोर्ड द्वारा एक डी डी आर कमेटी का गठन एक्सचेंज में चल रहे सभी वायदा सौदों के अन्तिम मिति निर्धारण हेतु किया जाएगा ।

( a ) इस कमेटी में बोर्ड द्वारा नामित कुल पांच सदस्य होंगे और एक्सचेंज के सचिव इस कमेटी के मैम्बर सचिव के रूप में कार्य करेंगे । सदस्य निम्न प्रकार नामित किए जाएंगे :--

( i ) इनमें से दो सदस्य वे व्यक्ति होंगे जो सीधे रूप से वायदा व्यापार से जुड़े हुए होंगे और चैम्बर के रिंग में भी वायदा कर रहे होंगे । ( ii ) इनमें से तीन व्यक्ति वे नामित किए जाएंगे जो व्यवसायिक जगत से संबंधित होंगे , विशेष रूप से आयतक, निर्यातक, मिलर्स गुड़, चीनी , आलू, मैंथा ऑयल, सरसों और अन्य दूसरे खाद्य तेल और उनकी खल के स्टाकिस्ट या डीलर्स होंगे तथा इसके साथ- साथ उन जिन्सों में भी कार्य कर रहे होंगे जिनमें केन्द्र सरकार एवं वायदा बाजार आयोग ने वायदा व्यापार की स्वीकृति प्रदान की हुई है लेकिन ये व्यक्ति चैम्बर के सदस्य नहीं होंगे ।

( iii ) इस कमेटी के दो सदस्य या उनके अधिकृत प्रतिनिधि डी डी आर सैटिलमेंट की कार्यवाही के अवलोकन हेतु बोर्ड की बैठक में उपस्थित रहेंगे, ये वे व्यक्ति होंगे जिनका चैम्बर में क्रमशः अधिकतम लिवान और अधिकतम बेचान होगा । ( b ) चैम्बर के बोर्ड द्वारा डी डी आर कमेटी के सदस्यों की नियुक्ति केवल एक वर्ष के लिए की जाएगी । ( c ) डी डी आर कमेटी का सदस्य नियुक्त किए जाने के लिए चैम्बर की सदस्यता का अनिवार्य होना कोई पूर्व शर्त नहीं होगी ।

(d ) किसी भी व्यक्ति को लगातार दो बार से अधिक इस कमेटी का सदस्य मनोनीत नहीं किया जा सकेगा । (e ) चैम्बर के बोर्ड को यह अधिकार होगा कि यदि डी डी आर कमेटी का कोई सदस्य वायदा व्यापार के हितों या सार्वजनिक हितों के विरुद्ध कार्य करता

[PART IV पाया जाए तो बोर्ड तुरन्त प्रभाव से उसको हटाकर अन्य व्यक्ति की नियुक्ति कर देगा ।

(f) यदि इस कमेटी के किसी सदस्य के त्याग पत्र देने, मृत्यु हो जाने या किसी भी प्रकार से अयोग्य हो जाने पर बोर्ड को अविलम्ब नई नियुक्ति करने का अधिकार होगा ।

(g ) कमेटी के सभी सदस्य बोर्ड की डी डी आर सैटिलमेंट बैठक में विशेष आमंत्रित सदस्यों के रूप में उपस्थित रहेंगे लेकिन इन सदस्यों को डी डी आर सैटिलमेंट की कार्यवाही के अतिरिक्त बोर्ड में विचारणीय अन्य विषयों पर भाग लेने का अधिकार नहीं होगा । (h ) कमेटी के सभी सदस्य डी डी आर सैटिलमेंट की तिथि से कम से कम एक सप्ताह पूर्व कमीशन द्वारा स्वीकृत जिन्सों के सभी डिलीवरी मंडियों के तैयारी के भावों पर अपनी निगरानी रखना प्रारम्भ करेंगे ताकि विभिन्न डिलीवरी केन्द्रों पर चल रहे भावों की वास्तविक जानकारी प्राप्त हो जाए ।

