आ.अ. 150.—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तम्भ ;2द्ध में यथा विनिदष्ट हरियाणा विधन सभा के लिए अक्तूबर, 2009 में हुए साधरण निर्वाचन, जो स्तम्भ ;3द्ध में विनिदष्ट तद्नुरूप निर्वाचन-क्षेत्रा से हुआ है, में स्तम्भ ;4द्ध में उसके सामने विनिदष्ट निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों द्वारा यथा अपेक्षित उक्त सारणी के स्तम्भ ;5द्ध में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहेऋ और
यतः, उक्त अभ्यर्थी ने भारत निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असपफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और अथवा उनके द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, पर विचार करने के पश्चात्, भारत निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई पर्याप्त कारण या न्यायौचित्य नहीं हैऋ
अतः, अब, भारत निर्वाचन आयोग लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10क के अनुसरण में नीचे की सारणी के स्तंभ ;4द्ध में विनिर्दिष्ट व्यक्तियों को संसद के किसी सदन के या किसी राज्य/संघ राज्य-क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए एतद्द्वारा निरहत घोषित करता है ।

New Delhi, the 7th September, 2011
O. N. 150 .—Whereas, the Election Commission of India is satisfied that the contesting candidate specified in column (4 ) of the Table below at the General Election to the Legislative Assembly of Haryana held in October, 2009 as specified in column (2) and held from constituency correspondingly specified in column (3) against his names, has failed to lodge account of his election expenses as shown in column (5) of the table, as required by the Representation of the People Act, 1951and the Rules made thereunder; and
Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due notice by the Election Commission of India or after considering the representations made by them, if any, the Election Commission of India is satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the persons specified in column (4) of the Table enclosed to be disqualified for being chosen as, and for being, a member of either House of the Parliament or the Legislative Assembly or Legislative Council of a State /Union Territory for a period of three years from the date of this order.

आ.अ. 153.—यतः, भारत निर्वाचन आयोग का समाधन हो गया है कि मई, 2008 में राजस्थान विधन सभा के साधरण निर्वाचन के लिए 190-कोटा दक्षिण विधन सभा निर्वाचन क्षेत्रा से निर्वाचन लड़ने वाले अभ्यर्थी श्री विनय शर्मा, 4ए, 15 तलवन्डी, कोटा, राजस्थान, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों द्वारा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असपफल रहे हैंऋ और यतः, उक्त अभ्यर्थी ने लोक प्रतिनिध्त्वि अध्निियम, 1951 के अध्ीन विध् िद्वारा अपेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल नही किया है, या भारत निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने के बाद भी उक्त असपफलता के लिए कोई स्पष्टीकरण नहीं दिया है अथवा उनके द्वारा दिए गए अभ्यावेदनों, यदि कोई हाें, पर विचार करने के बाद भारत निर्वाचन आयोग का यह समाधन हो गया है कि उक्त असपफलता के लिए उनके पास कोई उपयुक्त कारण या न्यायौचित्य नहीं हैऋ
अतः, अब, लोक प्रतिनिध्त्वि अध्निियम, 1951 की धरा 10-क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा, उक्त श्री विनय शर्मा को संसद के किसी सदन या राज्य/संघ राज्य क्षेत्रा की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए, इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरहत घोषित करता है ।

New Delhi, the 7th September, 2011
O. N. 153.—Whereas, the Election Commission is satisfied that Shri Vinay Sharma, 4A, 15 Talwandi, Kota, Rajasthan a contesting candidate at the General Election to Rajasthan Lagislative Assembly held on May, 2008 from 190- Kota South Assembly Constituency has failed to lodge any account of election expenses as required by the Representation of the People Act, 1951 and to Rules made thereunder ; and
Whereas, the said candidate has not furnished his account of election expenses in the manner required by law under section 10A of Representation of People Act, 1951 or explanation for the said failure even after due notice by the Election Commission of India or after considering the representations made by him, if any, the Election Commission of India is satisfied that he has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section l0A of the Representation of the People Act, 1951, the Election Commission of India hereby declares the said Shri Vinay Sharma, to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of three years from the date of this order .
