का.नि.आ. 17. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सेना आयुध कोर (समूह ' ग ' भण्डारण कर्मचारी वृन्द) भर्ती नियम , 1986 को , जहाँ तक उनका संबंध ज्येष्ठ भंडारी के पदों से है, उन बातों के सिवाय , अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , सेना आयुध कोर में ज्येष्ठ भंडारी और भंडारी के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम सेना आयुध कोर ( समूह ' ग ' भण्डारण कर्मचारी वृन्द) अराजपत्रित पदों की भर्ती नियम, 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे
2. लागू होना. ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे ।
3. पदों की संख्या , वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या , उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति , आयु- सीमा और अन्य अर्हताएं उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।
5. निरर्हता. वह व्यक्ति ,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या विवाह की संविदा की है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 887 G1/ 2012 (81) 82

6. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
7. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं टालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गा, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण: आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । (न कि वह अंतिम तारीख जो असम, मेघालय , अरुणाचल प्रदेश , मिजोरम , मणिपुर, नागालैंड , त्रिपुरा , सिक्किम , जम्मू- कश्मीर राज्य के लद्दाख खंड , हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उप-खंड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है ) । रोजगार कार्यालयों के माध्यम से उन पदों की बाबत जिन पर नियुक्ति की दशा में, प्रत्येक मामले में आयु- सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

S.R.O. 17. In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession of the Army Ordnance Corps ( Group ' C ' Storekeeping Staff) Recruitment Rules , 1986 , in so far they relate to the posts of Senior Storekeeper and Storekeeper, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Storekeeper and Storekeeper in the Army Ordnance Corps , namely :-
1. Short title and commencement . ( 1 ) These rules may be called Ministry of Defence , the Army Ordnance Corps, (Group ' C ' Storekeeping Staff) Non -Gazetted posts Recruitment Rules , 2012 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application . These rules shall apply to the posts as specified in column ( 1 ) ofthe Schedule annexed to these rules.
3. Number of posts , classification, Pay Band and Grade Pay and scale of pay. The number of the said posts, their classification pay band and Grade Pay and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule .
4. Method of recruitment, age limit , other qualifications , etc.---The method of recruitment to the said posts ,, age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 13 ) of the aforesaid Schedule.
5. Disqualification.----No person, ---
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of these rules .
6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and forreasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex- Servicemen and other special categories ofpersons , in accordance with the orders issued by the Central Government from time to time in this regard.

S.R.O. 18. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Data Entry Operator in Defence Estates Organization , under the Ministry of Defence, namely:-
1. Short title and commencement. ( 1 ) These rules may be called the Ministry of Defence , Defence Estates Service Data Entry Operators , (Group ' C' ) Recruitment Rules , 2012.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of Post, Classification and pay band and Grade pay or Scale of pay. The number of post, its classification and pay band and Grade Pay or scale ofpay in the different grade shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules .
3. Method of Recruitment , age limit , qualifications, etc. The method of recruitment , age limit , qualification and other matters related thereto , shall be as specified in columns (5 ) to ( 13 ) of the said Schedule.
4. Disqualifications . No person
(a) Who has entered into or contracted a marriage with a person having a spouse living, or
(b) Who having a spouse living , has entered into or contracted a marriage with any person,
shall be cligible for appointment to the said post :
Provided that the Central Government may, if satisfied , such marriage is permissible under personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

