सं. गैर्वैपवि ( नीप्र ) एमजीसी सं. : 6/मुमप्र ( यूएस ) -2011-- भारतीय रिज़र्व बैंक, जनता के हित में यह आवश्यक समझकर और इस बात से संतुष्ट होकर कि देश के हित में ऋण प्रणाली को विनियमित करने के लिए, बैंक को समर्थ बनाने के प्रयोजन से बंधक ( मार्गेज ) गारंटी कम्पनी ( रिज़र्व बैंक ) निदेश 2008 को संशोधित करना आवश्यक है । भारतीय रिजर्व बैंक अधिनियम, 1934 ( 1934 का 2 ) की धारा 45 ञक तथा 45ठ द्वारा प्रदत्त शक्तियों और इस संबंध में प्राप्त समस्त शक्तियों का प्रयोग करते हुए उक्त निदेश को तत्काल प्रभाव से निम्नवत् संशोधित करने का निदेश देता है यथा--
2. पैराग्राफ 27 में संशोधन
मौजूदा खण्ड " कोई भी बंधक ( मार्गेज ) गांरटी कम्पनी ऋण का अनुपात विक्रय मूल्य के ( एलटीवी अनुपात वाले ) 90% तथा अधिक होने की स्थिति में आवास गृह ऋण की गारंटी नहीं देगी " को निम्नलिखित से प्रतिस्थापित किया जाए " रुपये 20 लाख से अधिक के गृह/ आवास ऋण के लिए कोई भी बंधक ( मार्गेज ) गारंटी कम्पनी, बंधक ( मार्गेज ) गारंटी नहीं देगी , जहां एलटीवी 80% से अधिक होगा " । छोटे मूल्य के गृह आवास ऋण जैसे रुपये 20 लाख तक का गृह आवास ऋण ( जिसे प्राथमिक क्षेत्र के अग्रिम में श्रेणीबद्ध किया गया है ) के लिए एलटीवी अनुपात 90% से अधिक नहीं हों ।

सं . एन -15/13/15/2/2011-यो . एवं वि. कर्मचारी राज्य बीमा ( सामान्य ) विनियम1950 के विनियम 95 -क के साथ पठित कर्मचारी राज्य बीमा अधिनियम, 1948 ( 1948 का 34 ) की धारा -46 ( 2 ) द्वारा प्रदत्त शक्तियों के अनुसरण में महानिदेशक ने 01 जनवरी , 2012 ऐसी तारीख के रूप में निश्चित की है जिससे उक्त विनियम -95क तथा पश्चिम बंगाल कर्मचारी राज्य बीमा नियम 1955 में निर्दिष्ट चिकित्सा हितलाभ पश्चिम बंगाल राज्य में निम्नलिखित क्षेत्रों में बीमांकित व्यक्तियों के परिवारों पर लागू किये जाएंगे , अर्थात्:--

वास्तुकला परिषद्

वार्षिक रिपोर्ट 2010-2011
वास्तुकला परिषद् वास्तुविद् अधिनियम , 1972 के अधीन मानव संसाधन विकास मंत्रालय , भारत सरकार के अधीन गठित किया गया एक सांविधिक निकाय है । परिषद् को 31.03.2011 को समाप्त वित्तीय वर्ष के लिए परीक्षित लेखा विवरण सहित अपनी वार्षिक रिपोर्ट प्रस्तुत करने में प्रसन्नता हो रही है ।
संगठनात्मक संरचना :
वास्तुकला परिषद् का प्रेसीडेंट संगठन का प्रमुख होता है जिसके समग्र प्रभार के अधीन परिषद् काम करती है । संप्रति , प्रोफेसर विजय श्रीकृष्ण सोहोनी परिषद् के अध्यक्ष हैं ।
सांविधिक तथा अन्य समितियाँ :
वास्तुविद् अधिनियम और उसके अधीन बनाए गए विनियमों के उद्देशों को पूरा करने के लिए परिषद् ने सांविधिक समितियाँ गठित की हैं, यथा कार्यकारिणी समिति, जो परिषद् के कार्यकारी प्राधिकारी के रूप में काम करती है, अनुशासन समिति; जो शिकायतों की जांच - पड़ताल करती है और वास्तुविदों के व्यावसायिक कदाचार के संबंध में जांच करती है; सलाहकार समिति (अपील ) , जो उन आवेदकों की अपीलों की सुनवाई करती है जिनके पंजीकरण के मामले परिषद् द्वारा अस्वीकार कर दिए जाते हैं । इनके अलावा , विशेष/खास प्रयोजनों के लिए समय -समय पर अन्य समितियाँ गठित की जाती हैं ।
परिषद् और उसकी समितियों की बैठकें:
रिपोर्टाधीन वर्ष के दौरान परिषद् की दो बैठकें हुई 16 अगस्त , 2010 को 55वीं बैठक मंदुरै , तमिलनाडु में और 4 फरवरी , 2011 को 56वीं बैठक भुवनेश्वर , उड़ीसा में ।
कार्यकारिणी समिति की चार बैठकें हुई अर्थात् नई दिल्ली में 6 जून , 2010 को 105वीं बैठक; मदुरै में 15 अगस्त, 2010 को 106वीं बैठक;. नई दिल्ली में 26 नवम्बर, 2010 को 107वीं बैठक; भुवनेश्वर , उड़ीसा में 3 फरवरी , 2011 को 108वीं बैठक हुई । रिपोर्टाधीन वर्ष के दौरान परिषद् द्वारा लिए गए विभिन्न निर्णयों और कार्रवाइयों का सारांश नीचे दिया जा रहा है: -
1.0 वास्तुविद् अधिनियम , 1972 के अधीन परिषद् द्वारा रखे गए वास्तुविद् रजिस्टर में नामों को फिर से चढ़ाना :
परिषद् ने अपनी 55 वीं बैठक में 01.01.2010 से 30.06.2010 तक की अवधि में 610 चूककर्ता वास्तुविदों के नामों को वास्तुविद् रजिस्टर में फिर से दर्ज करने का अनुमोदन प्रदान किया । इन वास्तुविदों के नाम अपेक्षित फीस प्राप्त हो जाने के बाद वास्तुविद् रजिस्टर में पुनः दर्ज किए गए थे ।

