सा.का.नि. 172.—संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तथा सरकारी अपफीम तथा क्षारोद कारखानें उपक्रम समूह 'ग' तथा 'घ' गैर-राजपत्रिात ;डिस्पेंसरी कर्मचारीद्ध भर्ती नियमावली, 1983 का ड्रेसर तथा वार्ड बॉय के पदों के संबंध् में सरकारी अपफीम तथा क्षारोद कारखाने, उपक्रम समूह 'ग' तथा 'घ' गैर-राजपत्रिात ;तकनीकी स्टापफद्ध भर्ती नियमावली, 1984 के वुफशल तथा अर्धवुफशल श्रमिकों ;अपफीम पैफक्ट्रीद्ध तथा श्रमिकों ;क्षारोद संयंत्रा मेंद्ध एवं श्रमिकों ;अपफीम कारखानें में द्ध के पदों के संंबंध् में तथा नीमच में सरकारी अपफीम तथा क्षारोद कारखाना के कर्मचारी ;मैकेनिक, इलेक्ट्रीशियन, कारपेन्टर तथा वे मैनद्ध भर्ती नियमावली, 1985 में कारपेन्टर तथा वे मैन के पदों के संबंध् में और सरकारी अपफीम तथा क्षारोद कारखानें उपक्रम गाजीपुर तथा नीमच ;रसोईयाद्ध भर्ती नियमावली, 1986 में किए गए कार्यों तथा विलोपित किए जाने वाले कार्यों को छोड़कर, अतिक्रमण करते हुए राष्ट्रपति एतद्‌द्वारा बहु-कार्य कर्मचारी ;तकनीकी तथा रसोईयाद्ध सरकारी अपफीम तथा क्षारोद कारखानें, नीमच, तथा गाजीपुर के पदों पर भर्ती प(ति को नियमित करने हेतु निम्न नियम बनाते हैं, अर्थात्‌ :

1. संक्षिप्त नाम तथा लागू होने की तारीख.—;1द्ध इन नियमों को सरकारी अपफीम एवं क्षारोद कारखाना, नीमच तथा गाजीपुर बहु-कार्य स्टापफ ;तकनीकी द्ध तथा बहु-कार्य स्टापफ ;रसोईयाद्ध भर्ती नियम, 2013 कहा जाएगा ।

;2द्ध ये सरकारी राजपत्रा में उनके प्रकाशन की तारीख से लागू होंगे।

(987)988 THE GAZETTE OF INDIA : JULY 20, 2013/ASHADHA 29, 1935 [PART II—SEC.3(i)] 2. पदों की संख्या, वर्गीकरण तथा वेतन बैंड, ग्रेड वेतन अथवा वेतनमान.—पदों की संख्या तथा उनका वर्गीकरण और वेतन बैंड, ग्रेड वेतन अथवा वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम ;2द्ध से स्तंभ ;4द्ध में विनिर्दिष्ट हैं।

3. भर्ती की प(ति, आयु-सीमा, योग्यता, आदि.—इन पदों से संबंध्ति भर्ती प(ति, आयु-सीमा, योग्यता तथा अन्य मामले उपर्युक्त अनुसूची के कॉलम ;5द्ध से ;13द्ध में विनिर्दिष्ट होंगे ।

4. अयोग्यता.—कोई व्यक्ति,—

;कद्ध जो किसी ऐसे व्यक्ति से विवाह अथवा उसका करार करता है जिसका पति अथवा पत्नी जीवित हो, अथवा

;खद्ध जो, जीवित पति अथवा पत्नी के होते हुए, किसी अन्य व्यक्ति से विवाह अथवा उसका करार करता है।

उपर्युक्त पद पर नियुक्ति का पात्रा नहीं होगा ः

इसके अतिरिक्त प्रावधन है कि यदि केन्द्र सरकार ऐसे व्यक्ति पर लागू होने वाले निजी नियमों के अंतर्गत ऐसे विवाह तथा विवाह के दूसरे पक्ष से तथा ऐसे कृत्य हेतु अन्य कारणों से संतुष्ट हो तो वह इस नियम के लागू होने से किसी व्यक्ति को छूट प्रदान कर सकती है।