(i ) चैम्बर के सचिव द्वारा डी डी आर कमेटी के सभी सदस्यों को बाइलॉज में उल्लेखित समस्त डिलीवरी केन्द्रों की सूची एवं इसके साथ - साथ भाव प्राप्त करने के उद्देश्य से कम से कम 15 व्यक्तियों के नाम, पते व फोन नम्बर उपलब्ध कराए जाएंगे । ये सभी व्यक्ति स्पॉट पोलिंग प्राइस पैनल के सदस्य होंगे । प्रत्येक डिलीवरी केन्द्र से कम से कम तीन एसे व्यक्ति नियुक्त किए जाने आवश्यक होंगे जिनकी अपने व्यवसायिक क्षेत्र में विशेष पहचान एवं साख हो ।

(j ) वे व्यक्ति जिनकी स्पॉट पोलिंग प्राइस पैनल के सदस्य के रूप में नियुक्ति हुई है उनकी आपसी भागीदारी तथा पारिवारिक व व्यवसायिक सम्बन्ध नहीं होने चाहिएं तथा इसके साथ - साथ डी डी आर कमेटी के सदस्यों व बोर्ड के सदस्यों के साथ भी कोई आपसी संबंध न हो ।

( k ) स्पॉट रेट पोलिंग पैनल के सदस्यों की सूची पर प्रति वर्ष पुनर्विचार किया जाएगा और सभी डिलीवरी केन्द्रों से कम से कम 20 प्रतिशत नए सदस्यों की नियुक्ति होगी ।

(1 ) चैम्बर सचिव द्वारा अधिकतम बेचान व अधिकतम लिवान पक्ष के दोनों सदस्यों व डी डी आर कमेटी के सभी सदस्यों के समक्ष फोन पर ( स्पीकर खोलकर ) स्पॉट प्राइस एकत्रित किए जाएंगे । फोन पर भाव लिए जाने के पश्चात वॉईस रिकार्डिंग को कम से कम छः माह के लिए सुरक्षित रखा जाए । 567 THE GAZETTE OF INDIA , JULY 16, 2011 (ASADHA 25 , 1933 )

(m) डी डी आर सैटिलमेंट की तिथि से तीन दिन पूर्व लिए गए भावों के औसत ( Average ) पर डी डी आर का निर्धारण होगा । वास्तविक भाव प्राप्त करने के लिए प्रत्येक दिन दोपहर एक बजे से तीन बजे के मध्याह्न भाव एकत्रित किए जाएंगे ।

6. स्टाक एक्सचेंज के करेंसी डेरीवेटिव ट्रेडिंग खंड में प्रवेश के लिए भारतीय प्रतिभूति एवं विनिमय बोर्ड द्वारा अनुमोदित करेंसी फ्यूचर संविदा, ब्याज दर फ्यूचर और किसी अन्य संविदा को उक्त ट्रेडिंग खंड में अनुमति दी जाए ।"

CROSS BORDER POWER TRANSMISSION COMPANYLIMITED

(० ) चैम्बर के बोर्ड द्वारा डी डी आर सैटिलमेंट की कार्यवाही बाइलॉज में वर्णित नियमों, उपनियमों के आधार पर उसी दिन और तिथि को की जाएगी जो तिथि और दिन एक्सचेंज के बाइलॉज में पूर्व निर्धारित हैं ।

(p ) बोर्ड द्वारा जैसे ही डी डी आर सैटिलमेंट का निर्धारण कर दिया जाएगा इसकी घोषणा तुरन्त चैम्बर के ट्रेडिंग रिंग में कर दी जाएगी एवं इसके साथ- साथ चैम्बर के नोटिस बोर्ड पर भी चस्पा होगी एवं एक्सचेंज की वेबसाइट पर भी डाल दी जाएगी । डी डी आर सैटिलमेंट से संबंधित सभी जिम्मेदारी चैम्बर के बोर्ड की होगी ।

(q ) चैम्बर सचिव द्वारा प्रत्येक कॉन्ट्रेक्ट से संबंधित डी डी आर सैटिलमेंट की सभी कार्यवाही ड्यूडेट रेट निर्धारण तिथि के दिन ही कमीशन को फैक्स द्वारा भेजी जाएगी ।

176A The Board shall constitute a Due Date Rate (DDR) Committee for final settlement of all contracts traded on the Exchange .