परिषद् ने अपनी 56वीं बैठक में 01.07.2010 से 31.12.2010 तक की अवधि में 519 चूककर्ता वास्तुविदों के नाम वास्तुविद् रजिस्टर में फिर से दर्ज करने का अनुमोदन प्रदान किया । इन वास्तुविदों के नाम अपेक्षित फीस प्राप्त हो जाने के बाद वास्तुविद् रजिस्टर में पुनः दर्ज किए गए थे ।
2.0 निवेदन करने पर तथा निधन होने पर वास्तुविद् रजिस्टर से नामों को हटाना :
परिषद् ने अपनी 55वीं बैठक में वास्तुविद श्री श्रीहर्ष तुकाराम जाधव ( सीए/2000/25915 ) का नाम उनकी मृत्यु होने पर वास्तुविद् रजिस्टर से हटा दिया ।
इसके अतिरिक्त परिषद् ने निम्नलिखित वास्तुविदों के नाम भी उनके द्वारा निवेदन करने पर वास्तुविद् रजिस्टर से हटा दिए:-
(i) श्री तुषार एच. सुतारिया, जामनगर ( सीए/2002/29443 );
(ii) श्री प्रदीप अम्बादास इंगोले , पनवेल ( सीए/95/ 19249 ) ; और
(iii) श्री प्रभाकर रामदाव द्योभंकर ( सीए/75 /1427 )
परिषद् ने अपनी 56वीं बैठक में निम्नलिखित वास्तुविदों के नाम उनकी मृत्यु पर वास्तुविद् रजिस्टर से हटा दिए: - (i) श्री रामचंद्र पी. कीनी , मुंबई (सीए 177/3617 );

इसके अतिरिक्त , परिषद् ने निम्नलिखित वास्तुविदों के नाम उनके द्वारा किए गए निवेदन पर वास्तुविद् रजिस्टर से हटा दिए :
(i) श्री विष्णु शर्मा, न्यूयार्क ( सीए/77/4235 );
(ii) श्री नित्यम गंभीर, नई दिल्ली ( सीए/ 2000/ 26966 ) ; और
(iii) श्री अविनाश एन. जोशीराव , पुणे ( सीए/75/942 ) 1
3.0 अनुशासन समिति की बैठकें :
रिपोर्टाधीन वर्ष के दौरान परिषद् की अनुशासन समिति की कोई बैठक नहीं हुई क्योंकि वास्तुकला परिषद् नियम, 1973 में वर्ष 2009 में हुए संशोधन के अनुसार केंद्रीय सरकार को अनुशासन समिति का गठन करके उसे राजपत्र में अधिसूचित करना है । तथापि, केंद्रीय सरकार ने अभी तक अनुशासन समिति का गठन नहीं किया है और इसीलिए सभी मामले लंबित पड़े हैं । 4.0 वास्तुविदों का पंजीकरण :
परिषद् वास्तुविद् अधिनियम की धारा 25 के अधीन वास्तुविद् के रूप में ऐसे व्यक्ति का नाम पंजीकृत करती है जो भारत में रहता हो या वास्तुकला का व्यवसाय करता हो और जो मान्यताप्राप्त वास्तुकलात्मक अर्हता रखता है ।
वर्ष ( 1 अप्रैल , 2010 से 31 मार्च, 2011 ) के दौरान परिषद् ने वास्तुविदों के रूप में 3583 व्यक्तियों का पंजीकरण किया । इस प्रकार 31 मार्च, 2011 तक वास्तुकला परिषद् में वास्तुविदों के रूप में कुल 51516 व्यक्तियों का पंजीकरण किया गया है । इस प्रकार , वास्तुकला परिषद् में 31 मार्च, 2011 को वास्तुविद् के रूप में 39918 व्यक्तियों के पास वैध पंजीकरण है । 5.0 वास्तुविद बोर्ड, सिंगापुर और अन्य देशों के साथ पारस्परिक मान्यता करार :
भारत सरकार और सिंगापुर सरकार के बीच हस्ताक्षरित व्यापक आर्थिक सहयोग करार ( सीईसीए ) के निबंधनों के अनुसार परिषद् वास्तुविद् बोर्ड, सिंगापुर के साथ पारस्परिक मान्यता करार ( एमआरए) करने के लिए वार्ता कर रही है जिससे कि भारतीय वास्तु-अर्हता और वास्तुविदों के पंजीकरण को सिंगापुर में और सिंगापुर वास्तु-अर्हता और वास्तुविदों के पंजीकरण को भारत में मान्यता प्रदान की जा सके ।
परिषद् वास्तुविद् बोर्ड, सिंगापुर के साथ इस मामले में बातचीत करके पारस्परिक मान्यता करार को अंतिम रूप देने का प्रयास कर रही है ताकि एक- दूसरे के देश में वास्तुकलात्मक अर्हताओं और पंजीकरण को मान्यता मिल सके ।
6.0 भारतीय मानक ब्यूरो द्वारा राष्ट्रीय भवन संहिता ( कोड) का निर्माण :
परिषद् ने अपने पत्र तारीख 30 अक्तूबर , 2009 के द्वारा भारतीय मानक ब्यूरो द्वारा तैयार किए जा रहे राष्ट्रीय भवन संहिता (एनबीसी) की कार्यवाहियों से अपने नामितों को निकाल लिया है । भारतीय मानक ब्यूरो ने राष्ट्रीय भवन संहिता के प्रस्तावित प्रावधानों में वास्तुविदों की सक्षमता और कार्यों को गैर - वास्तुविदों के पक्ष में निम्न दर्शाया है और वास्तुविदों के व्यवसाय को राष्ट्रीय भवन संहिता के अधीन विनियमित करने की कोशिश की है जोकि वास्तुविद् अधिनियम , 1972 के प्रावधानों के विपरीत है। राष्ट्रीय भवन संहिता के कार्यान्वयन के लिए सोसायटी फार सेफ स्ट्रक्चर्स द्वारा उच्चतम न्यायालय में दायर जनहित याचिका माननीय उच्चतम न्यायालय द्वारा रद्द कर दी गई है और राष्ट्रीय भवन संहिता के कुछेक भागों को चुनौती देने वाली परिषद् की रिट याचिका को माननीय दिल्ली उच्च न्यायालय में सूचीबद्ध करने के निदेश दिए हैं ताकि उच्च न्यायालय उसका निपटान करे । 7.0 वास्तुविदों के विरुद्ध अनुशासनिक कार्रवाई :
प्रत्येक वास्तुविद् से यह अपेक्षा की जाती है कि वह 2003 में संशोधित वास्तुविद् ( वृत्तिक आचरण ) विनियमावली , 1989 के उपबंधों का पूर्णतः पालन करेगा । वास्तुविद् अधिनियम में यह व्यवस्था की गई है कि यदि किसी वास्तुविद् को जांच- पड़ताल और सुनवाई का अवसर प्रदान किए जाने के बाद वृत्तिक कदाचार का दोषी पाया जाता है तो उसके विरुद्ध कार्रवाई की जाएगी।.