5. छूट प्रदान करने का अध्किार.—यदि केन्द्र सरकार की राय में ऐसा करना अपेक्षित अथवा आवश्यक हो तो वह किसी वर्ग अथवा श्रेणी के व्यक्ति को आदेश द्वारा लिखित में रिकार्ड किए गए कारणों के लिए संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी प्रावध् ान से छूट प्रदान कर सकती है ।

6. इसके अतिरिक्त.—इन नियमों में केन्द्र सरकार द्वारा समय-समय पर जारी किए गए आदेशों के अनुसरण में अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिक तथा अन्य पिछड़ा वर्ग तथा अन्य विशेष श्रेणियों अथवा व्यक्ति को दी जाने वाली आयु-सीमा तथा अन्य छूट आरक्षण को प्रभावी नहीं करेगा ।

टिप्पण 2 ः रोेजगार कार्यालयों के माध्यम से किए जाने वाले पदों पर नियुक्ति के संबंध् में आयु-सीमा निर्धरित करने की अंतिम तारीख, प्रत्येक मामले में वही होगी जो रोजगार कार्यालयों से नाम प्रस्तुत करने के लिए अंतिम तारीख होगी ।

G.S.R. 172.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Government Opium and Alkaloid Works Undertaking Group'C' and 'D' non-gazetted (Dispensary staff) Recruitment Rules, 1983, in so far as they relate to the Posts of Dresser and Ward Boay, the Government Opium and Alkaloid Works Undertaking Group'C' and 'D' non-gazetted (technical staff) Recruitment Rules, 1984, in so far as they relate to the posts of Skilled or Semi-Skilled Worker (Opium Factory) and Workers in Alkaloid Plant) and Workers in Opium Factory, the Government Opium and Alkaloid Works Neemuch (Mechanic, Electrician Carpenter and Weighman) Recruitment Rules, 1985 in so far as they relate to the posts of carpenter and Weighman and the Governement Opium and Alkaloid works Undertakings at Ghazipur and Neemuch (Cook )Recruitment Rules 1986, except as respects things dome or omitted to be done before such supersession, the Presdident herby makes the following rules regulating the method of recruitment to the post of the Multi-Tasking Staff (Technical and Cook), Government Opium and Alkaloid Works, Neemuch, and Ghazipur, namely :—

1. Short title and commencement.—(1) These rules may be called the Government Opium and Alkaloid Works Neemuch and Ghazipur, Multi Tasking Staff (Technical) and Mulit Tasking Staff (Cook) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and the Pay Band, Grade Pay or Pay Scale.—The number of the said posts, their classification and Pay Band Grade Pay or Pay Scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification, etc.—The method of recruitment , age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage, is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

One year experience in nursing orderly's duties.

G.S.R. 173.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Field Publicity (Regions) (Group 'C' and 'D' posts) Recruitment Rules, 1986 in so far as it relates to the post of Lower Division Clerk and the Directorate of Field Publicity (Class III and Class IV posts) Recruitment Rules, 1971 in so far as it relates to the post of Lower Division Clerk, except as respects things done or omitted to be done before such supersessions, the President hereby makes the following rules regulating the method of recruitment to the post of Lower Division Clerk in the Directorate of Field Publicity, Ministry of Information and Broadcasting, namely :—

1. Short title and commencement.— (1) These rules may be called the Directorate of Field Publicity, Ministry of Information and Broadcasting, Lower Division Clerk, (Group 'C' post) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, and the pay band and grade pay or the pay scale.-—The number of the said post, its classification and the pay band and grade pay or the pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the above said Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Savings.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, other backward classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 174.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Land Resources Data Entry Operator (Grade 'A') Recruitment Rules, 2005 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Data Entry Operator (Grade 'A') in the Ministry of Rural Development, (Department of Land Resources), namely:—

1. Short title and commencement.— (1) These rules may be called the Department of Land Resources Data Entry Operator (Grade'A') Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, its classification and Pay Band and Grade Pay or pay scale.— The number of post, its classification and the Pay Band and Grade Pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule.

