सा.का.नि. 64. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , संघ लोक सेवा आयोग प्रशासनिक अधिकारी ) समूह ' क ' पद भर्ती नियम , 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम संघ लोक सेवा आयोग ( प्रशासनिक अधिकारी ) समूह ' क' पद भर्ती ( संशोधन ) नियम , 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. संघ लोक सेवा आयोग ( प्रशासनिक अधिकारी ) समूह ' क ' पद भर्ती नियम , 1999 में,-

(i ) नियम 2 में " वेतनमान " शब्द के स्थान पर " वेतन बैंड और ग्रेड वेतन या वेतनमान " शब्द रखे जाएंगे;

( ii ) विद्यमान अनुसूची के स्थान पर , निम्नलिखित अनुसूची रखी जाएगी , अर्थात्:-

केन्द्रीय सरकार के अधीन ऐसे अधिकारी :

( क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हों; या

( ii ) जिन्होंने मूल काडर या विभाग में वेतन बैंड-2, में 9300-34800 रु. ग्रेड वेतन 4800 रु . वाले पद या समतुल्य पद पर दो वर्ष नियमित सेवा की हो; या

( iii ) जिन्होंने मूल काडर या विभाग में वेतन बैंड -2 , में 9300-34800 रु. + ग्रेड वेतन 4600 रु. या समतुल्य पद पर तीन वर्ष नियमित सेवा की हो; और

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हों, अर्थात्:-

( i ) किसी मान्यताप्राप्त विश्वविद्यालय से कला या विज्ञान या वाणिज्य में बैचलर डिग्री; या

( ii ) किसी मान्यताप्राप्त संस्था से कार्मिक प्रशासन या मानव संसाधन विकास में तीन वर्ष का डिप्लोमा; और

( iii ) स्थापन , प्रशासन और लेखा कार्य में तीन वर्ष का अनुभव ।

II . ऐसे विभागीय सहायक प्रशासनिक अधिकारी [ वेतन बैण्ड -2 में (9300- 34800) + ग्रेड वेतन 4800 रु. ] जिन्होंने दो वर्ष नियमित सेवा की हो , पर भी बाह्य व्यक्तियों के साथ विचार किया जाएगा और उस पद पर नियुक्ति के लिए उसे चयनित किए जाने की दशा में ऐसे पद को प्रोन्नति द्वारा भरा जाना समझा जाएगा ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की तारीख को छप्पन वर्ष से अधिक नहीं होगी ।

टिप्पण 4 : प्रोन्नति के लिए , न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी , 2006 से या उस तारीख से जिसको छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है , पूर्व नियमित आधार पर की गई सेवा को, उक्त आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान में की गई सेवा समझा जाएगा ।

टिप्पण 5 : प्रतिनियुक्ति आधार पर नियुक्ति के प्रयोजन के लिए,

किसी अधिकारी द्वारा 1 जनवरी 2006 से या उस तारीख से जिसको छठे वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है , पूर्व नियमित आधार पर की गई सेवा को उक्त आयोग की सिफारिशों के आधार पर विस्तारित तत्स्थानी ग्रेड वेतन/वेतनमान में की गई सेता सन जाएगा , सिवाय उस दशा के , जहां एक से अधिक पूर्व- पुनरीक्षित संतनमानों का सामान्य ग्रेड वेतन/वेतनमानों के साथ एक श्रेणी में विलय हो गया है, और जहां यह लाभ केवल उस पद के लिए विस्तारित होगा , जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधारण प्रतिस्थापन ग्रेड है ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

GS.R. 64. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Union Public Service Commission , ( Administrative Officer ) Group`A` PostRecruitment Rules , 1999 , namely :--

1. Short title and commencement.- ( 1 ) These rules may be called the Union Public Service Commission, (Administrative Officer ) Group ' A' post Recruitment ( Amendment ) Rules , 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Union Public Service Commission , (Administrative Officer) Group ' A' Post Recruitment Rules, 1999, -

(i ) in rule 2, for the words " scale of pay" , the words " pay band and grade pay or pay scale " shall be substituted;

(ii ) for the existing Schedule , the following Schedule shall be substituted , namely :-

(i) Bachelor's degree in Arts or Science or Commerce from a recognised University; or

(ii) three years diploma in Personnel Administration or Human Resource Development from a recognised Institution; and

(iii) three years experience in Establishment , Administration and Accounts Work.