परिषद् ने अपनी 55वीं बैठक में वास्तुविदों के विरुद्ध कदाचार की 2 शिकायतों पर विचार किया और एक रिपोर्ट प्रो. यू. सी. गडकरी को उनकी यह राय जानने के लिए भेजी कि क्या प्रथम दृष्टि में कोई मामला बनता है या नहीं और दूसरी रिपोर्ट प्रथम दृष्टि के आधार पर खारिज कर दी ।-
परिषद् ने व्यावसायिक कदाचार के दोषी पाए गए 3 वास्तुविदों को यह चेतावनी देकर छोड़ दिया कि भविष्य में ऐसे कदाचार की पुनरावृत्ति नहीं होनी चाहिए । इसके अतिरिक्त व्यावसायिक कदाचार के दोषी पाए गए 3 में से दो वास्तुविदों को एक वर्ष के लिए व्यवसाय न करने की रोक लगाई और एक अन्य वास्तुविद को छह माह के लिए व्यवसाय न करने की रोक लगाई । 8.0 शिक्षा-सत्र 2010-2011 में नई संस्थाओं का अनुमोदन :
रिपोर्टाधीन वर्ष के दौरान बैचलर ऑफ आर्कीटेक्चर पाठ्यक्रम प्रदान करने के लिए 27 नई संस्थाओं को अनुमोदन प्रदान किया गया । पहले से विद्यमान संस्थाओं में 3 नए बी. आर्की डिग्री पाठ्यक्रमों, 8 नए एम. आर्की. डिग्री पाठ्यक्रमों को अनुमोदन प्रदान किया गया । इस प्रकार 2010-2011 में वास्तुकला में मान्यताप्राप्त पाठ्यक्रम प्रदान करने बाली संस्थाओं की कुल संख्या बढ़कर 186 हो गई । छात्रों की वार्षिक प्रवेश संख्या अनुमानतः पूर्वस्नातक ( यूजी ) स्तर पर 10121 , स्नातकोत्तर ( पीजी) स्तर पर 1060 और पीएच-डी स्तर पर 20 है ।
9.0 शिक्षा-सत्र 2010-2011 से आगे अनुमोदन की अवधि बढ़ाना :
वास्तुकला परिषद् ने शिक्षा- सत्र 2010-2011 के लिए 108 संस्थाओं के वास्ते बी. आर्की और एम. आर्की पाठ्यक्रमों के अनुमोदन या अन्यथा की अवधि निम्नलिखित ढंग से बढ़ाई :
(i) वे संस्थाएं जिनमें 2010-2011 से आगे वर्तमान या अधिक दाखिले सहित बी. आर्की. पाठ्यक्रम के लिए अनुमोदन की अवधि बढ़ाई गई : 108
(ii) वे संस्थाएं जिनमें 2010-2011 से आगे के लिए वर्तमान या अधिक दाखिले सहित एम. आर्की. पाठ्यक्रम के लिए अनुमोदन की अवधि बढ़ाई गई : 20
(iii ) वे संस्थाएँ जिनमें वर्ष 2010-2011 के लिए कोई " प्रवेश नहीं" है : शून्य
(iv) वे संस्थाएं जिनकी 2010-2011 से ' मान्यता वापस ' ले ली जाएगी शून्य
परिषद् ने शिक्षा- सत्र 2011-2012 के लिए उन संस्थाओं का निरीक्षण करने की प्रक्रिया भी शुरू कर दी है जिनका निरीक्षण किया जाना है ।
10.0 केंद्रीय सरकार द्वारा वास्तुविद् अधिनियम, 1972 के अधीन विदेशी अर्हताओं की मान्यता :
परिषद् को मानव संसाधन विकास मंत्रालय , भारत सरकार से निर्देश प्राप्त हुए हैं कि वास्तुविद् अधिनियम, 1972 के प्रयोजन के लिए निम्नलिखित विदेश अर्हताओं को मान्यता प्रदान की जाए :
1. इमाम खोमिनी इंटरनेशनल यूनिवर्सिटी, तेहरान , इरान द्वारा प्रदान की जाने वाली मास्टर ऑफ आर्किटेक्चर डिग्री;
2. एनडीडी यूनिवर्सिटी ऑफ इंजीनियरिंग एंड टेक्नोलॉजी, कराची, सिंध , पाकिस्तान द्वारा प्रदान की जाने वाली बैचलर ऑफ आर्किटेक्चर डिग्री;
3. क्वींसलैंड यूनिवर्सिटी ऑफ टेक्नोलॉजी ब्रिसबेन , आस्ट्रेलिया द्वारा बैचलर ऑफ बिल्ट इनवायरनमेंट ( आर्किटेक्चर ) और बैचलर ऑफ आर्किटेक्चर डिग्री; और
4. स्कूल ऑफ आर्किटेक्चरं एंड बिल्डिंग , डीकिन यूनिवर्सिटी , आस्ट्रेलिया द्वारा प्रदान की जाने वाली बैचलर ऑफ आर्किटेक्चर डिग्री ।
परिषद्की उप- समिति उपर्युक्त विदेशी अर्हताओं की जाँच कर रही है । इमाम खोमिनी इंटरनेशनल यूनिवर्सिटी, तेहरान , इरान द्वारा प्रदान की जाने वाली मास्टर ऑफ आर्किटेक्चर डिग्री के बारे में परिषद् की सिफारिशें केंद्रीय सरकार के मानव संसाधन विकास मंत्रालय को भेज दी गई हैं ।
11.0 मान्यताप्राप्त अर्हताओं वाले व्यक्तियों को वास्तुविद् के रूप में पंजीकरण प्रदान करने से पूर्व वास्तुकला परिषद् द्वारा वृत्तिक परीक्षा कासंचालन :

