आ.अ. 40.—यतः निर्वाचन आयोग का समाधन हो गया है कि नीचे की सारणी के स्तंभ ;2द्ध में यथा विनिदष्ट पंजाब विधन सभा, 2012 के साधरण निर्वाचन के लिए जो स्तम्भ ;3द्ध में विनिदष्ट निर्वाचन-क्षेत्रा से हुआ है स्तम्भ ;4द्ध में उसके सामने विनिदष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिध्त्वि अध्निियम, 1951 तथा त(ीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तंभ ;5द्ध में यथा दशत अपने निर्वाचन व्ययों को लेखा अपेक्षित रीति से दाखिल करने में असपफल रहा हैंऋ
और यतः उक्त अभ्यथयों ने सम्यक्् सूचना दिए जाने पर भी उक्त असपफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है । अतः निर्वाचन आयोग का यह समाधन हो गया है कि उनके पास उक्त असपफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं हैऋ
अतः अब, निर्वाचन आयोग उक्त अध्निियम की धरा 10-क के अनुसरण में नीचे की सारणी के स्तंभ ;4द्ध में विनिदष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य की विधन सभा अथवा विधन परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावध् िके लिए निरहत घोषित करता है :—

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 7th August, 2013
O.N. 40.—Whereas, the Election Commission is satisfied that each of the contesting candidates specified in column (4) of the Table below at the General Election to the Punjab Legislative Assembly, 2012 as specified in column (2) held from the constituency specified in column (3) against his/her name, has failed to lodge an account of election expenses as required by the Representation of the People Act, 1951 and Rules and Order made there under; as shown in column (5) of the said Table; and [भाग II—खण्ड 3(iii)] भारत का राजपत्रा : अगस्त 17, 2013/श्रावण 26, 1935 211
Whereas, the said candidates have not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that they have no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date of this order: -

आ. अ. 41.—लोक प्रतिनिध्त्वि अध्निियम, 1950 ;1950 का 43द्ध की धरा 13-क की उप-धरा ;1द्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग, सिक्किम राज्य सरकार के परामर्श से एतद्द्वारा, श्री डी. आनन्दन, आई.ए.एस. ;एस.के. : 2000द्ध, को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए सिक्किम राज्य के मुख्य निर्वाचन अध्किारी के रूप में नामित करता है ।
212 THE GAZETTE OF INDIA : AUGUST 17, 2013/SHRAVANA 26, 1935 [PART II—SEC. 3(iii)]2. श्री डी. आनन्दन, आई.ए.एस. सिक्किम राज्य सरकार के अध्ीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धरण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।
3. श्री डी. आनन्दन, आई.ए.एस. मुख्य निर्वाचन अध्किारी, सिक्किम राज्य के रूप में कार्य करते हुए सिक्किम राज्य सरकार के अध्ीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जायेगा ।

O.N. 41.—In exercise of the powers conferred by sub-section (1) of Section 13A of. the Representation of the People Act, 1950 (43 of 1950), the Election Commission of India, in consultation with the Government of Sikkim, hereby nominates Sh. D. Anandan, IAS (SK-2000) as the Chief Electoral Officer for the State of Sikkim with effect from the date he takes over charge and until further orders.
2. Sh. D. Anandan, IAS shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Sikkim, which he may be holding before such assumption of office.
3. Sh. D. Anandan, IAS while functioning as the Chief Electoral Officer, Sikkim shall not hold any additional charge whatsoever under the Government of Sikkim except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.
