( सी ) 2527/2012 ( भारत संघ बनाम सौम्या चंट्टोपाध्याय एवं अन्य) एवं उच्च न्यायालय में एसएलपी ( सी ) सं. 9653/2012 (सैयद एकराम रिज़वी एवं अन्य बनाम भारत संघ एवं अन्य) के अनंतिम निर्णय एवं उपर्युक्त के अलावा इससे संबंधित किसी भी सक्षम कार्यालय द्वारा दिए गए किसी भी अन्य आदेश के अध्यधीन होंगी ।

(ii ) तदर्थ पदोन्नति से पदधारी को ग्रेड में नियमित नियुक्ति के लिए कोई अधिकार नहीं होगा ।

( i) यह तदर्थ पदोन्नति ग्रेड में अनिश्चितकाल तक बने रहने अथवा नियमित नियुक्ति के लिए चयन सूची में शामिल किए जाने अथवा सीएसएस के ग्रेड-1 में वरिष्ठता का दावा करने का कोई अधिकार प्रदान नहीं करेगी ।

(ii ) तदर्थ आधार पर पदोन्नति बिना कोई कारण बताए किसी भी समय समाप्त की जा सकती है ।

( iii ) ग्रेड में तदर्थ आधार पर की गई सेवा की गणना ग्रेड में वरिष्ठता के लिए अथवा अगले उच्चतर ग्रेड में पदोन्नति के लिए नहीं की जाएगी ।

(iii ) अवर सचिव ग्रेड में तदर्थ आधार पर प्रदान की गई सेवा उसी ग्रेड में वरिष्ठता अथवा उच्चतर ग्रेड में पदोन्नति के प्रयोजनार्थ नहीं गिनी जाएगी ।

( iv ) तदर्थ आधार पर नियुक्ति अधिकारी को आवंटित मंत्रालय/विभाग में उप सचिव के पद पर कार्यभार ग्रहण करने की तारीख से प्रभावी मानी जाएगी ।