परिषद् ने वास्तुविद के रूप में पंजीकरण प्रदान करने से पूर्व वृत्तिक परीक्षा का संचालन करने से संबंधित मसौदा विनियमों को अनुमोदन कर दिया है । केंद्रीय सरकार का अनुमोदन प्राप्त करने के लिए विनियमों को मानव संसाधन विकास मंत्रालय , भारत सरकार को भेजा गया है । अध्यक्ष , वास्तुकला परिषद् ने माननीय मानव संसाधन विकास मंत्री से भेंट करके इस मामले में केंद्रीय सरकार के अनुमोदन पर शीघ्र कार्रवाही के लिए निवेदन किया है ।
12.0 प्रशिक्षण कार्यक्रम :
वर्ष के दौरान शिक्षकों और पेशेवर वास्तुविदों के लिए 7 प्रशिक्षण कार्यक्रम संचालित किए गए । निआसा में आयोजित इन कार्यक्रमों में 76 व्यक्तियों ने भाग लिया जिसमें देश के 33 वास्तुकला विद्यालयों और 7 व्यावसायिक कार्यालयों तथा संस्थाओं के सहभागी शामिल थे ।

13.0 राष्ट्रीय वास्तुकला अभिक्षमता परीक्षा (नाटा)
ऐसे भावी छात्रों के लिए जो वास्तुकला पाठ्यक्रम में दाखिला लेने के इच्छुक हैं, उनके लिए वास्तुकला में राष्ट्रीय अभिक्षमता परीक्षा 1 मार्च, 2010 से 30 सितंबर , 2010 तक आयोजित की गई थी । ' नाटा' 2010 परीक्षा पूरे भारत में फैले 117 केंद्रों पर संचालित की गई थी जिनमें 22272 परीक्षाएँ संचालित की गई थीं ।
14.0 राष्ट्रीय शोध- प्रबंध पुरस्कार कार्यक्रम :
वास्तुकला परिषद् ने ' निआसा' के माध्यम से युवा प्रतिभाशाली उम्मीदवारों को प्रोत्साहित करने के लिए पूर्व- स्नातक शोध-प्रबंध परियोजनाओं हेतु पाँचवां राष्ट्रीय शोध - प्रबंध पुरस्कार कार्यक्रम शुरू किया । वर्ष 2010 के लिए पुरस्कार कार्यक्रम 15 अगस्त , 2010 से 7 अक्तूबर , 2010 तक दो चरणों में संचालित किया गया था । आंचलिक कार्यक्रम निम्नलिखित स्थानों पर आयोजित किए गए:-

राष्ट्रीय जूरी का आयोजन ऐशान्य हाल , पुणे में किया गया । इसका समन्वय द् इंडियन इंस्टीट्यूट ऑफ आर्किटेक्चर , महाराष्ट्र चेप्टर, पुणे सेंटर और बी के पी एस कॉलेज ऑफ आर्किटेक्चर , पुणे द्वारा किया गया था । राष्ट्रीय फाइनल के लिए जूरी के सदस्य ये थे वास्तुविद अशरफ सलाम ( कतार ) , वास्तुविद मो. शहीर ( नई दिल्ली ) और वास्तुविद माधव जोशी ( पुणे ) ।
15.0 वास्तुविद् राष्ट्रीय कांग्रेस और भारतीय वास्तुविद् संस्थान महासम्मेलन
भारतीय वास्तुविद् संस्थान पुणे केंद्र और महाराष्ट्र शाखा नें वास्तुविद् परिषद् के साथ लक्ष्मी लॉन्स, मगरापट्टा शहर, पुणे में 8 अक्तूबर, 2010 ( शुक्रवार ) को महासम्मेलन की और 9 अक्तूबर , 2010 ( शनिवार ) को वास्तुविद् राष्ट्रीय कांग्रेस की मेजबानी की। इनके समन्वय और संचालन में ' निआसा' शामिल था ।
इस कार्यक्रम में राज्य के विभिन्न प्रशासनिक गण्यमान्य व्यक्तियों ने भाग लिया जिनमें श्री छगन भुजबल ( उप मुख्यमंत्री महाराष्ट्र राज्य) , श्री महेश जगाडे ( आयुक्त , पुणे नगर निगम ) , श्री मोहन सिंह राजपाल (माननीय पुणे महापौर ) , वास्तुविद् प्रमोद कुरील (सदस्य- राज्य सभा ) और पूरे देश से 2500 से अधिक वास्तुविद् शामिल थे ।
भारतीय वास्तुविद् संस्थान महासम्मेलन में निम्नलिखित कार्य निष्पादित किया गया :
पिछले 50 वर्षों से अधिक महाराष्ट्र की विभिन्न परियोजनाओं पर आधारित ' द् जर्नी' नामक स्मारक सचित्र पुस्तक के प्रकाशन काप्रारंभ । ) दस सीओए-निआसा शोध- प्रबंध पुरस्कार विजेताओं का अभिनंदन ।
मुंबई के वास्तुविद् हफीज़ कंट्रेक्टर के आधार व्याख्यान के बाद प्रतिष्ठित वास्तुविदों द्वारा प्रस्तुतियाँ और व्याख्यान । उत्पाद विनिर्माताओं, प्रौद्योगिकी समाधान प्रदाताओं और शहर के प्रमुख भवन निर्माताओं के स्टालों की प्रदर्शनी । महाराष्ट्र के उभरते वास्तुविदों, राज्य के 40 से अधिक वास्तुविद् विद्यालयों के छात्रों और अंतिम प्रवेश नामिकाओं के 10 चयनित सीओए- निआसा शोध- प्रबंध पुरस्कार विजेताओं के कार्यों की प्रदर्शनी / राज्य के 20 से अधिक वास्तुकला विद्यालयों ने जनता के अवलोकन के लिए अपने सर्वश्रेष्ठ कार्यों के साथ इसमें भाग लिया ।
वास्तुविद् राष्ट्रीय कांग्रेस ( द आर्किटेक्ट्स नेशनल कांग्रेस ) का आयोजन वास्तुविद् अधिनियम , 1972 से संबंधित नौ महत्वपूर्ण मुद्दों पर वाद-विवाद के लिए किया गया था, जिन पर एक साथ तीन पृथक मंचों पर वाद- विवाद हुआ ।
वाद-विवाद के विषय और उनसे संबंधित वक्ता निम्न थे :
1. वास्तुकला परिषद् और सरकारी केंद्रक मंत्रालय , वक्ता प्रो. शिरीष देशपांडे ( नागपुर) और प्रो. अख्तर चौहान ( मुंबई) । इस सत्र की अध्यक्षता श्री उदय गडकरी , सदस्य कार्यकारिणी समिति, वास्तुकला परिषद् ने की ।
2. विदेशों में कार्य करने के लिए भारतीय अर्हताओं को समतुल्यता प्रदान करने के लिए अन्य देशों के साथ पारस्परिक मान्यता करार ( एमआरए) , वक्ता वास्तुविद् ए एन. रामनाथन ( नई दिल्ली ) और वास्तुविद् रामाराजू ( चैन्नई ) । इस सत्र की अध्यक्षता श्री यू सी. गडकरी , कार्यकारिणी समिति, वास्तुकला परिषद् ने की ।
3. सार्वजनिक , अर्द्ध-सार्वजनिक और सरकारी परियोजनाएँ- कार्य का आबंटन , कार्य- क्षेत्र और फीस संरचना के लिए क्रियाविधि और प्रतिमानक , वक्ता वास्तुविद् निमीश पटेल ( अहमदाबाद ) और वास्तुविद पार्थ रंजन दास (कोलकाता ) । इस सत्र की अध्यक्षता श्रीमती ऊषा कसाना , सदस्य, वास्तुकला परिषद् ने की ।

