I-- राष्ट्रपति जी ने सूचना प्रौद्योगिकी विभाग के निम्नलिखित वैज्ञानिक ' एफ ' को पदोन्नति होने पर दिनांक 05.12.2011 से10,000/- रु . प्रतिमाह के ग्रेड वेतन सहित 37,400--67,000/- रु. के वेतन बैंड-4 में वैज्ञानिक ' जी ' नियुक्त किया है । इनकी नियुक्ति उड़ीसा उच्च न्यायालय द्वारा वर्ष 2005 की रिट याचिका ( सी) सं. 7080 में लिए गए निर्णय, जिसका फैसला दिनांक 26.09.2008 को सुनाया गया, पर राष्ट्रीय सूचना विज्ञान केन्द्र ( एनआईसी ) द्वारा भारत के उच्चतम न्यायालय में दायर की गई विशेष याचिका के अंतिम नतीजे पर निर्भर करेगी ।

2. तदर्थ आधार पर अवर सचिव के रूप में उनकी नियुक्ति निम्नलिखित शर्तों के अध्यधीन होगी :--

( i ) तदर्थ प्रोन्नति से, ग्रेड में अनिश्चित काल तक बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में शामिल किए जाने अथवा केन्द्रीय सचिवालय सेवा के ग्रेड-1 में वरिष्ठता का दावा करने के लिए कोई अधिकार प्राप्त नहीं हो सकेगा ।

(ii ) किसी भी समय , बिना कोई कारण बताए, तदर्थ आधार पर की गई नियुक्ति को समाप्त किया जा सकता है । ( iii ) उन अधिकारियों जिन्होंने केन्द्रीय सचिवालय सेवा के संवर्ग प्रशिक्षण योजना में लागू अनिवार्य स्तर ' घ ' प्रशिक्षण नहीं लिया है, को छः महीने की अवधि में उक्त प्रशिक्षण लेना होगा।

(iv ) तदर्थ प्रोन्नति , केन्द्रीय प्रशासनिक अधिकरण , नई दिल्ली में लंबित ओ ए सं. 3294/2009 , श्री पी. आर. शर्मा बनाम भारत संघ में होने वाले अंतिम निर्णय के अध्यधीन होगी ।

2. His appointment as Under Secretary on ad hoc basis is subject to the following terms and conditions :-

(i) The ad hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in the Grade - I of CSS;

( ii) The ad hoc appointment may be terminated at any point of time without giving any reason therefor;

(iii) The officers who have not undergone mandatory Level ' D' Training as enjoined in Cadre Training Plan for the CSS , will have to undergo the aforesaid training within a period of six months ;