II . The Departmental Assistant Adminstrative Officer [ in the Pay Band- 2(Rs . 9300-34800) with Grade Pay ofRs . 4800 ] with two years regular service shall also be considered along with outsiders and in case he is selected for appointment to the post , the same shall be deemed to have beenfilledby promotion.

Note 1 : The departmental official in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation . Similarly, deputationists shall not be eligible for consideration for appointment by promotion .

Note 2 : Period ofdeputation including period of deputation to another ex-cadre post held immediately preceding this appointment in the same or some other organization or departments of the Central Government shall not exceed three years .

Note 3 : The maximum age limit for appointment by deputation shall be not exceeding fifty- six years as on the closing date of receipt of applications.

Note 4: For the purpose of computing minimum qualifying service for promotion , the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation ofthe Commission .

Note 5 : For the purpose of appointment on deputation basis , the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the 6thCentral Pay Commission recommendation has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Commission except where there has been merger of more than one pre- revised scale ofpay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation .

सा.का.नि. 65. भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति छठे केन्द्रीय वेतन आयोग के कार्यान्वयन से पहले समूह ' घ ' वेतनमान में रहे पदों, जिन्हें केन्द्रीय सिविल सेवा में समूह ' ग ' में संघ कार्यों के संबंध में सिविल पदों की श्रेणी में रखा गया है , की सीधी भर्ती के तरीके एवं पात्रता की आवश्यकताओं आदि को विनियमित करने के संबंध में एतद्वारा निम्नलिखित नियम बनाते हैं , अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों को विदेश मंत्रालय समूह ' ग ' पद नियम , 2011 कहा जाएगा ।

(2) ये राजपत्र में अपने प्रकाशन की तारीख से प्रभावी होंगे ।

2. अनुप्रयोज्यता. ये नियम इन नियमों के साथ इससे उपाबद्ध अनुसूची के कॉलम ( 1 ) में विनिर्दिष्ट पदों के संबंध में लागू होंगे ।

3. पदों की संख्या, वर्गीकरण और वेतनमान, उक्त पदों की संख्या , वर्गीकरण और वेतनमान इन नियमों के साथ उपाबद्ध अनुसूची

के कॉलम ( 2 ) से (4 ) में विनिर्दिष्ट किए गए अनुसार होंगे ।

4. भर्ती का तरीका, आयु- सीमा और अन्यअर्हताएं आदि. भर्ती का तरीका , आयु सीमा , अर्हताएं और उक्त पदों से संबंधित अम्य मामले उक्त अनुसूची के कॉलम ( 5 ) से ( 13 ) में विनिर्दिष्ट किए गए अनुसार होंगे ।

5. निरर्हता. वह व्यक्ति,

(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है या विवाह का इकरार किया है जिसकी एक जीवित पति/पत्नी है , अथवा

( ख ) जिसने एक जीवित पति/पत्नी के रहते हुए किसी व्यक्ति से विवाह किया है या विवाह का इकरार किया है ,

उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा :

परन्तु यह कि यदि केन्द्र सरकार इस बात से संतुष्ट है कि ऐसे विवाह की व्यक्ति और दूसरे पक्षकार के संबंध में लागू पर्सनल लॉ के अंतर्गत अनुमति है और ऐसे विवाह के लिए दूसरे आधार विद्यमान हैं तो वह किसी व्यक्ति को इन नियमों के प्रचालन से छूट प्रदान कर सकती है ।

6. छूट देने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा किया जाना जरूरी या अपरिहार्य है , तो वह आदेश पारित करके लेखबद्ध किए जाने वाले कारणों के आधार पर व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के प्रावधानों में से किसी प्रवर्तन में छूट प्रदान कर सकती है ।

7. व्यावृत्ति. इन नियमों में कही गई कोई बात केन्द्र सरकार द्वारा समय - समय पर इस निमित्त जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और व्यक्तियों की अन्य श्रेणियों को दिए जाने वाले आरक्षण , आयु सीमा में छूट और अन्य रियायतों को प्रभावित नहीं करेगी ।

GS.R. 65.-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the President hereby makes the following rules , regulating the manner of appointment and the eligibility requirements etc. for direct recruitment for posts which were in Group ' D' scales prior to the implementation of the 6th Central Pay Commission and have been placed in Group ' C' in Central Civil Service and Civil Posts in connection with the Affairs of the Union, namely

1. Short title and commencement .-( 1 ) These rules may be called the Ministry of External Affairs Group ' C' postsRules , 2011 .