9. कार्पोरेट और बहुविषयक व्यवसाय की अनुमति के लिए वास्तुविद् अधिनियम में संशोधन , वक्ता वास्तुविद् रवि जोशी ( पुणे ) और वास्तुविद् विश्वास कुलकर्णी ( पुणे ) । इस सत्र की अध्यक्षता श्री मिहिर मित्रा , सदस्य वास्तुकला परिषद् ने की । 3-429 GI /2011 [भाग III-खण्ड 4

10. एक और दसवां मुद्दा वास्तुविद् अधिनियम , 1972 में संशोधन करने के लिए राज्य सभा में हाल में प्रस्तुत बिल से संबंधित है। इसकी सूचना सहभागियों को प्रो. विजय सोहोनी , अध्यक्ष , वास्तुकला परिषद् ने प्रदान की ।
16.0 वास्तुकलात्मक प्रतियोगिताएँ :
परिषद् वास्तुकलात्मक प्रतियोगिताओं का संचालन करके अनेक प्रवर्तकों की उन्हें उनके भवनों के निर्माण के लिए वास्तुविदों का चयन करने में सहायता करती रही है , यथा वित्त मंत्रालय , भारत सरकार द्वारा नई दिल्ली में राष्ट्रीय कर मुख्यालय भवन के लिए; भारतीय विमान पत्तन प्राधिकरण द्वारा विमानपत्तन टर्मिनलों के निर्माण के लिए; वृक्कन मूत्र- विज्ञान संस्थान, बंगलौर के उपभवन के निर्माण के लिए और साथ ही महाराष्ट्र सरकार की सहायता निजी वास्तुविदों की नियुक्ति के लिए दिशा-निर्देशों के निर्माण के लिए भी की ।
परिषद् ने अनेक लोक प्राधिकारियों को लिखा है कि वे वास्तुविदों की नियुक्ति निविदा या बोली प्रक्रिया के जरिए न्यूनतम फीस की अदायगी के आधार पर न करके वास्तुकलात्मक प्रतियोगिता दिशा- निर्देशों के अनुसार करें । प्रवर्तकों और प्रतियोगियों ने प्रतियोगिताओं का संचालन करने में जब भी परिषद् से दिशा- निर्देशों और निविष्टियों की मांग की उन्हें परिषद् द्वारा तुरंत उपलब्ध कराया गया है ।
17.0 वास्तुविद् अधिनियम, 1972 और इसके अधीन तैयार विनियमों को लागू करना
वास्तुविद् अधिनियम , 1972 की धारा 36 और 37 के अधीन वास्तुविद् के रूप में अयथार्थ रूप प्रस्तुत करने के साथ- साथ वास्तुकला की पदवी और शैली के दुरुपयोग के निषेध का उल्लंघन एक दंडनीय अपराध है । वास्तुविद् की पदवी और शैली के दुरुपयोग के संबंध में शिकायत मिलने पर परिषद् धारा 39 के अधीन प्रथम श्रेणी मजिस्ट्रेट के समक्ष अपराधों का संज्ञान लेने के लिए शिकायत दर्ज कराती है ।
परिषद् उन व्यक्तियों के विरुद्ध मेट्रोपोलिटन मजिस्ट्रेट , नई दिल्ली में दर्ज की गई आपराधिक शिकायतों का तेजी से अनुसरण कर रही है जिन्होंने वास्तुविद अधिनियम , 1972 के उपबंधों का उल्लंघन किया है और वास्तुविद् की पदवी और शैली का अयथार्थ रूप प्रस्तुत या दुरुपयोग किया है । इस समय 13 शिकायतें न्यायालय के समक्ष न्यायनिर्णयन के लिए लंबित हैं । इसके अतिरिक्त विभिन्न न्यायालयों में वास्तुविद् अधिनियम , 1972 के उपबंधों को लागू करने से संबंधित और अन्य संबंधित मामलों के लगभग 76 मामले लंबित पड़े हैं जिनमें परिषद् एक पक्षकार है ।

