सं. एफ.71 - एडी( एटी ) /2012--आयकर अधिनियम, 1961 की धारा 255 की उपधारा ( 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , अपीलीय अधिकरण एतद्वारा आयकर ( अपीलीय अधिकरण ) नियमावली, 1963 , में संशोधन करते हुए निम्नलिखित नियम बनाते हैं : -- संक्षिप्त नाम और प्रारंभ ( 1 ) ये नियम आयकर ( अपीलीय

अधिकरण ) संशोधन नियम , 2012 कहे जा सकेंगे ।

( 2) ये नियम शासकीय राजपत्र में प्रकाशन की तिथि से लागू होंगे।

नियम 2 में संशोधन परिभाषाएं

वर्तमान नियम 2 ( ii ) ( ख ) के लिए निम्नलिखित प्रतिस्थापित किए जायेंगे : --

" ( ख ) आयकर प्राधिकारी के संबंध में जो कि अधिकरण के समक्ष किसी कार्यवाही में पक्षकार हो :--

[भाग III-खण्ड 1

( i ) आयकर विभाग की ओर से प्रस्तुत होने , अभिवचन तथा कार्य करने के लिए केन्द्रीय प्रत्यक्ष कर बोर्ड द्वारा प्राधिकृत प्रतिनिधि के रूप में विधिवत् नियुक्त व्यक्ति।

( ii ) आयकर विभाग की ओर से प्रस्तुत होने, अभिवचन तथा कार्य करने के लिए मुख्य आयुक्त द्वारा विधिवत् प्राधिकृत व्यक्ति। " नियम 4क में संशोधन पंजीकार की शक्तियां एवं कर्त्तव्य

वर्तमान नियम 4क ( 2 ) ( i )के लिए निम्नलिखित प्रतिस्थापित किए जायेंगे :--

" सभी अपीलें, विविध आवेदन , स्थगन याचिका के अतिरिक्त, शीघ्र सुनवाई के आवेदन, अपीलों का स्थानांतरण, स्थगन के लिए आवेदन के साथ अन्य दस्तावेज प्राप्त करने के लिए"

नियम 9 में संशोधन अपील के ज्ञापन के संलग्नक

नियम 9 के अंतर्गत, " आयकर अधिकारी" के शब्द को " निर्धारण अधिकारी " के शब्द द्वारा प्रतिस्थापित किया जाएगा ।

वर्तमान नियम 9 के पश्चात्, निम्नलिखित नियम 9क के रूप में सम्मिलित किए जाएंगे: --

9क(1) अपील के पक्षकारों के पते के परिवर्तन की स्थिति में जो फार्म 36 के कॉलम सं. 10 और 11 में दिया गया है, अपीलार्थी को पक्षकार का नया पता देते हुए विधिवत् भरा हुआ संशोधित फॉर्म 36 फाईल करना चाहिए जो आयकर नियमावली , 1962 के नियम 47 के आवश्यकतानुसार विधिवत् सत्यापित हो ।

(2 ) संशोधित फॉर्म सं. 36 में मूलतः विनिर्दिष्ट अपील क्रमांक का उल्लेख किया जायेगा अथवा ऐसी संख्या की अनुपलब्धता की स्थिति में , आवरण पत्र पर अपील फाइल करने की तिथि का उल्लेख किया किया जायेगा । भाग III-खण्ड 1]

( 3) जब तक उप नियम ( 1 ) और ( 2 ) के अनुसार संशोधित फार्म फाइल नहीं किए जाते , किसी भी उद्देश्य से पक्षकारों के पता परिवर्तन का संज्ञान नहीं लिया जाएगा ।

(4) सभी नोटिस/आदेशों के प्रयोजन के लिए, संशोधित फॉर्म सं. 36 में दिया गया पता, पक्षकारों का पता माना जाएगा । नियम 26 में संशोधन अपील के पक्षकार की मृत्यु अथवा दिवालियापन के पश्चात् कार्यवाही को जारी रखना

वर्तमान नियम 26 के लिए, निम्नलिखित नियम प्रतिस्थापित किया जायेगा : --

453 प्रक्रिया ऐसे आवदेनों के लिए यथा परिवर्तन सहित (mutatis mutandis ) लागू होंगे । अपीलार्थी यह विवरण भी देगा कि धारा 254( 2) के अंतर्गत कोई विविध आवेदन उसी आदेश के विरुद्ध अधिकरण के समक्ष पूर्व में फाइल किया गया था, यदि ऐसा हो तो उस आवेदन का परिणाम, उन आवेदनों पर अधिकरण द्वारा पारित आदेशों की प्रतियां भी विविध आवेदन के साथ तीन प्रतियों में अधिकरण के समक्ष फाइल किया जाएंगे । नियम 34क( 3 ) के वर्तमान उपबंध को हटा दिया गया है ।

नियम 35क के उपबंध

काविलोपन

स्थगन याचिका के दायर करने तथा निपटान की प्रक्रिया वर्तमान नियम 35क ( 3 ) को हटा दिया गया है ।

अतिरिक्त संशोधन

निर्धारिती , जहां वह अपील का अपीलार्थी हो अथवा प्रत्यार्थी की मृत्यु अथवा न्यायनिर्णित दिवालिया होने पर कंपनी के परिसमाप्ति के मामले में, अपील समाप्त नहीं होगी एवं , यदि निर्धारिती अपीलार्थी था तो उसके निष्पादक, प्रशासक या किसी विधिक प्रतिनिधि के द्वारा और यदि वह प्रत्यर्थी था तो समुनिदेशिती , प्राप्तकर्ता या परिसमापक के विरूद्ध, जैसी भ ी स्थिति हो , अपील जारी रहेगी ।