(II) They shall come into force on the date of their publication in the Official Gazette .

2. Application . These rules shall apply to the posts mentioned in column ( 1 ) of the Schedule, annexed to these rules .

3. Number of posts , classification and scale of pay. The number of the said posts, their classification and the scales of pay attached thereto , shall be as specified in columns (2 ) to (4) of the said Schedule .

4. Method of recruitment , age limit , qualifications , etc. The method of recruitment to the said posts , age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to ( 13 ) of the said Schedule.

5. Disqualification . No person ,-

(a) Who has entered into or contracted a marriage with a person having a spouse living,

(b) Who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. सा.का.नि. 66.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेल सेवा ( पेंशन ) नियम, 1993 में आगे संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम रेल सेवा ( पेंशन ) ( संशोधन ) नियम , 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. रेल सेवा (पेंशन ) नियम , 1993 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 15 , के उप- नियम ( 3 ) के खंड ( क ) में " अनुज्ञप्ति फीस " शब्दों के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-

"और नुकसानी ( आबंटिती के सेवानिवृति के तारीख के पश्चात् अनुज्ञेय अवधि से परे रेलवे या सरकारी आवास के अधिभोग के लिए)" ।

3. उक्त नियम के नियम 16 में-

(i ) उप- नियम 5 में, " उपदान का दस प्रतिशत या एक हजार रुपए, इनमें से जो भी कम हो " शब्दों के स्थान पर " उपदान का दस प्रतिशत " शब्द रखे जाएंगे;

(ii ) उप- नियम 6 के स्थान पर निम्नलिखित उप- नियम रखे जाएंगे , अर्थात्:-

" ( 6 ) अनुज्ञप्ति फीस ( जहां संपदा निदेशालय के लिए बकाया अनुज्ञप्ति फीस अवधारित करना संभव नहीं है) और नुकसानी (आबंटिती के सेवानिवृति की तारीख के पश्चात् अनुज्ञेय अवधि से परे सरकारी आवास के अधिभोग के लिए ) की वसूली का उत्तरदायित्व संपदा निदेशालय को होगा और ऐसे सेवानिवृत्त सरकारी कर्मचारी जो सरकारी आवास के अधिभोग में हैं , की उपरोक्त उप-नियम ( 5 ) के अधीन उपदान की विधारित रकम सरकारी आवास के वास्तविक रिक्ति के पश्चात् संपदा निदेशालय से " बेबाकी प्रमाण- पत्र " पेश किए जाने पर तत्काल संदत्त किया जाएगा ।

( 6अ ) संपदा निदेशालय यह सुनिश्चित करेगा कि " बेबाकी प्रमाण- पत्र" सरकारी आवास की रिक्ति की वास्तविक तारीख से चौदह दिनों की अवधि के भीतर सरकारी कर्मचारी को दिया जाए और आबंटिती उपदान जो आबंटिती द्वारा देय अनुज्ञप्ति फीस और नुकसानी यदि कोई है , के बकाए को समायोजित करने के पश्चात् प्रतिदाय किया जाना अपेक्षित है, के अधिकतम विधारित रकम पर ब्याज ( भारत सरकार द्वारा समय - समय पर अवधारित साधारण भविष्य निधि निक्षेप को लागू दर पर ) भुगतान का हकदार होगा और ब्याज सरकारी आवास की रिक्ति की वास्तविक तारीख से उपदान की अधिक विधारित रकम के प्रतिदाय की तारीख तक सरकारी कर्मचारी के संबंद्ध लेखाधिकारी के माध्यम से संपदा निदेशालय द्वारा देय होगा ।