18.0 परिषद्द्वारा " आर्किटेक्चर- टाइम स्पेस एंड पीपल " नामक पत्रिका का प्रकाशन किया जा रहा है । यह पत्रिका पंजीकृत वास्तुविदों को निःशुल्क भेजी जाती है । इस पत्रिका में परिषद् की गतिविधियाँ, वास्तुकला व्यवसाय से संबंधित मुद्दों और प्रौद्योगिकी की अद्यतन प्रगतियों एवं अनुप्रयुक्त नवाचारों की उपयोगी सूचना दी जाती है । परिषद् इस पत्रिका का मुद्रण एवं प्रकाशन मै. लाइफस्टाइल मीडिया , नई दिल्ली की सहायता से कर रही है । परिषद् ने डाइरेक्टरी आफ आर्किटेक्ट्स तथा हैंडबुक आफ प्रोफेशनल डाकुमेंट्स 2011 को भी प्रकाशित करने की प्रक्रिया शुरू कर दी है ।
इसके अतिरिक्त, वास्तुकलात्मक शोध-प्रबंध 2009 के लिए उत्कृष्टता पुरस्कारों से संबंधित पुस्तक " आर्काइविंग आर्किटेक्चरल थीसिस 09 " जिसके डिजाइन और विषय- वस्तु को अंतिम रूप दे दिया गया था वह 14 जून , 2010 को मुद्रित और प्रकाशित हो गई थी ।

हमने वास्तुकला परिषद्, 'इंडिया हैबिटेट सेंटर , कोर 6 ए, प्रथम तल, लोदी रोड , नई दिल्ली-110003 के 31 मार्च, 2011 के संलग्न तुलन -पत्र तथा 31 मार्च , 2011 को समाप्त वर्ष के आय- व्यय लेखा एवं प्राप्ति तथा अदायगी लेखा. ( इसमें परिषद् के कार्यालयों के सभी लेखे शामिल हैं) की परीक्षा कर ली है । ये वित्तीय विवरण परिषद् के प्रबंधन की जिम्मेदारी है और लेखापरीक्षा पर आधारित इन वित्तीय विवरणों के बारे में राय व्यक्त करना हमारी जिम्मेदारी है ।
हमने भारत में सामान्यतः स्वीकृत किए गए लेखापरीक्षा मानकों के अनुसार लेखापरीक्षा की है । इन मानकों के अनुसार यह अपेक्षित है कि हम लेखापरीक्षा की योजना एवं निष्पादन ऐसा उचित आश्वासन प्राप्त करने के लिए करते हैं, कि क्या वित्तीय विवरण किसी विशेष गलत विवरण से मुक्त हैं । लेखापरीक्षा में नमूना के आधार पर जांच करना और वित्तीय विवरणों में राशि एवं प्रकटनों का पोषक साक्ष्य शामिल होता है । लेखापरीक्षा में प्रयुक्त लेखाकरण सिद्धांतों का निर्धारण तथा प्रबंधन द्वारा लगाए गए महत्वपूर्ण अनुमान और समूचे वित्तीय विवरण की प्रस्तुति का मूल्यांकन करना भी शामिल होता है । हमें विश्वास है कि अनुलग्नक सं. 14- लेखाओं के भाग के रूप में महत्वपूर्ण लेखाकरण नीतियाँ नोट सं. 04, 05 , 07 और 09 के अध्यधीन हमारे द्वारा की गई लेखापरीक्षा हमारी राय के लिए उचित आधार प्रस्तुत करती है ।
हम रिपोर्ट देते हैं कि:
1. हमने वे सभी सूचनाएँ एवं स्पष्टीकरण प्राप्त कर लिए हैं जो हमारी जानकारी और विश्वास के अनुसार लेखापरीक्षा के लिए आवश्यक थे;
2. हमारी राय में , हमने लेखा बहियों की जो जांच की है उससे यह प्रकट होंता है कि परिषद् ने वास्तुविद अधिनियम , 1972 द्वारा अपेक्षित रूप में उचित लेखा बहियाँ रखी हुई हैं;

No. DNBS (PD ) MGC No. 6/CGM (US)-2011-The Reserve Bank of India, having considered it necessary inpublic interest and being satisfied that , for the purpose of enabling the Bank to regulate the credit system to the advantage of the country, it is necessary to amend the Mortgage Guarantee Company (Reserve Bank) Guidelines 2008 in exercise of the powers conferred by sections 45JA and 45 (L) of the Reserve Bank of India Act, 1934 (2 of 1934) and of all the powers enabling it in this behalf, hereby directs that the said Directions shall be amended with immediate effect as follows , namely :-
2.Amendment of paragraph 27-
The existing clause "No mortgage guarantee company shall provide mortgage guarantee for a housing loan with 90% and above LTV ratio " shall be substituted with the following " No mortgage guarantee company shall provide mortgage guarantee for a housing loan above Rs . 20 lakhs where the LTV exceeds 80 % " . For small value housing loans i.e. housing loan upto Rs . 20 lakh (which get categorized as priority sector advances ) , LTV ratio should not exceed 90% .

ANNUAL REPORT 2010-2011
The Council of Architecture , constituted under the Architects Act, 1972 under Ministry of Human Resource Development, Govt . of India, deems it a pleasure to present the Annual Report and Audited Statement of Accounts for the financial year ended on 31.03.2011.
Organisational Structure :
President, Council of Architecture is head of the organization under whose overall charge the Council functions . Presently Prof. Vijay Shrikrishna Sohoni is the President of the Council of Architecture.
Statutory and Other Committees:
In order to carry out the objectives of the Act and Regulations framed thereunder , the Council constituted the statutory committees , namely , the Executive Committee, which functions as an Executive Authority of the Council , Disciplinary Committee, which investigates the complaints and holds enquiries relating to professional misconduct of architects , Advisory Committee (Appeals) , which hears the appeals of the applicants whose applications for registration are rejected. Apart from these several other committees are constituted from time to time for particular / special purposes.
Meetings of the Council and its Committees:
During the year under report , the Council met twice i.e. 55th Meeting was held on 16th August, 2010 atMadurai , Tamilnadu and 56th Meeting was held on 4th February , 2011 at Bhubaneswar, Orissa .
The Executive Committee met four times i.e. 105th Meeting on 6th June, 2010 at New Delhi , 106th Meeting on 15th August, 2010 at Madurai , 107th Meeting on 26th November , 2010 at New Delhi and 108thMeeting on 3rd February, 2011 at Bhubaneswar, Orissa.
The various decisions and actions taken by the Council during the year under report are summarized as under:
1.0 RESTORATION OF NAMES TO THE REGISTER OF ARCHITECTS MAINTAINED BY THE COUNCIL UNDER THE ARCHITECTS ACT , 1972:
The Council at its 55th meeting approved the restoration of names of 610defaulting architects , whose name were restored to the Register of Architects on receipt of requisite fee, during the period from 01.01.2010 to 30.06.2010.
The Council at its 56th Meeting approved the restoration of names of 519defaulting architects , whose name were restored to the Register of Architects on receipt of requisite fee, during the period from 01.07.2010 to 31.12.2010.