(a) The Committee will comprise of only five members nominated by the Board and the Secretary of the Exchange will work as Member Secretary of the Committee . Nomination of Members will be as under :-

(i) Two members will be nominated from amongst such persons , who are directly engaged in the business of forward trade and also doing the same in the Trading Ring/Trading Platform of the Exchange .

( ii) Three members will be nominated from the business community, particularly, importers & Exporters , Millers , Dealers & Stockiest ofGur, Sugar, Potato , Mentha Oil, Mustard Seed and other Edible oils and their Cakes and also dealing in those commodities for which the Chamber is recognized by the Central Govt . and registered by the Forward Markets

[PART IV Commission for futures trading provided such nominees shall not be Trading Members of the Exchange .

(iii) Top Trading Members holding highest long and highest short position respectively (total two) in the Chamber or their Authorized representatives will attend as observers in the DDR Committee meetings .

(b) Members of the DDR Committee will be nominated for one year only by the Board of the Chamber of Commerce ( COC) .

(d) No person shall be nominated as member of the DDR Committee for more than two consecutive years .

(e) The Board shall have powers to remove any member of DDR Committee if it finds that the working/ functioning of such member is not in the interest of trade or of the public interest and the Board shall nominate another person in place of member so removed .

(f) The Board shall also fill up the vacancy, which arises during the year due to resignation, death or incapacitation of a member, without delay.

(g) The members of the DDR Committee will be special invitees in all the DDR Settlement meetings of the Board, only to participate in the deliberations of DDR settlement and not on any other matters .

(h) Members of the Committee shall endeavor to keep continuous watch on the spot rates of commodity permitted by FMC for Futures Trading, to be aware of likely price trends beforehand, prevailing in all the delivery centers at - least one week before the Date of DDR settlement .

(i ) The list of all the delivery centers , mentioned in the Byelaws of the Exchange , with the names and addresses of persons /panelists with their contact phone number, forming Spot Polling Price Panel of at least 15 entities , would also be delivered to the Members of DDR Committee by the Secretary . At- least three entities of high business repute and goodwill must be nominated/selected from each & every delivery center.

(j ) Entities /Persons , selected for polling spot rates should not have any cross share holding, family relationship, commercial relationship among themselves or with DDR Committee Members or with the Board of Directors or Trading Members of the Exchange.

(q) The proceedings of DDR Fixation of each and every contract would be sent to the Commission by the Secretary of the Chamber on the same day (Due Date) by fax.

(k) The spot rate-polling panel would be reviewed every year for exclusion/inclusion of Penalists . At least 20% members of the panel will be changed every year from all the delivery centers.

(r) All the records of DDR fixation of each contract would be preserved for six months.

(n) The Secretary shall properly enter the Spot Rates of all the delivery centers, polled in front ofthe DDR Committee , in the Daily Spot Rate Display Register of the Chamber for the consideration of members of Daily Spot Rate Committee.

I. For Bye - law 6 of Chapter II of the Bye- laws of the Exchange, the following shall be substituted, namely :-

"Currency Derivatives Trading Segment

(o) DDR Settlement will be carried on by the Board in the manner as per procedure , rules and regulations, laid down in the Byelaws of the Exchange on the day and date fixed for DDR Settlement.

6. Currency futures contracts , interest rate futures and any other contracts approved by the Securities and Exchange Board of India for admission to the Currency Derivatives Trading Segment of the Stock Exchange may be admitted on the said Trading Segment . "