(6ब ) उपरोक्त उप- नियम ( 5 ) के अधीन वर्णित उपदान की विधारित रकम से समायोजन के पश्चात् अंसदत्ता के कारण शेष अनुज्ञप्ति फीस या नुकसानी की वसूली का आदेश पेंशन भोगी की सहमति के बिना मंहगाई भत्ते से संबंद्ध लेखाधिकारियों के माध्यम से संपदा निदेशालय द्वारा दिया जाएगा और ऐसे मामलों में कोई मंहगाई भत्ता का वितरण तब तक नहीं किया जाएगा जब तक ऐसे शोध्यों की पूरी वसूली नहीं हो जाती । "

4. उक्त नियमों के नियम 98 के उप- नियम ( 1 ) के खंड ( i ) के उप- खंड ( छ ) की मद ( 5 ) की उप मद ( v ) में, " मृत्यु तथा निवृत्ति उपदान के दस प्रतिशत या एक हजार रुपए, इनमें से जो भी कम हो " शब्दों के स्थान पर " मृत्यु तथा निवृत्ति उपदान का दस प्रतिशत " शब्द रखे जाएंगे ।

GS.R. 66. In exrcise of the powers conferred by the proviso to Article 309 of the Constitution , the President hereby makes the following rules further to amend the Railway Services ( Pension ) Rules , 1993 , namely :-

1. Short title and commencement.--( 1 ) These rules may be called the Railway Services ( Pension) (Amendment) Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. In the Railway Services (Pension) Rules , 1993 , (hereinafter referred to as the said rules ), in rule 15, in sub - rule (3), in clause (a) , after the words " licence fee " , the following shall be inserted , namely :-

"aswell as damages (for the occupation ofthe Railway or Government accommodation beyond the permissible period after the date of retirement of allottee)" .

3. In rule 16 of the said rules ,-

(i) in sub - rule ( 5) , for the words "ten per cent of gratuity or one thousand rupees , whichever is less " , the words "ten percent of gratuity " shall be substituted .

(ii) for sub - rule (6) , the following sub - rule shall be substituted , namely :---

"(6) The recovery of licence fee (where it is not possible for the Directorate of Estates to determine the outstanding licence fee ) as well as damages (for the occupation of the Government accommodation beyond the permissible period after the date of retirement of allottee) shall be the responsibility of the Directorate ofEstates and the withheld amount of gratuity under sub - rule (5) above , the retiring Government employees , who are in occupation of Government accommodation , shall be paid immediately on production of " No Demand Certificate " from the Directorate of Estates after actual vacation ofthe Government accommodation . (6A) The Directorate of Estates shall ensure that "No Demand Certificate" shall be given to the Government employee within a period of fourteen days from the actual date of vacation of the Government accommodation and the allottee shall be entitled to payment of interest ( at the rate applicable to General Provident Fund deposit determined from time to time by the Government of India) on the excess withheld amount of 403

gratuity which is required to be refunded , after adjusting the arrears of licence fee and damages , if any, payable by the allottee and the interest shall be payabie by the Directorate of Estates through the concerned Accounts Officer of the Govemment employee from the actual date of vacation of the Government accommodation up to the date of refund of excess withheld amount of gratuity.

(6B) On account of licence fee or damages remaining unpaid after adjustment from the withheld amount of gratuity mentioned under sub - ruie (5) above , may be ordered to be recovered by the Directorate of Estates through the concerned Accounts Officer from the Dearness Relief without the consent of the pensioners and in such cases no Dearness Relief shall be disbursed until full recovery of such dues has been made ."

4. In rule 98 of the said rules , in sub - rule ( 1 ) , in clause (i), in sub -clause ( g) , in item (5) , in sub item (v) , the words "ten per cent of the death - cum- retirement gratuity or one thousand rupees , whichever is less " , the words " ten per cent of the death- cum-retirement gratuity " shall be substituted.