2.0 REMOVAL OF NAMES FROM THE REGISTER OF ARCHITECTS DUE TO REQUEST AND DEATH:
The Council at its 55th Meeting removed the name of Shri Shreeharsh Tukaram Jadhav (CA/2000/25915) architect upon his death.
Further, the Council also removed the names of following architects upon their request:
i) Shri Tushar H. Sutaria, Jamnagar (CA/2002/29443);
ii) Shri Pradeep Ambadas Ingole, Panvel (CA/95/ 19249); and
iii) Shri Prabhakar Ramrao Deobhankar (CA/75/1427) .
The Council at its 56th Meeting removed the names of the following architects upon their death:
i ) Shri Ramchandra P. Kini , Mumbai (CA/77/3617);
ii) Shri Prabhat Chandra , Gurgaon (CA/76/2388);
iii) Shri Mahender Pal Sharma, Delhi (CA/77/3784);
iv) Shri V. M. Somasundram , Secunderabad (CA/76/2447);
v) Shri Adesh Kumar, Bareilly (CA/79/5325);
vi) Shri Sobha Ram Tamrakar, Raipur (CA/75/809);
vii) Shri Shriniwas M. Ganorkar, Mumbai (CA/76/2670; and
viii) Shri G. D. Nirala, Delhi , ( CA/2001/27197) .
Further , names of following architects were removed upon their request:
i) Shri Vishnu Sharma , Newyork (CA/77/4235);
ii ) Shri Nityam Gambhir, New Delhi ( CA/2000/26966) ; and
iii) Shri Avinash N. Joshirao , Pune (CA/75/942) .
3.0 MEETINGS OF THE DISCIPLINARY COMMITTEE :
During the year under report , no meeting of the Disciplinary Committee of the Council was held as under the Council of Architecture Rules , 1973 as amended in 2009 the Central Government has to constitute the same and notify in official gazette. However, till date the Central Government has not constituted the Disciplinary Committee and therefore all the cases are pending.
4.0 REGISTRATION OF ARCHITECTS:
TheCouncil registers a person as an architect under Section 25 of the Act, who resides or carries on the profession of architecture in India and holds a recognized architectural qualification.
During the year (1st April , 2010 to 31st March , 2011 ) , the Council has registered 3583 persons as architects and with this as on 31st March, 2011 , a total of 51516 persons have been registered as architects with Council of Architecture . As on 31st March, 2011 , 39918 persons hold valid registration with the Council of Architecture.

5.0 MUTUAL RECOGNITION AGREEMENT WITH BOARD OF ARCHITECTS SINGAPORE & OTHER COUNTRIES:
In terms of the Comprehensive Economic Cooperation Agreement (CECA ) signed between Government of India and Government of Singapore the Council is negotiating to enter into a Mutual Recognition Agreement ( MRA) with the Boards of Architects Singapore for recognition of Indian architectural qualification and architects to practice in Singapore and vice-versa .
The Council is undertaking negotiations with the Board of Architects Singapore in the matter to finalize the MRA for recognition of Architectural Qualifications and Registration of each other's country.
6.0 NATIONAL BUILDING CODE BY BUREAU OF INDIAN STANDARDS
TheCouncil vide its letter dated 30th October, 2009, has withdrawn all its nominees from the proceedings of the National Building Code (NBC) being prepared by the Bureau of Indian Standards . The Bureau of Indian Standards in the proposed provisions of NBC have usurped the competence and functions of Architects in favour of non- architects and tried to regulate their profession of Architects under the provisions of the NBC contrary to provisions ofthe Architects Act, 1972.
The PIL filed by Society for Safe Structures for implementation of NBC in Supreme Court has been dismissed by the Hon'ble Supreme Court and Writ Petition of Council challenging some of the parts of NBC has been directed to be listed before the Hon'ble Delhi High Court for disposal by the High Court.
7.0 DISCIPLINARY ACTION ON ARCHITECTS:
Each and every architect is required to observe and abide by the provisions of the Architects (Professional Conduct ) Regulations , 1989, as amended in 2003. The Act provides for taking action against an architect who is found guilty of professional misconduct upon investigation and after providing opportunity of being heard to the architect.
TheCouncil at its 55th Meeting considered 2 complaints for professional misconduct against architects and one complaint to Prof. U.C. Gadkari for his opinion whether there exists a prima case of not and the other complaint was dismissed as no prima facie case was found.
TheCouncil cautioned 3 Architects who were found guilty of professional misconduct to not to repeat such conduct . Further 2 Architects who were found guilty of professional misconduct were suspended from practice for a period of one year and one another Architect who was found guilty of professional misconduct was suspended from practice for a period of 6 months .
8.0 APPROVAL OF NEW INSTITUTIONS IN THE ACADEMIC SESSION 2010-2011 :
During the year under report 27 New institutions were granted approval to impart Bachelor ofArchitecture Courses . In the already existing institutions 3 new B.Arch . degree courses and 8 new M.Arch . Degree courses were granted approval . With this, the total number of institutions imparting recognized courses in architecture has risen to 186 in 2010-2011 . The annual intake of students (approx. ) Undergraduate ( UG) level is 10121 , Postgraduate (PG) level is 1060 and at Ph.D is 20.