का.नि.आ. 20.-केन्द्रीय सरकार , वायु सेना अधिनियम , 1950 ( 1950 का 45 ) के अनुच्छेद 189 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , वायु सेना नियम , 1969 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम वायुसेना ( संशोधन ) नियम , 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. वायुसेना नियम , 1969 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है) में;
(क) ( नियम -71 के उप - नियम ( 1 ) के स्थान पर निम्नलिखित उप नियम रखा जाएगा , ) अर्थात्:-
" ( 1 ) ऐसे प्रत्येक आरोप पर जिसे अभियुक्त पर आरोपित किया गया है, निष्कर्ष अभिलिखित किया जाएगा और इन नियमों में उपबंधित सिवाय " दोषी होने " या " दोषी न होने " निष्कर्ष के रूप में अभिलिखित किया जाएगा ।
( 1 क) प्रत्येक आरोप के निष्कर्ष अभिलिखित करने के पश्चात्, न्यायालय उसके समर्थन में संक्षिप्त कारण देगा ।
( 1ख ) जज अधिवक्ता या यदि वह नहीं है तो पीठासीन अधिकारी ऐसे संक्षिप्त कारणों को कार्यवाहियों में अभिलिखित करेगा या कराएगा ।
( 1 ग ) उपर्युक्त अभिलेख पीठासीन अधिकारी या जज अधिवक्ता, यदि कोई हो , द्वारा हस्ताक्षर तारीख दर्शित करते हुए किया जाएगा; "
(ख) [ नियम 73 के उप- नियम ( 1 ) में " ऐसी अवधि के बारे में जिसमें वह किसी दण्डादेश के अधीन गिरफ्तार या परिरोध में रहा हो " शब्दों के पश्चात् " या वायुसेना आदेश के अधीन रहते हुए, के अनुभाग में वरिष्ठ अधिकारी द्वारा परिनिंदा का अधिनिर्णय करेगा " शब्द अतःस्थापित किए जाएंगे ।
(ग) नियम 108 के उप- नियम ( 2 ) के पश्चात् निम्नलिखित उप नियम अतःस्थापित किए जाएंगे , अर्थात्:-
" (3 ) कोई काउंसेल , जिसे भारत के किसी न्यायालय द्वारा न्यायालय की अवमानना करने का दोषी पाया गया हो , उसे किसी साधारण और जिला कोर्ट मार्शल में अभियोजक के निमित्त उपसंज्ञात होने , कार्य करने या अभिवचन करने और अभियोग लगाने से तब तक अयोग्य होगा जब तक उसने अपने आपको अवमानना से मुक्त न कर लिया हो । '
(3क) जब विचारण भारत से भिन्न किसी अन्य देश में है और यदि काउंसेल को उस देश के न्यायालय द्वारा न्यायालय की अवमानना का दोषी पाया गया हो , तो उस काउंसेल को तब तक अयोग्य कर दिया जाएगा जब तक कि वह अपने आपको अवमानना से मुक्त न कर लेगा । "
(घ) नियम 129 के उप नियम ( ग ) में " दण्ड संहिता , 1898 ( 1898 की 8 ) के धारा 476 " शब्दों, अंकों और कोष्ठकों के स्थान पर " दण्ड प्रक्रिया संहिता , 1973 ( 1974 की 2 ) . के अनुच्छेद 340 " के शब्द, अंक और कोष्ठक रखे जाएंगे ।

1. (1 ) These rules may be called the Air Force (Amendment ) Rules , 2012 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Air Force Rules , 1969 ( hereinafter referred to as the said rules ) ---
(a) in rule 71 , for sub -rule ( 1 ) , the following sub - rules shall be substituted, namely : -
"( 1 ) The finding , on every charge upon which the accused is charged , shall be recorded and except as provided in these rules , shall be recorded as findings of " Guilty " or of " Not Guilty" .
(1A) After recording the finding on each charge , the court shall give brief reasons in support thereof.
(1B) The Judge Advocate or, if there is none , the Presiding Officer, shall record or cause to be recorded such brief reasons in the proceedings .
(IC) The above record shall be signed with indicating date by the Presiding Officer and the Judge- advocate, ifany";
(b) in rule 73 , in sub - rule ( 1 ) after the words " the length of time he has been in arrest or in confinement on any previous sentence , " , the words or " censure awarded by superior authority in accordance with the Air Force Order (AFO ) on the subject" shall be inserted .
(c) in rule 108, after sub - rule (2) , the following sub - rules shall be inserted , namely :-
"(3) A counsel who has been found guilty of contempt of court by a court of justice in India shall be disqualified to appear, act or plead on behalf of the prosecutor and accused at general and district court martial , unless he has purged himself of the contempt .
(3A) When the trial is held in any country other than India, a counsel shall be disqualified if he has been found guilty of contempt of court in that country, unless he has purged himself of the contempt . का.नि.आ. 21. राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , रक्षा अनुसंधान तथा विकास सेवा नियम , 1979 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. ( i ) इन नियमों का संक्षिप्त नाम रक्षा अनुसंधान और विकास सेवा ( संशोधन ) नियम , 2012 है ।
( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. रक्षा अनुसंधान तथा विकास सेवा नियम , 1979 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) , में :---
( क) खंड 4 के पश्चात् निम्नलिखित खंड अंतःस्थापित किए जाएंगे अर्थात्:-
(4क ) " आन्तरिक छंटनी समिति ( मुख्य ) " से , वैज्ञानिकों ' च ' से परस्पर अन्तः क्रिया करने के लिए, प्रोन्नति हेतु एवं पीयर समिति को अपनी सिफारिशें देने के प्रयोजन के लिए नियम 8 के उप- नियम ( 2 ) के अधीन गठित समिति अभिप्रेत है";
(4ख) " आन्तरिक छंटनी समिति ( प्रारंभिक) " से प्रोन्नति के लिए वैज्ञानिकों ' च ' की निष्पादन मूल्यांकन वाली रिपोर्टों का मूल्यांकन करने एवं " आन्तरिक छंटनी समिति ( मुख्य ) " को अपनी सिफारिशें देने के लिए नियम 8 के उपनियम ( 2 ) के अधीन गठित समिति, अभिप्रेत है";
(ख) उक्त नियम 8 के उपनियम (2 ) के पैरा ( ख ) में:-
( क) मद ( i ) के पश्चात् निम्नलिखित मद अंतःस्थापित की जाएगी अर्थात्ः--
(क) वैज्ञानिक ' च ' से वैज्ञानिक ' छ' में प्रोन्नति के लिए, अनुसूची । ख के अधीन विनिर्दिष्ट " आन्तरिक छंटनी समिति ( प्रारंभिक ) " छानबीन निष्पादन मूल्यांकन रिपोर्ट होंगी और वैज्ञानिकों ' च ' के लिए औसत अंक देगी;
( iख) " अनुसूची । ख के अधीन विनिर्दिष्ट आन्तरिक छंटनी समिति ( मुख्य ) " वैज्ञानिकों' च' से परस्पर अन्तःक्रिया करेगी और अपनी सिफारिशें पीयर समिति को देगी;
(ख) मद ( ii ) में " आन्तरिक छंटनी समिति " शब्दों के स्थान पर " आन्तरिक छंटनी समिति ( मुख्य ) " शब्द रखे जाएंगे;
( ग ) पैरा (ङ ) के स्थान पर निम्नलिखित पैरा रखा जाएगा, अर्थात्ः-
(ङ) ऐसे वैज्ञानिकों ' च ' जिनकी सिफारिश आन्तरिक छंटनी समिति ( मुख्य ) द्वारा की गई है , वैज्ञानिकों ' छ ' के पद में प्रोन्नति के लिए पीयर समिति द्वारा गुणागुण , उपलब्धियों , व्यक्तित्व , नेतृत्व क्षमता और प्रबन्धकीय गुणों पर विचार करने के पश्चात् की जाएगी " ।

