12/20-3-2009 Learned Sr. Counsel Mr. Anil Kumar Sinha submits that election petition filed on behalf of the petitioner has now been rendered infructuous in view of the fact that the petitioner has challenged the bye election of Parliament whereby the respondent Shri Babu Lal Marandi was elected. Admittedly, no corruption charge was levelled against the respondent Babu Lal Marandi. As the Parliament has been dissolved in view of ensuing 15th Parliamentary Election, this petition may be dismissed.

Learned Counsel Mr. Arvind Kumar Lall appearing for the petitioner fairly conceded that no charge of corrupt parctice was alleged against the respondent Babu Lal Marandi in the Parliamentary bye election.

Having regard to the facts and changing circumstances as also in view of the submissions made above, this Election Petition is dismissed as rendered infructuous. Inform the concerned as per statutory provisions.

आ.अ. 143 .—यतः, निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तम्भ ;2द्ध में यथाविनिदष्ट निर्वाचन क्षेत्राों से उड़ीसा विधन सभा के साधरण निर्वाचन, 2009 में स्तम्भ ;3द्ध में विनिदष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा तद्‌ध्ीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ;4द्ध में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहा ऋ

यतः उक्त अभ्यथयों ने सम्यक्‌ सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और या उनके द्वारा दिए गए किसी अन्य प्रतिवेदन, यदि कोई है पर विचार करने के पश्चात्‌ निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपर्युक्त कारण या न्यायोचित्य नहीं हैऋ

अतः, अब, निर्वाचन आयोग लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10क के अनुसरण में नीचे की सारणी के स्तंभ ;3द्ध में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन या किसी राज्य/संघ राज्य-क्षेत्रा की विधन सभा अथवा विधन परिषद्‌ के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरहत घोषित करता है :—

आ.अ. 146 .—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि श्री बनवारी, निवासी ग्राम व पोस्ट जैतपुर, तहसील राजाखेड़ा, जिला धेलपुर, राजस्थान, राजस्थान राज्य में मई 2009 में हुए लोक सभा के लिए साधरण निर्वाचन में 10-करौली धेलपुर ;अ.जा.द्ध संसदीय निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा तद्‌ध्ीन बनाए गए नियमों द्वारा यथा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहे हैंऋ और

यतः उक्त अभ्यर्थी ने भारत निर्वाचन आयोग द्वारा सम्यक्‌ सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण प्रस्तुत नहीं दिया है अथवा उनके द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, पर विचार करने के पश्चात्‌, भारत निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई पर्याप्त कारण या न्यायौचित्य नहीं हैऋ

अतः, अब, भारत निर्वाचन आयोग लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10-क के अनुसरण में श्री बनवारी को संसद के किसी सदन के या किसी राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद्‌ के सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए एतद्‌द्वारा निरहत घोषित करता है ।

N. 148 .—In exercise of the powers conferred by sub-section (1) of Section 13A of the representation of the People Act, 1950 (43 of 1950), the Election Commission of India in consultation with the Government of Himachal Pradesh hereby nominates Shri Narinder Chauhan, IAS (HP 84) as the Chief Electoral Officer for the State of Himachal Pradesh with effect from the date he takes over charge and until further orders vice Shri Manoj Kumar, IAS.

2. Shri Narinder Chauhan, IAS shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Himachal Pradesh, which he may be holding before such assumption of office.

3. Shri Narinder Chauhan, IAS while functioning as the Chief Electoral Officer, Himachal Pradesh shall not hold any additional charge whatsoever under the Government of Himachal Pradesh except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
