2. श्रीमती सुधा शर्मा की प्रधान निजी सचिव ग्रेड पर यह नियुक्तिपूर्णतः तदर्थ आधार पर है और यह उन्हें इसी ग्रेड में बने रहने या नियमित नियुक्ति के लिए या केन्द्रीय सचिवालय आशुलिपिकीय सेवा संवर्ग के प्रधान निजी सचिव ग्रेड में वरिष्ठता का दावा करने का कोई अधिकार प्रदान नहीं करती है ।

2. यह तदर्थ नियुक्ति श्री के. आर साजी कुमार को अपर विधायी परामर्शी ( भारतीय विधि सेवा का ग्रेड- II ) के ग्रेड में नियमित नियुक्ति के लिए न तो कोई दावा करने का अधिकार प्रदान करेगी और न ही उनके द्वारा प्रदत्त तदर्थ सेवाओं की गणना इस ग्रेड में वरिष्ठता के प्रयोजनार्थ अथवा अगले उच्चतर ग्रेड में उनकी प्रोन्नति के लिए की जाएगी।

II-- राष्ट्रपति , भारत के संविधान के अनुच्छेद 217 के खंड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पटना उच्च न्यायालय के अपर न्यायाधीश ( 1 ) श्री राकेश कुमार, ( 2 ) श्री बीरेन्द्र प्रसाद वर्मा , ( 3 ) श्री दिनेश कुमार सिंह , ( 4 ) श्री अखिलेश चन्द्र और ( 5 ) श्री मुंगेश्वर साहू को उसी वरीयता क्रम में, उस तारीख , जब वे अपना- अपना कार्यभार ग्रहण करेंगे, से पटना उच्च न्यायालय में न्यायाधीश सहर्ष नियुक्त करते हैं ।

Luikang , a regular Section Officer of CSS as Under Secretary (Grade- I of CSS) in the Ministry of Road Transport & Highways in the Pay Band- 3 Rs . 15,600-39,100/- + 6,600/- Grade Pay on ad hoc basis w.e.f. 01.09.2011 (F.N. ) for a period upto 31.05.2012 or till the posts are filled up on regular basis or until further orders , whichever is the earliest .
2. Her appointment as Under Secretary on ad hoc basis is subject to the following terms and conditions :-
(i) The ad hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in the Grade - I of the CSS;
(ii) Ad hoc appointment may be terminated at any point of time without giving any reason therefor .
(iii) The Officers who have not undergone mandatory Level 'D' Training as enjoined in Cadre Training Plan for the CSS will have to undergo the aforesaid training within a period of six months ;
(iv) The ad hoc promotion shall be subject to the final outcome in the OA No. 3294/2009-titled Shri P. R. Sharma Vs. Uol pending before the CAT, New Delhi ;
(v) As the CSL of Section Officers of 2003 is under challenge in several applications pending before CAT, New Delhi as brought out in Department of Personnel & Training's O.M. dated 30.06.2011 , publishing the CSL 2003 of SOs , the ad hoc promotion in so far as SOs of 2003 to the grade of US is concerned is subject to the various Court cases mentioned in the said O.M..
