का.नि.आ. 63.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और राष्ट्रीय भारतीय सैनिक महाविद्यालय ;सेक्शन मास्टर, समूह 'क' राजपत्रिातद्ध भर्ती नियम, 2004 और राष्ट्रीय भारतीय सैनिक महाविद्यालय ;मास्टरद्ध भर्ती नियम, 2004 को, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के अधीन राष्ट्रीय भारतीय सैनिक महाविद्यालय, देहरादून में सेक्शन मास्टर और मास्टर समूह 'क' राजपत्रिात अननुसचिवीय के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, राष्ट्रीय भारतीय सैनिक महाविद्यालय, देहरादून ;सेक्शन मास्टर और मास्टरद्ध, भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या विवाह की संविदा की है, या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा प्रोन्नति :

वेतन बैंड-3, 15600—39100 रु. ग्रेड वेतन 5400 रु. में ऐसे मास्टर, जिन्होंने नियमित आधर पर उस पद पर नियुक्ति के पश्चात्‌ उस श्रेणी में पांच वर्ष नियमित सेवा की हो । टिप्पण 1 : सेक्शन मास्टर के पद पर प्रोन्नति के लिए पात्राता सेवा इन नियमों की अध्सिूचना की तारीख को नियमित आधर पर मास्टर के पोषक पद धरण करने वाले व्यक्तियों के लिए दो वर्ष बनी रहेगी । टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह[भाग II—खण्ड 4] भारत का राजपत्रा : अक्तूबर 19, 2013/आश्विन 27, 1935 525 ;11द्ध

तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो । टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 1-1-2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उन पदों पर विस्तारित होगा जिनके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

टिप्पण 2 : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है । जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिये अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संम्भावना नहीं है ।

S.R.O. 63.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Rashtriya Indian Military College (Section Master Group 'A' Gazetted) Recruitment Rules, 2004 and the Rashtriya Indian Military College (Master) Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the posts of Section Master and Master, Group 'A' Gazetted, Non-Ministerial in Rashtriya Indian Military College, Dehradun under the Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Rashtriya Indian Military College, Dehradun (Section Master and Master) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the posts, their classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment, age limit, qualifications and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing and after consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The eligibility service for promotion to the post of Section Master shall continue to be two years for persons holding the feeder posts of Master on regular basis on the date of notification of these rules.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 3 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission, except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 3 : प्रतिनियुक्ति ;अल्पकालिक संविदा सहितद्ध द्वारा नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 4 : प्रतिनियुक्ति ;अल्पकालिक संविदा सहितद्ध पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह पफायदा केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

सशस्त्रा बल कामकों के लिए : प्रतिनियुक्ति/पुननयोजन

S.R.O. 64.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in superses- sion of the Coast Guard Legal Assistant Recruitment Rules, 2004, except in respect of things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Legal Assistant in the Coast Guard Organisation under the Ministry of Defence, namely:-

1. Short title and commencement. - (1) These rules may be called the Ministry of Defence, Coast Guard Organisation (Legal Assistant) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said posts, their classification, the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification, etc. .—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person, (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall effect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other backward classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

such for atleast two years and should have dealt with cases relating to service laws.

Note 2 : Period of deputation (including short term contract) including period of deputation (including short term contract) in

another ex-cadre post, held immediately preceding this appoint- ment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years.

Note 3 : The maximum age-limit for appointment by deputation (including short term contract) shall be not exceeding 56 years as

on the closing date of receipt of applications.

Note 4 : For the purpose of appointment on deputation (includ- ing short term contract) basis, the service rendered on a regular

basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Com- mission, except where there has been merger of more than one

pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

For Armed Forces Personnel:

Deputation Re-employment : The Armed Forces personnel hold- ing the rank of Master Chief Petty Officer or Chief Petty Officer in the Army, Navy or Air Forces in the pay band-2, Rs. 9300-34800 plus grade pay of Rs. 4200 and possessing degree in law from a recognised University who are due to retire or who are to be transferred to reserve within a period of one year shall also be

considered and if selected, such officers will be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employ- ment terms. In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on re-employment basis.

(ii) in column 10, for the word 'selection' where ever it occurs the word 'seniority', shall be substituted;

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 66.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Defence, Department of Defence Research and Development, Programme Office and Secretariat (Programme Officer, Deputy Programme Officer, Assistant Programme Officer and Junior Programme Officer and Stenographer Grade 'B' (Senior Personal Assistant) Recruitment Rules, 1989) in so far they relates to the post of Deputy Programme Officer (Manpower), Assistant Programme Officer (Manpower), Assistant Programme Officer (Finance), Assistant Programme Officer (General) and Junior Programme Officer (Coordination) except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the Programme Officer and Secretariat posts in the Defence Research and Development Organistion, Ministry of Defence, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Department of Defence Research and Development, Programme Office and Secretariat, Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the schedule annexed to these rules.

3. Name of posts, number, classification and pay band and grade pay/pay scale.—The name of post, number, their classification and the pay band, grade pay or scale of Pay Scale attached thereto shall be as specified in columns (1) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit and other qualifications.—The method of recruitment to the said posts, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the schedule aforesaid.

5. Disqualifications.—No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post :

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with Union Public Service Commission; relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time.