3. Method of recruitment, age-limit, qualifications, etc. — The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the Schedule aforesaid.

4. Disqualification. — No Person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 175.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पफरक्का बाँध् परियोजना ;समूह 'ग' पदद्ध भर्ती नियम, 2002 को जहाँ तक उनका संबंध् सहायक पद से है और पफरक्का बाँध् परियोजना ;प्रशासनिक अध्किारी श्रेणी-3 और कार्यालय अध्ीक्षकद्ध समूह 'ख' भर्ती नियम, 2003 को, जहां तक उसका संबंध् पफरक्का बाँध् परियोजना में कार्यालय अध्ीक्षक पद से है को उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, जल संसाध्न मंत्राालय, पफरक्का बाँध् परियोजना में सहायक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम जल संसाध्न मंत्राालय, पफरक्का बाँध् परियोजना, सहायक ;समूह 'ख'द्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.— उक्त पद की संख्या, उसका वर्गीकरण और उनके वेतन बैंड तथा गे्रड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 ः प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 1 जनवरी, 2006 से पहले, उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहाँ एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहाँ यह लाभ केवल उस पद पर विस्तारित होगा जिनके लिए ग्रेड वेतन या वेतनमान1008 THE GAZETTE OF INDIA : JULY 20, 2013/ASHADHA 29, 1935 [PART II—SEC.3(i)] ;11द्ध

प्रतिनियुक्ति : ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्धः

केन्द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रा, प्रशासनिक या लोक क्षेत्रा उपक्रमों या कानूनी संगठनों या विश्वविद्यालयों या मान्यता प्राप्त अनुसंधन संस्थानों के अध्ीन ऐसे अध्किारी :

क;iद्ध जो नियमित आधर पर सदृश पद धरण किए हुए हैंऋ या

;iiद्ध जिनकी मूल काडर या विभाग में वेतन बैंड-1 वेतनमान 5,200-20,200 रु. + ग्रेड वेतन 2400 रु. के पद पर दस वर्ष की नियमित सेवा की हैऋ और किसी मान्यताप्राप्त विश्वविद्यालय से डिग्री रखते हैं ।

टिप्पण 1-प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत अल्पकालिक संविदा भी है, की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

Note 1 : Where juniors who have completed their qualifying/eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service. Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January 2006, the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts(s) for which that grade pay/pay scale is the normal replacement grade without any up gradation. G.S.R. 176.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Farakka Barrage Project Senior Administrative Officer, Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment for the post of Senior Administrative Officer in the Farakka Barrage Project under the Ministry of Water Resources, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, Farakka Barrage Project , Senior Administrative Officer, (Group 'A' Gazetted Post) Recruitment Rules, 2013.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

टिप्पण 1 : अर्हताएं अन्यथा सुअहत अभ्यथयों की दशा में कारण लेखब( करके संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 ः अनुभव संबंध्ी अर्हताएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

टिप्पण 1 : वेतन बैंड-2, 9300-34800 गे्रड वेतन 4200 रु. मेंं 5 वर्ष की नियमित सेवा के साथ विभागीय पुस्तकालय सूचना सहायक पर भी वाह्य व्यक्तियों के साथ विचार किया जाएगा, यदि उसका वह इस पद के लिए नियुक्ति हेतु चयनित हो जाता है या जाती है तो यह पद प्रोन्नति द्वारा भरा हुआ समझा जाएगा ।

टिप्पण 2 : पोषक प्रवर्ग में ऐसे विभागीय अध्किारी जो प्रोन्नति की सीध्ी पंक्ति में है, को प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 3 : प्रतिनियुक्ति ;आई.एस.टी.सी.द्ध की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी बाह्य संगठन में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वष्र्ष से अध्कि नहीं होगी ।