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड व ग्रेड वेतन/वेतनमान, उक्त पदों की संख्या , उनका वर्गीकरण और वेतन बैंड व ग्रेड वेतन/वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु-सीमा व अन्य अहंताएं आदि. उक्त पदों पर भर्ती की पद्धति , आयु - सीमा व अन्य अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हताएं: वह व्यक्ति ,

(क ) जिसमे ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार के लिए लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. छूट देने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा छूट दी जा सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

Short title and commencement .( 1 ) These rules may be called the Wireless Monitoring Organisation , Ministry of Communications and Information Technology, Department of Telecommunications , Multi - Tasking Staff Recruitment Rules , 2011 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and Pay Band and Grade Pay/Pay Scale. The number ofposts , its classification and pay band and grade pay / pay scale attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications , etc .--The method of recruitment to the said post, age limit , qualification and other matters relating thereto shall be as specified in columns (5 ) to ( 13 ) of the said Schedule .

4. Disqualification . No person ,-

(a ) who has entered into or contracted a marriage with a person having a spouse living ; or

( b) who, having a spouse living , has entered into or contracted a marriage with any person , 406

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Schedule Castes , the Schedule Tribes , the Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 68.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और जल संसाधन मंत्रालय , केन्द्रीय भू- जल बोर्ड के अन्वेषयकारी नलकूप संगठन ( तृतीय एवं चतुर्भ श्रेणी पदों ) की भर्ती नियम , 1968 को, अधिक्रांत करते हुए उन बातों के सिवाय जिन्हें ऐसे अधिक्रमण से पहले किया गया हो या किये जाने का लोप किया गया है जहां तक कि पद वरिष्ठ तकनीकी सहायक ( जल विज्ञान ) से संबंधित है । पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम वरिष्ठ तकनीकी सहायक ( जल विज्ञान ) , समूह ' ख ' पद , जल संसाधन मंत्रालय , केन्द्रीय भू- जल बोर्ड भर्ती नियम , 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं. उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति ,-

( क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या विवाह की संविदा की है ; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,.

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

GS.R. 68.-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Exploratory Tubewells Organisation ( Class III and IV Posts ) Recruitment Rules , 1968 , in so far as related to the post of Senior Technical Assistant ( Hydrogeology ) , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Technical Assistant ( Hydrogeology ) in the Ministry of Water Resources , Central Ground Water Board , namely:--

1. Short title and commencement .( 1 ) These rules may be called the Ministry of Water Resources , Central Ground Water Board, Senior Technical Assistant ( Hydrogeology ) , Group ' B ' Post Recruitment Rules , 2012 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification , pay band and grade pay or pay scale. The number of post , its classification , pay band and grade pay or pay scale attached thereto shall be as specified in columns ( 2) to (4 ) of the Schedule annexed to these rules .

3. Method of recruitment, age limit, qualifications , etc.--The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 13 ) ofthe said Schedule.

4. Disqualifications .-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any ofthe provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

( ii ) जो मूल कैडर या विभाग में वेतन बैण्ड -1 , 5200-20200 रु. और ग्रेड वेतन 2400 या समतुल्य रु. में दस वर्ष नियमित सेवा कर चुके हों; और

(ख) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से सामग्री प्रबंध डिप्लोमा रखता हो ।

2. ऐसे विभागीय भंडारी श्रेणी !! जिन्होंने श्रेणी में दस वर्ष सेवा की है उन पर बाह्य व्यक्तियों के साथ विचार किया जाएगा और यदि उसको पद पर नियुक्ति के लिए चयन हो जाता है तो उसे प्रोन्नति द्वारा भरा समझा जाएगा ।

टिप्पण । : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य कैडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया 4 वर्ष से अधिक नहीं होगी।

टिप्पण 3 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 4 : प्रोन्नति/प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के लिए , किसी अधिकारी द्वारा । जनवरी , 2006 से पहले , उस तारीख से जिससे छटे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई संवा को, सिवाय उस दशा में जहां एक से अधिक पूर्व पुनरीक्षित वेतनमान का साधारण वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह फायदा केवल उस पद ( उन पदों ) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

