का.नि.आ. 58.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सैनिक इंजीनियर सेवा ;पर्यवेक्षक बैरक/भंडार अनौद्योगिक समूह 'ग' पदद्ध भर्ती नियम, 2008 को जहां तक उनका संबंध् भंडारी श्रेणी 1 और भंडारी श्रेणी 2 के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय, सैनिक इंजीनियर सेवा, भंडारी श्रेणी 1 और भंडारी श्रेणी 2 के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सैनिक इंजीनियर सेवा, भंडारी श्रेणी 1 और भंडारी श्रेणी 2 पद भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम, इन नियमों से उपाब( अनुसूची के स्तम्भ ;1द्ध में विनिर्दिष्ट पदों पर लागू होंगे । 3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन वेतनमान वे होंगे जो उक्त अनुसूची केे स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उफपर अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किन्हीं उपबंधें को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे, इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा । ;12द्ध

टिप्पण 2 : केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार अनुसूचित जाति/अनुसूचित जनजातियों अन्य पिछड़ी जातियों की और कतिपय अन्य वर्गों की दशा में शिथिल की जा सकती है यह शिथिलीकरण इन प्रवर्गों को अनुज्ञेय अन्य आयु-सीमा में अन्य शिथिलता के साथ संचित रूप में उपलब्ध् है । टिप्पण 3 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू और कश्मीर राज्य के लद्‌दाख खंड, हिमाचल प्रदेश के लाहौल एवं स्पीति जिले तथा चम्बा जिले का पांगी उप-खंड, अंदमान एवं निकोबार द्वीप या लक्ष्य द्वीप के अभ्यथयों के लिए विहित की गई हैद्ध । टिप्पण 4 ः रोजगार कार्यालयों/रोजगार समाचार में विज्ञापन/अन्य विज्ञापन माध्यम से उन पदों की बाबत जिन पर नियुक्ति की दशा में प्रत्येक मामले में आयु सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है या रोजगार समाचार में विज्ञापन/अन्य विज्ञापन माध्यम में आवेदन प्राप्त करने की अंतिम तारीख दी गई है । ;7द्ध

जिसके न हो सकने पर आमेलन दोनों के न हो सकने पर वाले हैं और जिनके पास स्तंभ ;7द्ध में अपेक्षित अनुभव और विहित अहर्ताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बध्नों पर रखा सीध्े भर्ती । जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना है, तत्पश्चात उन्हें पुननयोजन पर रफपये 5200-20,200 में 1900 रफ. के ग्रेड वेतन में विविलियन कर्मचारी बने रहने दिया जा सकता है ।

S.R.O. 58.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Military Engineer Services (Supervisor Barrack/Stores grade 'C' Non-industrial posts), Recruitment Rules, 2008 in so far as they relate to the post of Storekeeper Grade-I and Storekeeper Grade-II, except in respect of things done or omitted to be done before such supersession, the President hereby makes the following Rules, regulating the method of recruitment to the post of Storekeeper Grade-I and Storekeeper Grade-II in the Military Engineer Services, Ministry of Defence, namely:—

1. Short title and commencement.—(1) These rules may be called the Military Engineer Services Storekeeper Grade-I and Storekeeper Grade-II Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification and pay band, grade pay or scales of pay.—The number of the said posts, their classifications and pay band and grade pay or scales of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment, age limit and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation:

Officers under the Central Government/State Government :—

(ii) with eight years regular service in the grade rendered after appointment in the Pay Band-1, Rs. 5200–20200 plus Grade Pay of Rs. 1900 or equivalent in the parent cadre or department; or State Government.

(b) possessing the educational qualification of Matriculate or equivalent pass from a recognized Board or University.

Note 1 : The Departmental officer in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationist shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/department of the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of applications.

का.नि.आ. 59.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा अनुसंधन तथा विकास संगठन, रक्षा मंत्राालय, समूह 'ग' ;प्रशासनद्ध पद के भर्ती नियम, 1998 को, जहां तक इसका संबंध् प्रशासन सहायक 'ख' के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय, रक्षा अनुसंधान तथा विकास संगठन में प्रशासनिक सहायक 'ख' के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;iद्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, रक्षा अनुसंधान तथा विकास संगठन, समूह 'ग' ;प्रशासनिक सहायक 'ख' पदद्ध भर्ती नियम, 2011 है ।

;iiद्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन तथा वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड और ग्रेड वेतन तथा वेतनमान वह होगा जो इन नियमों से उपाब( उक्त अनुसूची केे स्तंभ ;1द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं । 3. भर्ती की प(ति, आयु-सीमा और अर्हताएं.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इन नियमों के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 59.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Defence Research and Development Organisation, Ministry of Defence, Group 'C' (Administration) posts Recruitment Rules, 1998, in so far as it relates to the post of Administrative Assistant 'B', except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Administrative Assistant 'B' in the Ministry of Defence, in the Department of Defence Research and Development, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Defence Research and Development Organisation, Group 'C' (Administrative Assistant 'B' post) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of Posts, Classification and Pay Band and Grade Pay or Pay Scale.—The number of post, its classification and the pay band and grade pay or pay scale attached there to shall be as specified in columns (1) to (4) of the Schedule annexed to these rules.

3. Method of Recruitment, age limit and other qualifications, etc.—The method of recruitment to the said posts, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the 6th CPC recommendations has been extended) shall be deemed to be service rendered in the corresponding Grade Pay/Pay Scale extended based on the recommendations of the Pay Commission.