प्रतिनियुक्ति ;आई.एस.टी.सी.द्ध पर नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 4 : प्रतिनियुक्ति आधर पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पूर्व नियमित आधर पर की गई सेवा, ;वह तारीख जिसे छठे वेतन आयोग की सिपफारिशों के आधर पर पुनरीक्षित वेतन संरचना का विस्तार किया गया है, वेतन आयोग की सिपफरिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगीद्ध सिवाय वहां जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान को एक साधरण ग्रेड वेतन/वेतनमान के साथ एक ग्रेड में विलय किया गया है और जहां यह पफायदा केवल उसी पद ;उन पदोंद्ध के लिए विस्तारित किया जाएगा जिसके लिए वह ग्रेड वेतन/वेतनमान किसी उन्नयन के बिना साधरण प्रतिस्थापन ग्रेड है ।

टिप्पण 5 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन हेतु किसी अध्किारी द्वारा तारीख 1-1-2006 ;वह तारीख जब से छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित संशोध्ति वेतन संरचना में विस्तार किया गया हैद्ध से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

G.S.R. 177.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to Group 'B' Gazetted post of Assistant Library and Information Officer in the Ministry of Road Transport and Higyways, namely :—

1. Short title and commencement .—(1) These rules may be called the Ministry of Road Transport and Highways (Assistant Library and Information Officer) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number, Classification, Pay Band and Grade Pay or Pay Scale .— The number of the said post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. — The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules.

5. Power to relax .—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. —Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Qualifications are relaxable at the discretion of the Union Public Service Commission, for reasons to be recorded in writing, in case of candidates otherwise well qualified. Note 2 : The qualification regarding experience is relaxable at the discretion of the Union Public Service Commission, for reasons to be recorded in writing, in case of candidates belonging to the Scheduled Castes or the Schedule Tribes, if at any stage of selection the UPSC is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

Note 1 : The Departmental Library Information Assistant in the Pay Band-2 of Rs. 9300—34800 with grade pay of Rs. 4200 with five years regular service in the grade shall also be considered alongwith outsiders and in case he or she is selected for appointment to the post, the same shall be deemed to have been filled by promotion.

Note 2 : The Departmental Officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, Deputationists shall not be eligible for consideration for appointment by promotion.

Note 3 : Period of Deputation (ISTC) including period of Deputation (ISTC) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not to exceed three years. The Maximum age limit for appointment by Deputation (ISTC) shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 4 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding Grade pay or Pay scale extended based on the recommendations of the Pay Commission) except where there has been merger of more than one pre-revised scale of pay into one grade with a common Grade pay or Pay scale, and where this benefit will extend only for the post(s) for which that Grade pay or Pay scale is the normal replacement grade without any upgradation.

Note 5 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended,) shall be deemed to be service rendered in the corresponding Grade pay or Pay Scale extended based on the recommendations of the Pay Commission.

2. पद संख्या, वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति-

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की है ।

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

किन्तु किसी मान्यताप्राप्त विश्वविद्यालय, वर्ष । बोर्ड/संस्थान से विज्ञान में कम से कम 10 2 कक्षा उत्तीर्ण जिसमें जीव विज्ञान या प्राणि विज्ञान या वनस्पति विज्ञान एक विषय के रूप में रहे हों ।

टिप्पण : पोषक प्रवर्ग के ऐसे पदधरी जिनके पास इन नियमों की अध्सिूचना की तारीख को विज्ञान में मैट्रिकुलेशन की शैक्षिक अर्हता है, प्रोन्नति के लिए पात्रा होंगे ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

G.S.R. 178.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Plant Protection, Quarantine and Storage, Technical Officer (I), Recruitment Rules, 1987, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Technical Assistant in the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Plant Protection, Quarantine and Storage, Faridabad, namely :—

1. Short title and commencement .—(1) These rules may be called the Ministry of Agriculture, Directorate of Plant Protection, Quarantine and Storage, Faridabad, Technical Assistant Recruitment Rules, 2013.

2. They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, Classification, Pay Band and Grade Pay or Pay Scale .— The number of said post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, other qualifications, etc. — The method of recruitment to the said post, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax .—Where the Central Government is of opinion that it is necessary or expedient so to do, it may by order for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. —Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-serviceman, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 the date from which revised pay structure based on the Sixth Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale.

Note 2 : Where junior who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfuly completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligiblity service.