GS.R. 69. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution and in supersession of Farakka Barrage Project ( Group ' C' Store Keeper Grades I, II and III) Recruitment Rules, 2004 in so far as theyrelate to the posts of Store Keeper Grade I except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Store Keeper Grade I in the Ministry ofWater Resources, the Farakka Barrage Project, namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Ministry of Water Resources , Farakka Barrage Project , Store Keeper Grade I Group ' B ' Posts , Recruitment Rules , 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post, classification, pay band and grade pay or pay scale. The number ofsaid post, its classification , pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment , age limit, qualifications, etc. The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualification .-No person, ---

(a) who has entered into or contracted a marriage with a person having a spouse living , or ;

(b) who, having a spouse living, has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post:

Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving . Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2.Departmental Store Keeper Grade II with ten years regular service in the grade shall also be considered alongwith outsiders and in case he or she is selected for appointment to the post the same shall be deemed tohave been filled by promotion .

Note 1 : The Departmental Officers in the feeder category who are in direct line of promotion shall not be eligible for consideration for appointment by deputation and similarly, the deputationists shall not be eligible for consideration for appointment by promotion .

Note 2: The period of deputation including the period of deputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not exceed four years .

Note 3: The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.

Note 4 For the purpose of appointment on promotion/deputation

basis , the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended , shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre - revised scale of pay into one grade with a common grade pay or pay scale , and where this benefit will extend only for the post (s ) for which that grade pay or pay scale is the normal replacement grade without any upgradation .

सा.का.नि. 70. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय मत्स्यिको, नौचालन और इंजीनियरी प्रशिक्षण संस्थान , कोच्ची, प्लवमान कर्मचारीवृंद ( समूह ' ग ' ) भर्ती नियम , 2010 को , जहां तक उसका संबंध इंजन चालक वर्ग 11 , ज्येष्ठ नाविक ( डेकहैन्ड ) , कानिष्ठ नाविक ( डेकहैन्ड ) , रसोइया और टोपैज के पदों से है , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , कृषि मंत्रालय, पशुपालन , डेयरी और मत्स्यपालन विभाग कं केन्द्रीय मत्स्य, नौचालन और इंजीनियरी प्रशिक्षण संस्थान कोचीन में इंजन चालक वर्ग II , ज्येष्ठ नाविक ( डेकहैन्ड ) , कनिष्ठ नाविक ( डेकहैन्ड ) , रसोइया और टोपैज के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:--

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय भ्..त्स्यिकी , नौचालन और इंजीनियरी प्रशिक्षण संस्थान, कोचीन, प्लवमान कर्मचारीवृंद ( समूह ' ग ' पद ) भर्ती नियम , 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतन बैंड , ग्रेड वेतन या वेतनमान, पदों की संख्या , उनका वर्गीकरण और वेतन बैंड , ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.-वह व्यक्ति,-

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Central Institute of Fisheries , Nautical and Engineering Training , Cochin , Floating Staff ( Group ' C' ) Recruitment Rules, 2010 , in so far as they relate to the posts of Engine Driver Class II , Senior Deckhand , Junior Deckhand, Cook and Topaz, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Engine Driver Class II , Senior Deckhand, Junior Deckhand, Cook and Topaz in the Ministry ofAgriculture , Department of Animal Husbandry, Dairying and Fisheries , in the Central Institute of Fisheries , Nautical and Engineering Training, Cochin , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the Central Institute of Fisheries , Nautical and Engineering Training, Cochin , Floating Staff (Group ' C ' posts ) Recruitment Rules , 2012.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and pay band , grade pay or pay scale .--The number of the posts, their classification and the pay band, grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment , age limit , qualifications , etc. The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto shall be as specified in columns (5 ) to ( 13 ) of the aforesaid Schedule.