9.0 EXTENSION OF APPROVAL FOR THE ACADEMIC SESSION 2010-2011 ONWARDS:
Council of Architecture granted extension of approval or otherwise for B.Arch . & M.Arch. Courses to 108 institutions for the academic session 2010-2011 as under.
i) Institutions granted extension of approval for B.Arch . Course for 2010-2011 onwards with existing or higher intake: 108.
ii) Institutions granted extension of approval for M.Arch . Course for 2010-2011 onwards with existing or higher intake: 20.
iii) Institutions put on 'No Admission' for 2010-2011 : NIL
iv) Institutions put on Withdrawal of recognition ' for 2010-2011 : NIL
The Council has also initiated the process of inspection for the academic session 2011-2012 ofinstitutions , which are due for inspections .
10.0 RECOGNITION OF FOREIGN QUALIFICATIONS UNDER THE ARCHITECTS ACT , 1972 BY THE CENTRAL GOVERNMENT
The Council has received reference from the Central Govemment for recognition of the following foreign qualifications for the purposes of the Architects Act, 1972:
i) Master of Architecture Degree awarded by Imam Khomeini International University, Tehran, Iran ;
ii) Bachelor of Architecture Degree awarded by NED University of Engineering & Technology, Karachi , Sind, Pakistan;
Bachelor of Built Environment (Architecture) and Bachelor of Architecture Degreeby Queensland University of Technology , Brisbane , Australia ; and
iv) Bachelor of Architecture Degree awarded by Schoolof Architecture & Building , DeakinUniversity, Australia .
A Sub-committee of the Council has been examining the above foreign qualifications . Recommendations of the Council in respect of Master of Architecture Degree awarded by Imam Khomeini International University, Tehran , Iran, have been sent to the Central Government in the Ministry of HRD.
11.0 CONDUCT OF PROFESSIONAL EXAMINATION BY THE COUNCIL OF ARCHITECTURE BEFORE GRANTING REGISTRATION AS AN ARCHITECT TO PERSONS POSSESSING RECOGNISED QUALIFICATIONS.
The Council approved the Draft Regulations for conduct of Professional Examination by it before registering any person as an architect. The Regulations have been sent to the Ministry of Human Resource Development, Govt . of India for conveying the approval of the Central Government. The President, Council of Architecture has also met Hon'ble Minister of HRD for expediting the approval of the Central Government in the matter
12.0 TRAINING PROGRAMMES :
7training programme were conducted for teachers and professional Architects during the year. The programmes were attended by 76 participants representing 33 schools of architecture and 7 professional offices and institutes across the country at NIASA .

15.0 ARCHITECTS NATIONAL CONGRESS AND IIA MAHA CONVENTION
Indian Institute of Architects Pune Centre and Maharashtra Chapter, along with the Council ofArchitecture (COA) , hosted a Maha-Convention on the 8th of October, 2010 ( Friday) , followed by the Architects National Congress on the 9th of October (Saturday) , at Laxmi Lawns , Magarapatta City , Pune. NIASA was involved in the coordination and conduct of the event.
The programme was attended by various state administrative dignitaries , including Shri Chagan Bhujbal (Dy. Chief Minister, Maharashtra State) , Shri Mahesh Zagade (Commissioner, Pune Municipal Corporation ) , Shri Mohansingh Rajpal ( Hon . Mayor of Pune), Ar. Pramod Kureel (Member - Rajya Sabha) and more than 2500 architects from all over the country.

An exhibition of stalls of product manufacturers , technology solution providers and prominent city builders,
A showcasing of the works of Maharashtra's budding architects , the students of more than40 schools of architecture in the state , as well as the final entry panels of the 10 selected COA - NIASA Thesis Awards Finalists . More than 20 state schools of architecture participated by putting up their best works for the public to see.
The Architects National Congress was held for discussions on nine important issues pertaining to the Architects Act, debated over three separate forums in action simultaneously .

10. There was also a 10th issue regarding the recent bill being tabled in the Rajya Sabha, for bringing changes in the Architects Act of 1972. This was brought to the notice of the participants,by Prof. Vijay Sohoni , President, Council of Architecture.
16.0 ARCHITECTURAL COMPETITIONS:
The Council is assisting a number of promoters for the conduct of the architectural design competitions for selection of architects for construction of their buildings , namely, construction of National Tax Headquarter Building in New Delhi by Ministry of Finance, Govt. ofIndia, construction of airport terminals by Airport Authority of India, construction of Annex Building by Institute of Nephro Urology, Bangalore and also assisted in framing guidelines for appointment of private architects to Govt. ofMaharashtra.
TheCouncil also wrote to several public authorities to appoint architects as per Architectural Competition Guidelines and not appointed through tender or bid process on payment of lowest fee. The guidelines and inputs required by the promoters and competitors from the Council in the conduct of the competitions were also made available as and when requests were received.
17.0 ENFORCEMENT OF THE ARCHITECTS ACT, 1972 AND REGULATIONS FRAMED THEREUNDER :
Sections 36 and 37 of the Architects Act, 1972, impose prohibition on misrepresentation as anarchitect as well as misuse of title and style of architect and violation of the prohibition is a punishable offence. Upon receipt of the complaints of misuse of title and style of architect, theCouncil files complaints u/s 39 before the First Class Magistrate for taking cognizance of theoffences.
The Council is vigorously pursuing such criminal complaints filed before the Metropolitan Magistrate, in New Delhi , against persons who have violated the provisions of the Architects Act, 1972 and misrepresented or misused the title and style of architect. Presently about 13 complaints are pending for adjudication before the Court.
Further, a total of about 76 cases are pending in different courts relating to enforcement of the provisions of the Architects Act, 1972 and other related matters where Council is one of theparties.
18.0 PUBLICATIONS :
The Council has been publishing a magazine titled " architecture time space & people" . This magazine is being sent free of cost, to the registered architects . It provides useful information about the activities of the Council and issues concerning architectural profession and latest technological advancements and innovations applied. 1 for publishing the Directory of Architects and Handbook of Professional Documents 2011 has started.
Further, the book on the Awards for Excellence in Architectural Thesis 2009 titled "Archiving Architectural Thesis '09 " whose design and content had been finalised was printed and published on 14th June , 2010.