बशर्ते कि :--

( i ) निर्धारिती, आयकर नियमावली , 1962 के नियम 47 के आवश्यकतानुसार यथावत् सत्यापित करके , पक्षकार का संशोधित नाम देते हुए विधिवत् भरा हुआ संशोधित फॉर्म 36 दायर करता है ।

( ii ) संशोधित फॉर्म सं. 36 में मूलतः विनिष्टि अपील क्रमांक का उल्लेख किया जायेगा अथवा मूल अपील क्रमांक की अनुपलब्धता की स्थिति में , आवरण पत्र पर अपील फाइल करने की तिथि का उल्लेख किया जायेगा जिससे पंजीकार मूल फाइल में नया फॉर्म सं . 36 रख सकेंगे ।

नियम 34क में संशोधन धारा 254 ( 2 ) के अंतर्गत आवेदनों के संबंध में प्रक्रिया

वर्तमान नियम 34 क ( 2 ) के लिए, निम्नलिखित प्रतिस्थापित किए जाते हैं :--

उपनियम ( 1 ) के अंतर्गत बनाए गये प्रत्येक आवदेन तीन प्रतियों में होंगे तथा इन नियमों के अनुसार अपीलों के फाइल करने की 3-486 G1 / 2011

आयकर अपीलीय अधिकरण की नियमावली में जहां कहीं भी " आयकर अधिकारी " शब्द है, " उन्हें निर्धारण अधिकारी " शब्द के द्वारा प्रतिस्थापित किये जाएगा ।

उसी तरह, आयकर अपीलीय अधिकरण नियमावली में जहां कहीं भी " अपीलीय सहायक आयुक्त" शब्द हैं उन्हें " आयकर आयुक्त ( अपील ) " शब्द के द्वारा प्रतिस्थापित किया जाएगा ।

आदेशानुसार आयकर अपीलीय अधिकरण

Amendment in Rule 2

For the existing Rule 2 ( ii) (b) , the following shall be substituted : -

"(b) in relation to an income- tax authority who is a party to any proceedings before the Tribunal :-

(i) a person duly appointed by the Central Board of Direct Taxes as " authorised representiatve" to appear, plead and act on behalf of the Income- Tax department; and (ii) a person duly authorised by the Chief Commissioner of Income-Tax to appear, plead and act on behalf ofthe Income- Tax department . "

Amendment in Powers and functions of the Registrar.

Forthe existing Rule 4A (2) ( i) , the following shall be substituted :-

"to receive all appeals , miscellaneous applications, stay petitions as well as other documents including applications for early hearing, transfer of appeals , applications for adjournment ; "

Amendment in Rule 9

What to accompany memorandum of appeal.

In Rule 9, the words " Income Tax Officer " may be substituted by the words "Assessing Officer. "

After existing Rule 9 , the following shall be inserted as Rule 9A :----

"9A (1) In the event of change in address ofthe parties to the appeal as provided in column Nos . 10 & 11 of Form No. 36 , the appellant should file a revised Form No. 36 duly filled up giving the new address of the party, duly verified in the same manner as required by Rule 47 of the Income Tax Rules , 1962 .

(2) The revised Form No. 36 shall specify the appeal No. as originally assigned or , in the event of non - availability of such No. the date of filling of the appeal shall be mentioned in the covering letter.

(3) No cognizance of change of address of the parties shall be taken for any purpose , unless a revised form per sub -rule ( 1) and (2) is filed .

(4) The address furnished in the revised Form No. 36 shall be deemed to the address of the parties for the purpose of service of all notices /orders . " 466

For the existing Rule 26 , the following rule shall be substituted :-

"Where an assessee whether he be an appellant or the respondent to an appeal dies or is adjudicated insolvent or in the case of a company being wound up, the appeal shall not abate and may, if the assessee was the appellant, be continued by, and if he was the respondent be continued against , the executor, administrator or other legal representative of the assessee or by or against the assignee, receiver or liquidator, as the case may be :--

Provided that:

(i) The assessee files a revised Form No. 36 duly filled up giving revised name of the party duly verified in the same manner as required by Rule 47 of Income Tax Rules , 1962;

(ii) The revised Form No. 36 shall specify the appeal number as originally assigned or, in the event of non- availability of such number on the date of filing the appeal shall be mentioned in the covering letter to enable the Registrar to place fresh Form No. 36 in the original file . " Procedure for dealing with applications Amendment in Rule 34A

under section 254(2 ) .

For the existing Rule 34A(2) , the following shall be substituted :-

"Every application made under sub- rule (1) shall be in triplicate and the procedure for filing of appeals in these rules will apply mutatis mutandis to such applications .

The Applicant shall also state whether any Miscellaneous Application under section 254 (2 ) was filed earlier before the Tribunal against the same order and if so , the fate of such application . Copies of the orders passed by the Tribunal on such applications shall also be filed before the Tribunal in triplicate along with the Miscellaneous Application . "

The existing proviso to Rule 34A(3 ) is deleted.

Wherever the words " Income Tax Officer" exist in the ITAT Rules , the same shall be substituted by the words "Assessing Officer ."

Likewise, wherever the words " Appellate Assistant Commissioner" exist in the ITAT Rules , the same be substituted by the words " CIT (Appeals) " .