4. Disqualification .-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.-Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward Classes , the Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मात्स्यिकी तटवर्ती इंजीनियरी संस्थान उप निदेशक ( अर्थशास्त्र ) , सहायक निदेशक ( अर्थशास्त्री ) , ज्येष्ठ आर्थिक अन्वेषक और आर्थिक अन्वेषक भर्ती नियम , 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या , वर्गीकरण और वेतन बैंड , ग्रेड वेतन या वेतनमान, पदों की संख्या , उनका वर्गीकरण और उनके वेतन बैंड, ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा और अन्य अहंताएं आदि.-उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ; या

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) प्रोन्नति :

केन्द्रीय सरकार या राज्य सरकारों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधान संस्थानों या पब्लिक सेक्टर उपक्रमों या अर्द्ध सरकारी या स्वशासी या कानूनी संगठनों के अधीन ऐसे अधिकारी : ( क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या

(ii ) जिन्होंने मूल काडर या विभाग में वेतन बैंड -3 , 15600-39100 रु. ग्रेड वेतन 5400 रु. में नियमित आधार पर नियुक्तिके पश्चात् उस श्रेणी में पांच वर्ष सेवा की है; और (ख ) जिनके पास स्तंभ ( 7 ) के अधीन सीधे भर्ती किए जाने वाले व्यक्तियों के लिए शैक्षिक अर्हता और विहित अनुभव है । टिप्पण 1.- वेतन बैंड-3 , 15600-39100 रु. ग्रेड वेतन 5400 रु. में ऐसे विभागीय सहायक निदेशक ( अर्थशास्त्री ) जिन्होंने उस 431 भारत का राजपत्र : मार्च 31 , 2012/चैत्र 11 , 1934

श्रेणी में पांच वर्ष नियमित सेवा की है पर भी प्रतिनियुक्त व्यक्तियों के साथ विचार किया जाएगा और यदि उसका चयन हो जाता है तो वह पद प्रोन्नति द्वारा भरा गया समझा जाएगा ।

टिप्पण 2.-पोषक प्रवर्ग के ऐसे विभागीय अधिकारी जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे , इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 3.- प्रतिनियुक्ति की अवधि ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए (जिसके अन्तर्गत अल्पकालिक संविदा भी है ) अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 4. प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा । जनवरी , 2006 से पहले ( उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है ) , नियमित आधार पर की गई सेवा को, सिवाय उस दशा के , जहां एक से अधिक पूर्व पुनरीक्षित वेतनमान का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है , उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थायी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

GS.R. 71.- In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Pre - investment Survey for Fishing Harbours [ Deputy Director ( Economist ) ] Recruitment Rules , 2003 , the Central Institute of Coastal Engineering for Fishery ( CICEF ) ( Economic Insvestigator ) Recruitment Rules , 2005, the Central Institute ofCoastal Engineering for Fishery (CICEF ) Assistant Director ( Economist ) Recruitment Rules , 2006 and the Central Institute ofCoastal Engineering for Fishery Senior Economic Insvestigator Recruitment Rules , 2007 , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Deputy Director (Economist ), Assistant Director ( Economist ) , Senior Economic Insvestigator and Economic Insvestigator in the Central Institute of Coastal Engineering for Fishery ( CICEF ) , Bengaluru , namely: ---

1. Short title and commencement .( 1 ) These rules may be called the Central Institute of Coastal Engineering for Fishery, Deputy Director (Economist ) , Assistant Director ( Economist) , Senior Economic Insvestigator and Economic Insvestigator Recruitment Rules , 2012 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2.Number of the posts , their classification , pay band and grade pay or pay scale. The number of the said posts, their classification and the pay band , grade pay or pay scale attached thereto shall be as specified in columns ( 2 ) to (4 ) of the Schedule annexed to these rules .

3.Method of recruitment , age - limit and other qualifications , etc. The method of recruitment to the said posts . age- limit , qualifications and other matters relating to the said posts shall be as specified in columns (5) to ( 13 ) of the aforesaid Schedule .

4.Disqualification .-No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal faw applicable to such person and the other party to the marriage and that there are other grounds for doing so , exempt any person from the operation of these rules .

5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any ofthe provisions of these rules with respect to any class or category of persons .

6. Saving. Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , the Ex - servicemen , the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The Departmental Assistant Director (Economist ) in the Pay Band- 3,15600-39100 with Grade Pay 5400 with five years ' regular service in the garde shall also be considered alongwith deputationist and in case he or she is selected for appointment to the post shall be deemed to have been filled by promotion.

Note 2: The Departmental Officers in the feeder category who are in direct line of promotion shall not be eligible for consideration for appointment by deputation . Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 3 : The period of deputation ( including short-term contract )