S: R.O . 21. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules further to amend the Defence Research and Development Service Rules , 1979 , namely :
1. ( 1) These rules may be called the Defence Research and Development Service (Amendment ) Rules , 2012.
(2) They shall come into force on the date of their publication in the Official Gazette .
2 Inthe Defence Research and Development Service Rules , 1979 ( hereinafter referred to as principal rules ) (a) after Clause (4) , the following clauses shall be inserted, namely :--
(4A) " Internal Screening Committee ( Main) , means the Committee constituted under sub -rule (2) of rule 8 for the purpose of interactions with Scientists ' F ' for promotion and giving their recommendations to the Peer Committee" ;
(4B) " Internal Screening Committee ( Preliminary) , means the Committee constituted under sub - rule ( 2) of rule 8 for the purpose of evaluating the performance appraisal reports of Scientists ' F ' for promotion and giving their recommendations to the Internal Screening Committee (Main)" ;
(b) in rule 8 , in sub -rule (2) in paragraph (b ) ,-
"(ia) after item (i) the following item shall be inserted , namely.--
(A) For promotion from Scientist ' F ' to Scientist ' G ' , Internal Screening Committee ( Preliminary) specified under Schedule 1B shall screen Performance Appraisal Reports and award average of marks for the Scientists ' F ' .
(ib) The Internal Screening Committee (Main) specified under Schedule 1B shall interact with the Scientists ' F ' and make recommendations to Peer Committee" ;
(B) In item (ii) for the words " Internal Screening Committee " , the words " Internal Screening Committee (Main) " shall be substituted;
(c) For paragraph ( e ) , the following paragraph shall be substituted , namely.-
(e) "Recommendations for promotion of Scientists ' F ' who have been recommended by the Internal Screening Committee (Main) to Scientist ' G ' , shall be made by the Peer Committee taking into consideration the merit , achievements , personality, leadership and managerial qualities etc. " ;

Internal Screening Committee (Preliminary)
(a) Scientist ' F'
-Chairperson (i) Secretary, Department of Defence Research and Development or aDistinguished Scientist nominated by him.
-Members (ii) Two Scientists not below the level of Scientist ' H ' nominated by the Secretary, Department of Defence Research and Development .
Internal Screening Committee (Main)
-Chairperson (i) Chairman Recruitment and Assessment Centre or a person having proven knowledge , experience and expertise in any field namely Science or Mathematics or Psychology or Engineering or Technology or Metallurgy, as the case may be , to be nominated by the Central Government.
-Members (ii) Two Scientists not below the level of Scientist 'H ' nominated bythe Secretary, Department of Defence Research and Development .
-Members (iii) Two external members ( one subject expert and one Management Specialist) nominated by the Secretary, Department of Defence Research and Development .
Internal Screening Committee to review Performance Appraisal Reports of Scientist ' G '
(b) Scientist ' G'
--Chairperson (i) Secretary, Department of Defence Research and Development or a Distinguished Scientist nominated by him .
-Members (ii) Two Scientists not below the level of Distinguished Scientists nominated bythe Secretary, Department of Defence Research and Development .
